Many, MANY people will turn a blind eye.
Well Hostin implied that the verdict may have been different if the jury had known about the sexual abuse. I think the jury did know about it. I was very young when this case was in the news, but I remember them saying that they put cinnamon in their father's coffee because it made his semen not taste so bad.
@blanegraham552 the first trial, where the brothers were tried separately, the judge admitted the Self-defense defense. Those resulted in a miss-trial. The second trial is where the judge refused the self-defense defense and left the defendants sitting ducks. It was a horrible application of justice and it was a very tone-deaf decision. People are just bloodthirsty and they don't care who they have to crucify to get it.
Yes ! @jodijodi-fq2eh the law of an imperfect self-defense is hinged on a subjection of constant abuse over the course of time. "Perfect" self-defense only requires two things: 1) reasonable believe immenent peril, 2) reasonable believe deadly force was necessary. Both of those conditions were met according to their testimony, and no proof is required. But even with imperfect self-defense, the penalty is not life. It is a max. of 3-11 years with the conviction of manslaughter, which they received. You all have to remember that these judges are only human and they OFTEN may huge mistakes in judgement. It's not because they went to law school and have had all this practice that their judgement is better than the common man. Moreover, the laws are also created and divided by judges with whom other judges do not simply agree. Such was the case of the superior court of California against the court of appeals rulings. From beginning to end, this case has been poorly treated and handled as an unjust head-upon-a-pike warning. I am disgusted with how this case has been handled in the USA. Their only saving grace here is that they are not people of color.
The bottom line is this case was political in the 1990's and is still political today. Their second trial in which they were convicted 12-0 and sentenced to life in prison without possibility of parole was a complete joke. The Judge limited the sexual abuse testimony thus taking away any defense. Mr. Murphy makes a good point by saying the release of the brothers would open the door for the vilest of lifers to be released. Justice isn't the broad stroke of a brush. Justice should look at each case individually. To those who ask, why didn't they just leave? That it was premeditated. How can an 18-year-old male be raped? I cannot answer these questions. Because I had the best parents in the world. They loved, nurtured and cared for me. However, a first grader who is sexually, emotionally and physically abused up until adulthood may think differently than I. I believe they were horrifically abused in every way. They had no childhood and no adulthood. Almost 35 years in prison is enough. Justice for Erik and Lyle Menendez.
They were sexually abused point blank, threatened by their controlling dad on several occasions that he'll kill them, that in itself is warning call. It was never for money, they were spending that on a daily basis. Kitty Menendez brother don't know sh*t about his sister, did he know that she overdosed on medication and was admitted to Hospital. He knows nothing about brothers and what they were going through, matterafact he never spend time with them at the house either on any given time. The trials was politically motivated, unfair and their was miscarriage of justice. The prosecutors spread the narrative that they did for money, and that it was greed and that's why they killed their parents; nonsense!!!!!!
@FreeBird2.0 Just because you cried over a Netflix series doesn't mean that 2 murderers should be released from prison. Abuse doesn't mean you get to kill. This guy is such a tool. The new resentencing law in California became a thing for a reason. Not *all* LWOP cases deserve to stay that way. The resentencing law focuses on age at the time of the crime (they were under 25), trauma an Individual experienced, rehabilitation and behavior/ disciplinary records behind bars. After 35 years, Erik and Lyle qualify for a new sentence because they meet all the criteria.. this specific case doesn’t mean all rapists, murderers and child molesters can be set free. You’re naive if you think that
They were never convicted with murder for financial gain because the prosecution couldnt prove it. They were given the incorrect sentence anyway, they should have never been given LWOP. It was just because the judge forced the hand of the jury and didnt allow the evidence of SA or more other options than First degree or not guilty.
True, however life without parole is unnecessary. Simply charge them in years and call it a day. There is zero reason ppl are serving sentences knowing they got 400+ yrs & then others just get life…
I think people are dumb who believe all alleged victims of abuse and sexual assault just because society says you should believe them without proof, especially if you know they are known liars like Lyle & Erik.

There should 100% still be life without parole. You just need it to fit the crime. Resentencing this case doesn't automatically eliminate life without parole for everyone. If they boys had been convicted without the prosecutor blocking any evidence of the abuse I'd be fine with it. But the jury that convicted them didn't get to hear about that because of the prosecution.

