Having someone do tests such as a modified Romberg test, to see whether they are under the influence with impaired co-ordination at the side of the road, within the vicinity of a large number of vehicles passing close by including HGV's is utter madness. As failure to pass the test would entail losing ones balance this could result in falling under the wheels of any of the passing HGVs or cars. Not only that but other drivers can become distracted because they are busy watching what is going on rather than the road and thereby causing an accident.
I'm from the UK if someone breaks down on the motorway here for example people are required to move away from their vehicle a safe distance away from the traffic and behind the barrier, separated from the traffic. Not standing on the hard shoulder near traffic. It is utterly imbecilic, any sane person should be anxious with an increased heart rate, they are being put in danger by having them perform such tests near passing traffic.
My resting heart rate is 90-95 bpm, with stress or exertion it can easily reach 160+bpm. No known medical condition, over weight but not excessively so, it has just been that way since I was a child.
Anxiety can cause you have a panic attack.. how can he say that?

Doesn't even require any medical training at all for your statement to be without a shadow of a doubt. This is ridiculous and this is why there is a push for law enforcement reform. I say they need to make the requirements to even review an application more stringent, background checks more extensive, and the physical mental psychological tests more strict. There has to be change and there is recorded evidence all over the internet to prove that.

This is hard to watch. Someone so innocent and genuine being kidnapped and charged for no reason.
I was arrested a few years ago for this same thing. Pulled over for a traffic stop, i have an adderall prescription, and i was arrested for DUI, taken to the hospital to have my blood drawn and then held over night in the jail, my car towed. They released me the next day and i had to take an uber 30 miles back home. A few weeks later i got a letter from the DA saying my charges were dismissed.

#3 never give a field sobriety test voluntarily they will use it against you no matter what.
This exact same thing happened to me back in 2016, however, since I “crossed the white line” the officer determined me being under the influence regardless of a prescription. The court offered a plea deal to lower to a reckless driving, in exchange for 1 year supervised probation, with monthly in person check ins. Part of that plea agreement included me attending an hour of therapy with a licensed psychiatrist. Had to do 4 days of work free. Lost my drivers license for 30 days, and between court fees, tow bill, reinstating license, therapy, & attorney fees the entire deal cost me around $12,000.
Money was tight for me and my job at the time was extremely stressful & demanding which limited my ability to give the case my full undivided attention. I still met with several attorneys and felt them out as well as did a ton of research.
In the end, I was sober, and my blood draw indicated amphetamine but within the levels consistent with my prescription. Regardless of this, my attorney gaslit me and claimed he did an excellent job for me. The system beat me up and I got screwed. My original mistake was answering the question the officer asked me. “Are you prescribed any medication? I was 100% honest and straightforward, but the officer essentially took my statement as an admission guilt of “driving under the influence.”
Wouldn't it be nice if they reimbursed you for the money you had to pay to bond out, hire a lawyer, pay to get your car back, your uber ride, etc etc??
I was a victim of a false arrest not once but TWICE. I was out a combined $20,000-$25,000 from both cases. They simply don't care if it cost you thousands. They just let the courts handle it later.
You're prescribed a stimulant, you're standing inches from speeding traffic, in the dark with a man capable of taking you to jail on a whim... why is your heart rate high? What a crock.

Exactly, and he is incorrectly stating that her 'resting' heart rate should be 'x'- but she isn't 'Resting'. She was standing up, walking around, interacting w/ a cop etc. Resting heart rates vary depending on the age, health and mental state of the individual: 60-100 is average. But again, She Is Not 'at Rest'.

Kind of like when cops continuously ask people- Why are you so nervous? And then repeat the question in some form or another every few minutes. And then they say something like you must be hiding something and try to get you to let them search the car.

Yeah, the sad truth is that once a cop "suspects" alcohol is involved. You're basically fucked. Sobriety tests are completely subjective based on the officer's discretion (You're at their mercy), and if you refuse them Which you're allowed to do, you have to go to the station. At this point, you'll have to submit to a breathalyzer. But as we've seen in other cases. Even a 0.00 doesn't make you safe as they can just suspect other drugs, at which point you will be forced into a blood draw. However, even with nothing in your system, you can still face the consequences as if there had been something in your system.
About a month ago I was actually stopped and passed my field sobriety test and they let me go but the guy saw a couple of bottles of wine in the back of my truck and he had me pull over and leave my truck in a parking lot and get a Uber home which was the coolest thing cop has ever done for me

When charges are dropped. The drivers license should automatically be reinstalled. And fees waived.

