    I don't think for a second he told those teens he was looking for little girls. I think a bunch of drunk teens saw a middle-aged man wandering around by himself, and he became their target for entertainment.

      Nobody with a brain would believe that blatant lie. Such a ridiculous story could only have been fabricated by a child's mind. Not to mention that one of the teens, Alex Vang, only told police about the "little girl" statement 2 weeks before the trial. He waited TWO YEARS to tell police that he heard Nic say "something about little girls". An obvious fabrication to deflect his role in this whole shitshow.
      These teens basically fabricated a claim that Nic raped children, broadcasted it to all the drunks on the river, and incited a lynch mob led by the 6 teens to attack Nic.

      I agree. Someone gaslighted the situation with that comment and the rest followed as a way to embarrass him and to get everyone as they said, to "gang up on him".

    We were so afraid.
    You can tell in the video of us laughing, taunting, screaming and pushing how afraid we were.
    It was 13 on 1.
    We only had 13 people.
    We were afraid.

    All of them feeding off of each other with one guy continuously dumping gas on the fire until reality hit and FAFO took over.
    Then Tough Guy starts screaming like a little girl.

      And what a difference it would have made if he had chosen to voice his issues and repeat what he was looking for. There are many things that would have allowed this tragic event to end in a very different way. Sadly, too many people made choices they should have probably not made. That includes the guy who stabbed people without saying a word.

      @@autosalesqueen Who cares if they were taunting him? Did that cause some chemical reaction in his brain that took away his self-control and ability to walk away from a situation? I'm a grown man. Know what I would never do? Confront a bunch of drunk teenagers who are calling me names. There is no world where that ends well. An adult is expected to use their years on this planet to make better decisions than a child would make. They all made bad choices, end of story. Is he guilty? I don't know. Would really like to hear what he has to say.

      How the hell do you know ANY of that??? No one testified that they were drinking and smoking before they hit that river. I have been down this river MANY times in my life. Almost EVERYONE drinks, it is a long tube ride. Can be as long as 4-6 hrs to get from the entrance to where they get off. At the bridge where it happened it was about 40 minutes away from the rapids where 95% of the tubers get out of the water. The investigators even testified that they did not give those kids any alcohol tests because they did not look impaired when interviewing them.

      I noticed that too. Many of the boys on the stand seem so aggressive. Bits like they think they are on trial for 1st degree murder. It’s the same out of place attitude that they displayed when the real world didn’t match their sheltered experience to date. Miu is obviously different in his life experiences (born in a different country and culture, traumatic childhood, PTSD…). I can tell that Miu doesn’t display strong emotion on his face, and that could be for a number of reasons but no reason those kids should treat him like a pedo when he was simply trying to find an expensive new iPhone (and then snorkel) that were lost. They taunted him. He was confused. Then they stood between him and the safety of his group.

      granted they are still young boys and to them this guy killed one of their friends right in front of them. Not 100% it was right or wrong at this point, but I had 3 teenage boys and I know that these kids are trying singlehandedly to put the guy that they know killed their friend behind bars. I am from this area and know how Stillwater HS kids in general (especially sports players) in the most part their attitude. I have officiated HS sports in this area for over 20 years. These kids were not good witnesses.

    As a High School teacher you become very attuned to “hearing” teenagers lie, they lie constantly, instead of taking responsibility for their actions. This young man is so obviously lying and trying to bend the facts to fit his narrative it makes me mad. Plus, he’s arrogant enough to think that he’s fooling everyone…the exact same attitude that caused all these issues in the first place. I don’t think any of these young men feel sorry about what they said and done. He clearly believes that Mr Miu should’ve left just because they told him to, entitled and arrogant.

      Completely agree. I also saw markers of stress (aka likely deception) at certain vital points, as well as what looked like smirks and contempt. Not what you want to see from a witness like this. There's zero accountability for their actions. It almost would have been better if he just admitted they were being assholes and trying to start something. I mean you can clearly see the kid smiling in the video. He's enjoying it!!!

      Most likely not. I mean this was a Saturday and if it was a nice day out that river is pretty packed with people. I would be sure they would've heard about any other incidents with these guys if they had been a problem with other tubers. They were towards the end of the river when this happened and had probably been on the water for a few hours already.

    MEMORY gets WORSE over time.
    There is no way he remembers better now. The more time passes, the more our memory decays. It is highly malleable and changes EVERY time we:
    - think about the event
    - remember the event
    - talk about the event
    - dream about the event
    - are reminded of the event
    - read ANYTHING that has ANYTHING in common with the event
    - hear ANYTHING that has ANYTHING in common with the event
    - watch video that has ANYTHING in common with the event
    Memory changes all the time - no person would believe this young fellow has better recall two years later than immediately after the event. It's a ridiculous thing for him to say.

