Why does Qualify Immunity cover for officers that are ignorant of the Law? 🤔😡
It's crazy how almost everything that cops do to people needs to be blurred out or cut from the videos on UA-cam. Ban the blue line gangs and abolish qualified immunity
$300,000 seems pretty low considering that she's been in litigation for 7 years.
She was a bit of an idiot. I guess that was considered.
100k at a minimum... Fair settlement. Immunity my azz!
7 years fighting for it is unforgivable
"I don't want to throw you on the ground"... is an oddly specific threat for not obeying him like a dog. The cop should go to prison for that level of violence.
Which was obviously a lie because it was his first go to .. how on earth do they sleep at night?
@@Autodidactic153 cops are psychopaths
when they say that, that is exactly what they are going to do. by the way he was talking, he was excited about throwing somebody to the ground to assert dominance. what a tyrant.

$300,000 hardly pays for 7 years of legal fees.
I'm sure it was a contingent case. i.e. the lawyers get 1/3 of a settlement.
@drummerman4444
Most law firms don't bet the farm defending a white person's civil rights.
How much "physical force" could a 22 year old, 115 pound woman (under the influence of alcohol) inflict on a 6-foot, 200 pound muscular man? She POSED NO THREAT!! This is a DISGRACEFUL waste of taxpayer money and trauma on the tax-paying public.
The cop looked like an out of shape, heavy, beer bellied thug that had a chip on his shoulder 17:10
"I'm afraid for my own safety"...is something these chicken-shit cops will always quote in their justification for any excessive force used. Anything from a small kid to an old grandma will make them fear for their own safety. I bet these bullies even shit in their pants when they see their own shadow at night.
The cop is still working and good to go. Probably causes law suites all the time because he can't control his temper.
There is something seriously wrong with American Law Enforcement.
Agreed, many, many somethings are wrong with American cops.
Quite obviously. There are less good cops than ones like him
IDF trains them
It's always been like this but it's just out there because we have cameras and technology and you know they like it like this because it keeps us busy from minding what they're doing on the top.
When I heard him repeat "Don't fake me throw you to the ground" I thought, what's wrong with this guy??
Zero qualified immunity. Absolutely excessive force. She wasn't even suspected of a crime. He seized her unconstitutionaly
Exactly, i dont think he even announced he was arresting her. How can you resist an arrest if your not told that. Im not sure why its not a legal requirement for cops to state when your under arrest and WHY.
I’m trying to understand how qualified immunity even applies here! A cop will always claim qualified immunity, they always claim that because it is their “cheat code.”
They get a free ride on everything, being a cop must be cool. You never have to answer for not knowing how to do your job.
She committed obstruction and resisting. That is not in question. The cop had the right to arrest her. He didn't have the right to EXCESSIVE force.

This cop should be in prison and she should be paid $20 million dollars for the crime this police officer committed.
Yea, and you can pay for it. If that was the amount to be paid, the police would be bankrupt or your taxes would be through the roof. Or, the cops would just stop showing up when they are called. She is drunk and there are a lot of drunk people there. She should NOT have won the case.
Always the bootlick shows up right on time
lol...ok...get it from Gavin newsom
I wholey believe the officer is responsible for excessive force, even if the courts disagree, but $20M is a ridiculous amount for this level of violence. That's basically guaranteeing the payer files for bankrptcy because there is no reasonable way for the typical officer or any other citizen to pay in a lifetime. Personally, I believe actual prison time would be a better form of justice. You know, similar to anyone else who batters someone...but you, QA and all that BS.
Really, try to be reasonable when you call out holding people responsible. Unless she had some undiscussed lasting medical effects from this, $300k actually sounds reasonable to me.
That sob needs to go to prison
She deserves to get paid from the cop, not the public.
AND the whole departments PENSION FUNDS, Including ALL OF MANAGEMENTS PENSIONS, Other cops will fix this problem.
Unfortunately the move he used waa standard police training. Probably pretty useful on a 200 lb man, but they didn't train him well enough on what to do differently with a waif.

