Absolutely! The interpreter missed crucial details on the witness emotional and mental state as well as details about opposing parties. Also, having a Spanish speaking police officer conducting the interview is not sufficient nor does it allow the witness to have an objective person there to be neutral. Why on cross for the defendant did they not throw out that evidence about the interview conducted by the Spanish speaking police officer.

One thing this case showed me is that people who question weather the Idaho 4 could have been killed by knife in the 12 minute window, the answer is yes. In this case this guy stabbed 5 people right in front of others, and they didn’t even realize it until after they were all stabbed. Took only 10-20 seconds.

I still believe that Miu is guilty. The force he used was not appropriate. His behavior aroused suspicion in the teens. Why does a 50's individual act like that? I am 69 and would never have acted like that. Very immature of Miu. I am sure the State will make mince meat of Miu when he takes the stand next week. Miu never stayed behind to tell police he acted in self defense. He lied and said the teens had a knife. The way he acted while in police car. He knew to put on his shirt hat and sunglasses but in the police car he acts clueless. Unbelievable.

I find it interesting that he didn’t say anything the entire time the video is recording. He could have walked away. He wasn’t in a contained room. When I look at the taunting and bullying compared to one killed and at least 3/4 seriously injured, it just doesn’t seem justified. I wonder what the jury will think of him not saying a word during the altercation. His behavior after the fact is insane. Ditching the knife. Not telling his friend group what happened, and then straight up telling the police he heard someone got stabbed and he matches the description?! How much man power was used looking for him that could have been used in aiding the victims? Interesting SD case and extremely heart breaking.

LISTEN TO THE AUDIO in the beginning of the video! Jawahn is so loud being next to the phone that it's difficult to hear, but when he yells "what are you doing?", one of the teens says "HE LOST HIS CELL PHONE!" Jawahn then taunts him with his new iphone and makes it appear that he has his phone, which then he heads back to the tubes to get it. Drops his snorkel and tried to retrieve it. Then Jawahn LIES and says he's looking for little girls. All Hell breaks loose and they all think this is funny....until it's not. The entire attack lasted less than 20 seconds.
You can hear them say he is looking for a lost phone! LISTEN. Pay attention. Listen to them without watching. I'm wondering if that missing part of the video was intentional. There were also other phones video taping. We have not seen the other videos.

And he knew the whole time that he had a weapon, which they didn’t know, and he used it discreetly and did as much damage as possible to as many kids as possible.

Might have worked, but when he came up swinging, he might have been really fearing for his life, and not in a position to make a reasoned assessment of the situation. 6. Irrelevant to whether subsequently when he was in the water being whacked and pushed he felt he was in danger. 10 in a 10+ v 1, you expect the 10+ to have a good enough conscious to collectively come up with the right decision, and they didn't. you can’t rely on one person to make the right decision. He was ridiculed, harassed and assaulted beyond what most people can tolerate. He also had a heart attack with a triple bypass before this, so I don’t doubt he feared his life. They had no regard for his mental capacity, and that’s how it got to this level of extremity. The outcome is very unfortunate especially over something so irrelevant, but I guarantee you Miu would not have gone on a random stabbing spree had they not triggered him to do so. I wasn’t understanding of his side at first, but I simply cannot stand behind individuals who said while assaulting him that this was “for the culture,” which they claimed meant “greater good,” when the greatest good would’ve been to call the professionals trained to handle “rapers” if they had felt any sort of unsettling feeling of him “looking for little girls” (in which they also failed to mention what i assume would’ve been an important piece of context to police or in the report). One persons guilt doesn’t define the rest of their innocence. All, including Miu, should be charged.

Several items that stand out as not self defense, but 3 main items.
Self defense has to be that you fear for your life being in immediate danger, and have no choice left but to use deadly force.
If he feared for his life, then why did HE refuse to leave when everyone else was asking him to leave, walk away from the situation. That was his obvious no violence choice, just walk away.
2nd, using a 2 inch knife, yet he gutted one kid with his intestines spilling out, the girl he plunged into her diaphragm, etc and killed the last kid. That takes a lot of force, and deliberate upward motion to inflict as much damage as possible. He wasn't wildly swinging or slicing, he was plunging the knife deep and upward. That is intent to kill. Which makes it seem like rage, not fear.
3rd, He lied to police and claimed the boys had assaulted him trying to pull down his pants, and they had knifes and we're threatening him; that he had no knife, and had no choice but to defend himself.

on him were stabbed. I am sorry that that boy died, but that boy had his hands on the defendants throat. The video doesn’t lie.

Didn't the defendant initially walk over and stop the boys' tubes as they were floating bye. Im going to have to go back and watch that young mans testimony and watch the beginning of the video. If he did, Initiated contact, he's guilty. He had time to ignore the chattering and head back to his group. I also believe the states attorney isn't very good. Very choppy questioning and seems not very confident. I get the self-defense senerio, but i feel the defendant had multiple opportunities to get away.

