      "Protect and serve" is a lie. Supreme Court has ruled police have no duty or obligation to "protect" citizens. They have one function as an entity; to generate revenue. An Arizona Judge has ruled that law enforcement isn't even a real profession. Interesting, huh?

      @@lightw8johnny There was no stop sign. The lights were flashing yellow. Flashing yellows are just caution lights. With no traffic he was not required to come to a complete stop.

      Charges were dropped, but they got him for on the offensive weapon. Which is a lesson for everyone that cops abuse their powers knowing that they can find something to cover them in almost every case, because people are lazy. Make sure you know the legality of everything you do and certainly don't have anything that might be an offensive weapon with you if you don't plan on acquiescing to police power cos they will find it and use it.

      He made a HUGE mistake taking a plea… I don’t think that they had a justified Terry stop because the states definition of accelerating too fast is not just a chirp, and cornering is only too fast if you leave your lane or the tires lose traction. Poor guy shouldn’t have caved.

Since the poison tree's first generation evidence must be suppressed, the fruit of the poisonous tree doctrine argues that derivative generation evidence should also be suppressed.

    I’ve noticed in loads of these videos, when drivers stay in their car the cop often insists they get out and get handcuffed. But if the driver is already out of the car or attempts to get out they insist that they get back into their car, and both versions are explained as officers safety.

      I've been saying this for a couple of months now and I've been saying at more often and I wish other people would pick it up and start carrying the banner with me. I do not believe that we're in a position to change all the laws that got us in this position, although if we stopped calling them lawmakers and start referring to them as law custodians maybe they'll start dealing with it in that way someday. And we're not going to be able to really accomplish anything by the defund the police or any of that because it's already been hijacked and in reality it probably never would have worked .. We've got too many loose strings to allow just social workers to deal with some of the insufficiently aided people out on the streets and in other play places who have just been run through the wringer, run through the system ,
      stripped of posessions ,value and self ,-worth dignity ,even theúr own families ,children ,friends ,futures and employability ,then booted out the door. Theres no 3asy path ,and the only solution I can really see-and that we need to do in this country - would probably be the easiest, and would probably fix a lot of the ills that are happening in policing today. S8mply turn policing around and quit letting it be a career occupation. For instance,( just spitballing here )for those not going straight to college at 18,9r military, can serve aa a 6 yr police officér.That being a Catalyst for college credits and financing. If someone has shown the aptitude, desire and stability to become a detective ,they can put in 10 years as a detective if all goes well then the remaining four of the 20 as a trusted consultant when needed. That gives 20 years to those who really do the right job . It gives structured discipline for those just turning military service age without having to send them off to war in other countrie. Good college credits to move on with their life after this 6 years ,which by all means they could be taking college classes while they're doing their 6 years I just believe this would stop the good old boy... got your back.... no matter what you do..I turn my eyes.. don't look at what you're doing....and all other BlueLine crap. Anyway, with somebody coming into the station and out of the station every1- 2 maybe 3 years.. there's not going to be that loyalty to each other on a personal level- and maybe more of the loyalty to the country and the job for which they've been hired . It would damn sure slap the crap out of the Union because there wouldn't be people paying those 20-25 -30 year dues and would eliminate moving up the ladder into the Union Rank and file... the blue line with eventually Wilt away because it isn't going to be us against them... it would be more of the individual trying to make sure they do the best job they can because their future and their next career basically depends on it. They wouldn't have time to sit around, get Fat Pat each other on the backs and get enough information on each other that nobody wants to open up any can of worms (on anybody else)as it might spill out on them. I really don't see any other way that we're going to straighten this out other than actually welcome those young men and women who go over and fight our war at that age become the ones will end up fighting the war here preserve our rights. Let the battle be against the things and people who wage war against the populous in America

    When my daughter was 6 she waved at a cop while we were at a red light, after he left the red light the cop got behind us and pulled us over for no reason. He actually said the reason I pulled you over is because the little girl waved at me. From that moment on my daughter has been afraid of officers. She's 40 now and still hates cops

      Similar thing happened when my oldest son was little. It was summer and our windows were down. A cop pulled up next to us not wearing a seatbelt. My 5 year old son said, “Buckle up copper.” The cop got behind my car and pulled me over for “failure to signal a lane change” even though I wasn’t changing lanes.

