      So right… in a nice world. U shd watch Todd Grandes assessment. He does a psychological assessment on it and it was interesting. I’m obsessed with this case. If I were a juror it wd be NOT guilty across the board. Just r not the right charges given the shared blame

    so… for 15-20 min directly after the incident, while von williams is leading first responders in, and for the 20-30 min it took the miu group to then float down to exit, nobody said a single word????? that is actually THE most unbelievable thing i’ve heard thus far in this…

    My husband has a pocket knife he uses whenever we camp, tube, hunt, and hiking. It's his tool, but he is also aware it's a self defense option. Most men I know have various pocket knives they use as a tool.

      ⁠@@honkytonk4465yes! My husband has one on him at all times. It’s easy to get tangled in floating twine and such in water. He has helped others before, too, and every time people say “I’ll bring one next time”.

I doubt none of this would have happened if they hadn't been drunk and smoking weed. There are MANY parts of the US where if you call a man a pedo you'll end up dead let alone put hands on him IN A DRUNKEN MOB. Like I said. F around and FIND OUT. With that being said I bet he's found guilty because of the emotional factor of a dead teen.

You can be emotional but the question in this trial is if his response was appropriate given the situation. Bottom line is this: The kid would still be alive today and no one would have been stabbed had these drunken idiots not harassed and attacked this guy.

      wouldn't ? drunken teen vs. drunken older man with a weapon? almost all were drunk. NM looked beyond " Happy Buzzed" drunk he appeared surly and confrontational angry drunk. And I'm curious...and history of DV between NM and wife? Divorcing to protect assets not due to problems in marriage? Alot of questions not answered. Possibly NM group knew he was drunk and aggressive and did not want to find them selves involved in his drama.

    My dad always had a pocket knife in his pocket. He was the ultimate handy man and used that knife for so many things even opening gifts. It’s not unusual for men to carry a pocket knife

      Alcohol. That one word is the root cause of this entire thing. I went to the same river 10+ times as a young adult. Everyone is lying about how much alcohol was consumed. The river is known as the place to go get wasted and party. Its not a family friendly place. Even the adults get outta hand. I've witnessed some horrendous beatings on the river or in the campgrounds. Never any stabbings but group attacks on multiple occasions. Men groping women or just being way to pushy toward them. I would never knowingly let my children go there.

      They told him to LEAVE LEAVE LEAVE over and over again. Why is that so difficult for anyone to hear and comprehend? I guess that is why he stayed there too, he just did not understand the word "LEAVE" or Get the fark out of here. Again, maybe he wanted to show these, what he considered "Punks" who the real man was because, I do believe he understood the AMERICAN version of the word, "LEAVE"!

    I re-watched this episode again today. When I was a kid the Apple River was much more of a family-type event. We went tubing with Parents, Aunts and Uncles, and Cousins. When I was in College it was turning into more of a young Adult with some light drinking no drugs. Now, I have not been there in 30 years, but it seems much more that it is a hard party place and not safe to just interact with strangers.

    We tube the Wisconsin River every year for my birthday (and have also tubed many other rivers in WI)... This is all wild to me. Normally the other people you run into on the river are fun and friendly, people offer each other beers and shots, bat a volleyball between groups of tubers, shoot the sh!t, etc.
    I also love learning more about the specific laws in my state. Thanks for covering this one, Peter!

      I live in Wisc as well and like you, enjoy tubing at different rivers. Never had any issue with anyone-- people are happy, friendly, and usually interract with other tubers, like you said. But there is always lots and lots of drinking. So it wouldn't take much for things to escalate. The situation is sad all around.

And verbal harassment does not justify punching someone which is was the guy did, and then that resulted in the kids pushing him. Then he took that pushing to justify him murdering one kid and stabbing and seriously injuring two other people, that's murder and assault and that's why he's headed to a cell.

Eventually he had to defend himself!! The young adults are at fault in harassing him and shoving him in the water, and I believe the middle age guy is NOT guilty without a reasonable doubt!     All I know as an older person, much older than the defendant, is that group of so called kids were scaring me in the video. At one point surrounding him. Yelling at top of their lungs.

