Apple River stabbing trial: Witness says Miu 'defended himself'

  • Ariel Chaguez Leyet took the stand to testify in the Apple River stabbing trial. Ariel was part of Miu's tubing group on July 30, 2022.
    Ariel testified Miu's wife said Miu was in trouble, so his girlfriend told him to go look to see what was going on. Ariel said he walked downriver toward where Miu was. Ariel testified he saw Miu getting bullied by a group of young people, who were hitting him and threw his snorkel. Someone then pushed him down and hit him but then Miu "defended" himself, Ariel testified.

      This guy was the worst witness so far, apart from the guy who took the second, blurry video -- but that one was epic and is truly in a category by itself in the bad witness hall of fame.
      We can't have been watching the same guy. He said "no recuerdo" more than anyone I've ever heard.

      Do you think deadly force is an acceptable response to verbal bullying by drunk teens? Watch the Video, yes they were being obnoxious, but he came across the river to them, he engaged with them physically, he started the 'fight' and proceeded to slash. Based on what I have seen so far I hope he is convicted. There's no explaining why he needed to come towards them if he was in fear of his life. Approaching teens with the idea that 'I can defend myself with deadly force if I'm bullied or offended' is sick, that is school shooter/ terrorist mentality.

    What we have to take in account..is how many men in their 50s that’s out of shape, had a passed heart surgery goes looking for trouble on a rafting trip…
    The two groups that encountered Nic..were all drinking heavily self admitting..so you do the math…it was not smart what Nic did, but he was being bullied, and cut off from his group..I’m siding with Nic..

      Everybody is drunk and almost everyone don't remember anything clearly. Everyone is lying. Nic had multiple opportunities to leave and was told to, he stayed for the party. His decision was made by anger, not fear. If he not had a knife on him, he would have no choice but to run. Which probably would be 100% success rate, even the women were there to help him. The fact that he had a knife, made his decision to stay and use it, even though he still could of just ran away. He decided to use the knife, using deadly force should be last resort.

      I honestly don't think this case should have gone to trial. I suspect that a grand jury is the reason this went to trial, in which case the prosecutor has to take the case. That might be why his work is lack luster in this case.

      @@phukuhu7310 prosecutors, it is said, can get a grand jury to indict a ham sandwich. Grand juries are notoriously swayed and influenced by the prosecutor. If they indicted him, it was because that was the result the prosecutor wanted, for whatever reason. fwiw, my sympathies lie more with the defendant. It sure sounds like he reasonably felt threatened by a mob of angry teenagers and young adults, especially with his heart problems.

    but as the trial unwound, and after hearing from these witnesses, I believe the defendant!

    Wisconsin Statute §939.48 establishes that a person is allowed to threaten or intentionally use force against another person for the purpose of preventing or terminating what they reasonably believe is an unlawful interference with their person by the other person. A person can intentionally use only such force or threat thereof as they reasonably believe necessary to prevent or terminate the interference. Self Defense was necessary against the 13-1 odds.

      There is no reason why he stabbed Riley.
      If you watch video she is off camera about 3 meters from him.
      He gets up walks 2 steps throws his life in that direction next thing u see Riley walking away from him looks down and realizes she got stabbed.
      MUI is walking away with charges there is no question.
      And Issac was last to be stabbed and he died. Why did that happen.
      We havnt even got to that part which is the biggest charge MUI has.

      He incited violence, but all the teenagers and young adults did. Miu made some significant mistakes, and this includes lying to police and trying to dispose of the weapon, but what they did was exponentially worse. If he had not used the knife to defend himself, it's reasonable to claim they would have started holding him underwater.
      AJ pushed him as hard as he could, and that is what actually caused him to be disemboweled. The teens, young adults and even the parents lied repeatedly. Their sworn statements contradict their trial testimony, and the video contradicts both. That makes them guilty of perjury.

      No, the female that was stabbed was several steps back behind him, he literally had to take multiple steps to get to her, and one boy was coming to help deescalate, and gently pushed his arm saying “break it up” trying to push him away from “punching” the kids, what he thought was happening, and he was stabbed as well. As was ANOTHER boy who didn’t put his hands on him at all. Only 3 people who were stabbed touched him, one of which was non violent telling them to break it up. But ok bro.

      But a man who got his feelings hurt and charged at them and grabbed them, then turned around while everyone screamed at him to leave and go away and walked back smiling getting up close to them, because if you watch never once did they come to him, he came to them, smiling the whole time like a crazy person almost like he was waiting for someone to hit him so he had an excuse to stab them, and when they didn’t he decided to throw the first punch-THAT is wanting to start something.
      Also only 2 of the people stabbed were aggressive to him, out of 5. He had to take several steps to even get to the female he stabbed, and she was shocked he “hit” her at all because she was not in his face or being aggressive to him, she was standing back several feet away yelling about him hitting a female.

