      Yeah, they were clearly not afraid of him. Still manslaughter I think.
      I mean we first have to see all evidence, but so far I think he didn't do what he could to avoid the conflict, he wasn't under the influence and he was the adult *and* approached *them*. All witnesses that don't belong to the defense claim he hit a woman first comes on top. Then he didn't talk to the police but instead tried to hide evidence. Also seems like he stabbed that one girl while she wasn't even facing him.
      I have no horse in this race, all I'm saying is it doesn't look good for him.

      @user-vy5fx4hk6h Why did the older man rub up to the group and grabbed on one of the guys legs? Also, if he was afraid for his own life. Why not leave when the 1st girl who approached him told him to leave. Seems to me he had plenty of opportunity to leave, but stayed for some reason. To fuel the intense moment and confrontation because that's the smartest thing to do?

    This guy sees his friend, under water, dying & his first reaction is to turn his phone around, in SELFIE mode, so he captures his facial expression, instead of helping him....... selfish friend should be ashamed of himself!!

      I heard apparently the mom of Issac (the lad that died) gave this ‘witness’ a scholarship. As a mother, I’m pretty sure I’d be holding him at least partly responsible for the whole thing.

    Dude, they were screaming pedophile, rapist, saying he's looking for little girls, over and over and over.
    They were taunting him. They surrounded him. They pushed him. They hit him, knocking him down into the water. They shoved him down into the water from behind while someone else hit him from the front. When he got back to his feet, they went after him some more - but, he had pulled out a lil buck knife and he used it to defend himself.
    You need to watch the original videos (the one's that weren't conveniently deleted) as well as the court testimony.
    This guy's video and testimony is incredulous - he exacerbated the whole altercation.
    BTW - The suspect was looking for a cell phone that had fallen in the water; he thought this guy was holding up the phone that he was looking for... so he waded through the water to these tubers. This guy suggests that he didn't hear the suspect explaining why he had come over to their tubes - but, he didn't care, as he was already screaming at the suspect, inciting the mob.

    Have to watch the entire video to get a sense of what happened here. The video does not show Nicoli punching the woman, however it is clear that they are invading his personal space and yelling at him. The women put their hands on him and he attempted to push their hands off. It is as if when he attempts to put space between himself and the yelling women, that is all the justification the crowd needs to attack him. Also in listening to the audio it is clear the mob is completely confident in their superiority of numbers and their ability to dominate Nicoli with impunity. It is also important to note that once the second group gets there, the only escape route Nicoli has is towards deeper water. Wisconsin does not have a duty to retreat and even if it did, Nicoli could not have done that safely when they continued to follow him.. After he was punched and slapped twice in the water, he attempts to get up and a man in yellow trunks pushes behind his shoulders as if to push him back down in the water. He does get back up and yellow shorts attempts to attack again putting his hands around the mans neck and that is when he stabbed him in the midsection. Seems clear self defense to me..

      I have as well . Many times , a drunk older man once was bothering us..we ignored him and thankfully he just left and went to.bug other people on the river . It's sad this happened ..this place use to be really fun there long time ago .. 😢

I wouldn’t have handled it like Miu did but, is he guilty in the eyes or the law? That’s to be seen. Would an appeal work out? This is going to be an interesting outcome for sure.

    I am close to 60 years old and have been bullied and attacked by intoxicated people. I was horribly afraid FOR Mr. Miu. I probably would have reacted the exact same way if they harassed me and then assaulted me. He was smart enough to not touch them first.

      Yup, I've been jumped before and woke up in the hospital with a brain bleed, 6 broken ribs, tooth through my lip and they curb stomped my fucking arm. My hand was hanging there by skin and tendons. Took me 3 years to have 80% use of my left hand again. All because I was wearing a suit(cousins wedding) walking from the venue to the car and looked like I had money. I wish I had a knife or my pistol on me but alas I was in that shitehole state of NY so I wasn't sure what I was able to bring with.

    I hope Nick gets off Scott free. This was clearly a self-defense reaction. These kids were acting like disrespectful, out of control animals. Being in the water, made it all that more dangerous for him. These kids swarmed him, harassed him, got in his face, touched him, pushed him. I don’t know what People expect somebody’s going to do and how they’re supposed to react in a situation like that. Laughing and taunting him does not equal being creeped out and afraid of him. The video doesn’t match their words. If they were so creeped out by him like they claimed, why didn’t they continue to float on down the river and get away from him. I’m so sick of entitled and bully type kids today. Everybody wants a video to put on social media and that’s what they were looking for.I have two boys, 22 years old and one 25, both military. They would’ve offered to help him find the phone. They would never act like this! They were raised right!

