      Depends on whether you have employment restrictions on your nomination certificate and what stream of OINP. If you have employment restrictions, you'll have to extend with T13 exemption.       Yes you do. The employer must submit an Offer of Employment either through the Employer Portal or using the Alternate Submission method (if authorized by IRCC Employer Portal) IMM 5802. They must pay the $230 compliance fee as well.

      If you are referring to the "A number" you'll see a field where it can be entered on IMM 5710 (if applying from within Canada) when selecting "Exemption from Labour Market Impact Assessment"

      Of course, there is no restrictions on having a PGWP and a closed work permit simultaneously. In fact, it can be beneficial if it's skilled work as that work permit can count towards 50 pts of arranged employment if you've accumulated more than a year of work experience for that employer listed on your closed FMP work permit.

      I believe I mention it here in the video, but as long as the employer enrolment was done correctly, and email address entered correctly, and no portal issues, it should be received within 10 minutes after submitted the offer and making payment for the employer compliance fee. It should be send by email and may also be viewed under submitted offers of employment.

      LMIA-Exempt are work permits issued under the International Mobility Program (IMP) whereas LMIA-based work permits are issued under the Temporary Foreign Worker Program. Whether or not you need a permanent/full-time job is dependent on the specific LMIA exemption, however, for the most part, full time/permanent is mostly the case.

      Should be within 10 minutes max after submitting enrolment request. If it has not been enrolled there may be an issue with the business number, or previous enrolment, so reaching out to the Employer Portal help email, becomes necessary. They have a 5 day turnaround time.

      If you mean while waiting to receive your nomination, then no, you cannot apply for BOWP at this time. If you have received your nomination from the province already, and it has employment restrictions on it, you'll want to extend with a T13 (as you are not eligible for BOWP). If you've submitted your PR application, EE-PNP, have no restrictions on nomination, and have eAPR, then you can apply for BOWP.

      Mine NOC code is same as well. You don't specify the stream like you will be applying under "General Draw" or "Health and Tech occupations". You just create the profile and if the NOC code that you submitted falls under the NOC code of that specific occupation, you will be invited under that specific occupations stream.

      Because it is a B.Sc., I believe it would qualify for 12 points. It's pretty easy to create a profile, and there is more distinction and breakdown of programs and degrees in the OINP portal. I'd recommend filling it out and seeking what it grants you. Sounds like it's a double major, but in the faculty of Science.

      I don't have a video yet on LMIA required CWP, however, you need to include also your employment contract/job offer, as stipulated in IMM 5556 checklist unlike the LMIA-exemption indicated in this video.

      No. You cannot flagpole to activate a visa. You can flagpole to obtain a permit at times, although I do not recommend, and some permits cannot be obtained at the Port of Entry.

      That is the only way I am aware of. Keep in mind when submitted an application you are expected to submit a complete application, and it's up to the officer's discretion whether to accept new documents/evidence.

      Thank you for your comment! It's challenging to pinpoint the exact NOC code for warehouse team leads since there are well over 500 NOC codes and job title is not always representative of the main duties. Focus on the main duties and the lead statement of the NOC to determine the correct one. Job titles are less important; it's the day-to-day duties that matter most. Narrow it down to about 3 possible job codes, reference the wage data on JobBank as well to help you focus it further.

      You can add family members to your application in the eligibility questionnaire. Your spouse, as they are not the principal applicant, is not eligible for a BOWP. However, they may be eligible for a SOWP, based on your BOWP getting approved. I would do these applications as the same time. If your BOWP is approved, and you included enough evidence so show you are currently working and your partner meets the requirements and eligibility of a SOWP, I don't see why you cannot do them both at the same time. In the event your BOWP is refused, your partner's SOWP will be refused at the same time. If your BOWP is approved, they will then review the SOWP application of your spouse of eligibility.

    Hi, great video, however regarding imm5710, I am currently on closed LMIA exempt WP valid till 2026 and I recently got my AOR, I would want my WP to be open, would I still select *Apply for a new work permit for the first time or with a new employer* or select mutiple options?

