- Nicolae Miu's defense delivered their opening statement on April 1.
Miu, 54, is facing charges of first-degree intentional homicide for the death of 17-year-old Isaac Schuman and multiple counts of attempted first-degree intentional homicide for his alleged role in the stabbings on July 30, 2022. His trial begins on April 1, 2024.

I find it pretty questionable that a district attorney (who withheld exculpatory evidence in a case from 2021) would even bring this to trial. "Beyond a reasonable doubt" is a very high standard of proof, and that just isn't possible in this case.
Not guilty. The group of 13 will never do that again.
Clearly, you can see in the video, that Isaac had his hands around Nic’s throat and Nic looked terrified when he stabbed and killed him. Not guilty.
As the old saying goes, if you play stupid games you win stupid prizes. It’s sad someone died but if you’re threatening someone’s life the outcome is going south.

It is very easy to be killed by a punch to the face, especially when you're 55 years old and just went through open heart surgery. Those punches were just as deadly as having a knife, they are both weapons to inflict damage and pain.

It's unsettling to imagine both outcomes: if he had fallen and hit his head on a rock, leading to his death. It's astonishing how swiftly situations can change, leaving us saddened by the tragic possibilities on both sides.

Then the voices got louder, and the teens were became more aggressive…saying how wrong he was and Rhyley just happened to be right there beside the girl who got struck so she was the one that he lashed out at with his knife and thrust his knife into her side, split wide open, 110lbs soaking wet girl… tell me he was really afraid of this woman. He could’ve blew on her to knock her over …. No need for violence and stabbing her! Then other joined in a started manhandle Nick to get him away… then he stabbed and wounded several and killed Isaac, and Isaac didn’t play a role in this discombobulation, except for mediator.. trying to calm him down.. it’s a tragedy! No one wins here!

I think Miu should sue for the trauma he's endured during and after the incident.

I can confirm that the system is generally broken, however, every so often the system will suprise me and do what it's supposed to do. A great example of this is the Kyle Rittenhouse trial.

Everyone who testified to that had a different version. How is it everything is recorded but not that. I'm interested in this trial. I'll wait to the end to see if he's convicted. I think the prosecution over charged this case. This defense team has Rittenhouse attorneys.
@@jennyfletcher5573 put yourself in their shoes .. this was a totally chaotic , an unexpected scenario…someone died, their good friend Isaac, and several of their friends went to the hospital with life threatening injuries..there was so much blood in the water, and some teens internal organs were exposed..hanging out of their body.. they are children, they are in total disbelief on what just happened to them.
So just picture it for just for a moment..if you were tubing down a beautiful river, mid summer, hot,sun beating down on you, with some of your closest friends, just having a grand old time…not a care in the world..would you have a tally board, taking notes on who did what? on who drank what, when and how much? Who smoked.. smoked what? ? This is their own recollection of what happened…doesn’t mean they are being deceptive.. most teens only pay attention to their iPhones nowadays…so I’m surprised that anyone saw anything! When this happened, it was out of the blue..it wasn’t planned or organized, or expected… so when people started seeing blood, hearing screams from the girls, they started paying attention at that time, b/c it’s their people injured..…or in danger…the kids who were struck by his fists, stabbed , disemboweled and they lost a buddy who was killed had , right before their eyes! They were in shock! As well as their friends… if you think you would have a perfect memory on a day your bff died… knife shanked right in front of you....or if you were rushed to the hospital with life threatening stab wounds…I’m sure your recollection of the events would be blurred as well! Shock is what saves people when they are in a horrific accident or they are experiencing a lot of pain..that is why there are so many different variations on what happened…it wasn’t a test, they were not prepared for what happened, no one was paying attention until it became serious.. the defense attorney is repetitive and annoying..like he’s going to catch someone in a lie if he repeats the same questions over and over and over again, in different ways..facts are facts.. and no two people see the same scenario in the exact same perspective, even when they are side by side..especially when no one is focused on what’s going on outside their bubble

He states, “ I hear someone got stabbed. And I fit the description” it’s like really dude? Are you that stupid? then he lied and lied some more about taking the knife away from one of the teens…until he was confronted with the video.. then his story changed drastically! It’s all on tape and believe me the prosecution will be playing his video of Miu’s interrogation at the trial when Miu testifies! If he has the balls to testify that is…He has been caught in so many lies…. He is guilty.. guilty..guilty!!!

