  • Alec Baldwin's team is back in court on February 20th for a status conference about the Rust case. The charges were previously dropped and then opened back up again. The prosecutor stated that they still have 30 witnesses that need to be interviewed. Baldwin's trial will most likely start in the summer of 2024.
    I'll provide gavel to gavel coverage of the Hannah Gutierrez 3 week trial. In this episode, I go over the recent motions in court, the charges, and the final witness list. This is everything you need to know before the coverage begins. See you there!

    The AD getting a deal so early on still bugs me. He was the one who demanded the gun and claimed it was a cold gun. Not saying Hannah and friends shouldn’t be held responsible, but I think he should have been as well and it was a bad move to have that deal.

      i think it’s annoying too, but his culpability is probably the reason he pled early on. i don’t think the state cares about HG or the AD they want baldwin

    Her job, if put in the position where she can't do the job safely, is to say "I'm leaving and taking the guns with me." Her job is to walk if they won't let her be safe. If Halls says there is no time, her job is to say that he doesn't get to touch any of the guns.

    I still desperately want to know HOW a live round got onto set, and WHY a live round was on set, for what purpose. We can argue recklessness till the cows come home, if "insert person here" had just checked or double checked or whatever... and for sure there is blame there to be had too, but who brought them on set to even be "confused" for the dummy rounds anyway. Because if they weren't on set they couldn't have been mistaken for anything.
    And I don't think she should go down alone or with highest blame, especially if that report about her needing more time and it being denied is true. And the way DH jumped at taking a deal rubs me the wrong way the way the prosecution is probably going to use him to hammer someone he should share blame with.

      i’m assuming DH knows how the live round got on set. if it was HG who brought it on like the state alludes to, that’s why DH got a sweet deal while the young inexperienced woman is having her credibility ruined

    Im a former movie crew member I worked on MANY action films with guns.
    Total criminal negligence as REAL BULLETS are never on a movie set ONLY dummies or blanks!!!!
    I was Hannahs job to NOT BRING REAL BULLETS ON A MOVIE SET !!!!
    What we are all forgetting is the next scene after the close up where Helena was killed and Joel the Director injured,
    ......was a multiple gun shoot out scene,.
    How many of those guns may of also had actual bullets. It could of been massacre of both actors and crew members in close proximity.
    There is a report that up to 6 other ACTUAL real bullets were found on the set. The other armorer Sarah admitted to tossing a hanful of bullets in the trash after the mishap.( they were never found or collected by police.
    Were some of those on the cart or in other guns.
    This mean that more than one person would have been potentially killed.

      I’d absolutely push harder on the narcotics issue too. If your job is this serious, and you are “brand new,” and still have the audacity to come in hungover and bring illicit substances onto the set… there’s a lot more going on.

    As someone who holds an FFL (Federal Firing License) I am held to a different standard than the regular citizen. Hannah should aslo be held to a higher standard! If something was amiss it was up to her to shut it down no matter who her boss was! SHE is liable for ALL firearms & ammunition period.

      I agree. No matter how much funny business by other people, re live rounds happened on that set Hannah Was The Armorer. She can't escape some major responsibility in any gun related accidents on that set. For example, she should never have accepted the idea that she had two jobs. Nor should she accept Anyone telling her that there wasn't enough time to do a (few seconds long) re-check.

If a trucking company is demanding that their drivers not stop at weigh stations or get rest at appropriate times etc.. it should be feasible to believe that it wouldn't take much for it to become a standard of the industry. Creating an atmosphere where that driver knows that they can't just quit and find a new job where an employer is willing to follow the rules.

      @@dkoch42There you go! My thoughts exactly! Also no one should ever point a gun at anyone under any circumstances unless there’s imminent danger (like death is a possibility) and then that’s another story.

    Production should absolutely be charged for their new GB licence as well. Unfortunately for Hanna that does not negate her incompetence. She was in charge of firearms. Ifan actor came up to her to get a gun to take home it's her job to say no. If the director wanted an actor to shot another actor at point blank range with a blank it's her job to say no. So when the assistant director tries to take a firearm without clearing it, it's her job to say no. Being timid and shit at her job does not take away her responsibility.

      You should live in Scotland. I’ve cried more than once just from knowing I had to sit on a freezing seat to pee. A cold bidet would kill me.

      US not having heated toilet seats, auto lid raise by sensor, wash, & dry mode is a shame :-). Japanese Toto toilets are the amazing (with remote, for easy mounting in wall)

    I think it's a shame that the person I think was the most responsible was given a plea deal. I think they wanted to prosecute Alec Baldwin and didn't think about anything else.

      Same. They really want to focus on Baldwin but DH should be 100% at fault. HG sounds like she was negligent but they chose someone new and then they gave her more than she should have been doing. DH was quicker to protect himself in a way that makes me feel he absolutely knew he was going to be found at fault.

