@@DonziGT230 Maybe I have to rewatch the case but I’m pretty sure Firestone said she needs a new transmission, they replaced the transmission, it’s working fine she’s not suing for it. 95% of the population has had a car make a sound or do something weird and when we take it to the shop they cant reproduce the problem. Plus I am 1000% sure that when she picked her car up, it wasn't fixed right and was still making that noise she would have said something.

Yes, there are some shops that will break things on purpose or tell you that you need something when you don’t however that actually happening is few and far between. Then if there were ONE employee who did do that, at any respectable automotive shop, they would be fired immediately and maybe get the police called on them as well. They are not dishonest when it comes to pricing though, if that’s what you’re referring to. Yes, they have to charge you extra for parts and labor because that’s how all businesses work. You buy groceries right? Well you’re paying a bit more of course because you are not getting it straight from the source. Same with car parts and having work done on your car. If you bought the parts yourself straight from the source AND fixed it yourself it would be cheaper. If you don’t then you have to pay the customer price for the parts plus the labor for them to fix it. Just like if you hire a cleaning crew to clean your house. Instead of paying $20 for cleaning supplies to clean your home yourself, you’re paying $100 for a crew to come out, do it for you, and provide the supplies to do the job as well. I clean my own house. *I’m just using that as an example!* There will always be people like you who don’t get that and who use absolutes like “all”, “every”, and “never” and are never happy with anything.
The shop did the job and provided a warranty, and she didn’t allow them to rectify any problems. It was too many hens in the kitchen, meaning too many mechanics under the hood, with too many opinions. I don’t believe they were trying to get over on her. She should have taken it back to them to make it right and go from there. The shop still put in a new transmission, so they were entitled to payment. Had she allowed them to try and rectify the issue they all would have been made whole.
Mark of someone who isn’t used to wearing a suit. They come in a box with a matching tie and pocket square (not handkerchief) but you’re not meant to wear both at the same time.
This is what happens when u go to multiple mechanics. No one can find the problem because too many people touched the car. Plaintiff was better off buying another car instead. Idk why this case was so long.
The plaintiff loved going around and around in circuses trying to answer such simple questions and just “wanted to explain” an explanation for your actions doesn’t change the actions you took! And the fact that she has already been to so many different mechanics to get each intricate part fixed on makes me think she’s trying to hustle these businesses to get the cheapest possible fix instead of addressing the whole issue and paying what it will actually cost her
I rember about 20 years ago, I worked for a cloud storage and media management start-up. We had a customer just like the plaintiff. Would complain about our service, but was still using a dial-up internet connection. He would literally call in every day, 3-5 times a day.

I'm not sure I believe her about the battery, because if it was brand new it would be under guarantee and in the letter from the other place it says she needs to renew her battery, so it wasn't new like she said! Most of the time when you have a manual transmission, the thing that goes bad is your clutch kit. It’s possible that she didn’t need an entire transmission and only needed the clutch kit replaced, but you won’t know that without opening it up and diagnosing it. She took the shops opinion about having the transmission replaced and not doing the clutch kit, which is a problem, because she even had to have it opened up again to replace the clutch kit. She should’ve asked this shop why the transmission needed to be replaced and what was wrong with it.
Exactly That is actually what she was trying to explain but Milian didn't have the patience and this monotone talking plaintif who can't seem to state shit in in simple sentences was getting on everyone's nerves. It was her speech style and inability to get to the point that lost her the case.

I agree with the Plantiff. The judge was giving her a hard time, yet she provided each piece of evidence asked. They thought she was lying by checking her whole ass bank account, still was truthful. Those transmission people are fraudulent. I think the transmission business in general is very sus.

She absolutely was right that the issue was mis-diagnosed by that shop. IMO The judge ruled incorrectly. As a mechanic for over 50 years, it was absolutely clear to me from all the fast talking she excitedly was doing that the issue from the start was a bad pilot bearing. The car did not need all those parts they were talking about and did not need a transmission. It only needed the clutch fixed and the pilot bearing. [That is what she struggled so hard to explain to the judge] Further to indicate they did not discover the clutch issue is that they testified they "looked at" the clutch and it looked ok. [that's not the same as took it apart, easy to do at that point, and found it ok] If they had, they would have found the cross treaded bolts and the bad pilot bearing [which is under the clutch, hard to see with clutch not removed]. They just "looked at it" and jumped to "bad tans". That repair shop major league dropped the ball. They were negligent in not finding the true issue. The prove that the plaintive was right is in that the last place she went did find the issue, repaired the bad clutch and replaced the pilot bearing and it was all right from then on. Also, what was so frustrating for the plaintive is that she told them [guided them] from the start that it seems like it could be a bad pilot bearing, and they ignored her. [later she was found to be right about that] She was legitimately frustrated with that shop after she tried so hard to help them and was justified to take it someplace else to have the work done correctly. She didn't deserve allot of what she wanted but the cost at the other shop that made it right she did deserve to get. She likely did not need a new trans but once it's in there it's too late to get her money back on that, but she should of [at the least] got the final shop bill paid [and maybe the part of the bill from the defendant's shop regarding diagnosis, since they failed to make a proper diagnosis] Last: if the pilot bearing is bad when a transmission is replaced that alone could have made it go to pieces and if not when installed it could have gone to pieces soon afterward. That shop failed her, and she deserved compensation to at least the tune of the bill from the shop that finally correctly diagnosed the issue, fixed the clutch and replaced that bad bearing. The judge got it wrong. [she does sometimes as she has read all the papers beforehand and already decided how she will likely rule and because of the poor communication skills {or lack of ability to make it clear} of the plaintive the judge believed the three people from the shop that missed the real problem and caused her a lot of aggravation] Sorry because I like this judge [but she is a bit of a talker herself] [more so than her patience to listen] and she got it wrong in this case.

