Wisconsin does not play. The charge for 1st degree reckless homicide in Wisconsin is up to 60 years. I’m in California. The sentence for that charge in California is up to 4 years. What a difference.

Hi, I’m in the UK. It seems that self defence in Wisconsin means you can use equal force in self defence back ie fists if someone used fists on you. Is my understanding correct? If so it may work for one against one but does not seem to take into account if you are trying to fend off several people and like in this case, they, or the extras, would have just kept coming back at him, till they more completely over manned him, risking serious injury to himself, Using the knife though drastic, did stop them and allow him to walk away without more harm (except a lifelong jail sentence).

@@francesholliday5427 the reason his self defense claim did not work was because the jury was able to take into consideration his failure to retreat. Meaning he was able to get himself out of the situation before it got bigger and he didn’t. I really really really don’t think those teens would have went after him if he was to walk pass them to leave. They may have kept talking shit but I don’t think they would have put their hands on him. They told him to leave multiple times and he chose to hang around to see what would happen.

    • @cayla7820
      @cayla7820 Місяць тому +2

@Jazlin92665 I just think the teens injuries were a direct result of putting their hands on Nic. They misunderstood him on purpose to start with him. He had every right to look for a lost phone. & they would have never been injured if they didn't surround him & lay hands on him. & after the fact is a trauma response. He eventually admitted it but when you endure a traumatic event you instantly try to act like it never happened or minimize your involvement. It is a shame they didn't put a psychologist on the stand to explain his behavior. Trauma response 101. & him almost losing his life bc of his surgery, he didn't want to take any chances. I honestly think the jury got this one wrong.

I think all these young adults should be charged as well for all the things they did-alcohol, drugs, battery, lying. These people invited and esculated a situation. My question is how is he guilty of battery of Madison Coen when there was no proof/evidence he hit her at all. The "battery" done isn't caught on video and everyone at the scene had a different version of how she was "hit" making their statements much less credible. Some say she was punched on her right side, some said left side, some said with an open hand and others said a fist. Madison herself said he hit her on her left side with his left hand??? I can't believe the jury bought that. Madison deleted the only alleged photo of her face and no one else saw an injury on her. In addition, how is he convicted of battery and all the other people slapping him around get charged with nothing?

To me it was absolute self defense and I really hope myself, nor my family, ever get into a situation like this because I thought you could defend yourself. @@heathermitchell7191maybe Peter's father would have walked away. Hell, maybe even Mr. Miu would have walked away if he had know what was to happen. Its easy to say you'd walk away because you have hindsight. So you and Peter can say you and your family would have walked away and then i can say that IF it were my kids, they wouldn't have been drunk and they wouldnt have bullied an old man into stabbing them. My kids would have done something differently.
See how ridiculous of a statement that is. You don't know what you or anyone else would have done befause you werent there and you AREN'T Mr. Miu with his ailments abd his life experiences.
English also isn't Mr. Miu's first language. I definitely think that had an impact on his response.
Yes, Miun walking away would have prevented this but so would the biys walkong away. Why is it his responsibility to walk away from a fight he isnt starting? Why is this all on him?
And just so everyone who thinks the jury got it right, THEY FOUND HIM GUILTY ON THE CHARGES AFTER THE CLOSING ARGUMENTS. That means that Miu's defense tram never got to defend against those charges and that's not fair. That's so ridiculous.

I CANNOT see even one decent human being I know behaving like those boys. My recovering addict of a brother AT HIS TEENAGE WORST would not behave like those boys. I am not sure I have ever seen anyone in real life be as cruel as those boys. Think about that! Who was their designated driver at the end of this tubing event? Who provided the drugs and alcohol?
Who is responsible for these "children" and their actions? How many times do teens go to Apple River and drive home drunk?
Maybe it's time to look into the parents. Isaac's mom said she knew them. They were all "best" friends since middle school. How often did they go to the river to bully people and finally someone fought back? Time to shut this party down. The parents ALLOWED this behavior.

