    The sport of cheerleading has seen its fair share of scandals and lawsuits. Regarding the Navarro program, which was the subject of the Netflix series Cheer, there have been several very high-profile scandals. In April, a former Navarro cheerleader sued the college, Coach Monica, and others over an alleged sexual assault by a fellow cheerleader, accusing the school and coaching staff of failing to protect members of the team from sexual assault and harassment. The case against Coach Monica has been dismissed, and she has been cleared by USA Cheer over six months after the lawsuit was filed.

    Keep in mind that a company HR is there to protect the COMPANY. Campus Police is there to protect the school! Always report to local police & get the case/complaint # to give the college. College needs the pressure of local LE is involved& there is no hiding behind campus policy.

      Except that in some cases the local pd won't have "jurisdiction" within the campus boundaries. That was the case of Lauren McCluskey. Campus PD wouldn't do anything so she made a report to SLC pd and she was told they didn't have jurisdiction. But she simply wanted them to know incase anything did happen to her (which did).

    I work at Navarro College. :) Even I don't understand how Cheer got so big... they win.. but they compete against 1 other team in their division.. I wish our band, choir and theatre programs got as much recognition... Go Bulldogs!!

    One of the twins in the Jerry scandal was removed from his cheer team The California All Stars and placed on the USASF banned list. This is the FORTH person from that program to be banned this season.

    This school has a lot of this going on in this one program I understand her being upset if she really had no idea but it feels like there has been a failure to protect the students at the school. I can understand why the cheerleader included everybody. That is too many incidents in a row at any school

      Sounds like this cheer coach isn’t the best at screening staff applicants to be in the program. Or the AD for the university.

    While I understand that Monica wants to get on with coaching and get her suspension lifted, I'm happy to see USA cheer take it seriously. Both USA cheer and USASF/IASF has been known to lift suspensions way too flippantly, and even allow suspended coaches/owners still coach and attend competitions.. On another note, the way she defended Jerry has forever left a bad taste in my mouth, and I lost the respect I had for both her and Gabi.

    The fact that she was dismissed, or rather dropped, could only mean that the plaintiff thought that they might not have enough evidence, or not enough funds to fight on all fronts. And the fact that Monica was suspended wasn't based solely on this single claim, I imagine. If you look at navarro team... there is a lot of shady things going, lot's of impropriety, and she is supposed to be a leader... ofc it is not leaders fault necesairly, but so many cases... something should have been done before maybe. I still would not trust to put my kid in her team, even without the lawsuit, at best she has the tendency to look the other way too often.
    The due process is another thing. Imagine being an actual victim and you have to wait months for the decision, she maybe was suspended, but imagine the stress that you never know what would be result and if/when she would be reinstated. Kids and parents also need a due process. At least some time frames, to be prepared.

    As someone who coached and and had a daughter in one of these programs is you can get really bad coaches. My daughter had one and ended up in surgery for her injuries and could never cheer again. She was devastated.

    This was interesting, I would have liked to hear the May filing why coach was removed from the lawsuit or whatnot. We assume she provided evidence that she reported incident, etc. that cleared her of wrong doing. I would also like to hear about the DCC Dallas Cowboys Cheerleaders they did not renew their show making the team and I later find out there was a suit brought against the media guy that does the photo shoots etc. Challenging topic, Ty for covering it

      Universities are not the proper venue for managing/adjudicating SA.
      The notion that the university has the jurisdiction/responsibility to provide kits for SA collection is puzzling. Where do the victims in the community go for the same?
      The accused and accusers deserve their day in a real court complete with due process. No one should ever allow him/herself to be railroaded in the extrajudicial processes at a university

    On the response to the 12b6.
    It's an 'and' for the requirements, so unless she plead that they had actual knowledge, the who thing fails at prong 1.she has to plead facts re. HER CASE. The other cases are irrelevant for that prong.

    My understanding of earning the letters was not the acronym itself but what they understand as needs to be done to obtain those letters. Following those in charge to obtain those letters means submitting to hazing and similar abuses. The culture is giving, “this is just how it is” and resilience to that abuse is how you “earn your stripes ”

    I would note - she got due process. She was afforded notice and an opportunity to be heard. We can talk about the amount of process due. She is likely to lose a suit based on known facts.

    I’m not familiar with this case so I’ll admit im speaking ignorantly but when it comes to children I think immediate suspension is the right thing to do. How can you continue to put children in potential harms way to let a process play out that could take years? It sucks for the adult but the children have to come first

    I think that the amount of past issues with the Navarro College Cheerleading Program indicates a known problem. No one would send their children to a college who does not feel it is their top priority to protect all their students, at all times, at all places where the students are competing for Navarro. Navarro's "cachet" for having a top cheer program, will evaporate unless they react proactively indicating how all students will have the college's support and protection. Even a perfunctory internet search by me produced: "Navarro Cheer Scandal". Humans may have short memories, but the internet does not. Navarro needs to look to the future, own these problems, set in protocols and settle the lawsuits asap. One year from now, will a search for Navarro result in "Cheer Scandals" or "Cheer Team wins competition"...it is literally Navarro's call.

    If one doesnt know it fundamental policy structure in such circumstances have been on the books since the early 80's. How are parents sending their children to such archaic in institutions? Please keep your children out of these halls, places where such complicit by failure to act/ protect them is clearly evident. Please do your research when applying for college entry.

