    Leah Remini’s court battle with Scientology has been met with tons of litigation. Both sides have made it clear they will not go into mediation regarding this lawsuit. David Miscavige, the ecclesiastical leader, claims he was never properly served by Leah’s team and should be removed from the lawsuit. Leah requests the court to place an injunction on the church of Scientology because their continued harassment campaign against her is so severe that by the time the trial is over, her reputation could be irreparably damaged. The Church of Scientology fights back with an ANTI-Slapp motion claiming their right to speech based on public interest. The court has been so overwhelmed with their back and forth that they requested both sides to stop filing motions while the court takes the time to review and consider the motions prior to the hearing.

    In my opinion, Leah is not going to settle. It will go to Trial. I think she has, for 10 years, carefully documented everything so that she will have ample evidence. This is not about a big settlement; it is about exposing Scientology and putting a huge precedent in place for helpless, vulnerable victims to use. Hopefully when she is done it will trigger the end of their tax exemption status.

      Yeah no settlement it’s not about money it’s about bringing them down and she still wants to know what happened to “Shelly" Miscavige. I don’t think we ever got answers on that. If they agreed to tell truth and let her grieve her friend might be one of the only things that would get her to settle.

    They need to 86 the whole internal arbitration clause all together when it comes to illegal acts. A church cannot be above the law

      The amount of churches and religious institutions (as well as those pretending to be such when they aren't) that are actively getting away with criminal activity by hiding behind the first amendment is nauseating. I'm all for people reading whatever religious texts they please. I'm all for people wearing religious garb. I'm all for people having religious symbols in their homes and on their front lawns. But the moment a so-called 'religious practice' starts hurting someone else in a provable way (i.e. child abuse, kidnapping, torture, medical abuse, elder abuse, harassment, and more), it should be irrefutably illegal. You can't just pick a law, make it part of your religion to violate it, and use it as an excuse to get away with violating the law. It's ridiculous.

      I also agree that ANY group is not above the law. But agreements (of any kind) between non-government entities (including individuals) frequently have alternative dispute resolution clauses. That’s the dragon’s den. 🐉🐲. All of us as consumers are pushed into “binding arbitration” on everything from cable to subscriptions. It’s a huge problem for transparency and real justice.

    He is clearly evading service- and has the means to hide. Surely the court needs to grant substituted service. Especially as his lawyers are completely aware of these proceedings.

      Can’t Leah’s team file a motion for alternative service? A process server then can post to physical address, certified mail, publication and other options that the judge can approve to bypass personal service.

    The one thing CoS doesn't get is that Leah has never given anyone a reason to dislike or hate her in general society. There is no one that would dedicate a hate page to her let alone hundreds. And that's not to say she is unimportant, the opposite-she treats people right and is respected.

    I’m Australia we have something called “dispensation of service” which is the last resort when something can’t be served (for various reasons). Basically the judge or registrar is saying the plaintiff/déponent has tried very hard to serve you via all options and you have now lost the option to be served. It’s a huge relief as it doesn’t allow people to keep dodging service like this! COS is insane.

    Yay! So happy you’re covering this. What came of the Jane Doe’s being allowed to cite Scientology protocols/practices in the Danny Masterson case proved illuminating as to how they keep people in fear of standing up for their rights. I have respect for Leah having the courage to further expose what abuses take place within the Scientology construct. And Ms Emily, your breakdowns of the law ALWAYS puts my head on straight. I love your perspectives! Watching you deconstruct legal documents are like Mind Church for me!

      In my 1st year of university, I changed my mind about becoming a law student come my 2nd year, because I noticed that "the letter of the law supersedes the intent/spirit of the law".
      The legal system is corrupt.

    The exact same problem with service is happening with a lawsuit in Florida against Miscavige. They refuse to allow access to any building he has an office in. He is a professional dodger.

    I hope Leah is filming this so she can show the entire legal battle with this institution/cult. I know she probably can’t discuss the case now but hopefully we can watch after it concludes. I admire Ms. Remini’s strength and determination to out Scientology and Miscavage’s dirty deeds. All the victims involved are brave imo.

    Scientology has always interested me. When Lean first came out with her show, I did a deep dive into the topic. I read several books written by former members, to include David Miscavage's father. Leah has been gathering the supports for this litigation for 10 years. Just from watching her show, I can confidently say that she has it. However, there have been so many lawsuits against them over the years and what they do every time is load the docket with motion after motion, etc hoping that the Plaintiff will run out of money and either withdraw, or take a settlement. I am not sure, but I don't think any of their cases have made it to trial. I am sure Leah and team are very prepared for all of this and I think this may be THE case that goes to trial. I hope so. They need to be stopped. Its a cult. Plain and simple. It is not a church, it is a business. There is way too much proof out there of the abuse and horrible treatment the members endure. If she wins this case, I see it opening up a lot more against them. GO LEAH!

    I want them to subpoena the missing wife “Shelly" Miscavige Which was one of Leah best friends she has been worried about and not seen for well over 15 years. Even with all the missing person reports Scientology gets away with not having to prove she is ok. Let her friends and loved ones have a service and grieve if she is no longer with us. Where did they put her. Nothing filed. These people get away with anything. 😢

      Shelly may not want to leave. It’s thought she’s in charge of LRH’s personal belongings, like his camera collection. Shelly worked for LRH starting as a young teen. She was groomed to be his slave.

