      Although a similar framework for the submission through the portal, it requires a lot more work on the back end of the work permit submission as it’s a self-employed application.

    Hello Steven! This video is pure GOLD. Thanks for explaining this process in detail. I finished my studies and got my PGWP for one year, then I got a job in my field as Marketing Coordinator buy my PGWP is close to expiring so I need to talk soon with my employer about this CA-CO Free Trade Agreement.     Youuuuu the Mannn, thanks a lot. Been waiting for a video like this for weeks. Quick question though, what if I am working already with the employer? What would be the start date ?, should I mention it ?. I am doing this cause my work permit is expiring soon. Also, I am a Mech Emgineer, licensing is required if you want to work as a P. Eng, meaning you can approve your designs, etc. but is not a requirement from the employer. Should I explain this ?. Once again THANK YOU!!!!

      And to answer your question. In general, whenever there is a section on an Immigration form that seems reiduclus or conflicting as they so often are…just add a couple sentences in your submission letter for each of these weird incidents. For example, start date makes sense but they should just have a checkbox that says “currently working” lol. This is why IRCC needs engineers and product designers. So for you( just put it 1 month out, and put in Letter of Explanation “impossible to answer this question truthfully because I’ve already started work.” But be a little nicer on the delivery ☺️

      I mean, you could also put the “day of” but in my experience, when doing that on the work permit form, and if you have to make a change the next day it will keep prompting you with an “invalid date.” Their tech is terrible, be sure to show your P.Eng or any registration, and let me know if you’ve got other questions.

So I am not a P.Eng, however I can work as a Mech Engineer, not as a Professional Mech Engineer, is confusing I know LOL. On the NOC website the P.Eng registration is required to approve Drawings etc. But what I understand is it is not mandatory. So should I explain all this?, the employer does not require me to have the license. THANKS

I have a question, a close friend is working as logistics coordinator, is it possible for her to apply with the Colombian agreement? Or this position will not apply in for exemption?

      Since LC is not TEER 0 or 1, you’d have to look at the technicians list, which I don’t think it’s there. So I do not believe they could

    Hello Steve, would an extension of a current contract be used to obtain the close work permit? I am currently with the PGWP and my company wants to help me, but they need to know if it is necessary to cancel the contract and make a new one or does it work with a renewal?

    Thank you for the video, I am a chef and was offered a job as a Cook in Canada (currently a visitor in Toronto), my employer is filling out the job offer and has some doubts about what to put in country of residence and the code of LMIA exemption, we watched your video and wonder if it is not possible to make a job offer of a cook position for me?

    Hello Stephen, thanks a lot for the video, in the hypothetical situation that I get approved for the LMIA Exempt Work Permit with an Expiry date of Dec-2024, could I apply before its expiration for a SOWP? (currently I have a SOWP expiring in Jul-30-2024, waiting for my wife to get a job to apply for an extension of the SOWP).

      For your spouse to get an SOWP based on your closed work permit application, or based on your work, you must submit with greater than 6 months validity left on your WP, so if it was less than 6 months, sometime in June then no.

    Hello! I'm peruvian and we are also exempt from LMIA. With the new announcements about PGWP made by the IRCC we are thinking about applying through this pathway. I already work for a Canadian company in Toronto, is it possible to apply while one is working? Would I have to "quit" and be hired again?

      Yes it is possible to apply while working. You would not have to quit and reapply. The job offer start dates seem odd when you are currently working for the employer, as they don’t let you indicate the day you started, or any date that is before the present day, or select a user friendly option such as “currently working.” The employer portal is an antiquated, archaic system that uses awkward wording and terminology.
      I usually recommend the start date chosen at least a month or two in the future if you are currently working when the employer submits the offer, so that you can put the same date on your start date on your IMM 5710 to remain consistent. Many inexperienced employers logically just put the next day, because the applicant is already working for them, but then this gets weird because just like the employer portal, the IMM 5710 doesn’t allow you to enter a date in the past, and since you have to submit the work permit after getting the A number from your employer, usually applicants take a few days to put together their work permit application, book a review, and by then, the exact start date from the employer portal job offer cannot be entered accurately into the IMM 5710 as it will not let you (as it’s past). Although I don’t think it’s a huge issue if they don’t match exactly, unless it’s a different year or significantly different by a few months.
      Just an FYI and for everyone reading this comment, you can have multiple work permits or have a work and study permit at the same time. They don’t cancel out. So don’t feel you need to quit your job and then re apply. IRCC certainly could make this portal more user friendly.

My position is Consulting Analyst in the fundraising field. I have searched using the NOC code, and it seems like 11201 would align with my position, but I'm unsure. This is the first time my company is submitting an offer of employment. I am self-represented, but I would like to have it reviewed just to make sure everything is submitted correctly. Could you support me with that?

    Hi Steve, what starting date should my employer use if I'm already working in the position?

