    In my case it's being difficult get the LMIA Exempt from my employer, at the beginning the company did not know anything about it, I have learned many things with your videos and I was able to explain more details to my employer until now.     Thankyou for the information you are sharing with us. But the LMIA cost $30,000 to $40,000 in the market. Government should keep an eye on these employers and businesses who are charging PGWP holders unfairly.
    Workers who are already in the country paid taxes government should help them in order grow future and career in the country.

    Hi, thank you for the detailed video. I had a question about being considered a CEC applicant even if you left Canada (given that you have at least one year of Canadian experience in the past 3 years). You mentioned that CEC applicants do not need to show proof of funds, which makes sense if you are working in Canada, but what if you went back to your home country for a few months and got an ITA while you are outside Canada? Are all CEC applicants exempted from submitting proof of funds regardless of whether they are in Canada or outside? Thank you :)

      My understanding is that you do not need to meet proof of funds requirements if you were invited to apply under the CEC. If you qualify for both CEC and FSW, and are invited in a general draw, they will evaluate you on the CEC requirements first as per program delivery instructions.     PGWPs are a part of the IMP. It cannot be extended unless you have applied for BOWP or apply for closed work permit.

Already applied through the OINP JOIS stream and hopping to get the nomination in a couple of months. Is there any chance to get a consult related to the LMIA exempt work permit and other options?       Certainly, it appears you’d have a qualifying occupation. If you receive your nomination and support letter from Ontario prior to work permit expiry, you should be able to extend your work permit as a provincial nominee.     Hello !! I hope you are doing well !! I have a question I really hope you can answer, I'm currently in Canada working under a Closed work permit that is going to expire in September this year, I want to be one step forward before that happens, and I want to extend my actual work permit with my same employer (they are whiling to help me out in this) I came here under an international mobility agreement so my employer issued me an offer of employment that have the LMIA number exempt, the question that my employer and I want to know is if they need to issue another offer of employment with a new number generated for me to apply for the extension, I'm assuming yes they need to submit another one considering they gave a wage adjustment but we just want to be sure that is needed or if I can just submit the old one with the previous number. Thanks in advance I'm hoping you can answer my question.

      They will definitely need to submit a new offer. The old offer is only valid for 60 days to be matched with a corresponding work permit application. Once it's matched, its done and exhausted. Good on you for being proactive. That is the most important thing in immigration, to plan ahead. Depending on the agreement, or the exemption, there may be limits to how often and for how long you can extend. For example, with Intracompany Transferee startup case, Officers are instructed to first do 1 year, then extend for up to 3, then extend for up to 3, for a maximum of 7. So make sure there are no restrictions or surprises with your agreement.

      I'm sure I could get around to it. It's a highly subjective exemption, and requires that the person be actively engaged in charitable work. Cooking for the homeless counts, but not working administrative back office for a large charitable organization. So there's a lot of subjectivity.

      So if you still are less than 90 days from the expiry of your work status, and have received ITA, and have eAPR, you should apply for a BOWP, and include the restoration fee in an attempt to restore your status as a worker and include a letter of explanation. As you lost work status less than 90 days ago, you are eligible to restore your status as a worker, and can do so with the BOWP. If it’s been beyond 90 days, I’m afraid I don’t believe you can.

    I had submitted my OINP application in January. This week I received a letter from OINP informing me that my application was returned due to a non-signed document, and adding that I have to start all over again from the sketch, I mean, send another EOI and wait for a new ITA. So by doing that, I will need at least 6 months to receive my nomination and be able to apply for a PR. But there is a problem, my PGWP expires in May/2024. I dont have an LMIA, but my job is in somehow specific, I fix locomotives in the US, Europe, and Canada for this company. Can I apply for an LMIA exemption? and after that apply for a Status Restore or Work Permit Extension? Or Can I apply for a WP EXT without an LMIA exemption?

      In almost all cases, you can really only extend your work permit if you have an LMIA-Exempt offer number, or an LMIA number. If your employer is willing to support an LMIA-Exempt job offer in the Employer Portal ($230), you could use this number that is generated to apply to extend your work permit (prior to expiry of your PGWP). That can be done in a couple days (employer portal offer is approved in 5 minutes), but then you still need to apply for work permit with that offer number, prior to expiry of your current PGWP. This would allow you to maintain your status as a worker until they decide on your work permit application which takes 3-4 months. You have to qualify for one of the LMIA exemptions, and they are based on everything from French ability (CLB 5 speaking listening for Francophone Mobility), to occupation specific, or even nationality specific like Canada-Colombia Free Trade Agreement. To focus on the occupation only, as I'm unaware of your nationality or French ability, I'd say the only exemption may be C10, as there are clearly significant benefits as you are ensuring essential transportation corridors remain viable for transportation of food and other goods in Canada. You also are highly skilled, and its niche and specific, which you'd have to emphasize in the submission, and the other significant benefits as outlined here: www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/temporary-residents/foreign-workers/exemption-codes/canadian-interests-significant-benefit-general-guidelines-r205-c10.html.
      I saw C13 which sounded a bit like your job, but it appears that's more for short duration work permits.
      Finally, there's also the LMIA option. Once your employer submits the LMIA application through Service Canada and pays $1000, you get an LMIA number, that you can use to extend your work permit, and update the work permit application once the LMIA gets approved before they decide on your work permit application. You'd have to get started ASAP so as to not have a decision on your work permit (3-4 months), prior to the issuance of a positive LMIA (about 3-4 months). Most LMIA's require 28 days of advertising first before submitting them, although I might argue your position could qualify under the advertising exemption as you sound like a "specialized service technician."