    Ok here is something to ponder for you: IF she was so concerned after she sees her husband get knocked down in the water--WHY does she look away from the scene? She said she didn't see "all of it" and only noticed when he was walking back to the group. So she see's her husband who is not in the best of shape get knocked down and surrounded by 11 or 13 people. He's on his hands and knees in the water, sends two guys in her group to go check on him and then testified she didn't see anything else. UHhhhhhh.....flippantly, "Oh hell...Nic got knocked down, Ernesto and Ariel can you go check on him......oh wow, look at how nice the river is........Oh he's fine, he's walking back....did you see that eagle up there Rosie?" (YES that IS Sarcasm). But it IS a question....why wasn't she watching the whole thing?

      I just don’t think she sees any benefit to trying to add to what’s already on the video since she was a couple hundred feet away and maybe she didn’t see him get it but we all saw him get hit on the video and at that point if everything just started there he’s totally justified it’s just when you factor in what happened before it gets murky. He may very well have drowned if he didn’t have the pocket knife

      It's clear you've never been in a trial because along with a great defense attorney duo, the prosecution is doing an excellent job. The judge, too, runs a tight and professional ship. I've been a court reporter for 45 years and have been in hundreds of trials. I know what I'm talking about.

    I think the main hang up for the jury will be the fact that the defendant did not verbalize anything on the scene. He was completely silent ( no yelling stop, get away…) not even initial normal interactions.

    Just finding out about this case… but just from seeing the video… they sought out an altercation, they surrounded and assaulted him. Murder is a WILD charge.

    congratulations! I'm following this case here in Brazil, and in addition to being Brazilian, I'm a lawyer. The laws here are absurd, and I love seeing trials in your country! but this case... killing is absurd but I can't blame the defendant. If I were on jury I would vote for self defense!

      That’s a terrible excuse- it’s “their” fault we can’t enjoy ourselves. You teach others how you want to be treated. If you skulk around or act like you’re in fear or irritated in your environment, people sense that. Walk around with confidence, positive attitude and calm demeanor is what should be done. Take some self defense classes too, it can help.

I’d say being pushed and slapped doesn’t warrant that kind of action. I’ve been pushed, and slapped, and I’ve never stabbed anyone. You’re looking at a grown man child here, I believe his ego was the reason for the stabbing…he had the chance to walk away a few different times.

    Let's assume it was all self-defense...... why did he remain quiet about it afterwards? He saw law enforcement and walked right past them, tried to leave and was caught, and then put up an act like "What happened i heard someone got stabbed by someone who looked like me". Like come on, why the lies and sneakiness. He didn't even tell his group memebrs that he had stabbed people. Why throw the knife away, why hide evidence?

      If you hurt someone in self-defense, in your own interest you should immediately contact LE. If I was assaulted and felt so threatened that I needed to stab not one, but 5? people, I would also want to press charges. If a driver hits someone with their car, and it was an accident, they can’t just leave the scene. It makes no sense. I also think he could have threatened and brandished the knife without actually stabbing anyone. He was with a big group. He would have stayed with his group when he went back the first time, or brought some of his friends with him when he went back if he was worried about being threatened.

      It certainly doesn't help him that he starting the situation by running up to their tubes and grabbing them. (the tubes) stopping their trip down the river. They would've just floated right past them. I live in this area and have gone down that river since the mid 70's. It used to be much bigger with thousands of people going down during the weekends in the summer. Huge groups of people (mostly drunk) just having a good time. I am still not sure which way I am leaning yet, but either way I don't think it is 100% clear cut one way or the other.

    If the only info I had was what was presented today and I had to decide I'd go with self defense. At least for the guy with the scar. The video is what did it for me. Forcing someone underwater is enough to make anyone believe they are going to be killed. That is scary.

    Today was day 3 of a two week trial. Prosecution has a possible 50 witnesses and I think we have seen about 17 so far. Went to Apple River many times when I was a young adult and EVERY knows about the sa, drinking and drug use on the river. It is not a family friendly river for tubing. If you want peaceful and safe you go to the Cannon or Zumbrota Rivers on the Minnesota side. Not sure on the Wisconsin side. I really appreciate your take on things so far. During stabbing you see that he actually has friends there on the river standing next to them.

      The kids that were laying in their tube's the entire time until he leaves, comes back, another group comes to help, and then they get up. At any point in time Nik could have just walked away. He was not chased or followed the first time he walked back to his group. I've watched every video and testimony. This guy made some absolutely terrible decisions and should be locked up forever.

