We just had a case when a drunk (1.3) driver without a licence killed 7 people (5 of them were only 19 years old). He got a 4 year sentence (hence he will serve 1-2 years)... I spare my thoughts.
I had a family member killed by a drunk driver back in the early 90’s (it wasn’t the drunk’s first offence either) and he got 4m and lost his license for 18m. Pathetic.

The problem is that these types of crimes are prosecuted as manslaughter cases. I think they should be treated as 2nd degree murder. When you get behind the wheel and you’ve been drinking you’re knowingly wielding a weapon in a dangerous manner. It’s no different than firing a gun into a crowd. Ya you’re not trying to kill anyone but what you’re doing is inherently dangerous and could lead to someone’s death. Until they start charging these cases as murder, people are going to continue to get off with light sentences

Why don’t all American police carry breathalysers? What’s the point of the road side test if you can’t just breathalyse straight away
To establish probable cause.
Part of it is because PBT tests aren't as accurate so they're used to establish probable cause. Once they've done that they are legally allowed to arrest the driver & take them to the station to use the far more reliable breathalyzer
Sad part is when they watch this, they probably will have no shame.

Drunk drivers should not be allowed to cop a plea and reduce their charges. They should not be allowed to cut deals at all. That woman who did not care one iota about the lives she took should have been in prison for at least 25 years. None of this early release BS and reduced sentencing stemming from pleading guilty.
