The defense team for accused quadruple murderer Bryan Kohberger wants the Idaho Supreme Court to toss out his grand jury indictment on four charges of murder. Kohberger is accused of brutally stabbing four college students to death in their off-campus home near the University of Idaho. Law&Crime’s Jesse Weber discusses the defense’s novel claim with criminal defense attorney Andrea Burkhart.

The Idaho Supreme Court just denied this motion.
Really?
If anyone is wondering I fact checked this and it's correct. So thank you for the timely update!

I feel for the parents having to go through this.
I do too, but they are his rights and those are afforded to everyone! 🇺🇸
Imagine being a parent or loved one of the victims.
Imagine being _his_ parent or loved one.
The loss of a child will become a fixture in a parent's heart for the remainder of their life.
The four victims who were brutally attacked and ultimately succumbed to their wounds is an absolute tragedy without an iota of justification.
That being said, their lives are frozen in time as memories that celebrate their best selves. They are cherished and revered. Because of the nature of their deaths, they are essentially eternally protected from any criticism or negative sentiment. Their well-wishers will protect them unconditionally.
The ones they have left behind will learn to heal in time and it is unlikely anyone would want to cause any of them further harm.
The Kohberger family, on the other hand, for starters has to live their lives will all these preliminary court proceedings are underway. This is not to invite empathy for him. I was just considering this would be much more horrific (in my opinion) than the alternative you mention - although neither should be envied.

What a psychotic thing to say. Love watching Americans fail to appreciate their rights and utterly selling out for the most petty reasons. I can't imagine why any good American would be content seeing someone locked up and the key just tossed without a case for guilt even being made. When did we lose our American values?
This is ridiculous!!! No wonder she keeps pushing back saying she needs more time. Because instead of getting ready for trial…. She’s wasting time trying to get it thrown out when it won’t work!
Judge needs to step up and bring on the trial!
exactly !!!!!
Yes!
Sadly she has to try. I think she’s smart to handle it the way she is. It’ll minimize any grounds for appeal.
She’s doing her job. Drafting and filing motions is likely a sliver of time compared to going through all the discovery. She’s also not his only lawyer
If he is innocent, he should INSIST to go to trial and prove his innocence instead of trying to find loopholes to excuse his crime.
That's an insane strategy. Going to trial is like flipping a coin. Juries convict innocent people all the time, and also let the guilty go free, to a lesser extent. Ask a lawyer, literally none would say it's worth it to prove your innocence.
He is guilty the expert I know has made It clear.

They survived their murders? Dispassionate information is definitely the way to go here
During the voir dire for a trial about whether a corporation is legally liable for the egregious actions of one of its employees, I shared that I had had multiple professional interactions with a couple of the witnesses who were also employees. While I was not eventually selected as a juror, I made it through multiple strikes until it was between me and another potential juror. I couldn’t believe it. Having a prior relationship with a witness was hardly a rule out and it wasn’t like any of the other jurors had a prior connection. The case was being tried way across the state because it was federal.
I feel for the family of victims who were stabbed to death. I can’t t imagine no Justice for these brutal stabbing to these students! This is crazy defense actually going to try this. Meanwhile that house the brutal crime has to stay up til the trial. The plans are to destroy this house. The house was destroyed in January. It is gone.