      Honestly, I agree with this. He was safety supervisor, he was the one that handled the gun last and declared it safe despite not having checked the gun himself. I am sure he had been involved in the decision for him to handle the guns and not the armourer considering his production role. And lastly, as he was acting in the armourer role he was the one that should have seen the position of Baldwin and Helena and stopped it immediately. Armourer aren’t just to load blanks then hand off the guns and let the actors go nuts. There are stories of armourer removing weapons from actors for unsafe behaviour. Pretty sure point the gun at a crew members with finger on trigger and manipulating the hammer would have qualified as unsafe.

    The gunpowder forensics seems to miss the point. The ammo could have been a batch leftover from another event provided by others at a prior time and not part of pdq normal inventory. That part of the story allows for an alternate trail of custody and the lack of freezing pdq inventory could have led to destruction of that batch/lot of ammo. Seems like an obvious possibility.

    The statement that there is a photo of her holding a live round makes no sense. To identify it as a live round would require a video of her turning it around at close quarters showing no hole drilled in it and shaking it near the mic, and pointing out it didn't rattle.

    If Gutierrez is held accountable, i really think David Hall deserves the same sentence. He’s at least as guilty as her, that he pled out to something so minor is enraging

    Where is the legality of a key witness using a FOIA in a case they are the witness in? It seems fishy.

      It's a really good question the public information laws have some boundaries for those requests being denied but it wasn't done here.... which is strange to me as well.

    I feel most responsability is on whoever brought the live rounds to set. If that didn't happen, none of this would be an issue.

    The AD pleading down to mandatory gun training is total BS. The new DGA contract is enforcing mandatory gun training for all its members anyway.
    (Not sure if he's a member in good standing or not. )
    From what I've heard, he's known to have a terrible reputation on his jobs and has several complaints against him.

    Hannah, Alec and the whole production company in charge of safety on set should be held fully accountable.
    it was reckless, negligent and this caused the sudden unproked death of another person.
    Halyna didn't ask to be shot and there was absolutely no reason in hell, live ammunition should've been past the front gate of the ranch, let alone on the set or in the props trailer.
    the possession alone of the live ammunition on set should be the deciding factor in this case cause ultimately from the bottom (Hannah) to the top (Alec and Rust Productions) all the safety measures were either bypassed or negligently disregarded.
    cause if the live ammunition wasn't there then Halyna would still be here with us, Halyna's husband would still have his wife and her son would still have his mother.

    Thanks, Emily! I’m going to wait to hear all the evidence before forming an opinion to your questions at the end. It’s just all so sad, especially when this could have been avoided. How the F did the live rounds get on set is absolutely my number 1 question at this point! 🤦‍♀️

    I look forward to hearing the evidence. My biggest question is where the live round came from. There are so many movies and TV shows using "guns" and I never hear that someone was killed.

      I’ve heard of deaths and injuries. But I have NEVER heard of it being from a live round. Wadding projectiles and burns from ignition, sure.
      There was a really famous death years ago of Brandon Lee on the set of the Crow that stands out as THE incident in many peoples minds

    The reason there are more people to interview for Baldwin than Gutierrez is because She was only the armorer on set while Baldwin was not only an actor he was also one of the producers (the money behind the project) so he has an even higher responsibility for what happened because HE was supposed to be making sure that SHE was doing her job. We already know he blew off the training he was required to do (even though he's had to do it on other sets before). He was essentially her boss & actively limiting her ability to do her job. If the person who is essentially your boss keeps telling you that you don't have to do something again & again, you stop doing it because they control your paycheck.
    Sorry, firm believer that the safety people, including the armorer, should NOT be on the payroll of the movie but should be independent from or part of the State's OSHA (or equivalent) agency.

      @@ianmcnally8501 I consider that the same job. A gun is a prop therefore you have to be a prop master to be an armorer. We call that resume padding, like custodial engineer versus janitor/general handyman

      @@Voodoofairy88From what I understand on a larger production or productions with lots of firearms, like this seeem to have been, the armourer is a dedicated job in the prop department. Hannah was working as armourer and also having to do lots of general prop-work. I think that is less typical and it seems like she did raise concern that she wasn’t able to properly do the armourer work because she was being overstretched into props.

    The name thing, I remember in a motion the prosecutor was pretty determined not to use Reed, as its not part of her legal name and claimed Hannah only used it to further her career. It was salty

    Could the extra witnesses in Alec Baldwin’s trial have anything to do with Baldwin’s responsibilities or actions as a producer of Rust, rather than his role as the person firing the weapon?

      His actions as a producers were for sure for creative reasons. It's probably on his contract that exact power he has on set (which, I don't trust a lot as it usual goes) and I doubt he had any power on the safety and technical aspects. Honestly, not even executive producers mess with that unless it's for insurance and liability.