      @@johnblossom8447 Even if you had changed lanes and did't signal, as an advanced driver, I am only to signal when can benefit another road user. If the car behind is for example too far behind for it to matter I won't signal. I also won't signal if it is obvious where I am going such as in a dedicated turn lane.
      In the USA though they seem to have 100s of rules to do you on and in some cases follow a driver for miles to find one.

      He was so out of breath from the smallest amount of physical exertion. Imagine if he had to deal with someone who was actually resisting, not the, you didn't put your hands behind your back the second I told you to, "resisting". His current state is a liability in a situation where he needs to protect his partner or a member of the public. He belongs behind a desk. I bet he has trouble just standing up or walking up a flight of stairs. And then you see the rest of them; I don't think that department has minimum physical fitness standards.

    How is it cops can just grab you without saying you're being detained or under arrest? Of course everybody is going to resist that because it doesn't make any sense. How can a citizen be considered 'under arrest' without being informed?

      I think the theory is that the red and blue lights mean you are detained and not free to leave. But I agree with you, at no point was this guy told he was under arrest before being grabbed and man handeled and hand cuffed. To me this is a case of excessive force. He plainly stated he stopped him for "taking off quickly" and then "spinning his wheels", no part of that warrants grabbing him. The cop also told him to get back in the vehicle, then as he opens the door says do you have DL, R and I, then quickly says stand over here all in the span of about 30 seconds. Which one was he supposed to comply with, they are all contradicing.

    The law ought to require them to clearly say "you are under arrest", and then wait at least ten seconds before they are allowed to get physical. Otherwise, telling someone to put his hands behind his back is not a lawful order, is it? Also, if people are not aware that they are under arrest and someone grabs you, the natural reaction is to pull away, which they call "resisting arrest"

      Working around "Mens Rea" (Latin for a “guilty mind”) is a terrible problem in the USA. "The Pressing Need for Mens Rea Reform" on "The Heritage Foundation" website describes the phenomenon as over criminalization.
      The case of Criminal Trespass against Travis Heinze somewhat recently in Paduka KY, exposed the serious need for reform since the crime in "normalized practice", working around Mens Rea, makes it illegal to go on any private property not owned by you. Travis' case is far worse than that however, since they also ASSUMED authority of the church and charged Travis believing they had permission to do the church's bidding on their property.
      On top of all that, trespass is a Civil matter which only permits LEOs "peace keeping" duties.

    The cop pulled him over and didn’t charge him with anything related to the traffic stop. Therefore he was illegally detained and searched. The weapon was found due to the illegal search. Therefore he was illegally arrested for the weapon found and had every right to resist an illegal arrest.

That case should be tossed, the prosecutor keeping it alive should be charged with malicious prosecution, the cops (all of the ones on scene, not the guy who died, obviously) should be fired and charged.
      That's in Florida. Ron DeSantis lost any credibility with me long before the Primaries because his executive branch, the cops, all throughout the state are completely out of control. If he can't control his branch of government in his state, how is he to be trusted in the White House?

    It should be a federal law that all police must explain the reason for a traffic stop as soon as they make contact.

    This kind of "plea" deal happens all the time. The cop loads the guy up with multiple tickets for ease of negotiating with the prosecutor so the "VICTIM" gets stuck with something. It is disgraceful, and it is not policing or law enforcement. It is Gestapo bullying.

    Why don't prosecutors prosecute police who admit on their own bodycam videos that they're retaliating for lawful activity? The only logical answer is that they want to stay buddy-buddy with their friends.

    He didn't "get on it". He's got a rear-drive car and he hit a puddle which was clearly visible, so course the tires might have slipped a bit. This cop is insane and this is clearly targeted & retaliatory, and he looked for ANY feeble excuse to stop him.

      That's a defense in court, that very well may win. But by using that defense, you are admitting that the stop itself was legal. You are admitting to your crime, but it wasn't a crime because of the justification that you gave. In order to prove fruit from the poisonous tree, to get the resisting on weapons charge dropped. You would have to prove the stop was illegal. That the cop just made everything up

      @@howdoesonesocial Spinning out around the turn. That's illegal. The puddle gives a justification for spinning out. But that's a justification that is used in court. Just because you are not guilty, doesn't mean that the police do not have probable cause.

    In this day and age it is hard to say anyone that takes a plea is guilty of anything because the vast majority cannot afford the fight. The prosses is the punishment. And even if you are innocent there is no guarantee is going to see it your way with the way the Judges will not let the Juries hear the truth.
