      I’m trying to understand how qualified immunity even applies here! A cop will always claim qualified immunity, they always claim that because it is their “cheat code.”

      I wholey believe the officer is responsible for excessive force, even if the courts disagree, but $20M is a ridiculous amount for this level of violence. That's basically guaranteeing the payer files for bankrptcy because there is no reasonable way for the typical officer or any other citizen to pay in a lifetime. Personally, I believe actual prison time would be a better form of justice. You know, similar to anyone else who batters someone...but you, QA and all that BS.
      Really, try to be reasonable when you call out holding people responsible. Unless she had some undiscussed lasting medical effects from this, $300k actually sounds reasonable to me.

      The courts , and the very idea of qualified immunity, is them basically saying that cops are not smart enough to be held to the same standards as the rest of us.

Once she refused that LAWFUL order, she was actively obstructing. That is when she was being arrested. Is what the officer did right? No. Was she completely innocent? Absolutely not.       @@kevinduprey9326 Naw, any reasonable law STUDENT could argue that she wasn't. It was her birthday, she was with her boyfriend, and they were trying to leave together. It's reasonable to assume that he was her mode of transportation and that he drove her. They detained him while she was a few steps ahead of him and the officer told her to "keep walking" ..... not stay back, hold on, etc. To keep moving forward. IF he was her way back home (remember, this was over 7-8 years ago, not todays insta uber/ride share with ease), one could argue that she would prefer to wait for him.
      Its a big leap to suggest she was interfering (with anything that they were doing) when she didn't even know WHY he was arresting her in the first place. In fact, she was arrested ASAP while the boyfriend wasn't....and HE was the person of interest.

      Keep in mind what happens during jury selection. People who have been formerly charged or convicted in the past are immediately excused. So what you end up with on a jury is people with lily white crime free backgrounds. The travesty in the judicial system begins with the jury selection.

How many times have officers warned of using a taser to get compliance? Why is this any different. The only reason why this is such a big deal is because she is a pretty woman. If it were a man the case would never exist. Girls can create this situation just as easily by non compliance. Work out the issue in a court afterwards and not at the time of the action.

      I'll never forget when I was in Jr High late 1970's. A Washington State Patrol was driving by and turned into the turning lane which had a red light. He put on his siren and lights and went thru the light, turned them off and drove into the local burger king drive-thru. I'll never forget that.

Nobody gave a care when mestizos in the barrio, blacks in the hood, or trailer park trash lived under the reality of pseudo military occupation, with smirking goons looking for any reason to inflict violence on you. You had to learn to keep your eyes to ground and say yes sir, no sir, particularly if you were older than 13.
      Even little kids like me, weren't spared, albeit without the violence. Police used to routinely lecture and harass my friends and I, for things we didn't and wouldn't have done. A true precrime existence of presumed guilt and harassment. Like i've said probably a million times. It's a hell of thing to not even be able to ride your bike down to the only corner store available to you, to buy a bag of chips and a coke and know there is a good chance the cop is going to be there waiting to give you a lecture about how you don't want to go down the wrong path and pretending like they are giving you good fatherly advice and doing you a favor! Leave me alone you creepy @$$hole, you aren't my dad! but you can't even say it.
      Part of me desperately wants to savor a little bit of schadenfreude from witnessing the middle classes start to get their just deserts, but I hate tyranny and injustice more than I love a good comeuppance.

    I'm from Italy. We have a lot of issues with policing in our country but if this had happened here, in such a public way, the officer would have been charged within a week. Just like in any other civilized country on earth.
    America, you're almost 250 years old, you're not a teenager anymore. Maybe it's time to grow up.

    Defending an officer for 7 years after his totally unecessary brutal assault on Miss Sarat is a public relations disaster. When officers get called to late night incidents at Bars they should expect that the people involved will have been consuming alcohol and some of them may be difficult to deal with.
    Slamming a young woman half your size and weight face first onto the concrete sidewalk for attempting to push the officers hand off her arm is not the reasonable action of a law enforcement officer.
    This officer should have been disciplined by his department and the case itself should have been cleared up within 12 months.The damage done to the Police/Public relationship by dragging this out over 7 years of litigation and in effect retaining an officer this violent within the force is not the level of service to the public that should be acceptable.
    How many other offences has this officer committed against the people, both before and after this incident with Miss Sarat, because of his violent nature?

Here this cop wants her to (dressed as she is) continue into the dark night by herself without the protection of her man. When she shows displeasure the girl is slammed to the pavement!     I noticed the victim asked the officer REPEATEDLY what she did and never received an answer then out of no where he attacked her and threw her to the ground. That's assault! Anyone else would be going to jail!!!

      The cop told her "you can go", which is legalese for "you are doing nothing illegal and I have no authority over you", and she approached the two police detaining her boyfriend.
      He didn't like that, put his hands on her, she didn't like that and tried to take his hands off of her.
      He then arrested her for NOT leaving, when she had no duty to, and slammed her on the ground.
      I try to be a LITTLE fair but I don't think any of you understand what a LAWFUL order is or when a cop has LEGAL authority over a person.
      I think calling people boot lickers is a bit extreme, but it's the need to fill in gaps for Police like this that makes me scratch my head.
      "oh but he was being detained, she interfered or was attempting."
      Okay well during the video I see none of that, so it's irrelevant to the facts.
      Nothing she did at the time he body slammed her was justified, provoked, and most importantly ILLEGAL.
      I dare say even if it was it didn't warrant the force used, which is everyone's NEXT favorite excuse.

    To the cop: There is something seriously wrong with you. You need a thorough psychological examination to try to figure this out. You're behavior is a danger to civil society, no different than any guy you would arrest for physically attacking a much smaller, defenseless girl. You are yet another one who is clearly unsuitable for the job.
    A real man protects a girl from harm and could never do anything like what you did.. and you did it so easily too. You have a very short fuse which is extremely dangerous and downright reckless in police work. Don't make excuses for your violent behavior, be a real man and own it. Put your ego aside, swallow your pride and apologize to that young woman you hurt. These are the things in life that can help make you a better man.