    Thank you for covering this. I have heard former scientologist and protestors attending the hearing, and they had no idea what went on and their opinion on what has been going down didn’t make sense. It’s clear we need an attorney covering this. Speaking of the protestors,have you been following that at all? Especially Streets LA here on UA-cam? The recruiters have been calling in false bomb threats against young protestors. I am grateful Streets LA (William Gude), has a history with the LAPD, and knows the law. Claiming protestors who are innocent, and have proof they are not doing any of what these scientology recruiters are claiming is a nice lawsuit as well!

    26:44 when you have the LAPD in your back pocket, and you travel between buildings behind locked gates with security, it’s ridiculous a court can’t make this more accessible to get him served. I’d publish it in the Clearwater paper and the LA Times and call it a day. Miscavige is a tiny child.

    This is insane, how long can he keep evading service (for a very well publicized lawsuit) without the court stepping in and saying he’s considered served? Like… if I just hide in my bathroom and don’t answer the door and don’t collect my mail can I just never be sued for anything?? Wild

      Because Scientologists think they’re above the law. Watch the protestors that are streaming live in Los Angeles in front of the Hollywood Blvd building. They have been calling in false bomb complaints, and lying about the protestors. Most of them are young kids, one is 16! This is par for the course with these kooks.

    There has to be some kind of law against service-dodging. It shouldn't be possible to avoid lawsuits by just hiding and ignoring it. David KNOWS he's being sued. How is that not enough? Isn't the point of process serving to make a person aware of legal filings? He's aware, his lawyers are filing motions, he should be considered served.

    Today's a WFH day so I can listen to you in the background. Excited to hear about this. Worked for a company that was run by Scientologists for a short while...nuts. When Leah said they keep files on members, she wasn't kidding!

    My suspish-Leah has said powerful people are connected in Scientology, I’m not surprised if she knew the judge was connected somehow and would absolutely be bias. That’s my immediate instinct.

    My dad was a Process Server for many years and the lengths many people go to in order to avoid service is entertaining!
    I can’t imagine the “throwing” of papers is appropriate, if it happened, but I know at least in Texas, you have to have the judge’s approval to do a substitute service.

      I'm in CA. I used to work for a process service, and many times our servers came back to the office with stories about yelling at the person peeking through the curtains, "I can SEE YOU! *drops papers on the porch* YOU HAVE BEEN SERVED! HAVE A NICE DAY!" They called it 'drop serving.'

    Somebody needs to take down Scientology. Leah has been the only one to have to guys. Had scientology not been involved with covering up everything that Danny masterson did it wouldn’t has gone on as long and he would have been exposed way sooner.

    While we all try to remain unbiased, I do hope that Leah is able to loop David into this lawsuit and does get served. The amount of hoops they are trying to put her and her lawyers through are really something. This whole back and forth of "she doesn't even go here!" Is so childish lol

    I don’t get this serving thing. If someone is dodging service, can’t the court allow their lawyers to be served, since they’re obviously directly connected to their own lawyers and can easily be given the papers by them? At some point someone has to make themselves available to be served. Also, Scientology accusing Leah of continuing to defend a man accused of grape is RICH. Danny Masterson is still in good standing in the “church”. They support a man convicted of grape.

    Hope the FBI or other legal entity outside of California is or can be involved. Seems that California wants to protect scientology and the money associated with the group. They certainly can't fit the standard understanding of what a church is. Hope it all comes to light with this case.

    If the United States of America can create a Space Force, why can’t we create a special team to research cyber bullying specifically. I realize it’s a big chore and may be State specific however cyber bullying and hacking has become out of control both by bad actors from outside of our country and inside. We need to realize that cyber attacks are not going away.

    I have seen a number of videos about Scientology. Some of it is disturbing.
    Allegation include human trafficking, collision with corrupt police officers, wrongful improvement, and worst of all murder.
    In Los Angeles Scientology and its opponents are almost at war. I could end badly.

    I have been following many Scientology court cases. Every single time, when they try to serve David miscavige they are not successful.
    This might be a silly question, but they keep telling everyone where he's not at.
    David miscavige must have an address and live somewhere.
    I know and what are the cases they did ask where he lives and they would not give them an answer.
    I don't understand this so does this mean that anyone can just avoid being served by not letting on to anyone where a person actually lives. Keep having someone else answer the door and say no he doesn't live here.
    So does the court just say oh well we can't find him so he's off the hook.
    I am confused.
    They will not tell anyone where his regular place of business is. They have not just Leah remini's but other lawsuits served him at so many different locations I believe they have to be running out of location.

      He has been doing this for years - he hides behind all the gates - he lives on one of the properties- the blue buildings has a tunnel that goes under the road to get to the other building so he doesn’t even need to walk outside. Eventually the court will consider him served like in the other cases but they will have to try a few more times

      For a case in Florida, they attempted to serve him 27 times before the Judge finally ruled that he was considered served. This is his strategy anytime anyone tries to include him in a lawsuit. Idk if he thinks it'll actually work this time or if he's just trying to delay it as long as possible. 🙄

    He's the leader of the organization. This run around is just ridiculous cuz frankly lots of people will give Leah money to continue this because it's not only a cult but they do horrifying things to children and adults. So, it would seem to me like a judge is going to be very annoyed to have this continue go to go on once it finally reaches court because this is just evading being served.. It is his place of business He owns all the center so it doesn't matter where they are
