FYI getting mental health is a nightmare in this country. I had a nephew in crisis and we called everyone and were told come in next week. No one was willing to see him right then. It was a nightmare.

Ridiculous that the school employees will not be charged. This is my whole problem with this case. They should have never allowed home back in school. Not saying parents shouldn't be held accountable. I believe school should as well.
Guns we’re on trial more than James. That is why the school gets off.
Agreed. I think a lawsuit though is more reasonable. I don’t think those in contact with Ethan at school should still be working in the capacity they were. Allowing him to return to class was insane.
The school is being sued. The school and everyone involved, individually. They aren’t getting off. A state judge dismissed it. A federal judge is letting the lawsuit proceed
@@Weatheredstorms1 …..the lawsuit is more reasonable but I just checked and the Dean and counselor are no longer employed by Oxford. They might be employed at other schools or in other states but not at Oxford. I can’t remember the name of the teacher who turned in the drawing but boy, she was trying to get help. I hope she still has a job. She was a bit aghast at the way it was handled.
i can understand why you feel that way but the school's job is to educate the student, not raise him. how can we possibly hold someone who's met with the student a total of 2 or 3 times to the same standard as the people that live with him? not saying the school didn't make mistakes but the counselor & dean didn't know the shooter which is why they summoned the parents. had the parents given them some info, any info, there may have been a different outcome.

The judge literally said in open court that he had been warned about this before. His own lawyer also sounded irritated and said she had admonished him also. He wouldn't stop because he doesn't think the rules apply to him. And that's why he is in the position he is in.

She didn’t have much to work with, but compared to her infantile mean girl inept law partner, she at least came off as a professional who gave her client everything she could. Quite the contrast.
I think the most damning piece is dad seeing the words and images the shooter wrote on his math assignment, and doing/saying nothing. And the fact that as soon as he heard there was a shooting, he went home to check for the gun. This says that he, on some level, knew there was reason to be concerned.

Exactly. James said she they were at school he had a journal he told him flat out to use it. Check the damn journal. Get him help. He begged and they as Jennifer said thought he was “joking”.
His actions show that he has no control over his anger- not a good look. People who threaten court officials should be held accountable.
My problem with the parents they have NO. Remorse for the part they played in what happened 🤦🏽♀️ 4 kids died by they’re actions and they’re son actions 🤦🏽♀️🤦🏽♀️🤦🏽♀️

I told my husband I disagreed with Peter Tragos on an issue recently & he offered me condolences on my internal angst I was suffering with "my favorite You Tuber". 😂 I think it's a good sign when your husband knows you're never going to "break-up" with your favorite You Tuber over one disagreement he knows nothing about.
I am a recently new to the channel enjoyer of tlyk, but Peter seems like the kind of guy who might enjoy disagreement and respectful discussion thereof.

in my opinion this lawyer did no better than the first one based on pure results - both guilty verdicts, if anything she probably could have done better as she saw the first case/witnesses/ reaction etc.
James Crumbley comes across as a smouldering & irritable who blames everyone else for the situation he finds himself in, look closer to home Mr Crumbley.
If the prosecutor would have told the truth the outcomes would have been different..these parents are innocent!

James’ attorney did a much better job, in my opinion, than Jennifer’s. She was more put together and organized rather than the drama seeking tantrums that were held by Jennifer’s attorney. I don’t think the verdict would be different and I agree with the verdict, but it’s a shame that she couldn’t represent both.

Neither parent suspected Ethan was planning a shooting. Yet as soon as they both heard about it. They thought it was their son.🤷♀️
If I and my spouse were on trial and my spouse was already convicted, i would presume that i would be also.

If I were the Crumblys, I'd be upset that they were the only ones charged for being responsible for Ethans crime. The school counselor, and was it the dean? The one who refused to search Ethan b4 sending him back to class had an immediate responsibility to protect the school and refused to do so. The counselor already decided that Ethan was a danger to himself because he said he sent Ethan back to class so he wouldn't be alone. Nobody searched him or asked if he had access to a gun. Those two people are more responsible for the school shooting than the clueless parents. Yet, they get to walk away from it. Why would Ethan be alone if he stayed with the counselor? He wouldn't be. He had all the info he needed to know that Ethan was a threat, yet he sent him back to class. He had more info than his clueless parents. How he gets to walk away free without the same charges is beyond me. I'm livid. And every person with a child at that school should be too. They were the last prevention of keeping Ethan from shooting up the school, and they failed miserably. There are definite ways to lessen the potential of school shootings and the school failed to do their job.
I agree. The school shares some responsibility for not insisting he be sent home and be seen that day. It can be done with an ER visit.
School personnel act all big until they come to court to defend themselves with all the childish facial mannerisms to convince!! Eeeeewwwhhh
Had the gun had the cable lock on it, and Ethan cut it off, would the parents still have been charged? Would the state say that he should have locked it up differently? If the gun was in a safe and the code was 777, would that be enough? Would the state say that the code should have been more difficult? At what point does a parent do enough?

