The defense team for accused quadruple murderer Bryan Kohberger filed official paperwork with the court declaring his alibi for the night four University of Idaho students were brutally stabbed to death in 2022. Kohberger claims he was out driving on the night of November 13 to look at the moon and stars. Law&Crime’s Jesse Weber debates the strength of this alibi with criminal defense attorney Andrea Burkhart.

I go out to the gym at 2am or 3 am and/or running all the time. I turn my phone off all the time. I have never killed anyone.

@@DJ_Cub his touch DNA was found "on an item" at the scene. I am not saying he is either guilty or innocent, but what he has claimed as an alibi, is quite normal, common. The media is suggesting otherwise. The DNA is an entirely different topic.

Andrea does an excellent job explaining things.
Its not an explanation. Its speculation about the evidence. The evidence is sealed and there is a gag order that prevents all of us including Andrea from knowing what evidence there is beyond the PCA and a few court filings that were not sealed when filed.

Alibi no worse than ....i was asleep...didnt hear any screaming...saw a man with eye brows!
😄 yeah. Both has phone confirming them. BK clearly location elsewhere. But frozen shock face in the crime scene.
Problem is Bethany Funke and Dylan Mortensen were cleared by Federal Bureau of Investigation expert interviewers and interrogators to an absolute,undisputed,irrefutable 100% certainty. And keep in mind those agents were brought in from the Denver Bureau to avoid any possible conflict of interest. Three of the victims were found in their beds in the prone position meaning they were most likely sleeping when attacked. One of the standing victims was stabbed in the lungs and neck (mortal wounds) which would make it literally impossible to scream let alone talk. This would be the point where i am exponentially 10 times smarter than you

I’m really surprised to see so many legal professionals either miss the nuance of the paragraph that talks about that specific night or they’re purposefully skirting around it so they have something talk about.
Nowhere does it say on that particular night he was “stargazing”.
“….as he OFTEN DID to hike and run and see the moon and stars”. This sentence is meant to paint a picture, to explain where he routinely went and the reason he goes there.
Next sentence talks about THAT specific night, all it says is that he “drove throughout the area….”.
Everyone, including law professionals, keep referring to this hobby as if it were a ridiculous thing to even consider. All you people need to get out the house and touch some grass.
I was just wondering same thing the other day. All soo lazy people had a melt down by someone been hiker and runner. My husband run the marathon two times. He went out always night, early morning hours before work.
Andrea has made this argument that the mentioning of the stargazing and whatnot is to establish a pattern of behavior and that [BK being out at night] isn't out of the ordinary. she has previously addressed it another places too.

I’ve always had my doubts with this case in terms of the DNA evidence and other factors. I’m gonna pause any judgement on this one until it’s gone all the way through……
Imagine in America we are talking about the strength of an alibi instead of the strength of a bunch of circumstantial evidence. People act offended that they want a fair trial.
In America, you don't need an alibut. What you need is your DNA not showing up on a sheath that's next to a dead body.That's next to other dead bodies.That's kind of what you need....

Maybe they should take a poll on the number of college students, (especially Masters and Doctoral student) who drive around at night to clear their minds. I drove down to the lake multiples times in college, because when your brain is full and you can't sleep, sitting in your car looking at the sky is very therapeutic.
When I was at university I would drive for several hours and sit by the sea until 4:00am. And I assure you that many people who are in college and suffer from insomnia do the same thing.

That is an ignorant statement. An alibi needs to be proven. Furthermore, if you're facing a prosecution that believes that thinks you're guilty, you don't just show all your cards right away. That gives them a chance to poke holes in everything.
Not only that, The alibi of driving around has been out for about 8 months now. What we got recently was the full alibi with details, backed up by an expert witness. This takes time.

Because it takes a long time for this man, to put GPS coordinates from his phone. Especially when the prosecution wouldn’t turn over the phone and the data from it.

Everyone needs to listen again to what Bill Thompson said at the recent hearing. He said BCK was not stalking on 'social media."
I believe what Bill Thompson was getting to was that in the probable cause affidavit it wasn’t stated that he was stalking them on social media. The stalking claim came from Kaylee’s ‘s family not the prosecution.

No one said BK was "stargazing." The media saying that just proves that the Defense needed that survey, because the media has tainted this trial with misinformation. In fact, it doesn't state where he went or what he was doing. It only says he went West, not East. That's it.

The arrest affidavit only states that his phone wasn't connecting to any towers. One of the possibilities for that is him turning his phone off. But it's also possible that he was in one of the many "dead zones" known to exist in the area.

In Idaho, “stalking” means that the victims were aware of the stalking. That’s why I think the prosecution won’t argue stalking. But suggest he had those intentions

Their best defense is to portray him as an insomniac, nervous wreck, ex drug addict. Recently lost his job. Regularly was awake and exploring during the nights.
U said it EX drug addict, EX! Him being up all nite had nothing to do with drugs. Insomniac yes it had all to do with him being up. His neighbor even testified to hearing him vacuum late nites. Being an insomniac he would go driving at night to help himself be able to go home and sleep. We don't have proof that he lost his job. Msm said it but they lie all of the time. If he did it was probably really because of him being accused of murder

The night he claims to be stargazing the national weather service says the weather in that location was overcast and freezing fog. The park he claimed to be at is also closed on the weekends as well as closes at dusk in the weekdays, but the individual in question also suffers from visual snow, something that would make it for hard for the individual in question to do. I’d think it’s slightly weaker than claiming he was playing poker on a smooth tree stump with a talking bear named Hugo who sadly passed away before he could give a statement, but I guess he could change my mind by bringing the evidence.

