    Scott Peterson was convicted of killing his wife, Laci, and his unborn child, Conner in 2004. The Jury rendered a death sentence. He appealed the case, and the California Supreme Court overturned the death sentence but was still deemed guilty of murder and was to remain in custody without parole for life. The LA Innocence Project has picked up his case, claiming new evidence that could lead to a new trial needs to be examined. I break down the new motions filed and an overview of the case.

      If he had done what he did in 2003, he would have got away with it.
      Neighbours cameras showed that Shannan and girls didn't leave the house.
      If no cameras, he could have continued to deny.
      No smartphones to find evidence of his affair.
      And if he never confessed, nobody would have known. Unless they found the bodies later at his workplace... but yeah, he could have got away with it.

    Laci was a beautiful human being. Not just physically. I knew her in HS, and even as a teen she was absolutely lovely - genuinely kind, funny, bubbly, and so sweet. Her personality was magnetic, and her smile lit up her entire face. When I first learned of her murder, I felt like a true light in our world had been stolen, because the world was a better place with Laci in it. I hate this. I hate that Laci’s family are being dragged through this again. I believe Scott is guilty AF, and should never walk free again. I pray Laci and Conner rest in peace. ❤

    Side note - thank you for covering some/more criminal cases! I know you started with pop culture/civil and originally didn't want to cover criminal cases or become a "true crime" commentator, but I love your approach. Being a former DA, you offer a perspective most legal commentators can't, backed by a lot of experience. And your approach to the heavy topics is appreciated. No sensationalizing, no pandering to social media.

      The innocence project is a JOKE.
      Every single criminal they parade around in the media has been hands down guilty. Some of whom have murd ered small children. Brutally.
      The founder starts his activism with OJ Simpson. They are a giant scam.
      They drudge up more pain for victims and parade guilty people around like martyrs all so they can elicit distrust in the justice system. They are anti-death penalty advocates and many of the people involved are prison abolitionists.
      They aren’t about “innocence”
      That’s just good propaganda in their name. They are explicitly advocates for the guilty, they just believe that monsters deserve to be released into the communities they have already terrorized so they can go terrorize more people again. They don’t believe in life sentences or the DP. They want to give the worst kinds of criminals freedom.
      They are a gross organization.

    I live in Bay Area, he had a lot red flags in my mind. Cash, disguise, brother's drivers license driving to Mexico border where he was apprehended. Showed up at a separate east bay boat launch area when police launched search and found her and baby but he said he didn't know they were there looking that day. Left as soon as he heard news police found her in the bay... lots of weird stuff going on with him. Cement blocks found in his boat..His demeanor was weird...I don't know. He got death penalty but CA stopped death penalty here sooo.. I think he did it but my opinion is just that. Sad case

      We didn't stop the death penalty, Governor Newsom put a moratorium on executions, that can/will be lifted with the election of a new governor. They can choose to extend the moratorium or lift it completely.

    This is just traumatizing the parents and siblings more. Which I’m sure Scott is okay with. Looking objectively he’s guilty.he was on his way to run when he was arrested. With a map to Ambers workplace. Let Laci and Connor rest.

      You are not looking at it objectively if I thought I was gonna be arrested and was innocent I would want to stop that from happening. The media decided his guilt there was no concrete evidence they only focused on him. I can't believe these comments on this channel it's not the first time I have been shocked. And as a member of this community you fail to see how the prosecution came up with their case???? You think it was all the MEDIA???? That makes no sense. It's not like anybody's claiming he's guilty when he hasn't been convicted. He has been convicted through the evidence that was presented by the prosecution. It is a shock that the Innocence project is even looking in Scott Peterson's direction. It is also right that any DNA should be tested. But the likelihood of it exonerating Scott Peterson is extremely slim. The case against him is rock solid. Actually it is at least a solid as the blocks of concrete that he had in his boat. No not everybody would act the way that he did if they were under suspicion of murdering their spouse. He dyed his hair blonde as an effort to disguise himself. There is no part of the story where I believe any exonerating evidence even exists regarding Scott Peterson's guilt. I doubt that they can even bring it on and sure they should have the opportunity. Not based on Scott Peterson's word. Based on science.

