      This is common sense stuff...You can literally know everything you need and what you don't need to say studying for 15 minutes... A lot of people say "I don't answer questions, you NEED to say per the 5th amendment I will not be speaking with you anymore and invoke the right to remain silent. Supreme Court case law on that as well

      You’re too easily impressed. He didn’t have a firm grasp on the case he was citing. _Florida v. JL,_ Supreme Court 2000, doesn’t stand for the proposition that an anonymous tip can never provide the “reasonable articulable suspicion that criminal activity may be afoot”.
      {The question presented in this case is whether an anonymous tip that a person is carrying a gun is, without more, sufficient to justify a police officer's stop and frisk of that person. We hold that it is not.}
      _-Florida v. JL,_ 529 US 266 - Supreme Court 2000
      In _JL_ the Supreme Court never said that anonymous tips can never provide officers with RAS.
      It is well settled that, under certain circumstances, an anonymous tip, by itself, can provide an officer with reasonable articulable suspicion to perform a _Terry_ stop. See _Navarette v. California,_ 572 US 393 - Supreme Court 2014.
      {After a 911 caller reported that a vehicle had run her off the road, a police officer located the vehicle she identified during the call and executed a traffic stop. We hold that the stop complied with the Fourth Amendment because, under the totality of the circumstances, the officer had reasonable suspicion that the driver was intoxicated.}
      _-Navarette v. California,_ 572 US 393 - Supreme Court 2014
      In _Navarette_ the Supreme Court assumed that the 911 call was anonymous. The police officer who stopped Navarette never personally witnessed anything that would inform him that the driver was intoxicated. The RAS that justified the traffic stop was based entirely upon the information from the phone call.
      The “law student” said that a stop can only be based on facts known to the officer. This is true…except that information given to the officer by others can contribute to RAS to perform a _Terry_ or traffic stop. They don’t necessarily have to witness the suspicious conduct themselves.

      Funny, when a citizen makes a mistake by depriving another citizen of their rights, they go to jail an/or pay a fine.
      The remedy is there for citizens, follow the trail and apply it to the cops.

      @@valdz90 If the cops in general were not so sneaky we would identify no problem under the sun, but knowing theta they play gotcha to make the numbers, especially with law abiding citizens, usually over an ego trip, and most of the time while real crimes are being committed, and while the real gangsters a roaming freemost of the time showering them to do so, you need to understand a certain level of distrust on behalf of the public in general, especially after how you all behaved during the lock-downs. He more than likely will file a lawsuit, if nothing but for practice.....!! He would definitely receive a few thousand if not a little more, because of the fact that he did actually get arrested and go to jail, plus he lost out on his locksmith and had his vehicle impounded which cost money, so he did lose out on some money and had his freedom taken away from him...!! Usually the only time someone doesn't receive any money is if they weren't hurt or lost any money but anytime someone loses money plus their freedom is when they normally win the lawsuit.....!!

    I hope a lawsuit is in the works. It takes 2 years to become a cosmetologist to work at a beauty salon. It takes four years to become a tradesman like a plumber or an electrician. It takes 8 years to become a lawyer. 6 months and any moron can become a law enforcement employee. The blue line of ignorance and douchebaggery earning the hate every day.

      Here in the UK a Police officer leaving University with a Degree takes 2 years to train as an officer ,, some one without a degree takes 3 years.
      6 weeks is ridiculous to take in all the actions an officer can and cannot do in line with the law.
      I mean these guys are on the streets and armed with very little training , I understand their job is hard ,, its dangerous but its doubly so for them and the public when they dont have the right amount of training.

      Funny thing, I emailed a formal complaint to a police department about an officer I witnessed with a suspect in a way I will say as "conduct unbecomming of an officer" to an administrative contact at the police department. My complaint took months but was reviewed and substained. I prefer email, it leaves a digital trail and the person I sent it to sure as hell doesn't want it sitting in their email inbox so forward it went just as I planned 😂.

