The Supreme Court does not give the reasoning for denyng?! What kind of judicial system is this? In my country, if the judges do not give reasons for their decisions, whatever the instance, you can be sure that their decisions will be annulled, fortunately, because we all know how "don't ask why, just obey!" regime is called... "They do it all the time", well, if you're happy with that I am happy too, as long as I'm not the one sitting in the defendant's chair.
Our system is so corrupt.. its a puzzle.

If he is found guilty, there's an automatic appeal, in which these issues will surface again and at that time, appellate court decisions will be explained by the appellate court, so there's no reason to cry foul just yet. Granted, a guy is sitting in jail, but that's because the state believes he committed horrendous crimes, so that's just how the justice system works. If he's guilty, nobody wants him out in the wild. Having said that, I have serious doubts about the PCA and the state's overall case against Kohberger. The trial is not only inevitable (unless shocks and booms suddenly arise, changing everything), but I think it is necessary for us all, most importantly a jury, to weigh the evidence and decide one way or another on facts and only facts.
This case is just crazy.... Drives me crazy. Appreciate your explanation on docs!

@@ceha9517 well if LE would have processed the scene correctly and did their job right it could have been a slam dunk. But all the poor effort may get a hung jury. So many mistakes have been made. It's a shit show. Innocent until proven guilty.

Thank you… I wouldn’t want the courts to swiftly look over things if this were my family in BK’s position. I would hope that they’d be thorough and take their time deciding these important factors/issues that would affect my life or my family members’ lives. I don’t like how lightening fast this decision was made 🤷♀️

It seems evident that if there were any major serious issues (the prosecution had nothing on BK, the charges could not stand at law and were vexatious, etc, and there was prosecutorial misconduct, etc) his defence team would be doing something about it. Eg. Filing a motion to dismiss the charges upon those grounds. As has just occurred in the Karen Read case. So we know for sure such a motion could be filed in those circumstances, in the event any major issues in fact existed and were serious enough to put before the trial judge, for hearing and determination.
It’s a “watch Peter all afternoon” kind of day, lol

How does the Defendants Motion to Augment the Record come into play here?
They may want to slow it down enough to avoid the typing errors they have in this Order- According to this Order, they failed to Seal the State’s Objection..
The Clerk has confirmed the Objection is in fact sealed and it was a Scriminars error and will remain as it is unless one of the parties make a request

Because there is a gag order. Just about everything will be temporarily up until trial. The gag order is in place for Bryan’s sake, to ensure that he gets a fair trial.
@Cycle-Breaker the gag order is ridiculous, it's not helping him get a fair trial, it's just aiding speculation which then leads to a tainted jury pool, imo
@@johannawigg6921I think this particular issue involves the grand jury and DNA which are both sealed from the public. The grand jury is secret by nature and the DNA is private health info (I might be wrong about whether the appeal involved DNA but it was the subject of a motion in this case). So that’s why it’s sealed.
@@johannawigg6921It was BK’s team that sought the gag order at the outset of the proceedings. It goes for him not against him (including imagine if the 51 terabytes of evidence against him given to the defence came out now)!

Why is it not considered conflict of interest if the prosecutor, judge, and college head are all tied to the college and same frat around the same or over lapping years with a personal history together. How is that fair to the defense?

Hoping you will do an update soon on the delphi filings ! They're talking about a trial as early as MAY ! And there's still discovery filing issues going on between the parties and something about the defense filing an ex parte motion that somehow the prosecutor was made aware of and wasn't supposed to be ? I'm trying to follow it myself , but have a lot of questions and would love your input

this whole case will eventually fall flat on its face. There are so many issues with it, and no one is taking it serious.😩.
Because the defense is throwing everything at the wall before trial? If he is so Innocent, why waste years of your life on frivolous motions instead of proving his case at trial? He may yet be found not guilty, but I won’t base my opinion on all these pre trial motions that do little more than delay the trial. Most of this is for post trial appeal.

Why does the defense not understand the clearly written law from the Idaho Supreme Court about Grand Jury indictments being based on probable cause, not beyond a reasonable doubt. It gives the impression that the defense doesn't really understand the state laws, and seem like they are really grasping at straws at every step along the way in this case. Here's the exact text off the Idaho Supreme Court's website.
Idaho Criminal Rule 6.5. Indictment
(a) Sufficiency of Evidence to Warrant Indictment. If the grand jury finds, after evidence
has been presented to it, that an offense has been committed and that there is probable cause to believe that the accused committed it, the jury ought to find an indictment. Probable cause exists when the grand jury has before it evidence that would lead a reasonable person to believe an offense has been committed and that the accused party has probably committed the offense.

I think Anne Taylor is simply covering all bases for her client, nothing wrong with that. What is concerning is that if you put forward anything trivial, and I'm not saying this particular request was trivial or frivolous, it may set up a general negative attitude against your team and your client, like it's all bothersome or something. This case should have a full blown trial, but only after the defense has had plenty of time to run their own investigation, get the witness depositions they feel they need, and so forth. An extremely complex case like this one should take more time to get to trial. What nobody wants is a rush to judgement, but I think the defense argument was that the grand jury indictment was indeed a rush to judgement, so it's interesting. Too bad the preliminary hearing was bypassed at the last minute, IMHO.

Bryan Kohberger had the same exact opportunity to have a preliminary hearing as every other defendant. If the defense wanted a preliminary hearing so badly, you have to wonder why they waived his right to a Speedy Preliminary?
He could have had the preliminary hearing his lawyer’s been crying about over the past year within a few weeks of his arrest.
She’s the one who wanted to take the gamble and request a the unreasonable amount of time to hold a preliminary hearing 6 months later. She all but gave the prosecution a grand jury indictment on a silver platter giving them enough time to get their ducks lined up in row and convene a grand jury.
Now she’s crying over the opportunity she let slip out of her own hands and wants to waste everyone’s time trying to get a do-over? She should have thought about that before waiving his right to a Speedy Preliminary.
They waived that right after the state’s indictment and they had no choice to waive when discovery still was not handed over.

The prelim would have allowed the defence to cross the states witnesses instead of this one sided hitpiece.
