      Yes but the confession gave him planning it. The death penalty. Without it they can’t prove he planned it, he will say he snapped life without parole best case scenario now. Cops screwed up royally.

      Doesn't make stamping on someone's rights acceptable though. Regardless of how we all feel about him. Ev1 in the world is entitled to rights or would be a complete mess of cops doing anything they want and criminals would all say forced confession

      ​@@martiferguson7087In this case, they didn't "stomp on his rights" as much as not read the rights exactly right. The suppressed confessions don't matter in this case. Just seeing the bodycam of arriving & Chad's response will convict him. This small town was traumatized. He wasn't beaten or forced to confess after being interrogated all night~ those happen all the time & are examples of rights stomped all over. This doesn't affect the case.

      Yes, there are witnesses, and also: He just sat there afterwards, calmly waiting for the police to come and arrest him. That's as close to a non-verbal confession as it gets, and that body cam evidence can be used in court. The cop screwed up, but I can't imagine that it will make much of a difference in the end.

    Do not believe this will change the outcome. We all saw the bodycam. We all heard him talking and the cops tell him he should be silent even while they were trying to render aid.

      It won’t, i think you’re forgetting his own words aside, the mom/step daughter were there. The step daughter ran to get help and the mom was holding on of the boys trying to get him away

    I would hope with two main witnesses, his wife & daughter (or stepdaughter), that not allowing his confession into trial wouldn’t matter as much.

      Yeah, I watched the body cam and honestly I was impressed by their ability to not lose it on him. When they put him in the car and he was babbling about nonsense one officer said, “you have the right to remain silent I suggest you use it.”

      Yeah I woudlnt be surprise if those officers didnt have PTSD in some format. I think Doemans attroney was desperate and grasping at straws. I think the case is strong without it but its something prosectors would LOVE to have.

      ​@MelindaMc no, they have him on bodycam immediately admitting what happened & he WAS read rights. There is so much evidence in this case, throwing out his statements doesn't matter. His step daughter saw, his wife saw & was shot. This isn't going to change anything. He's going down hard.

    When Miranda rights are printed on a card, and all an officer has to do is read them, there's really no excuse. It's a high pressure job and they should be trained to manage that pressure and emotion to maintain this practice.

      Exactly that's why the cops should have been more careful. One mistake to many and a criminal could walk away free. OK in this case they have other evidence but what if they didn't and what if they violated an innocent person's rights

      I think the first responding police officers must have been really traumatised. No one goes into the police imagining they might need to deal with this type of particularly outrageous and horrendous crime. They are human beings too.

      This crime was awful... I could not be a police officer or an attorney. When this crime happened, I was praying for everyone on the scene. (I have many friends in Law Enforcement and they regularly request prayers for traumatic crime scenes, for victims, and for the EMS services). It has become my new normal.

      He has a right to defense. He also has a fifth amendment right not to incriminate himself. You don’t have to like it, but that is his right. Also, he is STILL innocent until proven guilty in a court of law. Kangaroo courts don’t count.

      @blueskies this isn’t the perfect case of corruption….this is merely the perfect case of things done improperly. The guy is guilty as sin - we saw the body cam, and we have 2 living victims who saw it happen.

    The officer, Detective Michael Ross, took the stand and even testified: " I'm not a robot. I probably should have read the entire card, but I'm not a robot." So absolutely, the defendant was not properly and fully informed of his rights.

    He was blabbing away at the scene. Remember the LEO told him that he should keep quiet. Is he really going to put everyone through that? We have all seen the videos from body cam. Those cops were trying to render aid to his children while he was blabbing.

      @@melistasyno no- he would never. Anthony Todt did the exact same thing then took back his confession and went to trial because he’s also a narcissist. They rarely concede. Chris watts is a rare exception! And I think that’s because he couldn’t handle the shame of going to trial (the same reason narcissist Adam Montgomery didn’t even show up)

    I watched the interrogation in full. I wondered why the officer kept asking questions after Doerman said he wanted to talk to a lawyer. Since I'm not an attorney, I figured that I missed something about Doerman's statement that allowed the officer to continue.

    I totally agree with you, I know the Miranda warning has to be read and I’m from the uk, how could a detective not realise the importance of reading it. It’s bad that his confession can’t be used, but as you say this is about all your rights, not just his.