      @@Jenloves780do you understand how many defendants are convicted on circumstantial evidence? prosecution didn’t need “concrete evidence” so long as they proved to the jury, beyond a reasonable doubt, that Peterson killed Laci and Connor… you must not watch many cases 🤔

    My son was born at 32 weeks. He spent 29 days in the NICU but he is now a happy smart thriving and healthy 17 month old. Poor Connor.

      Baby Connor would be 21 now. So sad. I'll never understand if they don't want to be tied down and married, get a divorce. Not always simple but absolutely possible. To end 2 innocent lives for their own needs.

      My grandbaby was born at 31.5 weeks and left the NICU in 3 weeks.
      I just started working as a nurse in the NICU and have learned that there are now successful births as early as 22 weeks gestation.

    He called Amber during His Wife and Childs candlelight vigil and pretend to be in Paris! He dyed His hair, had cash and camping gear and his family members id. He was making a break for the Mexican Boarder! Does any of that say He's innocent?

      There was a discussion we were having with family. If there was nothing that he could say to the police because the police has already found you guilty and have indited you, I would be trying to get lost as well.

      @@janegomez1267 The problem is that people who run are always suspect. He could have stayed there and told his version of the story----they didn't just grab him and haul him into the precinct. Even if they did , they had a duty to let him speak. He should have immediately requested an attorney. He further damaged his case by taking off for Mexico. Running from the law is never a good idea.

    I remember when watching this unfold how the layers were peeled back and how much i learned about what a sociopathic man looks like. This and Mark Hackings murder of his wife. The facade cannot be distirbed without dangerous consequences.

      In my state Christopher Longo killed his wife and three young children the year before iirc, and he actually escaped to Mexico where he pretended to be a famous journalist for awhile before being identified and captured and taken back to Oregon. When Laci was murdered is was like the Longo case all over again

    Please keep covering this case!! I remember following the original case and my heart breaks for Laci’s family that they have to go thru this again. My cousin was killed by a serial killer & it took more than 20 years for him to be executed. It was so hard on my Aunt. She was never the same. I pray this gets resolved quickly.

      He will never be killed and the appeals will never end haha... So not likely ever gonna be over, even though its no longer death penalty. He was never getting killed in California. Mark Geragos that was his attorney! Anyways Peterson is guilty as hell. Innocence project making itself look blind is not a good look just to take every case. This case has no questions.

He acted like such a piece of shit after he killed her. He would stand off to the side by himself at the vigiles and searches. He never gave a fuck abt her and wanted his single life and pretend he doesnt have a kid. This is totally how murderers act when a kids coming... Cause thats really the end of your life.... And he did it in the 8th month cause he didnt wanna face killing a kid directly, so he just killed her and let it die as well. Were you an OJ juror? Lol

    The thing that made me sick was watching an old Dateline episode chronicling this case and they showed Connor’s nursery and it was nautical themed with boats and the ocean, come to learn that Connor and Lacey were found on the shoreline. SP is guilty and it’s disgusting that the innocence project is helping him. He is where he belongs

      I’ve thought the same thing about the nursery.
      And there’s no way that instantly becomes a storage room.
      It was said he spent a lot of time cleaning the pool while she was missing. I think he possibly drowned her there and then transported her body.

    I live in Modesto at the time, just a couple miles away. Police never followed up with my dad's boss who had a mail delivery (big rig) route from Modesto to Richmond CA. He said he saw Scotts truck pulling the boat on the freeway sometime between 1 and 1:30am.
    I believe police got the timeline wrong. I think he dumped her in the middle of the night, drove back, cleaned up, let the dog out, went back to the scene of the crime in case anyone placed him there, got his alibi with the receipt and came back. It's why his jacket was dry. He didn't even go into the water after he went back. He just went to get that time-stamped receipt.
    Unfortunately, my dad's boss has now passed away. Years ago.

      I always felt the same thing. He must have taken her to the bay in the middle of the night. There would have been no one around, he could have just put her body in the bay and no one would be able to see. That’s why when he went back home and then later in the morning he went back to his office he had time to look stuff up on his computer, put together his tools then hook up his boat and go back down to the bay to get a receipt and when he put the boat in the water just did this so people would see him.

