Now that Hannah Gutierrez has been convicted of manslaughter, what does this mean for Alec Baldwin’s case? He filed for dismissal of the grand jury indictment, arguing that the prosecution gave improper jury instructions, acted in ]bad faith, and failed to present exculpatory evidence. It also came to light that Baldwin was offered the same plea deal Dave Halls was but the prosecution withdrew the offer ten days before Baldwin’s deadline to accept. The court ordered and ruled on the proper instructions for the Grand Jury. I am interested to see how the prosecution responds to this voluminous motion.

every one who cheered on the prosecution of that stupid child while not questioning the "cart before the horse" aspect of that trial should pat themselves on the back for helping get Baldwin totally off the hook , motions aside once they get people in there and start selecting jurors it will become aperient that no one is interested in holding Baldwin to account the public has their scape goat it is over time to move on.

Please don't do a sponsorship with Lomi again. Their products are at best a waste of electricity and material, and at worst greenwashing. It's an expensive product and waste of plastic and electrical components (and the electricity it uses) that can be substituted by just composting in the first place. The dehydration the device does is pointless if you're just throwing the "processed" waste into an environment that is inherently humid, like a compost or green bin. They even have lists of foods and "lomi approved" bioplastics that can go into the device, practically admitting that it can't get the job done on anything else. They don't mention this anywhere in their advertising either. This concept has been tried before years ago and most have failed. Lomi isn't doing anything substantially different to others.

I try and stay neutral in trials I’m watching. In this case I can’t. Anyone who picks up a weapon should check and clear it. Baldwin being an actor should know as should all actors. Especially after the Brandon Lee incident. Last person to handle a weapon is more responsible than the first. In my opinion.
Baldwin can't be guilty by virtue of failure to personally check the gun because the prosecution`s own expert armorer said that actors are not required to personally check the gun and that such a safety check adds nothing to safety. The state can't use that argument once Bryan Carpenter said what he said in court.
That’s why Jennifer Crumbley was convicted, right? The jury said they believed she was the last one to handle it, therefore she was guilty.

This one was a little bit more difficult for me to follow along with Emily but thank you so much! I have to say having watched all of Hannah Gutierrez- Reeds entire trial with you, seeing her initial reaction after Helena ( full of panic & sadness) was shot and the immediate reaction of Alec (with whom I suspect or believe was his attorney) In and it's my opinion he has culpability here. It's not an abuse of the system, a woman was murdered. Taking all emotion out of any of this, I do believe that he is responsible too. I thought Mr. Carpenter said feet away from the camera to the side. Besides lying to the FBI about not pulling the trigger.
Mailing loaded guns is wild. I’m surprised that didn’t come up in her trial. Blanks or not that’s dangerous. I’ve seen how packages get yeeted around.

I'm amazed that I watched the previous 5 hour video about...legal motions. But you make it so interesting, Emily! Kind of like law school lite. Not that I'd be able to get into law school, graduate, or pass the bar.
As a citizen, I'm troubled by the fact that it's legal for a grand jury to indict without exculpatory evidence being presented. Why? It doesn't seem fair. Is this the case in all states? I honestly wonder if the grand jury understood what the target letter was about. It's not the most intuitive thing.
If I'm ever on a grand jury, I'm going to want to hear exculpatory evidence!
I agree, grand juries are a easy way to get a indictment in the first place but after watching this and other breakdowns it seems pretty clear to me that the prosecutor was intentionally stearing this one away from any and all exculpatory evidence and witnesses every time a member of the jury asked a relevent question.
The bar needed to get over is much lower in grand jury cases - it's not 'beyond reasonable doubt' - its a preliminary case - the actual case is the trial.

It was a fear of mine that all the responsibility would fall on Hannah & nobody else which is unfair. From my recollection Alec was the one that went on national television and told everybody that he didn't pull the trigger. We saw differently. An abuse of power or the system would be a wealthy celebrity getting away with murder
Had to have his "hero toy's" as real as they get, caulking the hammer back and pulling the trigger we saw that in the trial too. And although the FBI broke the gun, they know and come prove that the trigger was pulled. As I mentioned above, Mr Carpenter talked about how you point feet away from a person that you were going to shoot.
Doesn't matter... He pulled the trigger and pointed the gun. So if I thought a firearm was "unloaded" and did the same...I would be charged...

No, she didn't.
She did not. However, this grand jury pool had already conducted multiple grand jury sessions, all of which have the same rules, and it's possible in trial one for the pool, there is a blanket "here's how you grand jury" instruction.

They get a list of what they can hear as testimony. If it makes no difference, they don't want to sit through it.
@@toomanymarys7355 my point is the prosecutor sets the tone and if they treat the other testimony as unimportant of course the GJ isn't going to waste time on it, see what I mean? I'm not a big Baldwin fan but I don't like our system sometimes.

Baldwin's argument that he couldn't be a proximate cause because he had no knowledge of the live bullet and therefore couldn't have known he was a risk to harming HH is BS; Brandon Lee died from a malfunction related to a dummy round misfire with a gun aimed directly at him. Hollywood knows better. He's worked on "lots" of sets. HE knew better, especially rehearsing an unscripted action. HG's error is not fatal if Alec doesn't also act with carelessness.
Seems unlikly they would refile, specially after the plea deal has been exposed if the present case is didmissed.

Do actors who are required to handle guns as part of their role have to undertake mandatory safety training? Otherwise how can he be held accountable for not checking it?
I'm not sure why they would be required to do that since it is the armor's job to check all the guns for safety before handing them to the actor........??
@@astrialindah2773 Yes they are required to take it, we saw that in HG's trial. ANYONE who handles a firearm, movie or IRL, MUST take training to legally handle one. The training demonstrates proper handling of the weapon to prevent accidental discharges, improper handling/goofing off, safe staging to prevent accidents like Brandon Lee, as well as what the armourer SHOULD be doing so they know safety protocols and routines for themselves.
Aside from training, as already stated, he can be held accountable because the first rule of gun handling is to never ever point a gun at anything that you don't intend to shoot. The gun should never have been pointed at a person, regardless of whether he knew anything about guns or whether it was loaded or not.
@@EmmyLovesMagicActors point guns at things all the time and everytime they point a gun they NEVER intend to shoot whatever it is they are pointing it at.
@EmmyLovesMagic Then again it's not an actual firearm it's a prop, they point it at stuff all the time and especially if you have people whose whole job is to check the gun for safety. And even so, there are rules if a gun is aimed at the camera to protect the film crew. So it's not the same rules one would have with a real gun, and it's why so many people are pushing after this incident to reform gun safety on sets.

I listened to jensens police interview. What it sounded like there was he said it was an actors responsibility to also check the gun but he wouldnt trust 99%of actors to actually do it. That letter is misleading
Jensen Ackles said he checks the gun however he wouldn't trust 99 percent of actors to do so. He said actors should not be relied upon to be the last line of defence. Baldwin isn't required to personally perform a safety check and this was confirmed by the prosecutor's own expert armourer who said exactly that in the Hannah trial. The grand jury might have been misled because the expert armourer said in the trial that actors aren't required to personally check the gun but the prosecutor told the Grand Jury that he was legally required to personally check the gun.
@@almac9203 Jensen also said that most armorers load the gun with dummies in their presence shaking it to show its a dummy. And that they both agree its a dummy. In my definition that is checking it with them though.
