Well.... Lots of changes take place between 16 and 22. So the kids looked a lot younger at 17/18 than 20/21, plus the emotional issues of dealing with witnessing and being involved in death of a friend tends to psychologically and physically affect people. Prosecution probably showed bigger pics of the kids but we can't see all the exhibits.

That's not necessarily true especially if you know how traumatic events effects one's memory. It's been proven that it's not always best to get statements immediately because adrenaline, effects the memory as does injury, medication, surgery etc.
The whole reason the police want to question you right away is because your memory is fresh. It doesn’t get better two years later. This kid may as well be testifying for the defense.

The dad explained that in his testimony. He runs a bar and his sons are accustomed to diffusing arguments between drunks. He said that he could not hardly walk. I’m sure if he knew he was sending his sons to be stabbed, he never would have sent them.

I am almost positive that there was no cell phone signal where this happened at. I haven’t heard it discussed in the trial yet but they could not even call 911 for medical treatment for the stabbing victims. They had to send people up or down the river for help. So the father could not call the police for help.
Plus a perjured himself when he said Nikolai said he was looking for little girls because actually Nikolai never said that and somebody else did but a number of them told the police they heard him say he was looking for a phone and so you know the one who started all this did hear him say he was looking for the phone . It doesn't matter really. The jury knows this: Nic Mui didn't immediately call the police and tell them "I was just attacked by a group of bullies and used my knife and poked a few people." He instead, tossed the knife, told his group the kids had a knife, then tried to leave in his vehicle and when the cops approached, he didn't mention what just happened. He instead lied and didn't mention the altercation or that he stabbed some kids. It doesn't matter how confusing the kids testimonials are. The video shows the MAN approach them, get made fun of, then start poking people with blood spilling out. He was the grown up. He was morally obligated to walk away.

I don’t know if he had the knife in his right hand or not. I thought he didn’t pull the knife out until after he was knocked down into the water.
For sure, the judge is biased. Judge is very subtle but very effective in interrupting the flow of the argument. It is small acts but they all add up. Very sneaky.
Listen to all testimonies, the 6 teenagers were screaming help from the 50 year old. The 50 year olds wife at the time had a couple of their friends retrieve the 50 year old, twice the guy went back!

This is self defense in every way. He was literally surrounded and being taunted and yelled at. Any normal person in this position would feel like great bodily injury is imminent. 1 against 12 is hardly good odds. He was justified to use whatever force necessary to get out of the situation. And yes I have watched the video several times. It clearly shows a mob of people acting and behaving in a threatening manner. And then people started putting their hands on him. The group never stopped him from leaving, didn't beat on him first. He easily could and should have walked away. The only thing I don't agree with is the 13+ young adults and their behavior with their yelling and screaming, that was unnecessary.

It was his only option to defend himself against odds that noone would win against. If you were in that situation what would you think and how would you react? How did this witness or anyone from their group de-escalate the situation? To the contrary, each of these drunk brats made the situation worse. The girl gets hit (he alleges, we can't see in the video who hits who first) and he hits Nic in return. Is that what happened? I don't know since the video pans away. He was stabbed and airlifted out, so I assume he lost a lot of blood. If he was actively drinking at the time of the stabbing, then the alcohol was not fully absorbed (still in stomach). Less blood volume after stabbing equals higher BAC for the amount of drinks he had, which is why you shouldn't drink after donating blood. And don't even get me started on if his liver or splanchnic circulation was injured. Same goes for the rest of the stabbing victims. Bringing up BAC is just for show and doesn't prove anything.

He approached them, put hands on them and their recreational equipment. They literally asked him to leave, which he had every opportunity. He refused. They told him to leave… instead of leaving he made sure he had his knife. Kids call for help, 4 more people come and tell him to fuck off. The DAs job is to get a prosecution, and these boys are their witnesses. Too bad the boys family lost their son and friend to an unnecessary escalation. Miu is guilty of self defense. It’s sad he couldn’t navigate the situation without fatal force, but he was dealing with an intoxicated mob mentality while heavily outnumbered.

Well.... Lots of changes take place between 16 and 22. So the kids looked a lot younger at 17/18 than 20/21, plus the emotional issues of dealing with witnessing and being involved in death of a friend tends to psychologically and physically affect people. That's not necessarily true especially if you know how traumatic events effects one's memory. It's been proven that it's not always best to get statements immediately because adrenaline, effects the memory as does injury, medication, surgery etc.
The whole reason the police want to question you right away is because your memory is fresh. It doesn’t get better two years later. This kid may as well be testifying for the defense.

I am almost positive that there was no cell phone signal where this happened at. I haven’t heard it discussed in the trial yet but they could not even call 911 for medical treatment for the stabbing victims. They had to send people up or down the river for help. So the father could not call the police for help.

It doesn't matter really. The jury knows this: Nic Mui didn't immediately call the police and tell them "I was just attacked by a group of bullies and used my knife and poked a few people." He instead, tossed the knife, told his group the kids had a knife, then tried to leave in his vehicle and when the cops approached, he didn't mention what just happened. He instead lied and didn't mention the altercation or that he stabbed some kids. It doesn't matter how confusing the kids testimonials are. The video shows the MAN approach them, get made fun of, then start poking people with blood spilling out. He was the grown up. He was morally obligated to walk away.

He was stabbed and airlifted out, so I assume he lost a lot of blood. If he was actively drinking at the time of the stabbing, then the alcohol was not fully absorbed (still in stomach). Less blood volume after stabbing equals higher BAC for the amount of drinks he had, which is why you shouldn't drink after donating blood. And don't even get me started on if his liver or splanchnic circulation was injured. Same goes for the rest of the stabbing victims. Bringing up BAC is just for show and doesn't prove anything.