    Mui's attorney Corey Chirafisi is a sniper when it comes to cross examination. His cross of Gaige Grosskreutz in the Rittenhouse trial was a masterclass, and he has had some great ones in this trial. Absolutely my favorite attorney to watch in trials recently!

      I feel the same after watching the video and the testimony thus far however it still does not constitute anyone dying. Even worse for me is finding out that he hid the murder weapon and lied to the police and did it deadpanned. Brutal, seems like everyone involved was looking to escalate the situation at the time and now so many lives are ruined.

    The thing is -- it's actually exceptionally damaging to the witness that he initially said the man was looking for a phone. It wouldn't be all that damaging if he'd said the man was looking for his watch, or sunglasses, or a million other things, but the fact that his initial statement of what this stranger said he was looking for was, in fact, what the stranger had lost and was looking for, makes everything he says in contradiction completely incredible.

      This is why the people saying ‘he could’ve just walked away’ are not seeing the full picture… if you’re looking for something and some kids start shouting at you - you shouldn’t have to run away without your stuff to avoid things escalating.
      He had no way of knowing the mob was about to form around him, and up until then was under no obligation to walk away and give up finding a lost phone, just because some kids start being dicks

      Common words used by all testifying "children, commotion, scared" It seems like someone coached them because what kids say "the commotion" when they were the ones causing the commotion by screaming and yelling? But yet they act like others were causing a "commotion" when it was them yelling. And everyone calls them children even the guy who was 19 at the time (DC) is calling the 17 year olds children. How are you scared when you are laughing like a hyena?
      Yea Miu lied after the fact about what happened BUT these people are on the witness stand lying their butts off. ALL of them.

    They had me fooled at first. I can’t believe it. These young adults are just a disgrace. It’s embarrassing to see them try to justify their actions. It’s gross, they taunted and ganged up on an older man….one man vs a dozen people. They were screaming so loud they wouldn’t have even heard his response.
    And there’s a reason why when you get robbed by a bank, there’s specific protocol and employees train consistently on that.
    No talking to anyone else about it because it alters your memories.

      That attorney did his job and highlighted what he needed to the Jury, but both sides seem to put a lot of words into others mouths, without much in the way of objection. Some of it is so repetitive too. I’m in two minds as to the usefulness of this witness testimony because of the nature of the questioning, which was the desired result I guess. The most useful evidence is still the video regardless. If these young people had stayed away and not commented, just called Police, this tragic event wouldn’t have happened.

    My husband has always carried his pocket knife when we went on that river. If you don't cut the strings, you have to carry all the tubes tied together to return them, which can be a couple blocks away. Easier to cut them apart and everyone carries their own.

      1st degree murder in Wisconsin is 2nd degree in most other places. It doesn't require premeditation, merely intent to kill. Given he stabbed someone in the chest and gutted another I think intent to kill is clear.

There’s no way this was first degree intentional homicide. I would’ve been more on board if it was manslaughter. Either way, so many lives never the same. Extremely sad!

      If you recall the instance a couple years ago of the internet goon Tanner Cook who was harassing and pranking that delivery driver named Alan Colie, he kept getting his face while his friend recorded it and the food delivery man shot him in the stomach and wounded him, well Alan was acquitted of charges. The case here at Apple River could be compared to it, as Nikolai was harassed and videotaped by Juhwan, who created a threatening atmosphere and Nikolai responded once he was surrounded

If he had punched her in response and it ended, would he have faced assault charges considering the circumstances? I don’t think so. I think his punch or slap was justified.
      Then he’s in the water being punched and slapped and held down by multiple people. How was it not self defense?
      I’m sorry that someone died. And I wish these kids would have learned from what happened but it doesn’t seem like they did.

      A mob that he could have walked away from at any point. He could have yelled for help. He could have held his hands up. Said even a single word to deescalate. He didn’t. He walked away then rushed back when he was taunted. He pulled a knife very quickly and held it blade. He didn’t wield it and wave it to get them to back off, which they undoubtedly would have done, He silently stabbed them. Then walked off and tried to pretend it didn’t happen.

    Thanks for covering this case, much appreciated. This happened about 20 minutes away from where I live. I had a hard time decided whether or not he was guilty of anything but at the end of the day, I can see why he was found guilty of reckless homicide. These kids were nasty pieces of work, shame on them for what they did. Miu will likely die in prison given the sentencing guidelines as you pointed out. Sad situation all the way around.