      All the "so-called" "witnesses" say they saw laci with a white top and black pants which laci was wearing khaki colored pants when her body was found... their accounts directly contradicted the evidence d​@user-kv8po4er2j

    I am from the Bay Area and remember seeing this case on the news every day. After Amber Frey’s news conference, Scott was considered scum of the earth and we all believed he was guilty of murder. To this day, I still think he’s guilty but if the LA Innocence Project has evidence to prove otherwise, then he deserves to have another day in court.     If he was so innocent, why in the world did he do everything to prove otherwise. Forget the circumstantial evidence. It was his very own actions from the day Lacey went missing that showed his guilt. I feel like he sentenced himself with his actions.

      @aok4418 I'm so sorry you don't like my opinion, but it's my opinion. Scott acted incredibly suspicious and told a lot of lies. He literally told Amber his wife (LACI) was dead when the world was still looking for her. Sorry, but I stand by what I said. Scott's behavior made him look guilty even if he wasn't. If there's evidence to prove otherwise, I'm all for it. If he's an innocent man behind bars and it can be proven, then by all means, set him free. I won't hold my breath. We can agree to disagree respectfully.

      I agree they're not going to find any evidence to exonerate this horrible man. But now that DNA can be tested even if they do test it they're not going to find Laci's DNA. I agree, my mind is very clearly made up as well and I don't believe that there's any way Scott Peterson is innocent. I'm sure that it is distressing to Laci's family. It would be better if the self-serving scumbag would just admit that he did it and get on with his prison sentence.

    You know, Scott Peterson has never mourned the loss of his wife and child. I have never seen him breakdown or be upset that they are dead. The only time I have ever seen him get upset was when he got in trouble.
    They’re also leaving out the fact that he was gearing up to leave the country through Mexico. He even died his hair blonde.
    Since the time of her death until now, he has not acted like anything that resembles an innocent person.

      Yep I remember the bleached blonde hair and beard and the automobile flight towards Mexico. They were keeping a pretty close tail on him though because well he was their best suspect. They did check out the robbers across the street. I don't think they're going to come up with anything now. This is still just Scott Peterson's hot air.

      People don’t have to cry to grief. This is a big misconception. People sometimes would prefer to grieve in private I know I would much rather cry privately than in front of pretty much anybody and I’ve been like that my whole life and I’m very empathetic to living beings I’m not so sure about this one I watch the documentary on it I remember the trial, I have doubts that he actually did it but we have to see what comes in the new trial

Human emotion seeps out whether or not you want it to. You may not cry in front of others, but I doubt that you could hide your grief if you were deep in it. If you could, I believe you've probably been forced to live a lie much of your life. That's not your fault if that is the case. Or you were forced to repress your expression of emotion. True emotion is detectable on a face even if the eyes are dry.

    I don’t even see how LA Innocence Project could take this. The fact that in their documents they said he was always home with Laci is a flat out lie. He was having a full blown in person affair that has been proven as a fact. Hard to do that when you are “at home”. Eye roll.

    I don't understand the public upset over the innocence project picking up this case. I believe he did it but I also don't have problem with an organization taking a closer look. As an American citizen, I want to know the right people are held accountable.

      @@casey7187 Those who believe he is innocent don't realize that, even if by some obscure twist of fate the man is exonerated, he won't be found innocent. Innocent means you defintely did not commit a crime and being found not guilty doesnt mean you are innocent, just that there is no conviction you definitely did the crime. Therefore, the best Scott Peterson can hope for is to be found not guilty. He can't be proven innocent for the reasons I stated here. His supporters don't seem to know that.

      Circumstantial evidence is often what throws innocent people in jail. Last night I have seen 3 cases that were in jail from 18 to 28 years all three were innocent, they then found the real killers, there are many like that behind bars. If he is guilty he remains guilty but if he isn't and they find evidence that he had nothing to do with it, why would you want him to stay in jail?

      The only evidence that isn’t circumstantial is eye witness testimony. That’s direct . Forensic evidence is circumstantial. No murderer is going to plan to commit murder in front of people.     Believing someone is guilty is a feeling. Verdicts should never be made on feelings in a court of law. What determines guilt or innocence should be facts. If there is new evidence, it should be investigated and weighed. TRUTH is the only way justice is served.

    Hi 👋 Mark Geragos (on the Megyn Kelly show I think) said he received discovery from prosecution - only after Scott had been found guilty. Discovery evidence showed that Laci had apparently been confronted by burglars in their home. I’ve never heard this before & also can’t reconcile to Scott’s bizarre behaviour.