Responsible gun owners secure their weapons - possibly remove them from the home if they have to - the issue is that the parents disregarded all signs leading up to the massacre - not just the critically wrong decision to purchase a gun specifically for the child and then leave it available. Responsible parents and gun owners wouldn’t do that - So no I don’t think cable locking it; changing combo etc. would have made a difference cause he still could have broken in to get “his” gun. - the parents ignored their mentally ill child and now innocent people are dead.
Imo. If the parents had told the school they had purchased that gun FOR ETHAN three days before, it would/ SHOULD have prompted a search of his backpack right there in the councillors office, given the picture that were drawn on that math paper. The parents ALSO BOUGHT the journal that the father spoke to him about in the office. “ you have your journal, and you have me to talk to” Did either PARENT ever look at that journal?? I THINK LIKELY NOT. This was complete negligence on the parents part.
@@SusanMarie3 I am asking these questions because the prosecutor's closing included "one SMALL thing" that could have been different (cable locking the gun), which made the appearance that if the parents had done that, nobody would have died. So, if you don't think cable locking it would have stopped Ethan, then do you think the parents should still be found guilty if they had put a cable lock on it? What does "leave it available" mean if you don't think cable locking or changing the combo of a safe would have changed anything? None of my comments should be read to suggest that I don't think the parents should be accountable in some way, but I do not think that the state proved the elements of the crimes that the parents were charged with. I also think that this case is being looked at too much in hindsight -- "the parents could have prevented this." Of course they could have, many other people could have prevented it, too, but that's looking at everything in hindsight. *Every* crime is preventable in hindsight.
With regard to James' trial specifically, I don't recall evidence of "all signs leading up to the massacre," nor of such signs being ignored. What are signs of a massacre? Depression in a 15 year old when their grandparent and dog dies? Is every 15 year old exhibiting signs of depression at risk of committing a school shooting? The texts from Ethan saying that he asked his dad to take him to the doctor and was given a pill and told to suck it up - what was the reason that he told his dad at that time that Ethan needed to go to the doctor? Further, those messages were 8 months prior to the date of the shooting. In what way does the content of those messages prove that it was foreseeable on the day of the shooting that Ethan was going to do what he did? It seems like the only evidence that could have or should have possibly made it foreseeable (a required element of the crime of which they were convicted) to the parents is the math paper the morning of the shooting. This is where I have an issue with the element of exercising "ordinary care." If the parents had the gun unloaded and hidden (as Ethan's journal stated), what is ordinary care when they went to the school? It may not be what another parent might have done because ordinary care can vary - is doing something that the school counselor agrees is an acceptable plan not "ordinary care"? It's easy to say that they should have checked his backpack or should have told the school about the gun, but is not doing that so egregious that it amounts to not exercising "ordinary care"? What if they told the school about the fact that they bought a gun for Ethan to use and then nobody at the school checked his backpack? Or if they told the school about it and the school still didn't have concerns about Ethan being a harm to others? Should the parents still be found guilty because they didn't check his backpack themselves or because they didn't disregard the opinion of the school counselor?
The issue that people are calling the "slippery slope" argument and brushing off as nonsense is being misunderstood, in my opinion. It's not that it increases the risk of parents being charged when they buy their kid a car and the kid kills someone with it. The issue is that the state is saying that the Crumbley's should have done something, but nobody knows what actually could have been done in that moment, based on the knowledge that the parents had, that would have changed anything. Especially when Ethan, who wrote help me on his paper, lied to the people there to help him. That's why my first comment was about what would be enough to satisfy the state.
I have a friend who has been on a waiting list for over a year… mental health in this country is in a Huge crisis..
Sadly, that's true in just about every country.
"He didn't know what his son was planning."

"He didn't know his son took the gun that day."
I think that's the whole point.
He. Didn't. Know.
Maybe him not knowing what his son was planning or that he was a threat can be excused. But not knowing the gun wasn't secure and not in the house? Sorry. No excuse for that.
I think the "Don't get caught" text from his wife really damned them both.
It shows they both knew Ethan had head problems and neither took it seriously.