Well, I assure you that your DNA is found in all the places you visited today, and if a murder occurs in any of those places you were today, you could be guilty even without having committed the crime.

@@deathguise1992lots of people had DNA at the crime scene, we don't know where it was found. Including unidentified males DNA. Police haven't claimed the phone was shut off, only it stopped reporting to cellular resources. It's not as clear cut as you think.
I think her insights are some of the smartest I've heard on this subject. I certainly wasn't expecting her to bring up Maxwell. You could also add that runners tend to be a bit nuts. Running at night in inclement weather is certainly not an impossibility. As a local to that area I would also add that there tend to be some interesting weather zones around here. You cannot look at what is happening in Moscow and say that is what is happening even 5 miles away. The cell towers in the area are set up to cover the highways. Departure from those is definitely going to result in lost cell coverage.

Does anyone know why you can't remove your cell phone battery? So that the GPS is able to continue to track and store your location while it is turned off. The amount of data your phone tracks and keeps about you is scary. They have all that info. Never hear about it, because they don't want us to know. Shutting it off makes you look guilty!
Bingo. Removing the battery is the only way to really go off grid.

Everyone should note that she's a defense attorney. Literally her entire job is making up excuses for any and every possible bit of evidence to try to dismiss it as unimportant. You could have Kohberger on video walking into the house and walking out covered in blood and getting in his car, and this same exact woman would be on here going "Well, it's important to note that we don't actually see him kill everyone, he could have gone into the house, slipped into their blood, and then walked back out so clearly since we don't know we need to exclude this as important evidence."
As a defense attorney, she will NEVER say "Yeah, this evidence is bad and makes him look guilty". Because that goes against her entire job and source of income.

All evidence confirms BK is innocent. No motive, No connection, No Victims DNA, No murder weapon. Hope he sues when he's freed next year

What don’t you understand about touch dna? It’s been explained a thousand times. Someone could have touch his car door handle and the pca says the sheath was “placed” there as his dna probably was. What about the other male dna found at the scene? They didn’t say that was touch dna

It also depends on your cellphone service, plus my son and I have the same cellphone service, but out by my folks where theres a group of trees and inside my folks houses my phone still get service's but my son phone will not get service. We also have different cellphone.

Not only are they bushy but his prtruding forehead causes shadows on his eyes which makes the eyebrows appear even bushier, it's the main feature that totally stands out on his face. That why DM said that, bc even in dim light it would be noticeable!
Fascinating. However, typically when a scientist discovers a valid method of scientific discovery they draw up a research report (peer reviewed), so that the methods used are transparent, tested for validity and replication is possible. I can’t find any research paper for Sy Ray.
This whole case is just spooky. Like how do 4 full human bodies get torn apart with a knife by himself and had time to get away AND return to the crime scene BEFORE the cops were even called. LAWD please give me the strength he got

With all due respect, I feel like some people need to go back and read his alibi again. It didn’t say that he was star gazing, hiking or running that night. They didn’t say that he had any pictures that night.

And it says his PHONE was not in Moscow...it deliberately &carefully never says HE wasn't in Miscow? Hmmmmm...

He has an alibi. Otherwise they would have said nothing. This is very interesting because police changed original timeline to fit narrative wanted. And it has been falling apart on court documents and hearings.

@@ericpalmer3588When you are arrested all your devices are gone. It is called discovery what your attorney needs. He still owns his items properties, that is why state needs search warrants in a first place. If they will not give it, it is violation. I say, shady prosecutor!
They need to get his phone records from the days he has these photos from his "drives" and prove that his phone will surely ping the towers in these locations.

If it was cloudy the night of the murders, where he claimed to be, how would he STILL be driving around for hours? Why wait until the clouds cleared?
But you don't know that it was cloudy the whole night. I have a weather app that says it's going to rain and it doesn't rain.

There is a record of it. Now, that is in Moscow. Maybe he claims to be elsewhere but I have doubts

So all these areas that he says he’s been driving around in that night that’s where they should go look for the murder weapon🤔
The prosecution will easily be able to explain how they got the cars range years and when they knew it had changed. Put the detective on the stand that did those precise measurements from grainy videos and explain why they didn’t get it exactly right.

I started watching Sy Ray's UA-cam channel- Socialite Crime Club- about a week ago after hearing about him on another UA-cam channel, curious about his background & credibility. He & Keri are an awesome duo, both former cops. He is totally credible, no doubt in MY mind. Everyone here saying BK IS guilty- that's not how it works here in the USA! A JURY makes that decision (beyond a reasonable doubt) after hearing both sides. Every one of us who has been following this case should want the RIGHT person to be convicted- ESPECIALLY the victim's families. I'm disappointed that SG would double down before he's even heard the info from the expert witness.
Not gonna lie. I wouldn’t convict. At best, circumstantial. It’s a death penalty case and/or life imprisonment w/o parole.
Touch DNA for the sheath but none found elsewhere (2 other male DNA samples also found on said sheath)

While many in here have formed their opinions, let's remember that Kohberger is currently on trial in "the court of public opinion". We remember this with the George Floyd case. That cop did not kill him, and yet he was convicted. My point is..... what if he truly is innocent? The fact that the police have probably put "all their eggs in one basket", if it turns out he is innocent, the real murderer now has a slim to no chance of ever getting caught. The families of the dead will be the most devestated. Let's just keep an open mind. You would not want the public to convict you of something you didn't do, so let's give him the same respect.

If I was innocent and had an alibi I immediately would of gave it and argued and argued that I wasn't there at the time of the killings. Idk pretty sus to me but I guess we will see how it goes. I pray that the victims gets justice