    I agree with you Peter I’m just SO irritated that the police did some sloppy work here. I understand their emotions were likely running high, I mean, I never ever ever want to see 3 dead babies who were shot by their father. But they did choose their profession and must, then, remain professional during these moments of high stress. Also, they don’t like the guy. Fair. But their oversight could have cost the prosecutor the trial. Thankfully there is such a wealth of other info, but they ought to remember that screw up’s could land very dangerous people to walk among good citizens. I hope this is lesson learned.

    I hate that they didn’t do their job properly, and let their emotions run so hot. Now he has confessed but because someone didn’t read the rights properly , the court has to throw it out. And they should in my opinion. I absolutely agree with your Peter about this.

      Absolutely, he was trying to justify himself and make excuses. That's a crooked cop.
      He says that Doerman "asked to speak to Lara" which is a total fabrication, obviously he had "asked to speak to a lawyer". Dude is shameless and incompetent, I hope he is disciplined and dismissed. LE departments of integrity cannot have officers like that on staff.

    Peter, this was so helpful. I was like, didn't they read them at the scene, but you reminded me it was just a pissed off (reasonably so) cop telling him to shut up. But confession of a crime seems like that negates any "rights" someone has. But there is way too much evidence against him to worry about that confession.       Sad part is, if he gets a trial, the poor mother of the boys, and their sister have to live through this nightmare, which he is responsible of ruining their lives. They have to live with the vision of that day for the rest of their lives, and I am willing to bet that they never want to see his face again!! This is a coward, who wants andbhas options, but the boys were not given an option by him now, did he!

      They certainly wouldn’t be telling the jury a confession was thrown out, presumably they’ll try and find jurors with minimal knowledge of the case - not everyone is following the proceedings past the initial headlines. Whether some may still know or learn of the motion to suppress in some form, like with any trial they’ll be instructed to only consider the facts presented to them, and anyone who says they’ll be biases against him based on such knowledge would be struck for cause.. does it ultimately have the same impact as if a confession was never made? likely not, no, but that becomes a “bias problem” akin to the arguments we sometimes hear that a defendant can’t possibly get a fair trial because of the notoriety of a case - that’s been argued time and again and ultimately the answer to those arguments is that if near everybody knows about something, then that’s just what it is, and defendant doesn’t get off free because their alleged crimes get nation wide attention, so imperfect though it may be, nobody is moving a trial to North Korea just to get a jury pool that knows nothing of the case. Same here, if indeed it’s impossible to find people that have no clue of the suppressed evidence’s existence, well that’s just how it is and they’ll do it as fair as they can manage.
      Ultimately he sure as hell ain’t getting off so it’s not that consequential, I’d think the main reason his defense team perused it, besides they’re lawyers and that’s what they do, is that he may have a better shot at avoiding a death sentence without a confession on record.

      The same way ti find unbiased jury’s in any trial- look for ppl not following the case. If it’s not allowed in court they won’t know about it. No jury will know he confessed.

    100% agree with peter. Next time This happens.... It could be you and you did not commit the crime... "give an inch,take a mile”. It’s not for the police to decide what rights people should have when they feel like it. What happens when they are just mistaken?

    Just to follow up…it is imperative that all law enforcement officials do their due diligence to read the entire miranda rights every time! It should be mandatory for them to read rights verbatim to every person they arrest and or choose to question.

      I agree!! He is a coward, and nowcwants to use taxpayers money, to try and convince everyone that he is crazy, he didn't mean it. He wants to live, but he didn't give three beautiful boys the option!! He also ruined the life of the boys sister, and their mother!! He is diffently a POS!!

    I'm not surprised by this decision by the judge. About the time that this motion was filed it was being reported locally that Doerman had requested a lawyer and that the detective continued with his questioning.

    I'm so glad this body cam was released to the public.. They live in a small town, good luck finding anyone in that jurisdiction that hasn't saw it. When will our justice system be a justice system for the victims? This decision definitely hurt but the judge had to follow the law.

    My heart goes out to this family. I have friends who went to school with Chad and the mother. I live in Hamilton county and about 45 minutes to hour away from where this happened in Clermont County. 😢
