The State of Wisconsin v. Taylor Schabusiness murder trial is currently underway. The defendant described how she committed this murder and the actions she took after. Why is this going to trial when the evidence against the defendant is so strong? The defendant has pleaded Not Guilty and Not Guilty because of mental disease or defect (NGI). This means the trial is going to be done in two phases. If the jury finds Shabusiness killed victim, Shad Thirion, the jury will decide if she will receive life in prison or treatment with the opportunity to be released at some point. The facts of this case are wild; the defendant has had 5 competency evaluations and has repeatedly been deemed competent. This case will ultimately be a fight over the NGI phase of the trial.

She is laughing/ smiling during testimony, caught red handed and IMO she absolutely knew what she was doing was wrong. ⚖️
This is an extremely unusual case. Going the extra mile to dismember the life you took is on another level. Most murderers try to hide the body and deny the truth… this is the opposite side of a murderer’s mentality.
Smiling and laughing doesn't mean she knew at the time what she was doing is wrong. From someone who works in mental health, how she behaved in court isn't uncommon if she does suffer from psychotic features.
@Sonicsis she was fangirling Dahmer, she shows psychopathic personality (not a mental illness) and a clear idea of right from wrong.

This morning's evidence is truly horrific & very graphic. She was fangirling Dahmer .The police interview video of her is mind boggling. Sshe actually said at one point she heard a noise upstairs & didn't think she would get away with it. Not insanity in my humble opinion
I've been watching this case on and off this week. It seems pretty cut and dried. She seems lucid enough to know right from wrong at the time of the murder and after. I think her behavior in court is an act. I hope the jury sees through her.

I’ve dealt with nerve pain for a decade & a half. Perhaps this is a contributing factor in your empathy, but the world would be a better place if more people were as kind & nonjudgmental.

I cannot fathom finding my child dead, such less decapitated! My Lord!! It MIGHT be one thing for her to have strangled him while she was high on Meth, but dismembering a body would take a lot of time, AND she tried to get rid of the body parts! That took planning and intention. The attempts to clean, and trying to hide the evidence, IMO, shows she knew what she did was wrong. If she "blacked out" how did she remember where she put the body parts and how she committed the crime? Can't help but wonder if she is trying to use the smiles and laughing during trial as an attempt to appear mentally ill.

Yeah this goes beyond normal behaviors even with the boundaries of drugs and cognitive conditions. I’m honestly terrified to understand the final conclusion the court is able to come to.
Ms Shabusiness has been committed to mental health institutions since her early teens and has had several other commitments prior to this murder, and her treating doctors were unable to provide a conclusive diagnosis. The first prosecution psychologist for competency even expressed that she is unable to definitively determine competency without further extensive testing, including brain imaging. Two forensic psychologists believe there may be schizophrenia (which has onset in mid 20’s) thereby two psychologists wanting further extensive testing. As to her affect in court she is clearly on very strong antipsychotic medication and is not reacting to what is actually being said but what is happening in her own bubble. I can attest to psychiatrists’ incorrectly diagnosing schizophrenia or autism in women as bipolar disorder as the symptoms present very differently in men than in women. This is not to say I excuse what she did or the very sad and tragic loss of life, but I do believe a greater understanding of severe mental illness must be understood instead of simply stating guilt as a simple matter of fact.

I mean that's exactly why there is a two part trial? First they determine if she is guilty as in if she really is the one who commited this crime and if so there is a phase to determine if she was not guilty by 'reason of insanity'. Based on the evaluation of expert testimony.
So I cannot see how anybody would state guilt just as a matter of fact here.
she doesn't seem to exhibit symptoms of schizophrenia at least not when she spoke with the detectives for over an hour. i don't recall she ever mentioned auditory or visual hallucinations. She never said she attacked him because she was under some delusion that he was a threat to her, instead she said she liked it.And her ability to clean up the crime scene afterwards also seems to show that she was rational enough to know what she did was wrong and she wanted to conceal her involvement. I'll wait to hear from the experts in the 2nd phase of the trial, but so far I"m not convinced.
I agree... Imo, I believe she doesn't think what she did was wrong but that she knew others would think what she did was wrong, she also didn't try to hide it all that much... She said she got lazy and forgot all about the head. I'm glad I don't have to make the decision of what to do with her because this is a tough one..

I have been watching this trial. She is a really sick person. It's highly disturbing and she has been smirking and laughing through the whole trial. This portion of the trial should probably end today. The prosecution has no more witnesses to call and I don't think the Defense has any. They are at lunch right now.

I found the dead body of my adult only child after he hanged himself on the back of his bedroom door. I still find it hard to imagine what it would've been like to find the decapitated head of my child in a bucket in the basement. As 311 points out, some people really suck!