He could get punched, loose consciousness for a second and drown or get disabled from lack of oxygen or get a heart attack. It’s a very real possibility. They just started beating him, it could end up very badly for him. Sorry, kid lost his life but the guy was scared of these bullies and defended himself.

When you take everything in- this is extremely unfortunate but it is self defense. I’m sad for the families but someone also said that’s why it’s so important to teach and raise kids to avoid these situations 😢- kids should not even be drinking. None of them were 21- it’s really bad judgement- I’m sure if they were sober this would not have happened.

As a kid at schoool I saw this sort of thing. It was terrifying. One time I thought they were going for my mother. She began responding to the provocation and I pled with her to be silent and not make eye contact with the group. It was in a McDonalds, we got out of there fast.

I think if or when Nicolae is found not guilty, then the group of teenagers should be charged with felony murder. They assaulted Nicolae and someone in their group died as a result. It's the same when 2 people are committing a crime and one is killed. The other person is charged with their murder.

I’m reminded of ‘The Lord of the Flies’. Nick Miu was clearly the victim. They all turned on him then got each other so worked up that they started to get physical with the man. If he didn’t have that knife, they’d have likely ended up killing the man… I’ve seen the video footage. It says everything, so it’s a good thing that idiot filmed everything. He didn’t even stop filming to help his dying friend… What the hell is wrong with the youth of today? It’s a shame things had to progress to people getting themselves stabbed and a boy dying over it all but they clearly brought it all upon themselves.

.08% is an arbitrary number to get the most amount of money for the state in DUI arrests - it doesn’t mean the person is intoxicated. It used to be .10% and more than that previously, and it’s only related to driving a motor vehicle.
Regardless, .219% is indeed enough to be universally considered intoxicated.

Some sort of past trauma with water, being bullied, being touched etc. Given he had to flee a communist country I’m sure he’s seen and experienced some severe stuff. Being pushed in the water is terrifying, I can imagine that triggering a response.
As an old man myself (50+), I'm going to do whatever I need to get home safely to my family. 13 drunks against one middle-aged man, he did what he felt he needed to do at that moment to go home safe. He protected himself against overwhelming odds. Not only should he be found not guilty, but he should also sue the crap out of everyone there that took part. NOT GUILTY!

Body cam video shows her leaving the river, crying that she’d been hit in the face while her friends are still laying in the river. No mention or concern for them.

They claim the girl being punched is what started it but according to the video evidence the teens recorded themselves there is no proof of this whatsoever, what there is proof of is the video footage showing the drunken teens pushing him into the water, attempting to hold him down and punching him. They antagonized him, tried to humiliate him and eventually attacked him resulting in him defending himself.

I had no idea there was a trial. I saw another short video that made the man look like a drunken mouthy coward who was attacking kids.
I dont believe he needed to cut the girl, but Im sure he was in distress and in fight or flight mode and considering his heart disease, Im guessing he wasnt confident in his ability to outrun any of them and too afraid to turn his back on them.
It seems he tolerated a good deal of abuse & punishment before ever taking any defensive actions.
I still havnt seen the video actually played but it seems clear those "kids" was actually an angry mob of adults relentlessly knocking him down, harassing and threatening him over and over.
Those entitled Aholes were absolutely looking for trouble but never dreamed anyone would stand their ground and fight back.
It is a terrible and tragic outcome that I wouldnt wish on anyone, but its the result of the attack they brought on and I cannot fault the man for doing what he had to to get offenders off of him.

Because I have watched it from the start… Mr. Mui rushed up on the group of teenagers…accusing them of stealing his friends iPhone and his snorkel! Neither of which were true! He wouldn’t back down or leave their group! He approached them in an accusatory manner threatening them, and when yelled at then he punched a woman, and of course the man fought back. But during this time Mr. Miu left the group of teenagers, and returned to his group up the river, to retrieve his knife, then he returned about five or 10 minutes ( per his own wife’s testimony) later with a knife confronting them again, slashing out at whoever was in his way! So… who’s in the wrong in this scenario ? A 50 yr old codger man stabbing at will or a group of teens that were stabbed repeatedly and one died!