    I went into this case thinking one thing, through the testimony it becomes clear that he was SCARED. And he had every right to be...... Yes, he went at many people, with such deadly force... But at the same time, I could imagine my grandfather, with PTSD, being surrounded by shouting drunk people, not in the best health, being pushed down toward the water, he'd be deathly afraid too!

      Video proves it. Statements taken from the teens by law enforcement at the scene proves it. One of the teens parents even tried to help the man by sending his son over but instead the kid incited violence into the situation. Yes it is 100% self defense because how can you be telling someone go away when you’re following, blocking them off and your redneck from yelling in the man’s face is sticking far into it. I’d have pushed her too especially after saying don’t touch me. That second time he walked away, had he just kept walking and not went and tried to get Maddie's face, none of this would ever happen. But he walked over to get Maddie's face and then as she screaming at him to just go back to his group he pulls his knife out and start smiling. That's not the look of a man fearing for his life. Why would you keep going back to where the teenagers are if you're so afraid of them

    Kid with the camera started this then instigated the situation. His friends followed his lead. I think after the second group got involved it was a mob mentality. And started getting physical.     At the end of day none of us can even imagine what it would feel like to surrounded like that. Punched causing you to land in the water, then hit repeatedly and being pushed down while in water after being hit…your mind and body almost go into an alternate reality. That’s why Nic’s eyes look crazy when he stands up, his mind is trying to process what’s happening while his adrenaline is pumping beyond comprehension. Should anyone have died, no this escalated out of control. The kids should have just left him alone and ignored him. The jury has a very tough case.

Or that he hit her in the face because she demanded he let go of their intertubes - which he was pulling upriver. FACTS: The guy was angry at being called names and continued to engage with the group, hit the woman, got hit back and pushed into the water, then got back up and began stabbing people with a knife hidden in his pocket. This is the sequence of events in the cellphone video. He then walked off, hid the knife in the woods, put on a jacket, hat and sunglasses and tried to leave with his group. This is what the police body cameras show. Now, he says it was self-defense and he was sooo scared. Really?

    Unless the Prosecution brings Maddie to the stand to testify what happened and her side, the jury should be Hung, because everyone’s testimony up to this point is that it’s the moment she said he hit me that everyone attacked him and he is the supposed initial aggressor. Sorry yall but until her testimony, it’s clean cut bullying and attack on him and he reacted with frightful self defense!!!!! Cant look at opinion can only look at THE FACTS and the video, it shows and confirms everything stated by witnesses except him hitting her and the initial start of the “drunk teen and youngsters” attacking him.

      @@phukuhu7310 I agree, in the video you see everyone put their hands on him and the aggression towards him with him not saying a word, nor moving fast or touching anybody else, until he gets punched, and then more so when he gets pushed down, and on his way back up when people are still rushing him. I do believe the reason why they’re not bringing Maddie to the stand is because it’s going to be detrimental to their case when she has to admit that he didn’t hit her, or she will get up there on that stand and commit perjury, if none of that is the case, then they would have her testify, keep saying that she testified off camera, there’s nothing special that would require her to have to do that, and if that is the case, then, at this point, there’s a hidden agenda somewhere where they’re not wanting to show the public that, even though they have brought every other witness, and every other witness has had to testify on video, live streaming.
      Like they want to instigate an uproar, because everyone will do a trial by media first, and if he found not guilty, flip out, because the person that died was under the age of 18. SMH this is why there are rules to our justice system. This is why nobody has really heard of this case until the point of trial because of all the evidence and they didn’t want trial by media. But it looks like the media has made up their mind, whether guilty or not, and only showing what they want the public to see to get that outcome if it’s in fact, true that she testified off camera

The perpetrators even recorded their dumbasses harassing this guy and the video shows everything anyone needs to see. Just show a jury the video and let them decide. It won't take long to make a decision. The prosecutor is literally acting like the video does not even exist.

      One of the first points I made. If he were black, the teenagers, young adults and the parents would have spent the last 2 years laying low and being constantly cited by the left as despicable racists and all the rest of the bullshit they constantly push on society.
      If he had not used the knife, it's reasonable to suggest they would have started holding him underwater. Their strikes were getting more and more aggressive and powerful with each attack, and even after 2 had been stabbed, they continued to attack him because they were so lost in the bliss of the moment in abusing this man that was surrounded by 13 people. Even the young men that went over to help decided to assault him, and they also lied. He never hit the girl which the video proves. The idea that he could punch her in the face while holding the knife without their seeing it is only less ridiculous than their claims that he slapped her while holding the knife in his hand. All of their sworn statements claimed it was a slap, but when they saw the video and met with prosecutors, this was impossible, and they all changed their stories saying it was a punch.
      *At the point the one says "he hit a girl!?" mocking and taunting him, this is when they all claim he had punched her, but he had actually stabbed her, and even she thought she had been punched so they all rolled with her reaction to saying he hit her.* When the police arrived, her first words were "he hit me!" because they were relying on this lie as a cover story.
      It's absurd that people are believing them and arguing this in the video comments.