I DONT CARE ,FREE THEM ENOUGH IS ENOUGH every child deserves parents but not every parents deserve a child and this case is the example, they parents were monsters
Exactly. Jose and Kitty Menendez are not here to give their side of the story. What we do know is the Erik wrote a script about a son who kills his parents FOR MONEY about a year before the murders; Lyle got kicked out of Princeton for cheating, and both brothers were arrested for grand theft of $100,000 worth of property from their neighbors. The father was fed up and he threatened to cut them off financially and out of the will. The murders happened shortly afterwards.
Uh no...DA-elect Nathan Hochman said he will review the case and the facts including the confidential prison files THEN make a decision. He never said he wasn't going to re-sentence them. He has to review the case first. He's not even the DA yet.
Governor Newsom said a few days ago that he will not grant clemency, that it will be up to the new DA elect, who we just heard this guy say, he doesn't think resentencing is appropriate. I think it's looking alot grimmer for the brothers release
What confuses me is how Erik Menendez could go to Dr. Oziel, confess to killing his parents, and yet never mention the alleged sexual abuse at that time. Hypothetically, if the father had some connection to the therapist even after his death, wouldn’t that have been the perfect opportunity for Eric to disclose the abuse as part of his confession? Instead, he only focused on admitting to the murders.🤔
He was ashamed. It was terrible for them to talk about it in front of their own family and ruin their father's reputation. They took it as a betrayal against him.
Because what Kitty's sister wants means absolutely nothing what a joke but I think Matt is unfortunately a construct of our society our society believes that young men like the menendez brothers can't be victim s and that men like Jose can't be perpetrators but men like Jose are often perpetrators and to say well they could have left it's like Eric tried when he was 12 but Jose came and got him and to be honest it 18 with no money cuz if he left he would have to leave with nothing but the clothes on his back maybe he could pack some stuff where would he go I just wish people could think about that before they say well they could have left because it's not black and white did they burgle some houses yeah but did they violently hurt anybody when they were ruled those houses no The only time they've ever been violent with anyone else is Jose and Kitty so you have to wonder what did Jose and Kitty do to make them so violent towards them when since and before they had never been that way with anyone else just say it
Did you not listen or are you dumb? There is no denying that they murdered their mother knowing if she stayed alive they wouldn’t get the inheritance, so if you let the Menendez’s out of their Life W/O Parole conviction it opens this up to every child molester/rapist/murderer in California. Like he said the people that would truly be hurt are the future victims of these people.
He said the country is going to start healing now. Are you serious? Democracy just lost and a dictator has been put in the highest office. Otherwise great interview.
In the second trial the judge hampered the defense by refusing to allow testimony of the abuse. Therefore the brothers couldn’t mount a defense of “imperfect self-defense”-That they falsely believed their parents were going to kill them. This prosecutor is assuming that money was a motivating factor behind the killings. The Menendez brothers have always argued they killed their parents because they believed their lives were in imminent danger. He needs to remember that the brothers are victims of sexual abuse and NOT perpetrators of it.
Welp. I wish I hadn’t seen this because I kinda liked the guy before. Hopefully we can start healing now? Why? Because T has been reelected? Free the Menendez Bros. They’ve served plenty of time, have had zero issues in prison and have been “rehabilitated “ to the point that they wouldn’t do a crime like this again. Isn’t that the point of prison?
“Mothers aren’t supposed to lose their children”… You know what else mothers aren’t supposed to do? Betray and neglect their children by willingly turning a blind eye to years upon years of sexual abuse at the hand of her husband and their father. The hypocrisy when everyone talks about Kitty as if she were some innocent victim is just absurd and infuriating.
If you let the brothers out, don’t see either of them getting anything more than a parking ticket in the future. They killed their parents in cold blood, how many years makes up for that?
I would like to see the Brothers released, I think they should be resentenced. I think cases should be looked at individually. After the Miller v. Alabama case, children could no longer be sentenced to LWOP. Children, although the brothers weren’t kids, can seek resentencing. Not all of them get it reversed, many don’t, depending on the severity of the crime.
The way he explained it is definitely interesting. I mean, I am willing to bet that every person who is in jail for life without parole has been sexually and physically abused and probably came from worse circumstances. So are we going to let them all out? I feel bad for the brothers bc I dont think they are a threat to society but I also don't believe they kill their parents because they feared for their life.
God it's not the same!!! The brothers killed the people who were the first perpetrators of the abused they endured their whole lives. In other words, the parents were killed by their own víctims. It's not the same as a criminals who kill random people for fun because he had been SA by other non people non-related to the crime, get it??
