    Emily!!! THANK YOU for colour coding morning and afternoon and labelling "Morning Day 1". "Afternoon day 1" etc. Always on the replay crew due to time zones. Often used to get lost and would eventually give up watching. With the new colour coding and labelling of which day and which session, I will DEFINITELY be able to follow better and therefore watch the entire case from beginning to end!     It’s so wild to me that upon hearing the opening arguments from the state, it felt so administrative of Ms Guitierez. Like, oh boy!this will be a no brainer. Then moments later, hearing the defense….it switches so fast…this is way more complicated! This is why watching these trials with Emily and the law nerds is so informative!

      I had the same thoughts. It was like welp, yeah looks like those are live bullets and if it can be shown it didn't come from the prop house then it's on her. Then like oh no, here is another thing to consider. Defense is so far doing a good job. As armorer, yes, she should be checking, but if she's trying and ppl grabbing guns from her and not letting her check and not doing their safety meetings and demanding safety that puts her in a tough spot. And even if there is evidence of her doing drugs or drinking in free time, I'd need some good proof that she was affected by that on set or while loading weapons. I really put so much blame on production and Dave Halls. Only wish Hannah had said nope, not doing this cuz she was worried about killing someone then she wouldn't be here, but Helena would probably still be dead cuz Dave would have grabbed guns anyway. Her age and pressures put on her and her representing her step father's name and all that was probably a huge huge huge component. Heck, she might not have even realized she could say, nope, taking all these guns with me unless ya'll are gonna do safety checks and meetings and listen to me. She probably had no experience to even know that was possible

      Exactly! This is why it's so important to always hear both sides, ESPECIALLY when it's MSM giving it out. It's so easy for an unqualified person to look at an event and state, "well it MAKES sense" with no actual investigation. It seems a lot more people are at fault than just her

      I came here to say this too. I have a background in theater and I saw how intense props is. It's basically EVERYTHING that isn't a wall- props sources, designs, fabricates, shops for EVERYTHING an actor touches or set dressing. It's intense.

      I agree and disagree... Production was absolutely cutting cost by doubling up on jobs; it is quite common in independent film making.
      But I don't like it as an argument for the defendant's negligence. While it's never a good idea to split focus between two jobs it sounds like she went in knowing that information. The dates/timeline of production, the job titles, the pay rate would all be in her start work (or at least a deal memo). She may have gotten overwhelmed later but she chose to take on both roles.

      He has to explain it to a jury that might not know anything guns or filmmaking. Though the lack of emphasys and sense of importance of certain elements is quite infuriating. Somebody DIED that day!

    Listening to Emily while watching this makes me realize that ADHD can be a great asset for lawyers. I know that it makes a lot of things harder, especially while studying, but I hope that those who want to become lawyers remember that they have strengths that others lack.

      She could’ve taken a plea deal. Thr first one who accepts a deal gets the best deal. That has always been the case.

      @@kateashby3066 confirmed later she was offered it but I don’t know what the plea deal is. I do know part of plea deal for her is to reveal where the live rounds come from and she said no. This may indicate her team believes if that evidence comes to light her punishment may be worse. Usually it’s true the person taking the first plea deal gets the best package.

    Ironically, the mention of only loading five bullets is an Old West cowboy load. When holstered, the hammer rested on the empty cylinder to prevent it going off half-cocked. Hence the adage : Going off half-cocked.

      It's a flint lock reference, not a cowboy one. Nothing to do with keeping an empty chamber under the uncocked hammer. As soon as you cock the hammer, it has rotated to a live cylinder.

      I don’t think they specified if negligent discharges were blanks or live rounds (lead leaves barrel). The sound is very similar

      Well normally on a set they have only blanks, so Id assume misfires are not nearly as concerning.

    David Halls should be made to testify in this case, he's partly responsible for touching the weapon without her presence.

      If he refuses to testify his plea deal will be revoked. It's literally stipulated in the deal he needs to testify against them both.

      @@lindafarnes486I wouldn’t call what has been said about his deal to be “taking responsibility” as much as cover ass and throw the inexperienced young subordinate under the bus.
      Even based on this opening statement - as the superior and first AD who the armorer is supposed to do the full check in front of, I have to ask why he allowed her to do a shitty check.

      His deal is a load of crap... and how quickly he was given one. They wanted at Alec Baldwin, it's why the deal was given so fast & in my opinion, loose, Miss Guteiriz(sry if spelled incorrectly) has, IMO, been collateral damage and thrown under the bus in the process. I feel like Emily going into this, we will see if my opinion changes as things go.