This is so annoying! Ridiculous really! Defence keeps saying they need more time to look at all the evidence before booking the trial but they want to waste time with Supreme Court?? This guy is having the time of his life being in the spotlight. 🤬😳
Change the Constitution if you don’t like it. Time travel, perhaps?
@@plinky_planetshe’s the one trying to change the constitution. She’s tried throwing out the indictment three times already and all three times the indictment has stood.
This defense lawyer seems inept. If the defense wanted a preliminary hearing so badly, you have to wonder why they waived his right to a Speedy Preliminary?
He could have had the preliminary hearing his lawyer’s been crying over the past year within a few weeks of his arrest.
She’s the one who wanted to take the gamble and request a the unreasonable amount of time to hold a preliminary hearing 6 months later. She all but gave the prosecution a grand jury indictment on a silver platter giving them enough time to get their ducks lined up in row and convene a grand jury.
Now she’s crying over the opportunity she let slip out of her own hands and wants to waste everyone’s time trying to get a do-over? She should have thought about that before waiving his right to a Speedy Preliminary.
A grand jury indictment is written in the constitution. Now she’s trying to change the prosecution’s right to obtain one? 😂
Why did Anne Taylor ask for the Courts permission to speak to Kolberger's Parents? I feel like if his parents gave evidence to the FBI that is why the Family hasnt visited him and this is why she needs Court permission to speak to them.
He wanted to see his parent's they denied him , his parents were not allowed to see him? Strange isn't it
She claimed it was examine forensic DNA evidence related to his name coming up as a suspect. However that has already been deemed irrelevant by higher courts since the police are allowed to pursue any lead regardless of the source. So there was no good reason to go forward with that line of investigation.
This lawyer is just delaying. It’s clear. This is a frivolous motion. This is why you have appeals court. To appeal legal issues appealed after the fact. The defense only is concerned with appealable issues that affect the defense. Here they’re literally worrying about issues that would affect a trial and a guilty verdict
He's playing by the TRUMP playbook. admit nothing and keep working the courts.
If there were any truth in that, then the state should be handing over their discovery. They're refusing to do so. It's amazing how easy some people are to manipulate.
@@sneakyviewing4391This isn’t going to trial until at least 2025. Taylor said she had 51 TBs of data to go through. She’ll get discovery in time. People need to stop harping on the “delay”. This case isn’t taking any longer than many others. The Vallow case took longer, there’s several cases that took 3-5 years so this is a non issue, stop making it an issue. If the prosecution has such a strong case than they shouldn’t have been afraid of a preliminary hearing, they should hand over the discovery as well. They’re the ones causing the “ delays”.
Exactly! Well said !
Demanding his alibi sounds like tricks police use to get Mirandized people to talk. If they have a case against him they should just go forward with it instead of cry baby blaming the defense...which isn't even some hotshot homicide attorney, they're public defenders for crying out loud.
They have a GJ finding, they don’t need a PH as well.
There should have been a PH instead is what I’m saying. The shadiness of this event began with DM & BF not calling 911 and it continues all throughout this legal process. BT knew they had shaky evidence that they couldn’t explain and he didn’t want AT to have a chance at questioning it openly until they an opportunity to shore it up so he denied her the opportunity. He’s taking this time to overwhelm the defense with a mountain of evidence to go through in the hopes she won’t be able to put the pieces together.
Like look at Delphi which was 2017 and now they are starting to think on that one they may not have the right guy.. which back when I seen that case I personally did not agree on the arrest of that one either..
With the BK case four people were murdered four and Bryan had no dna on him in his vehicle? Or where he resided now with that being said I guess he could have changed before getting in the car or cleaned off but than Dylan the girl who seen a guy with “bushy eyebrows” which could have been anyone.. the house was literally bleeding on the outside how would he not get any dna anywhere?
This case should have been tossed a long time ago, grand jury proceedings are. So unconstitutional, preliminary hearings are much more fair to the defendents.
Please don't interrupt and speak over each other ,makes it extremely difficult to listen to as im disabled and trying to follow subtitles
Great episode, the lawyer was so good…I realize why lawyers are so important. Every word she stated was so articulate and significant to her statements. Shout out to the sidebar too I always tune into these videos because I will get what’s really going on in this case.
The link below is showing it was denied (his motion) but they did have the request for having his motion sealed granted
His tactic is to slog it out and hopefully get lucky , the more time that goes by the more likely hes going to get lucky
That's not how this works. The more time it takes the more each little detail will get picked over instead of being forgotten about. BK is in locked up this whole time so I'm not sure what you or anyone else realistically has to be upset about.
his tactic is "he is innocent"
@@sneakyviewing4391 not 100% true. Emotions die down and people get less heated over time. A law expert in this show said this a few weeks ago. Delay is a good thing for the defence. If another year passes, people will feel less intensely towards BK.
Yup
A delay is always a problem until you're the one on trial. If you're going to be convicted it should be done properly. My life shouldn't be surrendered because the public is impatient.
Especially with the charges he has!
Meanwhile, AT complains that there’s ’more than 400 witnesses, the alibi defense, and other preparation issues that mean we cannot go to trial for another 18 months and last for 12-15 weeks’… if she put her focus on those things, and not on this pre-appeal bs… maybe we wouldn’t need the 18+ months! The unending delays are absurd at this point. Throwing spaghetti at the wall??
I think you're confused. The defense is allowed to have all of the evidence the prosecution has and they're not handing it over. If they had a good case they would have handed it over. They don't have a good case and they're the ones holding this case up not the defense. Everyone in USA is allowed to have a fair trial. I'm sorry you lack patience, but the fact of the matter is that it's more important that justice is accurately delivered rather than in haste. Locking up the wrong guy isn't just life ruining for this one defendant, because that would also mean the real perp(s) is still out and about capable of doing this again.
Move to North Korea!!!! They would love u there we don't appreciate you here! Bye
@@sneakyviewing4391 I think you're confused, the prosecution does not have to hand over all their investigation information. Evidence they're going to use, absolutely, but not every shred of investigative info. And they do indeed have a very strong case!