What a convoluted answer regarding resentencing the Menendez brothers. I don't think it should have anything to do with anyone else asking for resentencing, or whether or not a family member wants them released. If these men are not being released to a family member then the family member's opinions should have zero influence. Imagine that, their resentencing vs. sitting in jail for the rest of their lives depends on the fear that other convicts will overwhelm the system with requests for their own resentencing. Ridiculous. Clearly the system doesn't work.
@@ollyolly1221 I understood the answer. That's how I was able to directly address some of his points. Convoluted, in this context, means complicated. With this clarification you may consider reading it, as to not jump to conclusions that make your reaction seem accusatory and rude.
The ignorance and ego in this man are stronger than any truth. He believes his own biases, the man is so blind all he sees is his own self righteousness. He completely fails to see how utterly incorrect he is on just about anything to do with the topic, regarding the brothers. The man is blind to anything that is not his own reflection. The Menendez brothers are far better individuals than this man will ever be. I would chose them over him, any day of the week. They are stellar individuals, this man wouldn’t survive one week of what they’ve had to endure since childhood. Actually, this man probably wouldn’t survive a week without a mirror, let alone a real trauma. He scores zero for empathy, and zero also for any nuanced understanding of the tragic case of the Menendez brothers and their horrific lived experiences.
Matt Murphy is such a tool! His lack of compassion is truly disgusting! All those murder cases he worked has left him cold! 🥶Keep plugging that book Matt!!!
Prosecution cherry picks. Never had a proof to start with, but defence case had. In doubt for innocence! And in this case its countless evidence including countless experts against people saying "i dont believe them", which is morally and legally not acceptable!!! Not everyone who kllls should be in prison for life! They are NOT a danger to society and have good characters having killed in fear, the people who severly absued them. Those things matter and considering THIS does NOT violate anything. It is called justice!
What he claims is FALSE. The new prosecutor stated that he would review all available documents related to the case. He did NOT say he believes they should remain incarcerated. Additionally, claiming that eliminating life imprisonment without parole "benefits" only murderers and child molesters completely ignores the purpose of prison: rehabilitation. Prison is not solely about punishment but also about rehabilitating inmates. Also, using the verb "winning" completely throws his argument out of the window. Please, we're not discussing Monopoly. Is he pretending not to understand the law?
55 family, friends, teachers, coaches all came forward in defense. Jose and Kitty's own family. And he believes the one that barely knew them. Definitely not confirmation bias lol
Mendes situation, back then family didn't speak up & felt they had t handle t situation w/in. My abusive father took a tole on my oldest sister & she would arrange in her mind t do away w him. So I understand their logic, back then too.
To mention that one uncle who is not in favor of release when the rest of the family stands united behind the brothers makes no sense. The uncle was one of the grown ups in that family who could have stepped up and done something for the brothers who were in a desperate situation of unimaginable suffering. But he takes no responsibility for the situation and now he even tries to deny them a second chance in life.
If they were being sexually abused, why didn't they use any of the non violent opinions? File an abuse charge with the police, who would then place the brothers in an abuse protection facility. Why did they not go to an abuse center? Why did they not go to other family members for protection? They had lots of money, so why didn't they just leave, figure out their options? For two wealthy people, with so many paths that they could have chosen, I can't understand why they would choose the most violent path? Money?
Lyle told his cousin when he was a young kid and he got in trouble. Erik ran away when he was a kid and he was reminded for years of how his father will unalive him if he ran away. Tell the police in a culture where rhey dont believe men can be abused. Tell the police on a rich and powerful man at that time...what exactly do you think that would do?
Yeah that is not what usually happens. The amount of times that the police put the abused right back with the abuser, is beyond reprehensible. Children are now collecting their own evidence because the police refuse to believe them, it's that bad. I just read a story about this, Yet again, with the Taylor Cadle case. "Would then place you in abuse protection," sure Jan.

Amazing how he didn’t even answer her question. They did not prove in any way that the brothers were motivated by money. The exact opposite. He aslos didn't speak to the prohibition of the self-defense in the second trial. All he said was some family members don't want them out and California shouldn't get rid of LWoPP.
So, just because a family member feels a certain way, and your politics are at play, you advocate for the withholding of justice???? I sincerely hope that this type of thinking backfires on him.

I hate it when someone thinks differently than you and says here’s the bigger picture, it’s so condescending.
They were not abused. It was a lie from spoiled rich boys who didn’t wanna go to prison