There is police questioning of Jensen Ackles where he made sure to explain that even if an actor is listed as a producer they don't have any real producing power because it is just to "sweeten the deal". He made sure the police knows this because it releases Alec from most of the responsibility for what happened.

    Why would live rounds matching a gun used on set be allowed?
    I feel like that’s asking for a fatal error !!! Is this not fun safety 101. Special gun used for scene. No matching ammo on set

    I'm sure the REED is dropped to save his good name in the industry. This whole case is a crying shame.
    Hannah was grossly under qualified and should of never been hired by the greedy profit hungry production company.
    That being said her unfortunate drug use, carelessness and lack of experience took a beautiful life. She should pay the price for her part in this death,. In a perfectt and just world every producer on that payroll should also be held accountable IMO

    On the “coke”. She passed the package to the caterer in her hotel room after 1st police interview. We don’t know that the package was in her pocket at police station.
    The police didn’t search her person before/during interview Based on fact that HGR pulled 5 rounds out of her pocket during interview.

    That safety coordinator should be the one in the most legal trouble. Baldwin is rightfully in the hot seat because from what I understand, he facilitated the unsafe environment in a big way.

    Is it in anyway possible that Hannah (or someone) purposely brought the live rounds onto set as a way to TEST or SET UP the safety issues? I expect this wasn't intended to end in a death, but perhaps an injury in attempt to point out the issues previously raised in cutting corners?

    The 2 alternative counts might make sense in the case of HG(R), but in the case of AB, the first alternative count, an illegal act (Negligent Use of a Firearm) leading to death, would only make sense if you could show that AB's use of the gun was negligent IRRESPECTIVE of whether the accident had happened or not. If the accident had never happened, no one would be charged with anything, which makes it much harder to show that AB was committing an underlying illegal act. The prosecution would have to show that pointing guns at people, pulling triggers, and not checking the weapon yourself on a movie set is negligent, even if no accident occurs. The State of New Mexico has never made an issue of it before, so why now all of a sudden? For example, in the movie Young Guns, which as filmed in New Mexico on the same Bonanza Ranch where the Rust accident occurred, in the scene depicting the killing of Joe Grant by Billy the Kid, the actor playing Joe Grant is point his gun directly in the face of Emilio Estevez and pulling the trigger, multiple times. As far as I know, the State of New Mexico never charged anyone with negligence, or put anyone on notice that such actions would be considered crimes in the future. For this reason, I think the first alternative count against AB is an invalid overcharge.

    I am watching Dave Halls police interview that was posted a year ago. Correct me if I am wrong yet didn’t he mention today in court on the stand that it was not a rushed /busy day? In this interview he says it was the opposite right out of the gate when asked about the day he responds everything was fine, and it was a faced pace busy day. Isn’t faced paced equivalent to a rushed day? Note: I meant to post this under the live show where he testified today yet aware just now this footage was done 8 days ago. Whatever, found this curious

    Imo, if there appears to have been issues all up and down that chain of command... up to and including the safety supervisor... then the person responsible is the safety supervisor. If there were just a couple small issues here and there or only one problem area and everything else was on point, then the safety supervisor is probably safe. Buuuut this sounds like a case of blame the safety supervisor.

    Why weren’t Hannah and Baldwin drug tested? In my profession (nurse) and I know with police or fire fighters, etc we get drug tested when something adverse happens. Even a med error gets you drug tested. Geez- with a death!!

    I feel like everybody should be prosecuted- there are so many failsafes in the system to stop this happening, and on that day all of those failsafes failed Halayna and she died a horribly preventable death

    Several people are at fault for this tragedy, but I have firmly believed from the beginning that a good portion of the blame falls onto AD Hall. HE was the safety coordinator. HE allowed for the unsafe conditions on the set that resulted in the crew walkout. HE was the one who got in the way of the appropriate actions being taken in the gun hand off. "There's no time to check it." There is ALWAYS time for firearm safety!

    I am confused as to why they jumped so quickly to wanting to charge Baldwin. As far as I can tell he didn’t do anything that was unusual for an actor in his position. It’s not part of his job to make the weapon safe or have a knowledge about weapons. He doesn’t seem like a particularly nice guy but I don’t think he is to blame.
    However the safety officer and Armourer were directly responsible and one of them got off super easy. I do think it ultimately comes down to the Armorer though to check the gun and the load and to insist on doing so if told there’s no time. That’s her job and responsibility. It’s a job with a lot of responsibility so I don’t take age as an excuse. People’s lives literally depend on it.
    But the Baldwin angle seems odd to me like they want a big name scapegoat.
    And Props Sarah dumping the bullets afterwards is very strange. She must have known the police would want them. Why was she even handling the gun at that point?

      It's my understanding that the death of Brandon Lee involved wadding from dummy rounds and not a live round. Doesn't change the outcome or the tragedy, but the circumstances were a bit different, and I think that is why no one was ever charged in that case.
