    We need to stop allowing our police officers to stop body cameras.

    • @kg4lod
      @kg4lod Місяць тому +144

      That's not practical due to privacy issues (like when an officer goes to the bathroom or when they're in sensitive discussions back at the station, etc), but a real solution is to make the lack of footage grounds for automatic dismissal of the charges/case. If you approach the public with the BWC off, you automatically lose the case, lose qualified immunity, and lose the presumption of innocence. Officer attitudes would change. They would understand that the camera exists to PROTECT good cops/good people, by rapidly removing bad ones.

      They aren't ,"our officers", any more than the Gestapo were the German's "officers". They are class traitors. Working class people criminalizing, and extorting their fellow working class brothers, for the Elite.

    • @winstonwolf6791
      @winstonwolf6791 Місяць тому +214

      @@kg4lod It is completely practical. Officers record sensitive things from citizens including full nudity that is redacted every single day. If officers can't handle being subjected to the same redactions everyone else has to live with then they should never have become an officer in the first place and are free to find a new profession.

    • @kg4lod
      @kg4lod Місяць тому +19

      @@winstonwolf6791 While I can appreciate your sentiments, recordings of nudity are either implied consent (someone nude on the public beach) or evidentiary (police raiding a home and finding someone naked) and redacted (as they should be; we need the recording for police accountability, but the nudity shouldn't be released to protect privacy). In almost all states (ex. California Penal Code section 647, et al.), laws criminalize employers recording workers at their workstations, bathrooms, or break rooms. Same applies to the government and its workers (e.g. police officers). That's why it isn't practical to continuously record from BWC's. I think we get the same effects you intend, simply by enforcing severe penalties for not recording when you should be recording. This works the same as evidence trails. If the police fumble the proper handling of evidence, it can't be used at trial often resulting in the suspect being found not guilty. With cameras, just make it an automatic dismissal or loss of presumption of innocence on the part of the officer (just like refusing to answer at a civil trial is an adverse implication).

      The judge admitted he heard the bottle being opened on the footage but that that was for the jury to decide but then claimed he was improperly mirandized and excluded the body cam footage. Calvin Riley was then convicted on the DUI based on the evidence the prosecutors and judge both knew to be planted.

      In Florida, tampering with physical evidence occurs where a person, with the intent to impair the use of evidence, conceals, alters, or destroys that evidence while being aware of the existence of an investigation or criminal proceeding. They are already arresting him over the suspended license, so what does it do for them to plant evidence for a DUI? Do they just get off on it? To play devil's advocate slightly here, I will say though that if the guy really wasn't drinking he should have just volunteered to blow into the breathalyzer and just get that out of the way.

The chief is making all sorts of accusations about the video that was released and 'edited' but won't release the full video that they have to any news outlet until after the trial concludes. Their internal investigation is apparently enough for him to be sure that the officer did everything correct and legal. Plus one of the jurors was removed because they had seen the video before the trial. The fix is in and more than likely he will have to go to appeal unless the jury can wriggle out from under the judges thumb.

      Every defense attorney in the nation needs her name. Any future testimony she brings, let them question her about the "time she planted evidence against an innocent man". THEN ask her how the jury is supposed to believe her testimony THIS time. If she can never testify, nothing she does will ever stick. Her career in law enforcement will be over. The only thing the prosecution these days care about is getting guilty verdicts. A bad cop who can't do that isn't worth covering for.

However this neither makes you better, nor does this sort of wrongdoing require anything you can call Sociopathy. It’s such an ordinary evil. The situation however is not helped by muddying the waters on what qualifies as Sociopathy or indicates it. The most you can say truthfully is it may lean towards that Pathology. Perhaps it does, but it’s hardly a more apt comparison than any other Pathological leanings in that particular domain. Narcissism. Machiavellianism. Or Sadism.