I have been watching the trial with Kurt @Uncivil Law. The first two days were so annoying! That was not because of the circumstances of the crime but because all Defense did was try and find fault in the handling of the crime areas. So you have the State questioning the officers and then the Defense asking the same questions again and again and again when the officers had already answered them several times. And yes she smirked several times during questioning of where the body parts were found and what body parts were found. It was horrific. And that was only day one. I will say one thing, the officers were very patient and controlled during the Defense questioning. They kinda looked at him sometimes like what? But they remained stoic. I want to thank you for giving the concise explanation on what they are about and why. Take care of you and don't over do. 💜💜💜

I finished watching “The trials of Gabriel Fernandez “, the mother was tested and tried with her cognitive condition in mind. Because she eventually plead guilty she was sentenced to life in prison. I don’t know what that state plans to do but I feel like Gabriel’s case could be used as an example. (Rip Gabrielito ❤)

Thank you for covering this. I really wanted to understand why they did the trial this way. I especially wondered why they told the jury about the second plea. It seems to me the NGI plea tells the jury "I did it".
The fact that she had part of him in the van she was driving will make this first part of the trial pretty open and shut for all but the SA charge.
I am very interested to see how the jury lands with the SA charges. It seems more like abuse of a corpse legally speaking.

The only scenario where I can see myself taking someone's life is if, God forbid, someone does something to my babies. Even in that scenario I could never come close to doing this to a person. Disturbing doesn't even describe it. And this was her lover? Regardless if she is declared insane there's no way she should be allowed in society ever again.
This case makes me doubt in my position of being against capital punishment. If anyone deserves it, if would be her.

I don't understand this verbiage. Why can't she be guilty BECAUSE of insanity instead of NOT guilty because of insanity? She committed murder. She's guilty of murder no matter her reasons.

The reason its 'not guilty by reason of insanity' is because the 'not guilty' part is what allows the court to get around whatever the statutory minimum for the crime alleged is and sentence the defendant to an alternative option. For instance, in Wisconsin the mandatory minimum for first degree homicide is life in prison (with or without parole). If you are found guilty of first degree homicide, that's what the absolute minimum the court can give is and things like a mental health facility or lifetime commitment to one of those facilities isn't allowed under the law.
Whereas if you are found not guilty by reason of insanity the mandatory sentencing is entirely different.
Is it normal to release the alternates before the whole trial being done? What if something happens where they are short a jure?

I haven't heard of a decapitation case since that Greyhound bus incident in Canada... 2008 killing of Tim McLean. NGI. Guy got fully discharged in 2017.

I’ve not heard of this case until a few days ago and all that’s coming to mind is Jodi Arias. The horrific nature of the decedent’s death is mind numbing. I feel for his parents. The accused has no soul 😧

I agree, Emily makes these trials much easier to watch. But, I've been following it since last year with Jeff of Legal Vices, and he's doing a good job. Bit different vibe, he does more black humor, and there's plenty of EMS, former military etc who also deal with traumatic things that way, so not everyone will vibe with it.

Question ( that you can maybe address during next phase): Right now her lawyer seems to going out of his way to point out that her demeanor was “ normal “ especially before the murder. How does he do that and expect an insanity defense to fly? I suppose he has a reason but I don’t see it, especially as an ordinary person with common sense. Thank you for covering this with sensitivity to the family. I just can’t imagine how you recover from something like this, and of course they won’t ever really. I hope justice is done.
Her lawyer is the worst in the area. He's only in it for the publicity.
Arguing unpredictability? She’s “normal” when not on drugs, so therefore she was temporarily insane on drugs? Who knows. I’ve only watched him cross a couple people so far and find him really hard to listen to.

I'm not buying the mental defect. As someone who is extreme rapid cycle bipolar and borderline schizophrenic. I have also been in and out of psych wards for over 10 years 20 years ago. I have seen a lot. She isn't acting like someone with a mental disease or defect. She is doing what people who are NOT, think they should act when they are faking!
I agree. I have a close friend with CPTSD and bipolar disorder; a sister with hallucinations resulting from complex partial seizures and resultant depression and mood swings; and my mom's cousin has schizophrenia (I've never heard a word from him that was based in reality) as well as knowing people with less severe mental illnesses. At times, Schabusiness reminds me of my sister being in a hallucination conversation, but most times she seems to be following everything and at times can't fight the smile or chuckle at what she did. The interrogation videos from this morning were very lucid.
Hi Emily! You should cover YNW Melly. His case was recently a mistrial but the prosecution is not dropping the case and instead getting a new jury. I used to work with his mom a little over a year ago so everything is a bit shocking for me!
If found guilty & also found incompetent, & let’s say sent to a mental facility, why if she becomes better mentally could she not be sent to prison? Why would she EVER be released?

I didn't know about the voluntarily impaired rule. There really should be exceptions for Ambien and Xanax though, it seems those people take the minimum dose and have no idea about anything.