      You want your employer to decide to apply for the LMIA as soon as possible (if that's an option), and you want to extend your work permit literally at the last possible second (IRCC operates in UTC time so be careful if you are submitting on the last day), to max out your time, and increase the likelihood of the LMIA being approved, and updating your application via webform, before they process your WP extension. They will refuse your WP extension, if your LMIA is not approved when they look at your WP application, and you will go out of status, and have to restore as
      a worker with your valid LMIA now. C10 is perhaps the most challenging LMIA exemption to prove, and requires lots of evidence, and supporting dos. Same thing, they take 3-4 months to decide on this, and if they refuse, you go out of status.
      You can also submit prior to WP expiry to change your status to visitor, but they will decide on that in a couple months, then you'll have to stop working once they do, and you'll need a letter of support from the province, after you received the nomination, and applied for PR, to get back on work status. Not all programs are eligible for letters of support for work permit applications either, and if you spend too much time on visitor status (over 90 days), you wouldn't be eligible for a Bridging Open Work Permit, as you are no longer in the restoration period. However, an employer specific work permit, with a letter of support and offer of employment through employer portal as a provincial nominee, could be an option.

    Where can I find the LMIA approval rating?
    My employer started the process of the LMIA (Dual intent for PR Support/Work Permit), they are about to submit the application to Service Canada and my PGWP expires June 28th. My lawyer said to apply for a visitor visa at the same time as my employer is applying for a work permit extension before my current one expires that way I will have status regardless of the LMIA approval. How long will IRCC give me until the LMIA is approved if they submit my work permit extension application before my current one expires? With the current processing time it seems that the LMIA will approved by July/August. What are your thoughts? Will the LMIA be approved in time before the work permit extension gets approved/rejected?

      At the bottom, you can see the negative LMIA. From there you can determine the approval rate.
      Here is the link where IRCC mentions they will allow 60 days after submission of the work permit extension, to come up with the valid LMIA. As a result, I would wait until the final few days before filing work permit extension, at least within 2 weeks. www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/temporary-residents/foreign-workers/exemption-codes/validity-suspension-duration-employment.html
      In my opinion, if you get your LMIA by the end of august and submit WP less than 2 weeks before June 28th, you should be in the clear. If the LMIA takes into September, it could be problematic.

    Hi Steven, I just got my test results from the TEF and fortunately I have enough points to qualify under the francophone mobility work permit, the thing is that my PGWP expires late June and I see that the work permit takes about 3-4 months to get approved, what would happen if I’m by the time I my PGWP expires I still haven’t received my work permit under the francophone program ?

      As long as you apply for a work permit before the expiry of your current PGWP, you will maintain your status as a worker in Canada, and extend your authorized stay until a decision is made on the application.       @@arturoolvera6254 you are right, in the sense that you maintain your work status under the conditions of your previous permit (which in this case, is a PGWP) however, a PGWP is an open work permit, which allows you to work for any employer, so you maintain your status to work for any employer until your closed Franco work permit is approved. Also, be considerate of the occupation, if you need medical exam, as there are some occupations that are restricted based on whether you have a medical exam.
      Where the maintain status can get people in trouble is the other way around. If they are on a closed work permit with a single employer #1, and they submit a new work permit application, to apply to work with employer #2. They maintain their status being allowed to work for employer #1, so they can’t go work for employer #2 until they are granted the new work permit.

    Hi! My husband and I have submitted our PR application through the OINP & have received our invitation we are just awaiting approval for our PR. Our OWP & PGWP expire soon because of my passport expiring. Am I able to renew because of that? Ive renewed my passport & I’ve only had my PGWP for about a year.
    (My husband was able to apply thru his work with a LMIA & closed WP.)

      You can renew your PGWP if there’s a note on it that it was cut short due to passport expiry. It’s a paper based process and the guidance is extensive for it online. However, if you have submitted a PR application through OINP, and have a valid nomination, you should apply for a work permit (T13) extension and your husband at the same time. You can get two years if you’re ineligible for the bridging open work permit due to restrictions on employment on your nomination.

    Please I have 2 years work experience and a bachelor’s degree in Canada for 4 years - I graduated may 2021 - business admin. Will I be eligible to apply under OINP international graduate stream of if I am currently working at a job with 12 months contract. Would that be an issue? Also the job offer they talk about which I need to submit when invited? Is it the initial job offer letter I got at the company. Pls note I’m on pgwp which expires Sept 2024 kindly advice- my score is. 493

      If you earned the credential more than 2 years ago, I think not. My interpretation is you have to apply to the OINP before 2 years has elapsed since you completed your credential.

      Yes. This is the generic form for applying for a work permit in Canada. For PNP work permit extension, you likely need to get an R204 letter of support from the province (after nomination typically), as well as may require your employer to submit a T13 offer of employment through the Employer Portal.

    I came here on closed work permit but I’m my work permit will expire this year. My file in the express entry pool with a CRS score of 472. I applied for visitor status. My question if I want to study in canada would I be able to do it. With visitor status and convert it to study permit. Cause I don’t thing I will get invitation anytime soon. I don’t have Canadian education.

      It appears if you are not on valid work or study status, that you need to apply outside Canada.       I have Canadian education with Ontario Secondary diploma and graduated from CENTENNIAL COLLEGE majoring in Truck and Coach Technician and have worked for a number of companies. Also, my CELPIP is 10-12 except Writing 9.. Unlucky, I was lạid off in March and my PGWP is going to expire in July. Can I have a way to stay? Hope to hear from you.

    What about if no LMIA, EE score of 526, PGWP expiring in days, visitor record & visa done... what can be done?

      Either a work permit extension with no basis to maintain work status, or conversion to visitor. If you can submit a PR application within 90 days of having lost your status as a worker, I don't see why you couldn't restore it with the BOWP. If it's beyond 90 days, it appears your options for getting back on work status are limited. 526 is a competitive score. Maybe you get drawn today :)