    I'm working on movie sets in Europe, where admittedly, the departments and responsibilities are structured differently. So I can only speak from that perspective.
    She is GUILTY. For the simple fact that the armorer has the final responsibility for the weapons.
    Her age can not matter at all. If she's too young to do her job responsibly, she can't be the armorer. There obviously just is no margin for error. Same with experience: if she's too inexperienced to do her job properly, she can't be the armorer. Maybe the second armorer, or the assistant, but not the first/main armorer.
    In the question if she's guilty or not, it also doesn't matter who brought the live rounds on set. Same is true for the actor pointing the gun and pulling the trigger. If she had done her job correctly, she would have found the live rounds and only put dummies in the gun. Period. That's her job. She has to check every single bullet she puts in.
    So imho she's guilty no matter what.
    Now that does NOT mean that others aren't responsible as well. If someone else brought live rounds on set: responsible. Prop master not giving Hanna time to do her armorer job: responsible. Alec Baldwin: definitely responsible. In my eyes not necessarily responsible for pulling the trigger as an actor, but very responsible as the producer. Hiring a very inexperienced person as sole armorer. Hiring a part time armorer - in a Western movie: ABSURD. Not caring enough about safety on set.
    But these people being guilty as well, doesn't take away the fact, that checking the bullets and making absolutely sure all guns on set are safe to handle by the actors, is the armorer's job. If she had done her job, it wouldn't really have mattered if someone brought live rounds on set. It wouldn't really have mattered if Alec Baldwin pulled the trigger. If Hanna had done her job properly, this would not have happened.
    And if she wasn't able to do her job properly, due to budget/time issues, she had to walk away.

      It's not really about her being guilty or not. She absolutely made mistakes she needs to be held accountable for and should never be allowed to work with guns again...but she isn't the MOST culpable. She is a scapegoat for the actions of multiple people on that set. Hall should have gotten years of prison.

    No, BRANDON LEE was killed by a tip of a bullet that got lodged in the firearm during a previous scene. When the gun was fired next, the powder created a strong enough thrust to eject the bullet tip. Hit in lower abdomen. It was a .45 ACP that killed BL, a very large bullet. Far from a blank. JON-ERIK HEXUM is the actor on the set of 'Cover Up' that died from wading from a blank. It was an accidental self-inflicted shot to the head due to the wading ejection from the blank.

      @@Cobbido how is her being a woman relevant? Any one young in this position would feel bulldozed. This set was well documented as toxic. There is often an imbalance of power on sets which is dangerous and ends up causing exactly whats happened here. Sit down!

If they purposely chose her because they were going to over work her and push her into unnecessary and unsafe situations that could end her career as it started that definitely needs to be taken into account. We think about all the movie producers that harmed young actors/actresses. Everyone of the producers knew they didn’t need a gun for the staging seen. Many people failed here.

So by “taking responsibility”, I think you are confusing the woman with the two men in charge. But thanks for sharing your misogynistic view.

    The defense needs to quit claiming she was "only" 24 years old while also saying she was very well trained from the time she was little. That is 6 years past being an adult. If she couldn't handle the job, she should not have taken it or should have quit.

      Maybe she was trained her whole life, but her being 24, a young adult, on a filmset with heaps of older people (men), might have meant they didn't take her seriously or listened to her. Wouldn't be the first time a woman was ignored with detrimental results. And now she is the fall guy.

      Defense will never quit using everything at their disposal. Age really does play a part. Because it was an accident, the jury will take nuance into consideration (or choose not to) when deciding her fate. This was her second job so she WAS inexperienced in terms of actually doing it under pressure for work. She may never have worked on a set that modeled for her how it should be done- so when her supervisor orders her to cut corners… she may not have felt confident enough to tell him to shove it (and thus never work in Hollywood again). Im not saying I feel this way, but a juror could.

      Not quite. He’s def responsible but she is an adult and supposedly a certified armorer sand that comes with obligations to do the job properly. If a cop is ordered by their chief to beat a citizen for no apparent reason other than they’re being snarky, that cop is still liable if they follow the command. They DO have the option to disregard their boss and do the right thing.

    This happened in my state. If she's been around guns her whole life as she says then she knows the first rule is to always assume the gun is loaded with a live round. You don't hand it to someone before checking it. And of course you don't aim a gun at anyone loaded or not. If that is part of a scene then you check the gun.

      EXACTLY!!!! The mistakes of having live rounds among blanks BAFFLES me! Even if someone manipulated her inventory, she STILL should have checked before giving him the gun. I do not get it at all. But let’s not put the bullets before the gun now… 😏😂

      So is Alec Baldwin. He’s been around guns his whole life. His father taught a gun course in a high school for years. He also bragged in his police interrogation hours he knew ALL at guns safety on full sets. He’s had over three decades of experience.