    Before cross examination- my opinion :
    Group of men fighting a man alone , in the water, definitely presents fear for life. Such a shame for the loss of that young man’s life. Should never have happened. There is provocation to and fro- but I would have feared for my life.

      he wasn't alone on the river he also was with a group of people, one which came up to the group but didn't get involved you know, like a real adult. Also the group of adults that came over to help the old guy but when they reached the group they heard what was going on and started defending the group of teenagers. That says something to me.

      He wasn't alone first of all and second of all those teams didn't even put hands on him until after he punched the female in the face and pulled her hair from behind and even after that all they did was kind of push him in the water to push him up off of her and I think one guy might have slapped him but they didn't all just start beating him down like everyone's claiming. These are 17 year old football players if they were really punching him and trying to beat him up that dude would have been out cold laying in that water floating. They weren't trying to hurt the guy in the video proves that because like I said if they are really trying to hurt him he would have never got up and prior to that the dude had so many chances to leave and they weren't stopping him from leaving they weren't blocking his path or impeding his movements he had every chance to leave but he chose to stay and fight

    The reason these kids are so emboldened is because at school the jocks bully other kids and staff turns a blind eye they want to win the championship and that would likely not happen if they held them accountable for their actions , we all know it but nobody talks about they should be held accountable !       Not defending the actions of the “kids” (most of whom were adults), as two wrongs don’t make a right, but I assume the suspect could have gone back to shore and called the police instead of staying near the group and later engaging in a mass stabbing.
      Both sides escalated this unnecessarily, but only one side killed and injured people.

    I've had 2 fights break out at my workplace where surveillance footage captured a group of teen bullies acting just like these kids, antagonizing and bullying a person who was clearly not seeking out a conflict. In each case, the person who was taunted threw the first punch. In each case, the police watched the footage and refused to press charges against the person who threw the first punch. They asked the teens what they expected to happen. Granted, if there'd been serious injury or loss of life, arrests would have been made. However, the police were crystal clear that the logical outcome of intense bullying was going to be a punch to the face, and they told both sides to knock it off and leave each other alone.
    Among other very good reasons to not be a bully, one very good reason is that you never know if the person you're frightening & humiliating has a knife in their pocket.

      All sounds reasonable, but does that mean you think the defendant did the right thing?
      I mean depending on the circumstances it could be just what he did, but when I watch that video and hear the witnesses and take his his overall behavior into account I have a hard time to consider him innocent.
      I ultimately do not know if he is guilty or not, but currently I'd be surprised if he walks.

    Those kids taunted that man beyond measure and the girl was no help either! They're all guilty and I hope the jury sees right through those guys and that girl. I'm sorry a life was taken and that man should be held accountable for what he did, but those kids were drinking and smoking pot beforehand, and they thought they were cool and slick!       there’s a reason people have to watch out for creepy old guys. He antagonized them by running up to them and touching them, then to punch a girl! These kids were clearly alarmed at first. Asking him what he’s doing and telling him to leave, then the women had to step in, not only did he refuse to leave when they tried to get him to leave, but he hurts one of them. The old guy was bad news from the get go.

    After reading some of the comments it’s no wonder why kids act the way they do these days. They’re out of control in schools and basically everywhere believing nothing will happen to them, and sadly they FAFO that some people don’t take kindly to disrespect and/or bad behavior even if they’re just “joking”. People saying the man should’ve just walked away should also be saying the “kid” should’ve just kept his mouth shut and this wouldn’t have happened. Had this kid not instigated drama trying to be “cool” this would have never happened in the first place so why couldn’t he have kept his mouth shut if he was so scared. Why do we not call out the bad behavior and bad choices made by all involved?

    100% self defense and the person on stand in this video is the cause of it, he instigated it he pushed it he lied about the person accused, he at any point could have deescalated it and yet was having too much fun pushing it until it became bloody, the drinking and drugs did not help at all, going to need more supervision on the rivers it seems, got to babysit bullies that attack a gentleman looking for a phone and minding his own business, just imagine how this could have turned out for him as well if he did not defend himself, they would have beaten him and likely drowned him for absolutely nothing! Sad that someone lost his life in this but when you play with fire you can get burned!!!

      I’m with you & after watching the full testimony of this witness before coming here to see his reaction, it’s a shame Fox9 coverage wasn’t used. I believe this kid was the instigator & his friend lost his life by his stupid mouth & what came out of it exactly as the defense showed! I don’t see how the girl could have been punched & not filmed when he’s filming them & there’s no punch of this girl. It’s a very sad case since someone lost their life over something so stupid & could have all been prevented by people minding their own business! You can tell all the young people all got there story’s straight by communicating. Now a man could spend the rest of his life in prison over this kids stupid big mouth & bully after getting his friend killed! Where does it end?