      Any start date in the future applies as you cannot backdate. I like to go at least a few weeks out to give you time to prepare the work permit after receipt of A number to be consistent with employer offer start date and start date on WP.

      If you add a “family member” to your application, then it will show you what you need to provide, and also refer to INM 5556 if from within Canada. I’ll do another video soon on how to add family members to an application at one time.

    Hi Steve, I'm an Industrial Engineer from Colombia, also about 7 months I got a Canadian College Diploma in business. Can I meet the employer requirements for a position in Quality Control with NOC for Industrial Engineering Technology or Technician? In this occupation, the employee requirements ask for a college diploma in industrial engineering technology or technician and may be have a certification. Can I make it fit or can I apply for this position?

      Tough for me to say here, it’s very subjective. You have to ensure that you meet the requirements for the job being offered and the job being offered is genuine. It involves comparing the job offered by the employer, the business the employer is in, and the NOC employment requirements, your education and experience etc.

      I believe I mention it here in the video, but as long as the employer enrolment was done correctly, and email address entered correctly, and no portal issues, it should be received within 10 minutes after submitted the offer and making payment for the employer compliance fee. It should be send by email and may also be viewed under submitted offers of employment.

    I am currently working on an intra company closed work permit visa in Canada. My work permit was issued for a period of three years however, since my passport was expiring in 2 years, I was issued a work permit of a shorter duration i.e. of 2 years. Now that I have received a new passport, can you let me know the process that I need to follow so as to get the remainder of the work permit that was issued to me stamped on my new passport.

      There's no way around it. They will only correct permits if IRCC made an error. If your passport information changes, you must submit a new application ie. Extend Your Stay as a Worker including a $155 fee and to be safe, I'd also do an updated employer portal $230 compliance fee. There's a chance, that you could get away without having to redo the $230 employer portal, but at that point, they would ONLY give you the remaining year, and they may just refuse it because it's not a complete extension, and the officer may be trying to match it with your previous offer (expired by now and already matched) and would be combing through GCMS notes trying to find original permit length. I would advise that you do a complete extension on your ICT, explain there's a year missing due to the expiry of your travel document, and include your new passport, and submit a new application with $155 for WP and your employer paying $230 compliance fee, and go for at least another 3 years.

    Hello, I have a question. I'm the employer and I have submitted a LMIA exemption application and get a 7-digit offer of employment number which starts with A. Does that means the exemption request is being approved,, so that it's safe to give it to my employee

      It will automatically be generated. What determines whether or not the exemption gets approved is when the applicant (your employee) applies for the work permit, and their work permit is approved.

      I believe they can issue a permit for greater than 6 months. They probably would be best to go to a year, but if your employer insists on 7 months, it should be fine.

    Good video, but the problem is that Human Resources of the Company doesn’t want to create and share information though that employer portal. What can I do in that case?. They told me that is my responsibility to process my work permit and they don’t want to do anything to help employees.

      Then if they don’t want to use the employer portal they can email the employer portal and complete form 5802, but it sounds like your employer just is not cooperative.

Blows my mind. Had a hospital unwilling to sponsor yet they wonder why nurses lose status and we have a healthcare shortage 🤷‍♂️

    Sir please reply, i recently got a job offer under overnight camp counselor category, my employer says he will apply for lmia exemption and send me 7 digit code which i can use during my application. My placement is only for 4 months and i am a pakistani national. What category of work permit i will apply?

      LMIA Exempt WP. Either inside or outside Canada depending on if you have valid status in Canada (visitor, student, worker), or if you're outside Canada. This would affect the forms you would have to submit.

    Thanks a lot for the information. Can you please help me with a question? I'm from Colombia and I want to know if I can apply through this agreement as a Pantry Chef. I'm professional but I have not done any studies as a Cook or chef. I have about 2 years of experience working in Restaurants as a Line Cook in Canada. My company is willing to help me with the NOC of Chef 62200, just if it is not an LMIA process. Do you think I can apply with this LMIA Exemption? I need to apply with my husband and son and my current permit will expire soon :(

      In short, if you can convince the officer that your employer needs you to work as a chef (reasonable employment need and genuineness), and that you can substantiate you have the experience and skills to do the job, it may be possible. They will look at the employment requirements in the NOC for chef, and that will factor into their determination. I would need to see your documentation and understand more about your work history and current duties to make any recommendations or provide advice.

I was checking to get the Red Seal but I need 5000 working hours and I still don’t have them:( I have worked for Tap & Barrel for more than 1.8 months and I have been working in the company that will help me for about 3 months. It is a big company that have different hotels, restaurants, casinos. The offer is genuine and I got the experience during my time here in Canada. My only concern is that I do not have studies in this field. I got a degree in Economics in my country 😰

      It can be possible once you’ve worked more than 1 year full time for the employer named on your work permit, and the LMIA exempt work permit is approved.
