Sounds like he didn't have access to the domain records. You can move the site anywhere you want if you can access the DNS records. Wordpress sucks. I had the same issue he did. A previous person set up sites that were failed. And understand that plugins are third party so wordpress doesn't support the plugins. Sadly this guy didn't articulate well the problem.

Agreed, this was painful. Plaintiff knows a LOT, but has a few gaps in his knowledge and (like many tech people) has a difficult time explaining things to non-tech people. The Defendant is pretty lacking (take a drink every time he says "secured"). Judge Milian is SO super smart but she also struggled to understand the Plaintiff's explanation. Bottom line, the Plaintiff should have backed up the site before he did anything to it, then shut OFF all auto-updates to Wordpress and plug-ins. Then if he upgraded and found that it broke the site, he could restore the back-ups and go from there. Also, shout-out to Namecheap and their fantastic Ukrainian tech support!

I think the Defendant expected a lot more without understanding how these jobs and websites work. It's not a one time job if you want ongoing maintenance and security. Plaintiff should have been able to do a site from scratch but it's a lot easier to just use what's already there. Old website dude probably didn't give the password because for whatever reason he didn't want someone taking credit for his original work. Wordpress sites are always updating its plugins, totally feasible that the plugins no longer worked with the older parts of the website. It's not difficult to understand..

When a plugin updates you may need to reinstall it, he simply deleted it like it wasn't his problem yet he charged for monthly upkeep of the site so he took on that responsibility. He clearly has only a very basic level of knowledge yet presents himself as an expert.

I work on a site that someone else built with two dozen iffy plugins; haven't updated those things in a year. Sounds like he has a very basic knowledge and uses the overly complicated terms in hopes he can sound like an expert. When a site breaks, it can be quickly fixed, especially if you have access to the hosts tech support who will do the majority of the work or pinpoint the error and how to fix it.

Word press plugins are generally developed by third parties. And to know whether a plug-in is compatible, you have to install and test it. Installing the wrong plug in can break your site and cause security breaches.

The plaintiff was in over his head, he's not a developer he just knows how to install plugins and apparently not even that well. He struggled to explain what WordPress is and how plugins and themes are independent from it. He needed to explain to the judge that he isn't liable for fixing anything that may go wrong if site functionality is lost due to updates either to WordPress, a plugin or the theme. If that were the case everyone would get a free website build under a maintenance contract.

To have absolutely no access to the backend, it would require the first guy to use his own personal credit to register the domain, which wouldn't happen if he ran off with the money. I was in a similar situation with a non-profit I was helping last year and we figured out a solution in half a day. The plantiff had absolutely no idea what they were talking about the whole time. Plugins don't update on their own, it's not some great technical challenge to find a new plugin, and if a site goes down, it can be returned to normal in less than 30 minutes. He was likely incredibly lazy and thought the defendant was so ignorant that if he just said enough technical words that he'd believe him.

I think “secured” means from a cybersecurity point of view. I’m in cybersecurity and oftentimes plug-ins can be used as vulnerabilities. So they’re often upgraded to fix it. Blame the bad actors who take advantage of that.

OK I've used WordPress before more than once and I know way more than the judge does. You do have to have compatible plug-ins and if the plug-in developer does not update it when WordPress does, it often will break. When he says it takes time to find an appropriate plug-in that will work, he is completely accurate in that statement.
The plaintiff doesn’t understand how any of it works but is so certain that the defendant didn’t do his job. He doesn’t know enough to know he’s unreasonable.
The biggest problem is the plaintiff sucks at explaining himself. I totally get what he’s sayin and the judge doesn’t. When a host program makes a big update to a new version, they can make changes the make old plugin apps obsolete until those apps update themselves to keep up with the host. The defendant was upset about the site not working and was already a month behind on his maintenance when the site went down. So what he needed to say was that 2 months is not enough time for the PLUGINS to catch up to the host site because they have to release those updates before hand. This happens all the time. And he made the fix it just didn’t work the same until he could find the proper plugins. That’s not a good reason to to deny him at least his first month of work. 🤔
Plaintiff has no idea, before you upgrade wordpress, you have to test on another server if the upgrade is going to break anything of the original site, such as plugins.

Web dev here…Wordpress does NOT auto update plugins or core functionality unless you have it turned on. You can turn it off. Both guys have no idea what they’re talking about.

I think “secured” means from a cybersecurity point of view. I’m in cybersecurity and oftentimes plug-ins can be used as vulnerabilities. So they’re often upgraded to fix it. Blame the bad actors who take advantage of that.
The plaintiff was in over his head. I think I could fix his problem just by starting all over. The defendant really doesn't whats going on.He is just repeating something that he heard from someone.

OK I've used WordPress before more than once and I know way more than the judge does. You do have to have compatible plug-ins and if the plug-in developer does not update it when WordPress does, it often will break. When he says it takes time to find an appropriate plug-in that will work, he is completely accurate in that statement.

The biggest problem is the plaintiff sucks at explaining himself. I totally get what he’s sayin and the judge doesn’t. When a host program makes a big update to a new version, they can make changes the make old plugin apps obsolete until those apps update themselves to keep up with the host.
The defendant was upset about the site not working and was already a month behind on his maintenance when the site went down. So what he needed to say was that 2 months is not enough time for the PLUGINS to catch up to the host site because they have to release those updates before hand.
This happens all the time. And he made the fix it just didn’t work the same until he could find the proper plugins.
That’s not a good reason to to deny him at least his first month of work. 🤔
When he said secured he more than likely meant with a certificate. The fact that the plaintiff didnt know shows how incompetent he is.

God, listening to non-technical people talk about technical things hurts me SO bad.
Plaintiff has no idea, before you upgrade wordpress, you have to test on another server if the upgrade is going to break anything of the original site, such as plugins.