Maneuver? If you first hand watched ANY OR ALL court proceedings you wouldn’t use that word. “ Maneuver.”
Judge Judge has been more than fair. This is Bryans team just finding another legal way of trying to delay this trial. He found a legal way of giving the families the finger. He is using the media as an excuse cause I think Ann Taylor is hoping for a deal where death pentaly is off the table. Kaylees dad Steve has flat out said he wont entertain a deal. I think Bryan is hoping he doesnt go on trial soon. He is dragging this out hoping for time served.

@mintyswirll she definitely doesnt want to lose, and she also wants to keep collecting those big hourly rates from tax dollars! DM wont mix up what shes said. The prosecuting team will review her statements with her prior to trial.

I do agree this is a high profile case that should be considered taking seriously according too Idaho Laws..These 4 beautiful students aren't coming back, but they deserve the best Trial ..Every loss life to murder deserves the best trial..So, if there isnt enough evidence that was presented at time too grand jury, other proceedings will come and this high profile case might take time..I still pray for the famlies because its most likely worse pain..But I hope they get a proper trial in the end..
The lady saying the defense team want to go ahead is absolute rubbish. They'd just as soon spend the rest of their lives on this.
Judge's name is Judge. Perfect
"Dredd" would be better
If he somehow “wins” and goes free, where’s the “real “ murderer of the 4 victims , the justice for them
Imagine if they have the wrong guy, the victims would not get justice either. We want justice meaning the right person goes to jail. Look into the innocence project, innocent people are often jailed and that means criminals out and about.
He is so mad he was caught. He thought he had done the perfect crime. What an ego.
Hi Andrea!
I think it’s interesting that they need so much time to establish an alibi. I would think proof of a solid alibi would be at the top of the list if he’s looking to get the case thrown out.
Maybe someone more familiar with the law could explain it to me.
It’s hard to tell who’s making those bad decisions, BK or his lawyer. My guess is he thinks he’s smarter than everyone else. (At least he got fired for behaving that way at WSU.)
I'm a paralegal, In my opinion, he has no alibi, so he's wanting to see what they have factually against him, so he doesn't make up an alibi contrary to what they know as fact. He's guilty is what this tells me!

I’m watching from Wales 😊
If the standard for grand jury indictment is the same as for conviction, guilty beyond a reasonable doubt, what's the point of having an actual trial? I mean, we've already proved the defendant is guilty, so why not move straight to sentencing?
You have to wonder if Kohlberger's lawyers have actually thought it through.
Do you really think he’s innocent??!
no
Innocent until proven guilty
Guilty
Hes innocent
I don't know.
In this country, there is no innocent till proven guilty. Everyone automatically assumes you are guilty.
people lie, DNA never does
Why is having a grand jury, where the defendant is not allowed to respond to charges, even allowed?
I don’t know the rules on this.
I feel like the question is more like, why does anything to do with he way jurries work something that the general public finds acceptable? There is so much one sided profiling and manipulations with juries. It really needs to be reformed because now everyone, potential jurors will see news articles and UA-cam videos all over the place about a case they might work on. The solution clearly is not to play make believe horse blinders making these people take the burden of not looking into it more. If anything they should be picked as arbitrarily as possible and be allowed to hear or witness whatever it may be. Doctored and manipulated justice isn't real justice. It's just charades.
A grand jury is where the prosecutors bring evidence to (usually) a secret grand jury. The grand jury then decides if they have enough evidence to be charged. The defendant doesn’t get to give their side because it’s not the trial. It’s about getting an indictment. I sat on a grand jury for three months. It was very interesting.
@heathermitchell7191 Yeah, I just recently learned how grand juries work. I understand it though, like you said it's just showing the evidence against him to get the indictment.
Grand jury's ca. Be tainted
There's a reason for the saying "a grand jury will indict a ham sandwich"
It's because the grand jury only hears one side and only sees one side presented.
The government should never be able to persecute someone in secret and violate their right to face their accusers and see all the evidence that is allegedly against them.

The Supreme Court of Idaho just denied his appeal!!!! Yay!!!!!! Get this trial scheduled NOW!!!!
Supreme , will do no such thing.
so, would all probable cause processes be nullified too, if this appeal is successful? Why not argue this at extradition, or arraignment? How bout a prelim hearing, would that be beyond reasonable doubt too, or do we need juries to hear prelims? How about my employer? Do they need beyond reasonable doubt to force a drug test on an employee?
How about 'special probable cause' cases, like this one, with SWAT raid/arrest? Does LE need to show beyond reasonable doubt standards to do a SWAT?
Defense never mentioned this aspect at argument. Is their argument even relevant to their own case?
Wouldn't alibi's need to be provided before prosecution turns over ALL evidence to defense like, immediately, 10 days before extradition or arraignment?
@@anon-lo6ikyou haven't been following this case.. he's guilty.