    EDB, do please keep following this case! Dr. Todd Grande did a video saying the case against Peterson was circumstantial, and he doubted it. That was the first I heard of this appeal. Probably part of LA Innocence project campaign. I would like to have your perspective. Evidence seemed strong to me.

    He sure was prepared for an impromptu fishing trip. The thing is…it’s WAYYYY colder on the water than it is on the golf course. All that effort for 90 minutes in the bay? No man alive only fishes for an hour snd a half.

    This is the only case where I went back from saying guilty to i dont know. There were some inconsistencies in this case and there was a lot of media publicity that made it hard for him to win. I heard some alleged things going on with the jury and just a lot of evidence that points to not him being the person who did it. I think he should get a new trial and this time cameras be in the court room. Just is an interesting case.

    I remember when this case blew up. It was during a ‘slow news/court’ holiday time & HLN (CourtTV) had been gaining steam. Her disappearance rocked the nation & gained international attention & so the hook was set.
    IMO, this case deserves at least another ‘look-see’. Because tainted justice is not true justice.

    I'm just going to put this out there. My mother was a domestic violence victim. She didn't disclose this on her questionnaire and was picked for the jury. She'd come home daily talking about how this man on trial reminded her of her ex and declared him guilty. Based off what she was describing I did not agree as there was no evidence I heard leading me to believe he had been the one to kill the victim but that he was most likely guilty of disgarding her body after a drug deal gone wrong .(pushing body out of moving vehicle and later atempting to burn vehicle in which wasn't successful as he left all the windows up). Luckly my mother was dismissed from jury duty she'd say she has no clue why but I'm gonna go out on a limb and say it was her comment in the elevator of "he's guilty" while in the presence of another juror. The other juror also was dismissed. All this to say. My mother would have found him guilty in my opinion not because of the evidence but due to her desire for vengeance toward her ex who has no involvement in the case. In my opinion lying or omitting prior legal cases that would relate to the trial at hand should be an immediate mistrial as there is no way to determine whether or not your prior experience with any similar trauma could cause prejudice or as Id like to call it "I didn't get justice so this is my way of getting revenge justice". Id also like to add my mother ranted about the similarities between her and the victim which when asked she had no evidence to show proving any of the similarities she spoke of other then to say that's how she HAD to have felt or to just say ik he's guilty he reminds me of my ex. She was far to close to the trauma supposedly this woman had been through. But as far as I saw they were not similar in any way other then they were both bootycalls for a man at one time. Lying or omitting to being a victim of a prior crime in my opinion only shows you are not well intentioned when becoming a juror. Omitting is a spiteful form of lying and a form of revenge but again this is all my opinion.

    Honestly, I get why most of the comments follow a “ Scott’s going to always be guilty in my mind” attitude. But I watched a show about it recently. I was quite surprised by some things, including two neighbors that knew lacy saying they saw her walking the dog, after the time in which Scott was suppose to have already been gone. Will be interesting to see what comes out of this in the way of any new evidence, or not.

    Oh the day will come when we each reap what we sow. Our youngest was 5 months when this happened so I've thought of Connor as our baby grew up. Like Jon Benet is the same age as our oldest, so everytime my kids have a birthday, I think of these children ❤️

    awfully HUGE coincidence that Lacy was taken by "robbers across the street" on Christmas eve, when her cheating husband, who had already told his lover he had lost his wife 6 weeks prior, left her all alone to go golfing - not, "fishing", yet couldn't even say what kind of bait he had gotten. SURE SCOTT, sure. rot in hell.

    There's unfortunately , a lot of people in prison who actually are innocent and i'm finding it very difficult to believe that they would have taken this case if there wasn't something there that convinced them because it wouldn't make sense otherwise.

    I live in Modesto & kept an open mind when Scott was on trial. Most opinions changed when his affair was revealed, but for me, it was the trip to the S.F. Bay, where we have numerous lakes and a delta that are much closer to us. Traveling that far in that weather on Christmas Eve makes no sense. He initially said he had his boat in the water for 20 minutes? He was also "fishing" for fish that weren't present in the bay at this time.

      He told Amber this was the first Christmas without his wife. He called her during his wife/son’s candle vigil saying he was in Paris.
      It actually says quite a lot.

