  • A straight forward explanation of how to get off probation early and why you should. A probation can be terminated years earlier than the original date set by the court.

I really enjoy ur channel !
I was convicted of Terroristic Threat and got time served 11 months followed by 3 years probation. I’ve gotten conflicting info about whether I’m eligible here in Pa for early term but all my court costs and everything are paid in full.
I just got a new PO and idk if it’s a good idea to start asking him right off the rip about getting off early since I still have 33 mos left. What do u think?

As a general rule, you should wait until the half way mark before asking for early termination. Also your PO can be very helpful in getting your probation terminated early. Before the judge will grant an early termination, the judge will reach out to your PO for input about whether to terminate early. So always do your best to keep your PO happy. No violations makes for a happy PO. Good Luck!

@@THEFEDORALAWYER TY much. I wish u practiced in the state I reside (Pa) and as time goes on the more I think my Pvt Atty took the 15k from me and scared me into an unfair plea bargain copping to 2 misdemeanors after originally getting charged with 16 bs charges. I did one of the misdemeanors and told him I wouldn’t cop to the one I didn’t do. He advised me against rolling the dice as he termed it bc if convicted a coulda got 10 years for the ridiculous felony they falsely charged me with. It’s quite the long story as I’m sure you’ve heard thousands but I still feel screwed

@@borgata_boss4088 Your attorney should be reviewing all the evidence with you before you plead to anything. I don't try to bully my clients into a plea. I just give them the facts and my best advice as to the outcome of going to trial versus pleading guilty. I am also very reluctant to help a client plead to something he didn't do. Sorry to hear you had a bad experience. Sorry also for late response. I was in court all day yesterday.

As a general rule most states allow you to request for early termination at the half-way mark in your probation. First check with your PO to see if there is any opposition to early termination. Then you likely will need to hire an attorney to file a motion with the court and approach the judge to early terminate the probation. Hope this helps.

I was put on 3 years probation after my November release from Jail. I was put on minimum supervision after the first couple months, and I have been providing clean drug tests, even though Marijuana is legal. I believe I am trusted and on good terms with my PO. I can't stand being bogged down by probation, and I want to expunge this nonsense from my record. I believe I have a chance to terminate June 2024 as that would be the half way point. After that l, I'm moving out of this place and never coming back.

I would absolutely try for early termination. Sounds like you meet the criteria. Worst case is they say no and you continue on probation. No reason not to try. Good Luck!

Do you have to get a lawyer to get off probation early or can you file yourself

    • @THEFEDORALAWYER

You are better off getting a lawyer to help you. Generally you must file a formal motion and possibly have a hearing in front of the judge. So using a lawyer is a good idea. Always check with the probation officer first to see if they are agree to it. Judges usually go by what the PO suggests.

HOW CAN ANYONE HAVE A PROBATION OFFICER TO REPORT TO WHEN THAT SOMEONE HAS NEVER GONE TO TRIAL, NEVER CONVICTED OF ANYTHING, YET IS COERCED, INTIMIDATED, THREATENED, THREATENED WITH KIDNAPPING IF THEY DON'T REPORT OR SHOW UP TO COURT, WHEN THAT MAN/WOMAN IS PRIVATE, NOT A CITIZEN, OR WARD OF THE COURT, OR SUBJECT, CATTLE/CHATTEL OR INFANT?
I PARTICULARLY LIKE THE FACT, THAT THEY HAVE " NO JURISDICTION " SO DETERMINED BY THE SUPREME COURT. HOW ABOUT THAT?
HOW ABOUT ANOTHER FACT, THEY KIDNAPPED SOMEONE WITHOUT THAT JURISDICTION, COMMITTED CRIMES AGAINST THEM, UNLAWFULLY IMPRISONED THEM FOR OVER 3 MONTHS IN SOLITARY CONFINEMENT? HOW ABOUT THAT?
HOW ABOUT IT BEING SOMEONE WHOSE NEVER DONE " ANY " WRONG, THERE IS NO INJURED PARTY, THEY ARE TOTALLY DISABLED, A WHEELCHAIR USER, WITH SERVICE DOG WHICH WAS SEPARATED FROM THEM.
HOW ABOUT THEM HAVING ABUSED THE PARTY EVERY DAY, INJURED THEM WHILE CONFINED, DENIED MEDICAL ATTENTION, DENIED OTHER THINGS PERTAINING TO THEIR HEALTH NEEDS?
    HOW ABOUT THAT? THANKS

You cannot be on probation unless you have been convicted of a crime. You may be required to appear in court if you have been accused of a crime and you are on bond pending the outcome of the case. In that case you are required to appear in court or your bond could be revoked by the judge.