    According to the International Association of Forensic Nurses, only 17 to 20% of American hospitals have SANES(sexual assault nurse examiner) on staff. The worst shortages are in large rural communities. It's support that's desperately needed for victims. Typically even in an emergency department (not rural) can take hours for a SANE nurse to come. Don't absolutely have to have a SANE nurse but it's best. I don't know what Navarro was supposed to do for her other than direct her to an emergency dept. (reporting the assault and getting a "rape kit" or medical assistance is a different thing if I remember correctly them directing Maddie to Waco was when she inquired about medical attention)

    Ok I just have to pause and comment real quick about the partial motion to dismiss…
    It seems to me that the college’s argument that they’re not responsible under title xi is not based on law or the fac, but would be an issue for the fact-finder to determine, and therefore an issue to take to jury trial. So are they just wasting Lane’s time and money on this motion to dismiss? 🤨🧐

    I would LOVE to see you go over the Safesport guidelines and talk about the pros and cons of their process. Especially since you have been a high level athlete.
    There is no due process, no right to know who accused you etc. Essentially it's a non-profit that wrote a series of guidelines in the wake of the USA Gymnastics scandal, and it seems like most sports' governing bodies have adopted them. But Safesport manages the entire report and investigation process exclusove of any legal process.
    We need to protect athletes, but it's also a tricky balance. No one feels bad for a coach who got suspended for a year if it turns out at the end that they're found guilty of SA, but I also know of coaches who are off work for months as well as tens of thousands out of pocket defending much less egregious claims that ultimately come to nothing.

      @@Mama_Bear524 Well, in the one case in particular that I was thinking of, the allegation was "bullying". The coach in question has a decades long reputation for being blunt and hard to impress. It's not my style, but she's been producing winners about as long as I've been alive. The student who made the report was an almost adult aged teen, not a young child, and stayed in her program for 3 years. Many, many other students publicly supported the coach, and the ultimate decision was that the student was treated the same as everyone else, so she wasn't being unfairly picked on. But that cost the coach $50,000.
      Ultimately, there's no innocence because there's nothing to be guilty of. It's not a legal process. There are definitely people coaching children who shouldn't be. There are a lot of safesport guidelines that are inconvenient to comply with, but I'll do it because there's a chance it will protect a child. But the whole program was put together fairly hastily and the report-suspend-investigate process needs to be more nuanced and refined.
      I don't think anyone deserves to be made to feel bad about themselves, especially children. But I also think there's a grey area in between singling out a small child and a group of older teens being spoken to harshly and one of them feeling more hurt than the others that needs to be a bit more thoroughly thought out.

      It takes tremendous amounts of grace and forgiveness to apologize to people/institutions that tried to drag you in a lawsuit even though you are innocent.
      Especially if it affected her and her loved-ones as much as it did.

It doesn’t help her or her family to not do it plus it is a big step in the healing process. Well also in clearing her name in the public’s eyes. Just my opinion.

    These colleges/universities look out for themselves first. Until a case is going to change the precedent for reporting sexual assault, we will continue to see this type of scenario. Students' reports need to be investigated and documented immediately. The proper authoritative personnel need to be held accountable when they fail to report an allegation, provide medical attention to those who request it, and when there is a blatant attempt to cover up/protect the perpetrator. I enjoyed watching Cheer but Jerry and now these allegations have taken the joy out of this sport unfortunately.

    This just feels like Erica being cleared…. Just because you can’t prove she did it, doesn’t mean she didn’t do it…….. I fully think she was well aware of issues and did not protect those children. Just like Erika knew it was blood money, just can’t prove that she knew…

    Can't have transparency. Bc there isn't Due Process. & .. IF a lock step hollow drone walk thru Due Process, then there isn't/ can't be /often aren't For Cause findings.
    But you're fired by then. And off licking the wounds which won't heal fast enough.
    TG her program was so talented & the Netflix publicity was so positive. Imo: this helped force her forward into the maddening process -‐> w the no hope , while possesing all the exculpatory evidence

      I dont think she was charged for anything, this was a civil suit. But it was for failure to disclose knowledge of sexual assault as a mandated reporter. It was alleged she covered up SA on her team.

      ​​@@coffee8599 Under the title as watching, it says "2.9k watching..started 24 minutes ago.". When that is posted on a video, it indicates the video is live. Once the live video has ended and the video is subsequently posted, the "# started watching X minutes ago," is removed.

    It took me 14 months to unf*k my life after false allegations. A year to get the determination of factual innocence and settle the lawsuit I filed. It’s devastating how much damage false accusations do to people’s lives. There should be due process before suspensions and firings over unproven accusations.

    When our kids go off to college they are adults, but to us they are still our kids and we expect that they will be safe. That is one of the things we look for when helping our kids choose one. Yet you hear of so many horror stories these days of missing students, AS and self harm. They should at least be safe when attending school functions and away trips for competitions. If you are going to have male teachers in conditions as this they should be fully investigated before hire. If it happened once you can bet it has happened before. I thank you for being you. You give all the facts and none of the judgement for either side and I appreciate that. Thank you Emily 😁

    I hate that Monica had to go through this situation where people tried to tarnish her reputation. She handled this whole situation with such dignity and grace. I am so thankful and blessed to know Monica. She is really a role model on how to handle issues with the utmost dignity and grace. So happy for my friend Monica!