What if investigators do find the knife? Due to the gag order, only the prosecution would know about it and the prosecution would have to turn it over or share it with the defense as Discovery. @@abebuckingham8198 No one who's been to both has ever said jail is better!
He waived his right to a speedy trial because discovery wasn’t being turned to the defense.
@@americanprincess851 No he waived the right to a speedy trial because he wanted more time to mount a defense. That included hiring their own professionals and doing their own investigations. It had nothing to do with discovery.
It would never be tossed out with his DNA there. The defense wants the hearing to get more info for their defense. State chose right with grand jury.

I hope not. The wider media just ruins good people.
The surviving friends are who really did it. Allegedly. And I think it’ll come out eventually.
Are we thinking now that maybe he didn't do this crime?
Yep
No!! He did it! No doubt in my mind.
@@heathermitchell7191 Hope you're right
There are definitely some unhinged conspiracy theories that people believe about this case. The evidence clearly points to his guilt though. Once you look at the actual case documents instead of listening to the media it's obvious.
He deserves to sit in jail until his trial - and he needs to be on trial.

This defense just won't give up. Instead prove your own innocence 😏🧐
No one is required to prove their innocence in a trial. The prosecution is required to prove guilt.
The burden of proof is never on the defendant.
Literally has no idea how courts and criminal justice works. Another American who doesn't care about rights, diligence and due process.
What an asinine comment.

No. Just following the Constitution. I’m pretty sure the Patriots in Idaho support our Constitution, right?
@plinky_planet actually, I'm not so sure...lots of sovereign citizens out there and they don't believe in "our" laws
@@plinky_planet Sounds like defense is just trying to delay based on BS.
They tried throwing out the indictment three times already and all three times the indictment has stood. His defense lawyer seems inept. If the defense wanted a preliminary hearing so badly , you have to wonder why they waived his right to a Speedy Preliminary?
Kohberger could have had the preliminary hearing his lawyer’s been crying over the past year within a few weeks of his arrest.
She’s the one who wanted to take the gamble and request a the unreasonable amount of time to hold a preliminary hearing 6 months later. She all but gave the prosecution a grand jury indictment on a silver platter giving them enough time to get their ducks lined up in row and convene a grand jury.
Now she’s crying over the opportunity she let slip out of her hands and wants to waste everyone’s time trying to get a do-over? She should have thought about that before waiving his right to a Speedy Preliminary. 😂
They have been delaying this case for a while now
If the standard for A grand jury is proof beyond A reasonable doubt than what’s the point of the trial? It’s basically 2 trials.
They don’t hear from the defense, they only have to agree based on majority (rather than unanimously like in a trial), and there are different rules/proceedings
And if you use probable cause than what the difference from the arrest warrant ? He's already been arrested on probable cause. A just has already reviewed a subset of the evidence and ruled there is probable cause ... So what's the point of the secret grand jury?
@@TravelElectroit’s a co-sign/double check before sending a defendant to trial
They didn't interrogate anyone.. including Kohberger
The prosecutions left put paperwork on 2 steps that must be taken in order to reach the results of the DNA testing they did to "match" kohberger.
When the defense argued that the judge make protection release said paperwork, the judge literally said "its not my job to make the other side turn in all evidence.."

Is it just me or have there been improvements to the back drop panel at Jesse’s left shoulder? It doesn’t look as red. 🤔🧐 Please do the one to his right!
It doesn't work that way. If you think that's how this works then you have a lot to learn. If we could just learn the most about Criminal Justice and Law then every gangster in the country would be getting PhD's like BK.
@@sneakyviewing4391oh, it's Brian's daddy who should have masterbated into a sock THAT time
Anything that is 'poured' over law books is likely to damage them, and to obscure the text. That would not help Kohberger.
He is guilty and he knows it too
Lol the instructions r sometimes confusing cuz of the wording. Ppl now a days can't even spell instructions without auto correct lol my trial had that. Jurors had too continually ask if they were doing it right. Legalise needs to b stopped. Interpretation is so scuffed now cuz of archaic words, for no reason, r being kept relevant to keep lawyers on a pile of money.
This case has mistrial written all over it.
Why? His lawyer is pulling out all the stops
No it doesnt
How?
The cops fudged the investigation. They weren't really prepared for such a gruesome situation.
I don't think mistrial means what you think it means.
No case should ever put vicitms thru a lifetime of in and out of court. How about a sentence date that fn is it??? Period. It causes them to have 2 continously deal with the a hole who victimized them to BEGIN WITH. Does guilty mean nothing anymore. 28 years
Exactly, it's infuriating! Justice system, what justice system it's an absolute joke. Sick crazy world we live in!! Run by a bunch of complete tw*ts
Don’t you think it’s important to get it right so they don’t have to go through this again? He hasn’t been found guilty yet. No reason to ruin any potential conviction.