      I’m with you on the determination of this one. I’ve gone back-and-forth through opening statements, through the testimony, through closing arguments, whether or not it was self-defence and what if anything he should be guilty of.
      The teens were amused by the situation, were enjoying harassing and assaulting someone they undoubtably thought of as a fat old fool. They have been just as guilty of lying throughout the process, because on some level, they understand that what they were doing was wrong, as well.
      The one that I really think has far more culpability in this than gets acknowledged is the guy videotaping it, who set the narrative, made the accusations, did everything he could to escalate it, and kept giggling with glee all the while. I was particularly stunned when, after he realizes one of his friends is injured, he doesn’t put the camera down and rush to assist, he turns the camera on himself to capture his reaction, then continues recording. he thought all of this made great content right up until he realized one of his buddies died for it.
      And all of this really over nothing - which is happening far too often these days, it seems.

    Background of Miu
    According to the defense's opening statements, Miu was born in Romania. When he was a teenager - about 15 or 16 - he immigrated to the United States because his father wanted his family to have a better life. They were taken in as political refugees and accepted by a church in Minnesota.
    Defense attorney Aaron Nelson highlighted Miu's language proficiency; he grew up speaking Romanian but also learned Russian. By the time he moved to the United States, Miu also knew French and Latin. Then he picked up his fifth language: English.
    Miu went to school in South Dakota and then became a mechanical engineer. Nelson said Miu was "a bit of a handyman" and good with tools.
    Miu eventually settled down in Prior Lake with his now ex-wife, Sondra, who goes by Sandi. He later told police he was "living a peaceful, quiet life in Minnesota" and "had never been in trouble before."
    Nelson also mentioned that Miu "isn't in the best health." In 2020, he had a heart attack and a quadruple bypass. "It still makes him feel fragile," Nelson said.

      Found it very interesting that he heard Miu hit the girl, but he never heard his friends hit or slap Miu. The kid had the opportunity to say that, re Miu being surrounded, punched & slapped, but he didn't. And I think this omission discredited his testimony even further. Esp based on Miu's bruises & scrapes; video footage of him being grabbed & assaulted.

    I think you missed a key point from 37:00 to 37:04 when the defense gets this witness to admit that Miu only used his knife on those that put hands on him. To me this is a big deal since it reinforces self-defense. The "cherry-on-top" is that this kid doesn't even realize what he just gave the defense with his answer. Clearly, no re-direct by the state indicates this kid was a bad witness for them and they chose to cut their losses and get him off the stand.

    I am a stabbing victim of both a knife and box cutter. The police failed to write in their report about my stab wound period! I felt like a jack ass on the stand during preliminary. After preliminary , I told the prosecutor the police report is very faulty, and I'd rather use the forensic evidence. I did have forensic pictures taken of the box blade cuts and the stab wound. The prosecutor told me I watch too much csi! I've never watched csi or forensic files. I was lucky the dude who cut me up took a plea.

    I read some things about witnesses and memory: after a while, when you can't remember some details or even entire events, your brain will automatically fill in these "holes" with what you hear people say or by assuming what must have happened based on what you know. At this point, it is impossible for you to discern between what you _REMEMBER_ and what you _THINK_ happened.

    I am 62 years old, I have kids and grandkids. But all I can say is it's amazing how young people would rather impress and stick together than stand up and speak the truth, (even when on trial). I am sad about what happened to these kids and their families. It has changed their lives forever. But if I am on that jury, I am saying this was self-defense. That is my verdict, based on following the trial thus far. Maybe my mind will change. I try to see things from all points of view, but so far my opinion is self-defense.
    Sorry kids, and sorry to the families and everyone else affected by this tragedy. So many bad decisions that day. 😢😔

      @@falseprophet1024 I am sorry for the way their lives have been changed forever and that they will probably be traumatized for a long time from all this. I am sorry that their actions caused so much tragedy. Just because they made horrible choices that day doesn't mean they don't deserve some empathy. Those kids aren't evil, they just made some big mistakes that they will be paying for the rest of their lives. Hopefully, this incident won't take them down the wrong path. Hopefully, some of them will use this horrible event to make themselves better adults.

    People keep calling them kids like they are 5 year olds they are adult enough that they were getting drunk. Adult freedoms come with adult responsibilities. They just learned that the hard way. It’s called natural consequences. Actions provoke reactions. It’s pretty simple.