      He approached them 😂 nothing self defense about that. He should have MOVED ON, coming back to knife a bunch of kids is a complete felony. All those kids did was call him names. I just walk away and go home to whine about it and forget about it by the morning. No court cases and life stays normal. His reaction got him trouble no offense, most cell phones have insurance in case of lost/thief.

He wanted payback for their bullying so he escalated it by grabbing the tube first. Then hitting Madison. Even a guy in his own group said he slapped her. He wanted it to escalate so he could use that knife - he was very angry.

He was looking for his friends phone and they pulled out a phone to record him while they were taunting him. He thought it was the phone he as looking for which is why he approached them. He gave up on that immediately after dropping his snorkel. They then incited a mob against him by lying. They should have moved on instead of escalating the situation. They weren't scared at all, they were laughing like excited chimps. He only attacked people who attacked him first. He didn't touch the people who were insulting him. He didn't even look back at the cameraman after going to look for his snorkel. This is self-defense.

    I've watched this whole trial so far. This young man was the instigator of this whole tragedy. He kept his inebriated friends hopped up. They could of easily gone on. This was too much of an opportunity for Him to film some culture. This young man was a bully and an opportunist. You need to watch the whole video to understand why this defendant felt out numbered, surrounded, and struck back in defense. Both defense attorneys are excellent in defending their client. The individuals that came over to "help" were blitzed, too. How would you feel surrounded by 11 drunks, taunting, screaming, and calling you ugly names? Have you ever floated a river? I have many times. It's fun, refreshing, and something a family can do. The only thing that ruins it is the drunks along the way. Law and Crime Channel had clear audio and didn't leap stuff out.

      Pro tip- learn when it’s time to walk away. Don’t punch a young woman in the face while surrounded by her friends.
      As an adult you should know by now how to deescalate situations, especially when dealing with stupid drunk teenagers. There was about 20 different ways he could’ve handled that Situation without killing and hurting people.

Hopefully not violently, but if I thought it was the only option?       I agree. This being Peter’s channel, I also try to look at it from a legal standpoint…. And this doesn’t strike me as self-defense.
      I also think losing your life, or seeing your friend losing their life… is horrible.
      So I guess all at once I find these teens behavior gross, the defendants reaction horrible, and him not acting in self defense.

      Second the slap/punch is the only thing the victims have and none of them can get their story straight about it.
      If I had to make an assumption based on the vid. He's not even making eye contact with the girls he's looking past them and waves to his group. They got in personal space and started touching him right? That's on video cant deny that
      So I'm guessing he tried to brute force his way past them and got touched more and probably shoved the girl. That was all the group needed to attack, a reason.
      I would say shoving someone and slapping someone when they're down and outnumbered is trying to kill someone.
      Also based on the video he doesn't go after anyone. Everyone that gets stabbed lounged at him or gets in his space after the attack.
      I'd argue against self defense if he chased after one of them to finished the job.
      Issac has his hands around mius throat when he's stabbed. Is choking someone not lethal?

    I have watched everything I could find on this in the last few days. I started watching with an open mind. These “kids” assaulted and provoked this man. We have a right to defend ourselves. The older man was being beaten by two groups of men and women and he was in the water. Hopefully this is a wake up call for everyone, especially young adults. Every action has a reaction. If that was my dad it would’ve ended a lot worse for those young adults.

    The fact that the defendant originally walks away but then turns back and walks back towards the group with a prolonged big smile on his face and a knife at the ready to me reduces the argument that he was afraid. He looks more like a guy who plans to teach these kids a lesson the hard way and he’s looking forward to it. Additionally he immediately lied rather extensively to the police which makes me feel he knows he did something he shouldn’t have.

      When he walks from the front of the raft pack to the middle of river as he is stopped by the one lady you see him wave to a group of people up stream. He was returning to where he came from and was disengaged from either group when they reengaged with him in a threatening manner. Watch the video in .25 speed that is on their local fox channel and you see that happen. You also see him checking for his knife in pocket at that time and as he gets half circled by the mob he grabs the knife and has it at his side when the two girls go hands on him first.

If you want to bring emotions into this I suggest you stop watching a channel which is talking about the law. Lethal force is allowed for self defence in America. At what point a defendant should feel 'safe', ie has reasonably removed the threat, is another question for the jury to decide. To answer your question, if 5 people were stabbed at different times, he chased after them to stab them, no I would not consider THAT self defence. If he stabbed and killed 5 people all around him at that time, yes, still self defence.