      To my knowledge it's a tactic police use to try and make you seem like a liar. If the officer has to be the one to write the complaint he can purposely write something else and then can use the lie "this is what the complainant told me" and if there isn't any video to back it up it becomes your word vs. Officer's word

      The issue with suing is finding an attorney who will take the case. I don’t see much money here. How was this law student harmed? Did he lose a job or a house or his eyesight? Here in Philadelphia I know of a similar case that was settled out of court for $20k but only because the attorney was the litigant’s father. I don’t think any other attorney would touch it.

      Retaliation! From the first time they could not arrest him.
      So they thought they had something on him to make his lawsuit go away from the first case. They have to get an arrest and him take a plea deal and the first civil lawsuit they have on him will be dropped.
      Now they bought a second civil lawsuit. His law professor is representing him in the first case.
      The police chief needs to tell all officers to avoid this guy like the pledge.
      No one does anything to this guy without written permission from the deputy chief or the chief.

      Because they were holding him while they did what is usually a quick and easy info lookup. However it became a serious investigation that made them release him so he ended up being in cuffs longer than someone normally would be.

But only 83.5 hours of that is focused on learning the law--so yes, a law student who has taken or is taking a single law school class on criminal law has far, far more training. But as a friend who is a former cop says "the real problem isn't that police don't get enough training, it's that they hire dummies" (I'm paraphrasing that word "dummies"--he was more direct and less politically correct.)

      He was questioned outside of his dorm room for the alcohol in New Mexico. This arrest at a junkyard happened in El Paso, Texas. So they don't know who he is (maybe they do), Just wanted to point that out if you weren't aware.

      Cooperated with the illegal arrest, posed no threat, locked in a cell. It was punishment/torture, and that's how it will be interpreted when it goes to court. Absolutely no reason for him to still be cuffed there. The supervisor knew that, he probably just wishes he got there sooner. It looks bad, and it's going to be an easy case.

Especially if they get caught in the moment or challenged. I challenged about 10 officers that surrounded me and wanted to search my property cuz THEY believed they could since the statute said they could. I clarified what a search was, clarified what an inspection was. Asked em can you stop a driver to inspect his DL just to see IF his license is valid. No of course not it's a 4th violation. So you have no actual violation to stop me for correct,, you can't determine by observation if there's a violation correct. The only way is for you to seize me and search my property, correct...Right so why would it not be an unlawful search for you to stop me search and inspect my property to see IF my property has a violation??? Crickets....well the statute says...(it did but we all know it's unconstitutional) They did end up arresting. Yet prosecutors declined ALL 3 charges...1 was even the catch all obstruction. I got them to admit EVERYTHING which is they had nothing to base it all on.
      1 important factor is there has to be factual observations or facts NOT a hunch or gut feeling of criminal activity etc

      It's why I'd like to see people using the word "decline" (or to go super wordy "I'm electing not to satisfy that voluntary request"). You can only refuse something that is mandatory, especially in a legal sense.

    I still don't understand how the police can arrest the citizen on an anonymous call and no evidence and no property owner swearing out a complaint for trespassing and the police not saying any crime committed??

      He has to. Department policy requires they get the ID. Cops conflate policy with laws and hold the belief that what they are doing is lawful. A cop can lose his job if he fails to follow policies but qualified immunity protects him if he fails to follow the constitution.

      So many officers have that "rules are for you and not for me" mentality. I wouldn't be surprised if they started "receiving more anonymous calls" because retaliation is not a problem if the officer can come up with any excuse for it. (They can even admit it's retaliatory so long as they have some excuse It's good enough for courts)

    All citizens need to read a book on their rights. If you are a criminal, and committed a crime, that's different, but many people are accused with zero evidence. I want to know my rights, and we all need to know our rights.

The cop who feigned respect in the beginning, didn't show the same respect, even while admitting he'd violated the guy's rights. Maybe you lack empathy, or maybe you reflexively yield to authority, but yours is an extreme opinion, given the facts.