    I find her to be a very credible Witness, she's answering honestly for the defense and for prosecutor.
    He did fear for his life, and if I was a juror I would vote not guilty on all counts. Let's say he did slap the girl that was in his face, the mob could have called the police not engaged in Street Justice.

      He tried. He said I’m looking for a girls phone. They switched it to say, he is looking for little girls. He started out looking for a phone but the teens appear to knock the snorkel off n then you see him looking for it. Moving the tubes n looking down for it. They are all yelling at him then women screaming n cursing at him, in his face, hands on him. I think he raised his hand to remove the woman’s hands from him n she thought it was a hit. She was drunk n most were doing drugs too. Anyway she walks away to say she was hit. A woman has no right to get in a strangers, yelling n cursing at him n expect nothing to happen. If he was moving his hand up n hit her I don’t think he intended to hit her. You can see his face in slow motion. He doesn’t seem to be a bad man. Helping a friend look for a phone, handy man, helping others. Compare to a bunch of drunk 17-24 yr olds. Hmmm

(They got off, save 1 that turned state witness, 1 kid's Dad got him a tag for his car that said "above the law") horrifying. 😳 I think he left because he didn't realize how badly the kid was hurt.

    Don’t know if you will see this but I was always taught that you walk away from the situation. The defendant had plenty of time to walk away BEFORE the situation escalated. I was taught You don’t physically attack with lethal force because someone is taunting you.

      My ex was not smart enough to walk away. At 65 yesrs old, he would take on a fight because he was a bully as a young man. They don't change. At 65, he would have gotten his butt handed to him, but he thought he could still do what he did at 18.

    Thanks for covering this. Was watching the Arizona trial yesterday- the case about victim being shot after having entered onto private property near the border. The defendants wife testified yesterday as a witness for the state, and I was confused as to why. On cross examination, the defense attorney was allowed to lead and had more freedom. So it almost made me wonder if the defense had encouraged the defendants wife to be a witness for the state

    Although horrified at what happened, the more I watched and listened, I think he was legitimately afraid with a bunch of drunk teens surrounding him, accusing him of horrible things and then summoning others to come and join in the crowd, yelling and being threatening. He was separated from his group. Depending on how the jury views things - including the fact you cannot hear him EVER say he was looking for little girls... well... could be not guilty.

    Duty To Retreat! Not required in Wisconsin... peter can you discuss if it is usually required, and merits or challenges with it? Personally, I think it's good law to ask citizens to try and retreat a situation to the best they can... sets good example for kids, too. Thoughts?

    What I've been asking and have no answer thus far is why the group of young guys were calling him a predator or pedophile; why were they taunting, ridiculouing, laughing, and bullying Miu? And why didn't Miu just get as far away from them as possible? From the images I've seen, Miu doesn't say a word to them at all. Does anyone know? Can someone please answer and let me know?       Mr. Mia was snorkeling and someone asked him what he was looking for and he said little girls. There was a couple of girls from the group close by.

      IMO- they had been drinking and thought it would be funny to taunt the man as for walking away I think he was caught between fight or flight he charged towards them (fight) he moved away and the followed him (flight) they taunted him more he froze IF he hit the girl which I’m still not sure he did (fight) he stabbed after being hit (fight) I personally thing he was overwhelmed and didn’t know what to do and eventually lashed out (I am in no way condoning what he did)

      I really think he said I am looking for my googles and they thought he said I am looking for little girls. Then one kid heard that and hollered out predator then another said pedophile. Then the drunk kids were laughing. He walked ver to them really creepy like and never said a word. At that point he should have left. Instead he hit a girl and all hell broke loose. It was creepy how he had his knife out hiding it under his belly. He is guilty of manslaughter at the very least.

      No. Evidence said there were no little girls anywhere. He said he was looking for a girl's phone imho. She dropped her phone and he went to look for it in the river with his snorkel.

      They thought he was being creepy. He lunged at the boys legs and wouldn’t leave. So, nobody knows why NM didn’t walk away. That’s the whole reaches on trial for murder imo

      it is on video case closed. Murder and 2 counts of attempted murder. leaving the scene of a crime then hiding the weapon.