I’m sure when the ppl on the bank heard them calling Mr. Mui this and they started encircling Mr. Mui, he probably thought he would be found floating downstream without a tube. I’d be afraid too if I were outnumbered and they started calling me horrible names. That whole mob mentality doesn’t end well, as we’ve seen. From the little I’ve seen this videographer instigated the whole sad mess.

    Please cover this trial! My unfortunate natural bias always leans towards prosecution. After watching the video I was shocked how staunchly I side with defense!

      Please try to overcome that particular bias. You have acknowledged it, which is great. The defendant should be presumed innocent, the state's burden should be recognized, then go ahead and start to make impressions as evidence is received.

      If he thought they’d stolen his friend’s phone and were waving it around taunting him with it…. While falsely shouting the little girl stuff - you can see why he didn’t want to be bullied into backing off initially, maybe wanting the parents to come and help sort it out and get the phone back.
      Then when ‘the adults’ do arrive and seem just as drunk and abusive as the kids, and they start surrounding him - you can see why he might start to feel unsafe.
      Now if he didn’t punch the woman first (which seems far from proven) and gets jumped like he did, it seems reasonable he would fear for his life (and dodgy heart)
      The fact he’s ended up stabbing five people does sound (and I think is) totally disproportionate, but I can see him getting off…
      … also I don’t believe for a second even the dumbest of predators would go up to a group of drunk rowdy young men and say ‘I’m looking for little girls’, and not expect to get a serious beating - it makes zero sense other than as a fabricated justification to attack him

      Being bullied or called names doesn't give you the right to physically assault someone. He could've walked away. Instead he got angry and confronted them. And at least according to this witness, threw the first punch. Plus he clearly took out the knife before it got physical.

      I watched it again and notice when he turns to approach them at the start of the video - he’s not trying to attack them- it’s like he’s looking for something in and around them - almost like just before they started filming they shouted they had his phone, and then started filming him turn and come towards them.
      Looks like one of them kicks his goggles away as soon as he drops them as well and they all start laughing, and seconds after one of them is laughing at him and ‘his new iPhone in a bag’ or similar - couldn’t quite make it out but definitely ‘new iPhone’ is mentioned while mocking the guy.
      If they had baited him into thinking they had his phone i think it’s understandable he comes back to (non-violently) try to get it back, signals his friends when he realises he’s about to get jumped, and then fears for his life when the punches start coming.
      If the phone theory is not correct, or it’s proven he did actually hit the woman first before they jumped him, I reserve the right to delete this post and pretend I agreed it was murder all along.

    Hi and thank you Mr. Tragos, I enjoyed this stream and the way you covered the situation. I avoid just sitting down every day to watch the news. The reason for that is, every day it is filled with how many people died and how they died = crime & drama. I like seeing the court cases, learning both sides unfold and hopefully the truth comes out. Well as sure of the truth as can be.

    I’ve been to the Apple River many times back in the day-always a party spot with lots of underage drinking. I thought the defense did a good job with the witnesses. Wasn’t real impressed with prosecution opening

      I have yet to see a family go down this river I used to go there when I was in high school and there’s no way I would take kids there, so yes I agree it is a party place and most people are drinking. there is another river not far from there that most people take families with that’s not so rowdy

    Dependent is being over charged. Alcohol played a big part in this incident with everyone involved. Not a defense but I’m having a hard time believing that drunk minors can remember everything clearly. Sad tragic incident, but not murder. Fortunately he has a good attorney

      @@CMpuffin In WI 1st degree murder is what most states called 2nd degree murder. No premeditation is required, merely the intent to kill. Given that he stabbed one man in the chest and eviscerated another I see clear intent to kill. So the charges are correct in this case. It's self-defense though and the jury will find him not guilty. Even his lies after the fact aren't enough to overcome the video and the testimony of the victims. He might have thought he was guilty but he isn't.

    There were 18 people screaming and threatening him, he was looking for a cell phone. They keep saying he punched the woman with his right hand. Not possible he had the knife in his right hand, she would have been cut. She didn’t go down either. 18 to 1 like it or not, self defense

Whether or not they could have left him alone, he can leave, or he can talk shit back. In the end, he punched a woman who was trying to de-escalate the situation, and then stabbed multiple people, resulting in one homicide. This guy is not the one to defend lol.

