The defense team for accused quadruple murderer Bryan Kohberger wants the Idaho Supreme Court to toss out his grand jury indictment on four charges of murder. Kohberger is accused of brutally stabbing four college students to death in their off-campus home near the University of Idaho. Law&Crime’s Jesse Weber discusses the defense’s novel claim with criminal defense attorney Andrea Burkhart.

Imagine being _his_ parent or loved one.
The loss of a child will become a fixture in a parent's heart for the remainder of their life.
The four victims who were brutally attacked and ultimately succumbed to their wounds is an absolute tragedy without an iota of justification.
That being said, their lives are frozen in time as memories that celebrate their best selves. They are cherished and revered. Because of the nature of their deaths, they are essentially eternally protected from any criticism or negative sentiment. Their well-wishers will protect them unconditionally.
The ones they have left behind will learn to heal in time and it is unlikely anyone would want to cause any of them further harm.
The Kohberger family, on the other hand, for starters has to live their lives will all these preliminary court proceedings are underway. This is not to invite empathy for him. I was just considering this would be much more horrific (in my opinion) than the alternative you mention - although neither should be envied.

During the voir dire for a trial about whether a corporation is legally liable for the egregious actions of one of its employees, I shared that I had had multiple professional interactions with a couple of the witnesses who were also employees. While I was not eventually selected as a juror, I made it through multiple strikes until it was between me and another potential juror. I couldn’t believe it. Having a prior relationship with a witness was hardly a rule out and it wasn’t like any of the other jurors had a prior connection. The case was being tried way across the state because it was federal.

I feel like the question is more like, why does anything to do with he way jurries work something that the general public finds acceptable? There is so much one sided profiling and manipulations with juries. It really needs to be reformed because now everyone, potential jurors will see news articles and UA-cam videos all over the place about a case they might work on. The solution clearly is not to play make believe horse blinders making these people take the burden of not looking into it more. If anything they should be picked as arbitrarily as possible and be allowed to hear or witness whatever it may be. Doctored and manipulated justice isn't real justice. It's just charades.

A grand jury is where the prosecutors bring evidence to (usually) a secret grand jury. The grand jury then decides if they have enough evidence to be charged. What if investigators do find the knife? Due to the gag order, only the prosecution would know about it and the prosecution would have to turn it over or share it with the defense as Discovery. @@plinky_planet Sounds like defense is just trying to delay based on BS.
They tried throwing out the indictment three times already and all three times the indictment has stood. His defense lawyer seems inept. If the defense wanted a preliminary hearing so badly , you have to wonder why they waived his right to a Speedy Preliminary?
Kohberger could have had the preliminary hearing his lawyer’s been crying over the past year within a few weeks of his arrest.
She’s the one who wanted to take the gamble and request a the unreasonable amount of time to hold a preliminary hearing 6 months later. She all but gave the prosecution a grand jury indictment on a silver platter giving them enough time to get their ducks lined up in row and convene a grand jury.
Now she’s crying over the opportunity she let slip out of her hands and wants to waste everyone’s time trying to get a do-over? She should have thought about that before waiving his right to a Speedy Preliminary. 😂