There was not a law at that time to secure the gun. They were negligent but not grossly negligent. It should have been a different charge.
@honestguy6486 if there wasn't a law in place at the time, then what other charge should he have had? You have to work with what you got. I believe any parent who owns a firearm and does not secure away properly to where a child can get it to cause harm to themselves or someone else is grossly negligent. Even if it was just a kid who decided to play with the gun, if the parent did not secure the gun properly so the kids could not get to it, then it is more than a tragic accident. It's gross negligence on behalf of the parents.
Regardless, I think everybody's looking at the wrong thing. I think it was beyond gross negligence. It's Crystal Clear that they considered the gun to belong to their son. I do not believe for one second that it was dad's responsibility to lock it away. I think they considered it the kid's responsibility because it was his toy. I believe saying it was dad's responsibility was just a cover.
Going by the correct definition and examples of gross negligence ,the parents do not meet this criteria[ from a lawyer's definition]. I personally would of not had a gun in the first place.@@richardthemagician8991
Sounds like the "threats" have just as much basis as the charges. Can't imagine what reality people live in to want to punish these parents even more.

Thank you for breaking these legal issues/dilemmas down! As the shooter was tried and convicted as an adult, how were the Crumbleys charged with 4 counts of Involuntary Manslaughter? IIf their son was 18 years old at the time, how would that effect the Crumbleys being charged? Does it make a difference if the child is still enrolled in a public high school?
What really did it for me was not securing the firearm .
And purchasing it fir a troubled child in the first place

(I imagine if Crumbly had not been convicted, not only would he have his liberty, but also his 2 firearms, could purchase more and he has a grudge, so a threat is something I would take seriously and not want the jury to be aware of.)

I don’t agree with him making those statements about the DA, but for her to make it a big deal more than a year later is dirty. If they verbally or otherwise implied or gave the school immunity without disclosure to the defense is also dirty. I do not love this DAs methods in either trial. Maybe their conduct is not legally unethical, I feel it was morally unethical. Whether you like the Crumbleys or not it is patently unfair to try them with innuendo and shaming tactics about irrelevant things to the charges.
Karen McDonald said he physically threatened her in a phone call in Jan 2024 and she also said there was no immunity granted

I used to work at a shooting range. Not one person brought their teenage or pre-teen child to the shooting range to shoot. A couple of people brought their children, I watched over them while the adults went shooting. My position where I sold tickets to shoot and ammo for the "shotguns" was at least 100 yards from the fields across from the lunchroom/café. Sometimes the kids came into the "Hunt lodge" and sometimes they just sat outside the café where still I watched over them. It was an open shooting range with clay targets. Skeet, Trap and Sporting Clays. That said, I saw gun owners who were very serious about safety. I have no doubt all of them locked up their guns when they returned home.
IMHO, instead of purchasing a gun for your child, buy them horse riding lessons, or skiing lessons, or skateboarding lessons, art lessons, etc. And certainly, if your child asks for mental help, get them a psychologist and/or psychiatrist. Do family things together, like camping, church and church events, picnics, museums, science experiments, get involved at their school, make homemade pizza together, make a vision board, play basketball or baseball together, plant a garden and/or flowers/trees together, go for a hike, help a neighbor, pretend to be an interviewer with your child and let them interview you, and more. As a parent, your primary focus should be bringing up your child to be a respected, intelligent, cultured person. Families should be doing homework together - adding discussion to history, science, etc so that the information is clear and remembered. A parent's job / career is important to bring home the bacon, but once home both or either parent should be not just living with the child but learning from them and teaching them, listening to their needs and wants, teaching them about money, social skills, etc. Children are FAMILY! FAMILIES should be doing things together. Additionally, when I was young, my mother read all of my incoming letters and my journal/diary. I think that is a typical mom thing to do.
She is all class. I believe she was saying they hadn’t seen each other since before both of their trials- meaning before the trials were severed. Not literally before each of their trials.

I’m now wondering about Jame’s sister being called as a witness and then nothing came out about the threats unless that was an agreement made with the prosecution with the gag order regarding his phone privileges. It was a poor choice on James to have made those threatening comments about Karen McDonald.
My guess is that with the gag order it stipulated that it could not be discussed in testimony because it could/would prejudice the jury. Maybe? Her testimony as it was seemed weird to me. I don’t think they’re all that close but they needed to dig somebody up that was on his side.

Thank you. I don't mind how long your streams are. I can't handle the 3 hour ones that some YTers do but yours are great. It feels like dirty tricks from the prosecution re immunity for the school. I would have wanted to know that detail if I was on the jury. I would have voted non guilty anyway.
I thought it was unfair to hold the trial in that county, since the whole county was so traumatized & highly emotional by the shooting.
