He is seeking restitution from the sale to go toward the Franke children for their future care and treatment as they recover from the abuse at the hands of Hildebrant and their mother, Ruby Franke. The Judge has ordered that Hildebrandt's assets may not be disposed of until after a restitution order is made.
In shocking news, Cheer coach Monica Aldama’s son, Austin, has been charged with ten counts of possessing or promoting illegal images of children. I review the grand jury indictment and break down the charges for the state of Texas. Coach Monica talked about how shocked she was when Jerry Harris was prosecuted for similar charges.

State prefers family over foster care. They still will help pay for their support.

Franke really SEEMS like a callous, self-centered opportunist-- he didn't notice the torture of his kids, but he spotted the potential for grasping someone else's money VERY quickly.
Not only he saw, but he accepted, he did nothing about, possibly even participated then, when he left he failed to report.

I came to the comments for this.
I saw the video from the parking lot of the police station where Kevin Franke was badgering two officers in a conversation about WHY he couldn't press criminal charges against his adult daughter who had entered the family home to retrieve belongings for the minor children after Ruby Franke was arrested. Clearly, his badgering took place after he asked inside to press charges and was denied.
You have to wonder how twisted he is to INSIST he wants to press charges against his young-adult daughter in those circumstances.
That man can be judged as a waste of oxygen for this act alone.

Yeah because she took some of the kids stuff because she had some of the kids and also she took some of the lac electronics and turn them into the police and he wanted them back because he's got issues but unfortunately the police did give him the electronics back which is not a good thing.
Kevin should never have access to any moneys his kids get. Frankly, he should never have access to his kids.
Actually, cutting all ties is not always best, often supervised visits are in most cases. Let's wait and see if he is charged.

It’s amazing that KF can go over a year without seeing, or protecting, his children, but the second he sees a way to continue using them for profit, he’s right there to collect. The children definitely deserve compensation, but it should be awarded only with a third party to manage it, and protect the children’s long term interests. KF should never see a dime, as he was right next to Ruby approving of, and participating in, the emotional abuse of those poor kids. Frankly, he should have been charged with abandoning/neglecting the children, at the very least.

As an child abuse survivor who later became an SA and DV survivor. Kevin Frankie shouldn’t be allowed around his children or any $ they could receive. He’s just as guilty as anyone else. They need counseling not him.

Given how wretched his stewardship of his family's welfare has been, it's absurd to entrust him with their money. And since a LOT of people have been abused by Hildebrandt, it does seem grasping of Franke to demand a $5M prize for betraying his kids.
I don’t trust him one bit. And it’s easy to prove he’s got bad intentions. All they have to do is say they’ll put the money into a trust that is fully for the kids and not controlled by him. You’ll see immediately what his true intentions are because he’ll freak out about it. This money is for him. Full stop.
@@Mama_Bear524 exactly. i PRAY that if the money/restitution is awarded that it is awarded to the CHILDREN in the form of a trust somehow instead of to kevin himself. They need someone to truly advocate for their best interest. I can almost gaurantee if Kevin gets the money it will be gone and the kids will be left holding the bag into adulthood to pay for their own medical/mental health care. This is likely going to be a long term issue for kids who were raised like this. The older children ALSO deserve mental health care IMO too for what they had to live with and the trauma of growing up being forced to see what their mother/jodi was doing to their younger siblings , the 2 middle girls who were staying with Pam seemed emotionally disconnected from what was going on and even just THAT has consequences mentally- having to dissasociate and emotionally detach from how your siblings are being treated and the situation at home... they were also probably brainwashed to some degree to think it was ok . This is the kind of cult mentality that needs 'deprogramming' via counseling and then when you realize what you've been thru it can be a whole other level of retraumatization that needs even more mental health care. All of these children need help and I hope they have someone making sure they money will end up in the right place, in the right hands, for THEIR benefit, not their neglectful (opportunistic and money hungry) father
I seriously want to know why people who have possession of CP or sending it don’t have longer jail/prison sentences? It’s not a victimless crime.
Would it be appropriate for any restitution to go into some kind of a trust so that Kevin couldn't misuse it? Given that by Ruby's admission that they made millions and he apparently can't afford treatment out of the marital assets (aka the money she made from abusing her kids), what oversight is there to make sure the kids actually get the money to fund their recovery?

Re. Kevin: whatever the outcome, all the money should go directly to a trust fund for the kids. Kevin got his millions from UA-cam and other associated deals.
They will need very long term mental health help. The little boy, after leaving Hilldebrant's house said it was His Fault. That's a really hard notion to remove once deeply imbedded in a child's mind. I feel for these kids.

I have an almost 3 year old daughter. Humans are absolutely disgusting. That’s why we are very careful what photos we post online and take on our phones (posted or not). I’m speechless. I’ll be interested to see how this plays out. Especially when Monica dealt with this already.

Emily thank you for NOT going into the details of these cases involving children. It does no good to further the abuse of these children to name them and state what happened to them. When they are adults, if they choose to come forward and discuss these things publicly, then they can do that as they are ready to. It breaks my heart knowing people like this exist in the world. I would die to protect my child and I don't think I could live with myself if I wasn't able to protect her, even if it wasn't my fault. I even feel guilt for these kids who aren't even mine. As adults, we have a responsibility to protect those who cannot protect themselves! Whether it is children or other vulnerable people! I pray none of us end up in this situation!
I absolutely love how you approach these types of cases. They are important to talk about instead of sweep under the rug, even if it’s hard to hear. We need to hold these monsters accountable.