    PNW Weirdness Podcast did a great job on this story of you want a little more in depth look. As a fisherman from the bay area I loved to fish for anything, not just one thing in particular. And I would appreciate if fish people washed their clothes separately. Fish clothes and bay water stinks BADLY!!!! Is he guilty, possibly, is he innocent, maybe. And those search dogs were known for getting it less than 60% right. Soooooooo this case is worth another look by law.

    My daughter was 3 years old when this happened and it was HORRIBLE! It was hard to watch anything related. When I saw Innocence Project was getting involved my mind was blown! So much time has passed I don’t remember the intricacies so I’ll hesitantly keep an open mind.

    Emily, you neglected to mention that Lacy & Baby Connor washed up in the San Francisco Bay. Ropes still attached to Lacy. Baby washed up a few weeks later. I live here and it took over the whole region.

      It was in the Supreme Court fact breakdown, as I remember they washed up within a day of eachother and when the DNA was in he was arrested.

    Yes Emily please cover these developments. I lived through this case living and working in the Modesto area at the time. It was heart breaking! I had met many of the people involved, even Scott, briefly. It was like 7 degrees of everyone and then the case being transfered to San Mateo, where I grew up. The evidence may have been circumstantial but it added up to 100%=no doubt.
    Many years later it was again heart-breaking for the family and everyone to find one of the jurors made mistatement on initial vior der (idk latin); with resulting lower sentence of life imprionsment. This screamed future appeals.
    However, how painful it is to all of us who knew Lacy or her family and those who participated in the case, this is about our justice system and our constitional rights. We have to follow through, like Murdaugh's recent proceedings.
    I personally believe that no matter how many times this is rejudicated the answer will be the same, Scott is guilty but ...
    We have to get this right!

    This is that one case for me that just stays with you forever. I had a newborn when Laci went missing and of a night time up feeding him, this was on my TV. I believe Scott got a fair trial. Geragos was told about the van, he was told about the "witnesses", he knew about the burglaries. Yet he didn't present them, there was a reason why. If you look into the witness statements, firstly they were all made after those missing posters went up which had the clothes Scott said she was wearing, black pants, white shirt on it and the time she was last seen as 9:30am. So many claimed they saw her before 10am. But then when it was proven that Scott was still home at 10am, those witnesses said, oh sorry, it must have been 10.30am. Every single witness changed their story multiple times. Rules them out. The burglary theory makes no sense because Laci was found in pants similar to the ones she had worn the night before she went missing. So she could not have been abducted on her walk because according to Scott she was wearing black pants. So it means she had to have come home. It also means that she put the dog back with the leash on, exactly as the neighbor did and latched the gate, exactly as the neighbor did. And Scott said it was odd that the dog still had the leash on. So if it was odd, why would Laci have done it twice? The defenders like to say the media was camped out the front on the 26th so the house across the road could not have been broken into without them all seeing it. One of the burglars said from day one, that he saw ONE media truck down the end of the street. Ted Rowlands confirmed just a few days ago that he was the only media person there early in the morning and he was parked at the end of the street, how would the burglars have known that?? When the Medinas returned home to find their house robbed, the first thing they saw was a dolly (trolley) in their front yard and they knew immediately something was wrong. If the robbery took place on the 24th how did not one person see the dolly whilst they were searching for Laci? And either the burglars took Laci and Connor to the Bay as soon as they heard Scott had gone fishing there to frame Scott, a place they knew the police were searching and risked having a body in the car for a 90 minute drive, but they weighed down the body because she wasn't found until April. Why would they weigh down the body if they were framing Scott?? Or the next theory is that they actually dumped her the day she was found. So they held onto the bodies, just waiting for the right time, and traveled with a decomposing and delicate body 90 minutes or more and dumped them apart from one another on rocks, someone please tell me that makes sense?? Laci was supposed to be making french toast for Christmas morning breakfast and she had gone to the market on the 23rd and couldn't get the bread she wanted as they had sold out, so was planning to go again on the 24th to get it. All of us moms know, Christmas Eve morning and you need bread for a recipe that sold out the day before, please you'd be up there first thing in the morning. You wouldn't be mopping the floor and taking the dog for a walk as a priority. Just some of the circumstantial reasons I know he did it.