Why are cops so insistent in NOT telling people what they are arresting them for??? This ALWAYS escalates any incident!!
A bad cop can really mess up someone's life and future. Did this affect this girl's job, life, school, family, mental and physical health, financially, etc? Cops do mot have the right to put their hands on anyone! I'm glad this young lady reached out for legal assistance.
Why are cops allowed to assault people with the slightest provocation?
" OFFICER SAFETY!!!!"
The courts , and the very idea of qualified immunity, is them basically saying that cops are not smart enough to be held to the same standards as the rest of us.
We are all expected to understand what is, and what isn't, to much force to accomplish a legal goal, but they are not, unless it is made super, ultra, extra clear.
Because there's nothing more important than the safety of police officers.
Because everyone allows it.

What gives this tyrant the right to assault the public, and no he should get jail time shameful
This woman found guilty, what is up with American citizens
I completely disagree with the point of her commiting a crime at all. She was being unlawfully detained and every American has the right to defend themselves against a cop acting outside his delegated authority. That jury was wrong
Exactly, she wasn't under arrest or detained. She had every right to take the armed strangers hand off her
I agree, I didn't see her initial offense. I did see the cop lose his self control. I would've like to see the $300K come from this cop's personal liability insurance in his name.
Exactly, the officer assaulted her by grabbing her harms and pulling her. She then defends herself against him. He then uses her self defense as grounds to arrest her. Then uses excessive force and claims that he is immune from her 4th amendment rights. You can't make this bat shit crazy stuff up. The government can not have immunity from the constitution in any shape or form. The constitution is a LIMIT on government. How can a government give it self immunity on the limits placed upon it by the people?
@@strawberrylotlizard She wasn't arrested or detained. Her boyfriend was being detained, she turned around, but the officer told her to keep walking away as it did NOT involve her. That officer was totally clueless. The only thing he did was grabing and threatening. Absolutely the worst things he could have done towards someone agitated.
Woman in high heels could have been controlled with wristlock. She technically was attempting to interfere. You gotta walk away. But definitely didn't need to be slammed.
@@kevinduprey9326 Naw, any reasonable law STUDENT could argue that she wasn't. It was her birthday, she was with her boyfriend, and they were trying to leave together. It's reasonable to assume that he was her mode of transportation and that he drove her. They detained him while she was a few steps ahead of him and the officer told her to "keep walking" ..... not stay back, hold on, etc. To keep moving forward. IF he was her way back home (remember, this was over 7-8 years ago, not todays insta uber/ride share with ease), one could argue that she would prefer to wait for him.
Its a big leap to suggest she was interfering (with anything that they were doing) when she didn't even know WHY he was arresting her in the first place. In fact, she was arrested ASAP while the boyfriend wasn't....and HE was the person of interest.

Keep in mind what happens during jury selection. People who have been formerly charged or convicted in the past are immediately excused. So what you end up with on a jury is people with lily white crime free backgrounds. The travesty in the judicial system begins with the jury selection.

If it were a man the case would never exist. Girls can create this situation just as easily by non compliance. Work out the issue in a court afterwards and not at the time of the action.

You didn’t get the memo. The corrupt crooked system of DA, judges, police chief, and politicians receive campaign money, endorsements , and election engineering from the police labor unions, police fraternity, and criminal Justice industry. In reciprocity the corrupt crooked government officials give the cop criminals a ‘get-out-of -jail card’ as a token of appreciation.
Police shouldn't have qualified immunity. They get a free pass for everything from littering to murder.
I'll never forget when I was in Jr High late 1970's. A Washington State Patrol was driving by and turned into the turning lane which had a red light. He put on his siren and lights and went thru the light, turned them off and drove into the local burger king drive-thru. I'll never forget that.
Cities should not enter into collective bargaining agreements with police unions either. The idea of a union for the government function that has the monopoly on use of deadly force on the citizens is just insane. These aren't sanitation workers and administrative clerks.
I don't think you're freed them from immunity from someone like Jim Bronson because they're awesome people like that today that will get revenge and take the law in their own hands

Yeah I mean I get it but it’s unreasonable to expect someone to just take a beating I know a guy with 20+ years because a cop was beating his ass and he tried to grab something turned out he grabbed the cops gun didn’t take it or anything but just grabbing the gun got him 20+ years

I'm from Italy. We have a lot of issues with policing in our country but if this had happened here, in such a public way, the officer would have been charged within a week. Just like in any other civilized country on earth.
America, you're almost 250 years old, you're not a teenager anymore. Maybe it's time to grow up.