      I don't think you can select multiple options for those two fields, only when restoring can you select additional options. If it's a BOWP you are applying for, and you are eligible (no employment restrictions on your nomination), or meeting all the other requirements, I would select "apply for a new work permit for the first time or with a new employer" as this will be an open work permit (no employer restrictions). The other selection infers "an extension." This is not an extension, it's a new work permit, or new type of application.

      It depends on what the letter says specifically, and you received on entry? I’m unclear as to what it looks like. You can book online to speak with me and I could have a look at the letter, address your reasons for visiting, and understand your reasons for wanting to extend, if possible, depending on the letter.

First thing I would do is apply for GCMS notes (to get the full disclosure on the officers notes for refusal), before reapplying, or considering a Judicial Review of reconsideration request.

If I have PGWP 3 years remaining, if I want the points that the job offer gives with the Francophone mkbility, my PGWP will be canceled and I would move to a closed work permit with my current employer that want to support me? It would be a trade of f 50 point but on the other hand move from 3 years PGWP to 1, correct?

      Great question, and of course you can do this to qualify for 50 pts if you meet all the requirements (approved closed work permit naming the employer, 1 year of full time work for that employer, etc.). You can have multiple authorizations in Canada, many people fail to understand this. Issuance of a closed work permit will not cancel out an open work permit.

    Your video was really helpful. I truly appreciate it! I have a few questions. My LMIA has expired, and my closed work permit expires in December 2024. I gained additional points through the LMIA. Currently, I'm awaiting EE CEC processing, and everything else is complete except for the ongoing background check. I'm still working for the same employer under the same conditions. Should I need a new LMIA? or, can I apply for a BOWP in August 2024 without obtaining a new LMIA and continue working until I receive permanent residency approval with the same employer?

      In the meantime, I'm working under the same address, same store name, same position, and same hourly wage, but the owner of the store changed hands while the owner sold the business (takeover). Should I report this to IRCC? The name on my closed work permit is different from the current owner's name.

      You should report any changes in employment to IRCC. Recall that those 50 pts of arranged employment were based on a job offer that is valid for up to 1 year after you become a PR. If the employer is no longer making that commitment, then IRCC should be notified. If it was a share purchase, and the operations of the business remained the same, a new LMIA is not usually required as the new employer became the successor in interest. This is the situation it sounds like for you. Think of the employer like the corporate entity. If the ownership changes, this is acceptable. If it was an asset purchase, and the payroll number and business number changed, or the business operations changed substantially, then yes, you would require a new LMIA, and those 50 pts may no longer apply, and if you are working on a closed work permit, it could have an impact: www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/temporary-residents/foreign-workers/guide-mergers-acquisitions.html I would apply for a BOWP and continue working for this employer. If you are being paid from the same payroll number as the previous ownership, I believe you would be fine. I already submitted my PR app through Japanese agent, but definitely will recommend you to my friends going to apply any types of visa! I have a couple of questions. My PGWP is expired at the beginning of Sep 2024. I submitted PR last month. I am preparing for BOWP now. I am Japanese citizen. After BOWP is issued, do you think it is safe to travel outside of Canada and return safely? (I understand that last decision is made by immigration officer at the airport.) I would like to go back to Japan from the end of Sep for a month, which my PGWP is expired. PR final decision may or may not be made yet by the time when I come back to Canada, which is at the end of Oct. Also, how do we know eTA is attached to BOWP? I have applied study visa multiple times and have never applied eTA. I was wandering if eTA is automatically attached to BOWP or not. Sorry for the lengthy questions..:( Thank you again for the great video!

      Hello Miki! Thank you for the comment and for the thank you tip. Usually, when applying for a work permit, the eTA status is automatically applied for, and shown in the portal. Please let me know if you see this when your BOWP is approved. It should take about 3 months if you apply today. Secondly, you can always apply for ETA separately at any time. Yes, officer always makes decision at port of entry, and if you are out of the country when your PR is approved, do not worry, you will be able to email the portal approval email, let them know you are out of the country, and to email them once you’ve landed in Canada to confirm your residence and COPR.

      It should include the family information form IMM 5713 when you add a family member. Of course, minors cannot sign their name, and the parent signs on behalf of the child.