    It seems like many of you haven't followed the case at all. There's no proof that he hit any woman. Several of the drunk and high teens also called him a pedophile. Does that mean he is without there being any proof of it? Hypothetically if he did hit her that doesn't make it legal for several people to assault him. As a bystander it's legal to defend someone but once the threat is no longer a threat it's not legal to continue assaulting them. After he was pushed down he was no longer a threat to the woman he supposedly hit. You have to take each person as a separate incident. The guy in the orange swung at him after he was already in the water and had already been hit multiple times. He wasn't protecting anyone. He was assaulting him. It's a tragic situation and there are many things on all sides that could have prevented it. People need to learn what can happen when an angry group/mob corners and attacks someone. What are the other possible outcomes? The guy in orange hits him and/or others hit him knocking him unconscious and he drowns. They beat him up possibly putting him in the hospital and the video goes viral that a pedophile was beat up. That could ruin his life and put a target on him.

This was when they say leave which is what he was doing. You can’t push someone to leave in public area that’s not in your personal space and ontop of that he was leaving.       Ariel is not a great witness for the defense. He was seen watching the trial while sitting outside the courtroom. He also claimed to remember a lot more during his testimony than he did when speaking to the police officer back then. That’s why the prosecution asked if he was told not to watch the trial by the defense and he lied and said yes. During the break before he testified, the defense even admitted that they didn’t tell their Spanish witnesses (Ariel & another guy) to not watch the trial, which every witness was supposed to be sequestered. He can be charged with perjury for lying under oath.

    It’s sad it had to escalate to this point. But following this trial I personally would find him NOT guilty. The teenagers fed off each other and not in a good way. It’s sad not one of them had the guts to say stop let’s leave him alone. But they were all drunk and high. Actually I’m not sure how far they would have gone. Started out name calling to surrounding him and then hitting him. I personally would have been horrified .Curious which teenager was the first one to start the harassment .     I think all parties were wrong in this situation. But as some one who tubed my local river many times in my late teens early twenties, neither my friends or me would ever treat someone like these young men did to Mr.Miu, screaming he's a pedophile looking for underage girls is akin to calling for a lynch mob. My group of friends were for the most part burly dudes that didn't start shit but sure as hell would finish it , we had respect for everyone until someone proved they had bad intentions . This current generation has no respect and no morals. Look at how the boys acted after they realized their actions resulted in many injuries and the death of their friend. They were still filming and already assuming their friend was dead ( which he probably was since his heart was sliced). Mr. Miu should have tried to joke with the boys or something instead of being kinda weird and silent, he could have just said he was snorkling for jewelry and his friends cell phone. The whole scene was filled with intolerant grown children. Also when are women going to get the clue that you dont confront men get in their face and expect them to do as you say, like it baffles me that they don't realize it only escalates things. SMH

    Some of the questions that need to be asked in this case is if the group of young victims felt so threatened by Nic when he came over searching for the phone in the water….then why did they not:
    A) back away, move away, or walk the other way, and
    B) if they felt threatened why then did they continue with the altercation? why did they continue to instigate and make the situation worse? Why did they toss his goggles into the water?
    Because normally a person who feels threatened does not shoot a video of what’s happening or continue to call the aggressor names to lead to a situation which is even worse……they were obviously not threatened and felt empowered by the whole thing. It’s sad what happened and maybe he could’ve walked away…..but they could have easily withdrawn themselves from the situation….instead of suffering the knife wounds and a dead friend as a result…..this doesn’t excuse the stabbing but their awful behaviour shouldn’t be excused/dismissed either.

    I can't believe of all the people involved this man is being charged with first degree..there was no intent here...the only thing i have witnessed is a bunch of brats trying to show off ...i laughted when the lawyer asked her how much she weighted...if you even seen a drunk girl in action run run...its the brain that reacts ..not the weight...she got involved without even knowing the situation....who calls a man ..don't even care of age....a raper...a pedophile..looking for little girls....that alone would be enough to make someone scared.. makes me wonder who the hell raised these young adults...i think of Rambo ..she drew first . The hitting and shoving was scary to watch ,yet alone be him....if this man is found guilty ...we should all lock our selves away....one gets a warning yet more get stabbed....you would have had to be in very close contact....i feel sorry anyone had to get hurt ,lose their life...but the facts are as plain as the i can't remembers.❤

      I would agree with you: except for the fact that Nic made some very dumb statements to the police after he was in custody. A juror who wants to find him guilty will latch on to that and will be difficult to convince. Idk how you explain making up a story to the police that has every single material fact wrong.

    The guy said they were drowning him, pushing him down and the interpreter only translated the pushing down part, not the drowning part.

    I had completely different opinions when I saw the stabbing video, but after seeing the young kids harass, bully, and assault him while he was just older and looking for a lost phone with snorkeling gear, convinced the defendant did not instigate. He should not have killed, but as also a younger idiot in my days, these kids and especially the one recording should take responsibility for escalating.