England is the same, may take maybe 2years but the cop would have been found guilty of unlawfully attacking her. It was plain to see for gods sake. And England has a horrible justice system that protects bad cops but you can see everything he does and everything he does is wrong.

@@FloridaCatholicGuy She could have been calmly told where to stand and to wait until the cops finished talking to the boyfriend. That whole 0 to 100 mph escalation by some big-a$$ bully cop was completely uncalled for. He deserved an off-duty visit from her relatives.
In this case, It would be legal to defend that person and subdue the officer.
The cop didn't even try to cuff her while standing. The slam to the ground was totally unnecessary.
Defending an officer for 7 years after his totally unecessary brutal assault on Miss Sarat is a public relations disaster. When officers get called to late night incidents at Bars they should expect that the people involved will have been consuming alcohol and some of them may be difficult to deal with.
Slamming a young woman half your size and weight face first onto the concrete sidewalk for attempting to push the officers hand off her arm is not the reasonable action of a law enforcement officer.
This officer should have been disciplined by his department and the case itself should have been cleared up within 12 months. The damage done to the Police/Public relationship by dragging this out over 7 years of litigation and in effect retaining an officer this violent within the force is not the level of service to the public that should be acceptable.
How many other offences has this officer committed against the people, both before and after this incident with Miss Sarat, because of his violent nature?
It was his poor excuse to touch her for his own kicks. Remember they only join these gangs to commit the crime's
I concur with You David...100%!

It's been engraved into my consciousness to never raise my hand to a female. That we as men protect them. Here this cop wants her to (dressed as she is) continue into the dark night by herself without the protection of her man. When she shows displeasure the girl is slammed to the pavement! This is sick and goes against everything I've been taught my entire life.
Cop got his feelings hurt because the girl didn't say excuse me when walking through. He retaliated.
I think his wife said "No" to him.
I noticed the victim asked the officer REPEATEDLY what she did and never received an answer then out of no where he attacked her and threw her to the ground. That's assault! Anyone else would be going to jail!!!

@@bluntman3180Dude she turned around as her boyfriend was being detained.
The cop told her "you can go", which is legalese for "you are doing nothing illegal and I have no authority over you", and she approached the two police detaining her boyfriend.
He didn't like that, put his hands on her, she didn't like that and tried to take his hands off of her.
He then arrested her for NOT leaving, when she had no duty to, and slammed her on the ground.
I try to be a LITTLE fair but I don't think any of you understand what a LAWFUL order is or when a cop has LEGAL authority over a person.
I think calling people boot lickers is a bit extreme, but it's the need to fill in gaps for Police like this that makes me scratch my head.
"oh but he was being detained, she interfered or was attempting."
Okay well during the video I see none of that, so it's irrelevant to the facts.
Nothing she did at the time he body slammed her was justified, provoked, and most importantly ILLEGAL.
I dare say even if it was it didn't warrant the force used, which is everyone's NEXT favorite excuse.
If that was my daughter.. oh no.
To the cop: There is something seriously wrong with you. You need a thorough psychological examination to try to figure this out. You're behavior is a danger to civil society, no different than any guy you would arrest for physically attacking a much smaller, defenseless girl. You are yet another one who is clearly unsuitable for the job.
A real man protects a girl from harm and could never do anything like what you did.. and you did it so easily too. You have a very short fuse which is extremely dangerous and downright reckless in police work. Don't make excuses for your violent behavior, be a real man and own it. Put your ego aside, swallow your pride and apologize to that young woman you hurt. These are the things in life that can help make you a better man.