I don't know if there is someone doing this but I have avoided lives lately here because people in the chat are being nasty, name calling and generally making one not want to be around them. Someone needs to keep an eye on those kinds of things. I did not say anything for a while because I did not want to be jumping to conclusions but it is getting worse. I can speak to anyone w/ opposite views or not if they are respectful and open to discuss. So I do not think I am exaggerating. They were loud, they were obnoxious, but he was the one who walked away, returned, stood silently, & smiled while fiddling with a knife in his pocket that nobody knew he had. A lot of bad behavior from both, but his implicit & explicit actions created this entire situations. He should have continued walking away the first time, or turned & left at any point, like they were screaming at him to do. Nobody would have followed him. He could have brandished the knife once he was attacked to get them to back off long enough for him to escape. No legal duty to retreat, sure, but that creepy smile was a product of the rage building inside of him. He viciously stabbed anyone within reach, blade up, & chased the final victim down as he was running away. It was brutal & completely reckless. I also find it despicable how they responded to the judge asking if they'd notified their witnesses of the sequestration order (after the witnesses were caught watching a livestream of the trial 🙄). Their answer? Sorry, Judge, we couldn't bother finding a translator. "We'll do better in the future." ?!!!
How TF does this kind of sh*t fly in any courtroom? WTF is the point of an "order" if the people ordered to abide by it don't actually have to? They were ordered to not watch the trial before testifying; the attorneys tasked to inform them didn't (but the prosecutors did!); they said 🖕 to the order; the judge, completely unbothered by their disrespect of said order, repeated the order to their faces; they, after having watched parts of (probably all of) the trial, were still able to testify; thus, what is the POINT-?

I dont think the jury had any other option but to find him guilty. The stabbings were quite brital and he continued to stab innocent bystanders after he had left the water. Shortly after, the place was crawling with police and instead of asking for help for himself or his victims, he lied and said he had only heard about the attack. Then he lied to the nurse and said that the kids had the knife and he turned their own hand around to stab them. He knew what he had done was wrong.
It isnt self defense when you have the option of leaving the sitiation without being hurt, and when you attack people who aren't physically harming you, like the bystanders.

I feel tremendous compassion for Isaac's family and...this will not bring justice for Isaac.
To truly honor Isaac that community needs to do some deep soul searching that includes difficult conversations about taking responsibility for one's behavior when it misses the mark of being a good citizen.
Destroying Mr. Miu's life will not bring honor or justice.

For what? minding their business floating down the river and some creepy dude comes up? teens will be teens, he was already walking away and the teens were floating opposite directions, he turned around and charged because he was angry, he incited it all. and he will have the rest of his life in prison to think about it. hope you find peace in life, teens dont deserve death for mouth off. sad to think you think so.

Mr. Miu needed to take responsibility for his actions. He knew he went too far. That is clear from his actions after the attack. Rather than take responsibility he left the scene of the crime, ditched the murder weapon, and repeatedly lied to the cops. He missed the "good citizen" mark by more than a mile. The actions of the teens obviously wasn't stellar but they were just chilling until Miu approached them. They weren't out looking for trouble. They said some dumb stuff, but THEY didn't touch anyone until the woman got hit. They were not going out of their way to find trouble or randomly attack people (even a weird dude that ran up on their group). Their blame seems be minimal. Not sure why so many want to blame them rather than the guy that hit a woman and stabbed 5 people? Actions speak louder than words.

You hit the nail on the head. Why aren’t we teaching our kids citizenship? At the very least, those boys should have to do some kind of community service. They weren’t just being mouthy. Once the adults came over they were screaming, antagonizing and escalating the situation along with crowding and pointing at him. My visceral response was to agree that he would be in fear for his life especially after I saw him get hit, knocked down and slapped. I agree with the verdict and give no quarter to Miu but don’t agree this was a ‘kids will be kids’ situation.

Oh well. I will find solace thinking that those youngs will grow with the deep down feeling that they sent their friend to the grave. One may escape accountability, but not its own conscience.
They will grow old, have children, and I can rest assured they will teach them to not effe around with people.
People wanting to see Miu guilty may cheer, but the verdict is clear on that: the guy didn't intend to kill people that day. It just happened following a series of events.

Usually I'm against the prosecution and I'm against the police but in this case I was just speaking common sense and facts on what I saw and I saw that it's not self-defense when you insert yourself into the so-called threat. You have a chance to leave plenty of times and get away from the threat but you choose to stay and be a part of it. And then I don't believe pushing someone or touching someone's arm or touching someone's shoulder is justifiable to stab them. Make it make sense everyone was sitting there saying it's justifiable and self-defense because a girl touched his arm, because Tony touched his arm SMH make it make sense