I have so many strong opinions about Kevin and his actions in this family. Though I could not agree more that these children absolutely deserve restitution! Kevin seems pretty preoccupied with stuff of value! From his assertion that the oldest daughter burglarized the home he hadn’t stayed in for more than a year to now a large sum of money he sees on the horizon. I don’t disagree that the money should be held for dispensation towards the children’s long term care, I do disagree that Kevin should have any decision making powers over how such restitution should be spent!

Then he seriously tried to have his adult daughter arrested for gathering the minor children's belongings... Which was abusive considering he just left the premise without any items for his children. @brittbritt3196 do you have proof of your allegations of neglect and abandoning his children?? Women can be nasty, vindictive and manipulative when it comes to stopping fathers seeing their children. I've witnessed it 1st hand. I've also witnesses how fathers have had to step away from the family to get their own mental health in check before trying to look after anyone else.
Until you have the complete story and FACTS you can't accuse someone of things you have no actual proof of.
Clearly the police don't see your one sided view of things. And if they were to charge him for "abandoning" his children, there's millions of fathers and mothers across the world for generations who should be arrested and charged then.

Any financial resistution need to go to those harmed children, with DADDY having NO LEGAL CONTROL. Daddy is a GDF adult w the ability to make choices his damaged children weren't allowed.
He likely wouldn't get the house, he just doesn't want the $5.1million to disappear and Jodi to say "oh no, I have no money and no assets, I'm broke, too bad so sad". Liquidating assets is kinda a red flag.
The house is one of Jodi's biggest assests (if not the biggest) & it's currently for sale. If it sold without this claim, then Jodi gets the money & it would quickly disappear. This way, the children will get any & all profit from the sale of her home. Kevin isn't actually wanting or asking the court for the house itself, like to live in it. He's just asking for the money/profit from the sale of the home. The house can't sell now until the judge has ruled on this filing.

As someone that went through that type of child abuse. As someone that was raped as an adult. I will never understand why the punishments are not more severe. In my opinion, doing that to people is worse than murdering then because they have to live through the pain and the trauma every day of their life. They have a life sentence, they never are free or normal or back to what they used to be ever again. And these people are getting away with either probation or two years in jail. Like what? The Punishment needs to fit the crime.

Because Jody Hilderbrant was an approved councilor of the Mormon LDS church. The church referred church members to her. Does the church have any liability to her victims?
The Frankie parents demonstrated a lot of issues surrounding ownership . Kevin should in no way be in control of the restitution money.
I adopted children through foster care. The foster care system pays for basic psychiatric care. However many children who have been through tough situations before being adopted or brought in to a safe place need or could benefit from therapy services that the state will not pay for such as biofeedback, Equine Therapy….
Looked through that Zillow listing. It's eerie knowing what it is and what occurred there. It reminds me of a cult compound in a way.

Everyone was saying how abusive Ruby was and nothing got done and now it's escalated to this. So what we do know is he was involved and supported Ruby with regards to the kids. What don't we know about him is what I'm interested in.
Especially after his reaction to his eldest daughter and not listening to police. If my lived ones had been horrifically abused, there's no way I'd be worried about another of my loved ones coming into my home to retrieve items that belong to the abused. Just would not be my priority at all.

Sorry Emily... you're wrong on the idea that "most of the big operations" for CSAM (Child Sexual Assault Material which is the current proper reference to what your call CP) is done by the federal government. The LIONS share of cases are initiated by State and Local departments, often working in ICAC (Internet Crimes Against Children Task Force which is a Federal partnership). Feds often take over prosecution of the case that was initiated by Local. Just to give credit where it is due. ICACs often but not always receive cyber tips from NCMEC (National Center for Missing and Exploited Children) which is the official clearing house for Cybertips about people transmitting or receiving CSAM. Just offering a little info about the people that have to look at that crap constantly and pursue the inhuman garbage that trade in it.

Jodi being a referral from the Mormon Church would hopefully open a Class Action Suit against Both for the other victims in Jodi’s past.
Just wanted to pop in and say thank you Emily! Love your podcasts and lives. Question could the investigation into Harris led to the investigation into Aldama, since their is such a close proximity to each other?
They would’ve had to be tipped of or know he he was obtaining them. They wouldn’t investigate without probable cause, I would think. Just knowing someone convicted wouldn’t warrant that.

I've been in fandom spaces for more than a decade, I've unfortunately seen a few teens who do not want NSFW content in fandom or public spaces send CSEM pictures/videos to people who are against censorship and also pretend to be 18+ and bait adults to "expose" them as pdos. Completely baffling how they can claim to be against NSFW content about fictional characters but don't even blink twice about using such CSEM data as weapon.
That ‘father’ is just as culpable as his wife. He disgusts me.
The kids need that money in trust for their therapy and college. A trust officer needs to be appointed and the father is not appropriate. He is not trustworthy as he was a part of the abuse! He let it all go down by doing nothing to stop the abuse……

Kevin knew of the abuse happening. If the kids get restitution it should be put in a trust to be given to them at 18. He should have no access to it.

Why do these people get so little time in prison? These things harm children for the rest of their lives. Redrum is a one time thing, these actions are like repeated redrum. Every single one should count as a redrum.... Texas is so PRO LIFE but seem to not care about children once they're born.

Personally I think he deserves nothing, the children should get it all and it should be put in trust for them to help pay medical bills and on going therapy. He did nothing for them (even the ones that ran away before this was discovered) , he should not get a dime.