    Thank you for your continued coverage of this trial. I've been watching the live stream every day, but I enjoy your commentary. It helps me see the trial from another perspective. So far the evidence has me thinking he's guilty, but I'm waiting to see his testimony before I make a decision. Yes, these kids were behaving badly, but a prudent person would walk away from rowdy, drunk teenage boys rather than take out a knife and wait for something to provoke him. The fact that his friends walked rather than ran to "help" him says there wasn't an overwhelming threat from people yelling at him. He escalated to physical fighting.

      @@Ickshter2112 I’m not sure which witness stated those circumstances. But if she was hit, where’s the picture? If she was hit there would be a picture. There is no picture therefore Miu did not hit her.
      I would not rely on someone that’s 2.5-3 times the legal limit of drinking’s opinion.
      Those kids had no business being out there alone (they can’t behave themselves appropriately); no business underage drinking, no business smoking weed.
      And I find it absurd that they think it’s okay to drink so much, okay to smoke weed, okay to call someone a rapist; okay to taunt and laugh at someone older as a group, but then when they think he hit a woman it’s not okay and now they can jump him.

    The defense should have brought up the fact that a full 45 seconds transpired between when Mr Miu supposedly said “I’m looking for girls” and it was mentioned to the rest of the group. The fact that, when he said whatever he said (as it was clearly unintelligible) the teens all looked at each other confused, and said “huh, what, what did he say?” Such a riled up and reaction group surely would have reacted to that immediately and called attention to it. But no response happened, because Mr Miu never said that.

      I've been tubing on that very river. Unless the group of boys made a very definite effort to stop the tubes where they first encountered Mui, they would keep floating in the direction to where the actual incident occurred. So how did Mui get 60 ft further downriver along with the boys and their tubes? Especially considering his group was stopped at a sandbar back UP river?

    This was such a traumatic event. It happened so quickly everyone’s vantage point was different. There’s not a single witness thats story lines up. It’s the case on both sides. Even detectives!

      Exactly Miu said he took possession of the knife from one of the kids, that’s clearly false. He brought the knife and he stabbed several victims. And killed one. Horrible

      I think it's reasonable for Miu to be scared that no one would believe him, it was 10+ vs. him after all.

      Eye witness testimonials are worthless.
      Humans are very bad at recalling things accurately and without bias.
      Most people couldn't accurately recall something said to them 5 minutes earlier let alone accurately recall a chaotic and traumatic event like this.
      The videos are the best witnesses.

But then things get murky, Miu seems generally unstable, he ends up doing a lot of really suspicious things, and I can't tell if he was justified or not. The teen group was certainly instigating, but I don't know if Miu could have disengaged or if he was really justified in using deadly force like that.

      That's why I'd say a week, 2 weeks, absolute most probably a month for a clear picture of a memory. 2 years though? That's a lot of time to start exaggerating events in your own head, mixing up memories from that day with other days, forgetting details, etc. That's not even getting into talking to another person or watching other people's recounts where you can start unintentionally adopting those details. Like not remembering what was in the person's hand until you hear someone say "there was a cellphone," and now you think "that sounds right" and the memory has changed.

    When it comes to memory it gets tricky. Several years ago my wife and I were on 3 N in MA going from Boston back to NH. It was about 2am and she was driving. I was sleeping because I had been drinking. I woke up to her screaming, heard a crash and saw a car spin in front of us and go into the grass. As she stopped she was terrified. A Mercedes was in the center lane wrecked. I checked the driver in the grass he was messed up bleeding, unconscious and drunk. The driver of the Mercedes had a broken arm and his wife was just hyperventilating. The cops were there quick and my wife was trying to explain what happened. It was completly disjointed and not true. She thought the car was speeding and flew by causing the wreck.
    What actually happened was the guy was drunk driving the wrong way and hit the Mercedes head on and spun in front of us. The cops were there so fast because the cars he passed and didnt hit had called 911. The cars on the other side had done the same. They were already on the way.
    Point: She was not lying or drunk. She was in shock at a traumatic event and needed to compose herself to really process what happened. Memory later can be better than the moments during or directly after.

      @@astrialindah2773 I asked an Officer before leaving and he told me. The officer who interviewed my wife was just taking statements. The officer I spoke to before leaving told me what happened and that they had been receiving 911 calls for a car going the wrong way. I also looked it up later. The Mercedes was very lucky they were in a quality vehicle. Many other cars would have resulted in fatalities. They were going about 70mph and were in a head on colissions. The wife was generally fine and the husband driving broke his arm.