Yeah we heard you for the 100th time. No need to say it over & over. And you're wrong, manual transmissions can wear out like any other parts of a vehicle. But majority of the time the clutch should be checked first. But to say a manual transmission can never wears out is assainine.
The plaintiff is not making any sense, if she’s driving off with the car, and it’s still making noise, why don’t you make a U-turn and take a right back?

Yes, there are some shops that will break things on purpose or tell you that you need something when you don’t however that actually happening is few and far between. Then if there were ONE employee who did do that, at any respectable automotive shop, they would be fired

They are not dishonest when it comes to pricing though, if that’s what you’re referring to.
Yes, they have to charge you extra for parts and labor because that’s how all businesses work. You buy groceries right? Well you’re paying a bit more of course because you are not getting it straight from the source. Same with car parts and having work done on your car. If you bought the parts yourself straight from the source AND fixed it yourself it would be cheaper. If you don’t then you have to pay the customer price for the parts plus the labor for them to fix it. Just like if you hire a cleaning crew to clean your house. Instead of paying $20 for cleaning supplies to clean your home yourself, you’re paying $100 for a crew to come out, do it for you, and provide the supplies to do the job as well. I clean my own house. *I’m just using that as an example!*

The shop did the job and provided a warranty, and she didn’t allow them to rectify any problems. It was too many hens in the kitchen,
meaning too many mechanics
under the hood, with too many opinions. I don’t believe they were
trying to get over on her. She should have taken it back to them
to make it right and go from there.
The shop still put in a new transmission, so they were entitled to payment. Had she allowed them to try and rectify the issue they all would have been made whole.

The plaintiff loved going around and around in circuses trying to answer such simple questions and just “wanted to explain” an explanation for your actions doesn’t change the actions you took! Most of the time when you have a manual transmission, the thing that goes bad is your clutch kit. It’s possible that she didn’t need an entire transmission and only needed the clutch kit replaced, but you won’t know that without opening it up and diagnosing it. She took the shops opinion about having the transmission replaced and not doing the clutch kit, which is a problem, because she even had to have it opened up again to replace the clutch kit. She should’ve asked this shop why the transmission needed to be replaced and what was wrong with it.
Exactly That is actually what she was trying to explain but Milian didn't have the patience and this monotone talking plaintif who can't seem to state shit in in simple sentences was getting on everyone's nerves. It was her speech style and inability to get to the point that lost her the case.

She absolutely was right that the issue was mis-diagnosed by that shop. IMO The judge ruled incorrectly. As a mechanic for over 50 years, it was absolutely clear to me from all the fast talking she excitedly was doing that the issue from the start was a bad pilot bearing. The car did not need all those parts they were talking about and did not need a transmission. It only needed the clutch fixed and the pilot bearing. [That is what she struggled so hard to explain to the judge] Further to indicate they did not discover the clutch issue is that they testified they "looked at" the clutch and it looked ok. [that's not the same as took it apart, easy to do at that point, and found it ok] If they had, they would have found the cross treaded bolts and the bad pilot bearing [which is under the clutch, hard to see with clutch not removed]. They just "looked at it" and jumped to "bad tans". That repair shop major league dropped the ball. They were negligent in not finding the true issue. The prove that the plaintive was right is in that the last place she went did find the issue, repaired the bad clutch and replaced the pilot bearing and it was all right from then on. Also, what was so frustrating for the plaintive is that she told them [guided them] from the start that it seems like it could be a bad pilot bearing, and they ignored her. [later she was found to be right about that] She was legitimately frustrated with that shop after she tried so hard to help them and was justified to take it someplace else to have the work done correctly. She didn't deserve allot of what she wanted but the cost at the other shop that made it right she did deserve to get. She likely did not need a new trans but once it's in there it's too late to get her money back on that, but she should of [at the least] got the final shop bill paid [and maybe the part of the bill from the defendant's shop regarding diagnosis, since they failed to make a proper diagnosis] Last: if the pilot bearing is bad when a transmission is replaced that alone could have made it go to pieces and if not when installed it could have gone to pieces soon afterward. That shop failed her, and she deserved compensation to at least the tune of the bill from the shop that finally correctly diagnosed the issue, fixed the clutch and replaced that bad bearing. The judge got it wrong. [she does sometimes as she has read all the papers beforehand and already decided how she will likely rule and because of the poor communication skills {or lack of ability to make it clear} of the plaintive the judge believed the three people from the shop that missed the real problem and caused her a lot of aggravation] Sorry because I like this judge [but she is a bit of a talker herself] [more so than her patience to listen] and she got it wrong in this case.
@@gulfy09 Yes! So many people just didn't like the ability of this plaintive to explain the situation. The judge is supposed to look beyond the character and judge on the facts of the case. The judge failed to do her job. [I am so disappointed in the large number of people responding here that just didn't like the plaintive when she was right in her complaint and after doing her own research proved she was right all along about it only needing clutch work and a pilot bearing]
I think the judge missed the fact that her initial complaint was the clutch and she did have evidence of that. However she does talk a lot.

Yeah we heard you for the 100th time. No need to say it over & over. And you're wrong, manual transmissions can wear out like any other parts of a vehicle. But majority of the time the clutch should be checked first. But to say a manual transmission can never wears out is assainine.
The plaintiff is not making any sense, if she’s driving off with the car, and it’s still making noise, why don’t you make a U-turn and take a right back?