      There should be no live ammunition on a movie set. The armorer is in charge of all weapons and all accessories to those weapons, which includes ammunition. This person should have and could have minded all weapons and all accessories for the weapons. I’m not sorry for her. She shirked her job.

      ​@@AgathaMistyDefense did a good job of making me feel she is scapegoat, because many people are to blame. In the end, she didn't do her job correctly that they all rely on for their safety. However, she being very young and at the bottom of the totem pole, it's already obvious that she DID NOT receive the respect she deserved, in that she tried to do the right thing and was very frustrating that other people, like Baldwin, did not do what she asked and I bet they even argued with her about her concerns. Like not being able to train Baldwin. On the other hand, as a juror, I would be swayed by the fact that she was doing drugs, and from what I know about people who do these types of drugs, she was most likely under the influence since she had it at her hotel room.
      I think she will not escape, but the sentence should be light because it seems that other people are ALSO to blame. So sad.

    blame everything on Hannah & Dave does have merit. But.... Baldwin was never "shown" a cold weapon. As the film's producer, Baldwin skipped safety protocols, and carelessly engaged an unchecked firearm.

    I've been pissed about AD Halls sweetheart deal for months. I'm so glad you brought it up multiple times. As one of the safety links in the chain and as the safety officer on set he really should have shouldered more of the responsibility for what happened.

      It appears that in cases like these they’re gunna give the least guilty person the best deal because they need him to testify to get the other two. Just like we saw in Adam Montgomery’s trial- his wife Kayla got off practically Scott free and yet she practically aided in a murder of a child and helped cover it up for years. But it got her to flip and give up all the details in her husband and thus got him convicted. Without her they wouldn’t have been able to get either for murder.

      @@DrunkComments And I suppose that's a fine takeaway. Perhaps my own preference is a prosecutor who's able to explain important concepts to a jury and therefore seem knowledgeable enough on the topic to be able to confidently and competently say "she did it wrong."
      In fact, I would argue that handling firearms in this situation is NOT that complicated and that she was SO reckless because the concepts are actually quite simple.

    I love your goat so much that I bought one for my husband so he can use it at work. He gets frustrated with his job very often and I thought it would give him a good laugh to be able to have his goat scream at them. I lived in NM for 5 years. Their jury process is much different than any other I've encountered or at least it was in the area of NM where I lived. I was on jury duty for 3 months and had to call in each week to see if I needed to report. Even after being on a case you're still "on" jury duty for the full 3 months and can be called to serve on multiple cases. I hated that. Just having to remember to call each week. Most of the people in NM do have a VERY laid-back demeanor. I'm from the South and it was laid back even for me. They're like "I'll get to it, today, tomorrow, maybe next week" kind of style.j

    What people hardly talk about in this case is the fact that the assistant director who handed the gun to Alec told him that it was a 'cold gun', meaning there was no live ammunition in it! This is further proof that Baldwin is not guilty: Baldwin trusted the words of the person he worked with and who was in the production department and oversaw all these things. So if I have been in this business for several decades, like Baldwin and the director's expert/assistant tells me that it is a 'cold gun', then I trust him, just like Baldwin did, because I have no reason not to trust him, because words indicate that the person giving you this weapon has checked it. So why would Baldwin further check this gun if the people who handled it told him it was a 'cold gun'? This is the whole point: the production people whose job it was to prepare this gun told Alec that they had done it!! So they lied because they didn't actually check it! This fact alone exonerates Baldwin, period.

    Emily, I love you platonically, and you really are my go to legal analyst. Having said that: The dude from the opening statements really wasn't that boring, nor do I think he needed to skip parts of what he was saying.
    This is coming from someone who has not closely followed this trial, and who has only heard some news through social media and whatever. I had no clue what exactly was going on, nor do I know about blanks and dummy rounds. I imagine that at least some of the jurors, if not the majority, were somewhere close to the same boat as me.
    I agree he sounded a lot better when he got sped up, but the contents of his statements were not boring or unnecessary, in my opinion. Your treatment of him, however, was a little unnecessary and possibly a little disrespectful to his character.
    Either way I do appreciate you endlessly, and I thank you for taking the time and giving your energy to cover these trials to teach us about the American legal system, and to entertain us while we go through the motions.

    A PROP GUN is just a regular gun.... the only difference is what rounds you place in it. There should have been no LIVE ammo allowed onset. Period. NO exceptions. A replica has no working parts so you can't even shoot the blanks, so that is why a replica was not used in production, I'm pretty positive that is why.