      @@serpenteye12 There is no proof, evidence, or video of anyone being punched. Although there is video of everything else. One witness said she was punched, then changed to slapped then… or pushed… and she fell in the river. There is a video of the woman still holding her drink and her cell phone with not a mark on her and dry as a bone. When he was shown that footage, he said maybe she slightly stumbled. Then another of the group said it was the other woman.
      I strongly suspect it was a very quick whispered story they concocted on the spot after the incident, to justify why they all attacked him like rabid dogs.

    I would have feared for my life as well. This Coldfield guy started this whole thing and got all the others involved. This Coldfield guy is not a good witness and changed his story like alot of them did after the fact. Why in the world would the older man say he was looking for little girls .       IMO Miu was calling the teens "little girls" and his dark humor was not understood but was instead twisted back against him. Doing so provoked his anger to the point that he charged at them, and things escalated from there.

    This is absolutely self defense. Imagine you were in his shoes. One older guy with a large group of younger, fitter guys surrounding you, taunting you, screaming at you, and then pushing you down into the water, hitting you, not one but multiple times? And you wouldn't be in fear for your life? You've got to be kidding me! They didn't know he had a knife, that's the issue. Who knows what they would have done if he didn't get his knife out and fight back. He was looking for his snorkel. They called him a pedo and rapist, jeered at him, taunting him, and they were drunk and high and I cannot imagine a better self defense case than this.

      He was being asked to leave by two females when he punched one of them and stabbed the other. This took place before anyone threatened or touched him

      No he had already pulled knife on video before ever got punched and he had left and came back to group more than once why did he come back? Yes kids were drunk being idiots but he is an adult and should’ve just stayed away from them why approach them once hollering?

    Im just hearing about this case as well and VERY HAPPY you are covering this ! Although very early in this trial , I am ABSOLUTELY thinking SELF DEFENSE right now ... Seeing that video clip , i wanted to CRY for the defendent seeing A MOB of drunk and stoned young people gathering around that man the way they were ,,, ABSOLUTELY SELF DEFENSE IMO

      @@NoFear69262that’s not what happened lol. Old man was minding his own business, got bumped into when he was looking for a phone under the water and was asked by the teens what he was doing. He said something?? I don’t know exactly. and kids began yelling “he’s a pedo” “rap3r” “looking for little girls”, then that provoked the man to come over. It is said in an opening statement that Niko approached the kids, thinking that the phone that was being held up was the phone he was looking for due to it being in a water case and was being teased, hence him trying to reach for it of some sort¿ Im not sure how much i believe of that but, they swore an oath lol gotta have to believe it whether you like it or not i guess pfft

    Excellent coverage once again LYK. I am new to this case. I am already getting a sense of young males drinking and smoking some weed thinking they can "down" an older guy with taunts. I can see the dawning realisation on this witness's face of what horror they were conjuring up. A horror born from a terrible mixture of innocence, immaturity and cruelty.
    Now their friend is dead.

    I like when you cover cases of “regular” people like this in between the high profile/celebrity cases. It gives a nice variety and expands on different jurisdictions and how it varies from state to state

    These teens were drunk and high and feeling invincible. They were also looking for trouble. This guy wasn't bothering them at all, and they decided it would be fun to pick on him. It escalated and they began to get aggressive in their actions and their words. They were saying disgusting things to him that were absolutely untrue. He tries walking away more than once. The other group decides to wade over and butt in on something they had no clue about. The videos had ME upset, the way they were all screaming at him, surrounding and taunting him, acting like a mad mob. 13 against one, they shove him and hit him and he falls down. Then they are surprised when he decides to fight back? This was absolutely self defense and this group of "boys" started the entire thing. Any person surrounded by this mob would have been fearful because they were all behaving like mad dogs. It's sad that someone got hurt, but what did they expect would happen, taunting a guy like this?!! I would find him not guilty because they instigated the trouble and escalated it until he felt like he was in trouble. And for what? Because he was snorkeling, looking for a lost phone. I feel bad for this man.

      Use your brain...they assaulted him first (when they pushed him down into the water). As awful as this situation turned out for them, he was outnumbered and they are at fault.@@fatee5069

    I have so many cases I am following at the moment that when this video popped up I didn't watch it but I accidentally came across the video. Now I am invested in catching up, I believe based on the video alone that it was self defense, gonna watch the trial now to see if my opinion changes upon hearing the evidence.

      Also, if he was looking for little girls and u don't have little girls in your group he's no threat to u therefore no need to engage, call the police if u feel the need to prevent a future CA incident

      Agree. A couple of the kids were being fools. The two who came to help the kids were not doing any naw calling. They were being really good citizens. I’d love to have neighbors like them all around me.