Then they’ll bring a mental health worker to give you a false diagnosis and commit psychiatric and medical and insurance fraud. This is All with your tax dollars.I am a Psychologist, by the way. I was not able to obtain the incident report for that date or the cop cam footage. They wiped clean my porch cameras.
in the civilized countries the coppers don't do voodoo test. you blow into a pipe and it shows the approximate alcohol level. then you will do a more precise test. that is all to it.
you do not need to block major arterial roads. and it does not 7 police cars to watch the voodoo.

Indeed. Its so funny the laws refer to "Reasonable people" a lot, yet I keep seeing these vids of cops that are completely insane and controlled by fear. The average normal reasonable citizen does not approach every communication as a conflict, the average normal reasonable citizen doesnt approach people assuming they are going to hurt them. Its not a reasonable stance that everyone wants to hurt you and that your job is the most dangerous when the reality is cops arent even in the top 20 most dangerous jobs. Garbage collectors and Lawnscapers jobs are more deadly. Reasonable people consider facts and evidence and not just assumptions and speculation, just as the law states the police are to use due process and the constitution as their guide. Reasonable people realize you cant effectively enforce laws by breaking them
Lets add a little more perspective. 139 police officers died in the line of duty in 2023. That includes all deaths in the line of duty including illness and natural causes, less than 50 of those were from shootings. BUT the police KILLED 1,232 people in 2023. THEN they want to act like "Why are you nervous? Thats a sign of crime" when actually, its a completely natural response to being approached by a predator
But why does the US still use and give such great credit to these atavistic tests. It seems a travisty of justice to Europeans. And still have to argue to keep driving licence after in station breath test showing zero alcohol? Proof beyond reasonable doubt? How free is TLOTF?

The roadside tests serve the purpose they're intended to. They're designed to be failed, and to give the cop more reasons to detain / arrest / charge their 'suspect.' Following their instructions won't help either. They'll just keep on making the 'suspect' jump through hoops until they get a result they like.
I'm in Europe too, and I'm as appalled as you are with the apparent state of US 'law enforcement.' American cops act more like an armed paramilitary occupation force than anything resembling modern policing in any European nation.

People, and their lawyers, need to start ASKING cops the RIGHT questions during stops like this one AFTER clearly stating several times that they only use their prescribed medication exactly as it is prescribed to be used. Asking the cop what training he had, when he had it, how long it lasted, did he have to take a test and get certified, does he consider himself to be an "expert" and IF SO is he acting as a doctor "diagnosing" that they are drunk or high on some narcotic? CHALLENGING a cop that is at least average intelligence IN THIS WAY THOROUGHLY would get some of them to think about the mess they might be creating for themselves IF the person isn't drunk or high and tests CLEAN at the station after a blood draw. A little studying up on what to ask a cop and what to say ONLY as it pertains to the concept of flipping the situation around on them might just work COUPLED WITH asking for a Supervisor several times. The Supervisor might get there, hear you state what questions you've asked their officer, the answers they've given on camera and your explanation of Rx only medication being on board and nothing else might cause the Supervisor to not want to open up a liability can of worms.

My mother had an anxiety disorder, when she was pulled over by a cop she literally nearly passed out because of her anxiety. Also, this cop doesn't know her medical history, she could have a cardiac issue.
You arrest someone for DWI and their tests come back negative, you should be suspended without pay for three weeks. You do it again, you're suspended for two months. You do it a third time, you're fired. ... A cop is no more qualified than a person on the street to determine someone's sobriety -- I will never believe otherwise.

There should be a law where charges are dropped the person is paid $500.00 for their time in court and the $300.00 is garnished from the arresting officers paycheck.

I was pulled over one time, high as a kite, and the cop's never suspected a thing. I was also pulled over while completely sober, the cops pulled me out and wasted my time for an hour, desperately trying to prove I was impaired.

There are many big tweaks to the various amphetamines, both legal and illegal, that make their power and associated dangers quite different, but Adderall is one of the smaller tweaks. Adderall is a dextroamphetamine mixed with standard amphetamine, and those two are virtually the same. The mix made it brandable as a "new" product. Adderall would be an equally attractive proposition for a recreational user as would street amphetamine, and the effect and addictiveness of the two drugs would be the same. Prescription is important to keep dosage from getting out of control.