He actually after stopping the boys walked away then went to the 2 girls/women. That dude is missing something. I get getting pissed off but you also cant claim the women were in his space when it was him that approached them. He even admitted pushing Madison(2nd initiation) but I really think he did punch her. Either or, that set off the events. Several people not even involved in the altercation also said they saw him punch her

      Why???
Several items stand out as not self defense, esp 3.
Self defense has to be that you fear for your life being in immediate danger, and have no choice left but to use deadly force.
If he feared for his life, then why did HE refuse to leave when everyone else was asking him to leave, walk away, from the situation. That was his obvious and easy no violence choice, just walk away.
2nd, though using 2 inch knife, yet he gutted one kid with his intestines spilling out, the girl he plunged into her diaphragm, and killed last kid. That takes a lot of force, and deliberate upward motion to inflict as much damage as possible. He wasn't wildly swinging or slicing, he was plunging the knife deep and upward. That is intent to kill. Which makes it seem like rage, not fear. And no need since after initial reaction to his striking a female and coming to her defense they were already backing off and yet the guy that was telling them to stay back even got stabbed.
3rd, He lied to police and claimed the boys had assaulted him trying to pull down his pants, and they had knifes and we're threatening him; that he had no knife, and had no choice but take away a knife from one of them and defend himself.
If not for the video, his story could have ended up being believed, him the sober adult vs drunk teenagers.

I looked up self defense, came across good explanation.
Four elements are required for self-defense:
      (1) an unprovoked attack
      (2) which threatens imminent, immediate injury or death
      (3) objectively reasonable degree of force, used in response
      (4) an objectively reasonable fear of injury or death.
      Using the above,
He hit 1st, and those present reacted in defense of the female he hit. He provoked the actual physical reaction.
And 3, they hit and slapped him, while he used deadly force and was the only one with a weapon. He went for vital organs (intestines, diaphragm, heart). With a 2 inch knife that took force to deliberately cause as much harm as possible (including upward thrust which causes maximum damage)

He then proceeds to strike the woman in the face and stabbed another. What ever the teens were saying or yelling or laughing NEVER gives the right to hit and stab. WALK away or ignore. Very interesting session! Years ago all courts did not have certified interpreters and translators. Some courts, especially those located in smaller communities or rural areas did not have many available for legal cases. Thus, the only available native speaker(s) would be hired, For example, a local foreign language teacher may be hired. Total accuracy was not always achieved.
Thankfully, there are now certification standards, training etc. to ensure correct translations in the foreign language.in the courts. Plus, we have a
large number of people who are fluent in a wide variety of languages in the US.
There is definitely a growing need for a wide variety of competent court interpreters and translators.

I'm a disabled veteran in my 50s with decades of martial arts and hand to hand training, including a good amount of full contact experience. I can tell you that if I have any chance of winning a fight, I have to do it fast because I will not be able to get my strength back during a fight.
I can also say, and I've trained and proved this a hundred times, that any two people with fighting skills working together, can defeat almost anyone. Simply kicking feet toward each other and stomping ankles can make a superior grappler lose.
Fighting two people in shallow water is suicidal. As an older man, you can't get back to your feet repeatedly, and laying in the muddy water it's impossible to defend yourself. Once he got back up, it was life and death for him to stay up.
Instinctually we know you can't run from a group of predators, it will encourage the chase and you will be taken down and overwhelmed by the more confident predators. If you have them afraid of you, running is going to quickly end thier fear and resume the attack.
I haven't seen the whole video, but I saw just the part with multiple big fit men pushing him down into the water, and I saw the man charge him when he got up and was backing up. The first stabbing was the only reason the old man wasn't back in the water being pushed under.

This is a really interesting point. I keep trying to imagine what it would be like for me to be surrounded by 13 people less than half my age. In murky water up to my ankles/calves. If I’m in my 50s, not in superior shape and with a serious heart condition, I’m probably terrified beyond belief. Once I go down one time, then get put back down again, my fear is through the roof. I’m really disturbed that this happened but some people seem to be ignoring the reality that being surrounded by 13 people all ridiculing and taunting you would put anyone on the defensive.
The defense has a really effective exhibit which provides a birds eye view of where everyone was standing at the height of the altercation. Once you see that exhibit it becomes hard to maintain that he could have just walked away.
To the person asking about the girl he allegedly hit, I have not heard any clear evidence that she was ever hit. And unfortunately, the teens recollection of this is not consistent and is getting more and more confusing. The defense is doing a pretty good job of creating doubt that she was “punched” at all.

I’m going to respectfully disagree after seeing several pieces of evidence and testimony. Why that particular area to search for the phone and stay there? Initially he is seen forcefully pushing the kids tubes which could be seen as a threat to the kids. He didn’t say anything of why he was there. Another threat to the kids. The kids yelling posed a threat to Mui. Their fear response to his actions. He did initially have the opportunity to leave and forget about looking there for the phone initially. The kids who were seen just trying to tell him to leave with no force were stabbed , which looked to me like an irrational impulsive response. In the moment, he was in fight flight response , specifically fight. With the knife. On the video there was no threat for the subsequent stabs, which were more like gutting. Excessive response IMO. As a reasonable potential juror I would say guilty . At this point. He also lied twice. Telling his friends the kids took his knife, and telling police he heard someone got stabbed. That says he is hiding something. Looks like he froze and went straight to fight mode. Not rational mind. Let’s see what the defense has … my opinion may change.
