What are the chances this cop gets prosecuted for tampering with evidence?
US19 between Beckley & I-79 in WV is notorious for bad cops & speed traps.

I see by the dashcam footage, there is NO WAY he was traveling at 80 MPH.
Why?
To wit, MANY years ago, as a “kid” around 20 years old, the 55 MPH speed limit was incredibly boring. So, there are about 115 dashes to the mile on Federal Highways.
I still have, in my brain, the EXACT timing for 55 MPH.
The lines pass at just under one second each.
Obviously, less time for faster speeds.
There is no way this boy was anything over 70.
Depending on the interstate, most are 65 to 70 for cars.
I invite anyone out there to check the speed by using the dashed lines between the lanes.
I have traveled all of the Lower 48, and all the highway markings are consistent.
The officer was lying about the speed, regardless of any other devices.
The camera would likely not be off save for a few milliseconds, which would be negligible.
All timing these days is digital.
The DA that REFUSES to charge these criminals with badges is pro-crime scum. The pieces of garbage in the community that got him re-certified are society’s problem.

I agree. I am not one to want more laws, but we one dealing with re-certifing officers. Any union or lawyer who gets a cop re-certiied should be resp9nsible for that cop. The union or lawyer would be responsible for damages the cop does. Court award would paid by them and not us.

We already know the cops, DAs, judges, and politicians are corrupt scum. But the people are also a huge part of the problem. They want these thugs in positions of power. They only care if he victimizes their innocent son or daughter.
The police officer should be charged with destroying evidence, amongst so many other charges.

They won’t for destroying evidence-which I think is wrong. When a person tries to kill another and doesn’t succeed because their would be victim pulled through, they shoulld be charged with murder.
Intention should count for pressing charges!
I agree about evidence tampering. Any officer involved should receive a charge and lose their ability to work in law enforcement.
What about them by confiscating and then by deleting footage is to permanently deprive the owner of their property which is theft.
I just want to throw this in there. When you delete a video on an iPhone, it goes to the recently deleted folder. And that folders access is secure by your passcode or your face ID. So when you record a video, if an ignorant officer like this one tries to delete it, you will still have access to it when you get your phone back. And that is likely what happened here.
And this officer should never be allowed to wear a police uniform again. There's no way he can be trusted to do a proper investigation when he has no issue deleting evidence like this.
Deleting evidence should be a mandatory twenty year sentence.
I believe the penalty should be severe as well.
So severe that you’re better off taking the punishment for whatever you’re guilty for.

Immunity is not a LAW, Congress could pass a Law strippin their Immunity that was just an idea of Judges to make up. The real law says they should be personally liabble for all damages and pay their own insurne and bonds. Do that and cops stop in a heartbeat!

Fabricating evidence must have felony consequences. What kind of low-grade justice system allows such criminal behavior to go unpunished.? This behavior can destroy a citizen's life, yet the system doesn't incarcerate the criminal. There should be a mandatory 10-year sentence for falsifying or destroying evidence.

2 years later: Update! the officer has been sentenced to attend a counseling session within the next six months (meanwhile still working as a police officer albeit for another town). YES! justice has been served. Oh yeah, and our tax dollars pay for the lawsuits. Awesome again 👍

If a police officer deletes any evidence they should go to prison for a min of 10 years. Same with muting or shutting off body cams.

Qualified immunity is a license to commit atrocities. Why tyrants should be granted “qualified immunity” for bad behavior is beyond all rationale for justice.
It made perfect sense that the government SCOTUS would give the government COPS QI as a license to circumvent the constitution and the law. Why do you think it was created with such an impossible hurdle to overcome.

Qualified immunity doesn't apply in situations where an officer commits a willful/wanton assault or in cases where an officer purposely destroys evidence. Until you learn when qualified immunity applies, you should refrain from using the term because frankly, you sound foolish. In a nutshell, qualified immunity applies when an officer, while acting in good faith, makes a mistake. It does not apply when an officer commits a crime. They're police officers, not democrat politicians.

That anyone was willing to re-certify that PoS is indicative of just how broken the system is. Video being deleted is why my dashcam doesn't just have a password, I super glued the SD card in place so it can't be removed without leaving evidence of tampering. That cop should be in prison for evidence tampering and banned from public service for life.

the only good cop I ever saw was a lady cop who broke rank to stop her suspect from getting violently assaulted and life threatened while in cuffs by her ROIDED up SUPERIOR mad he had to do what she couldn't do. She actually went to stop the battery on the innocent suspect, that man turned around and choked her off her feet bc of it. That's the only good cop I have ever seen.

Those towns need to generate revenue as well - So they stake out stop signs to see if anyone is rolling thru them or running stop lights. They got nothing going on there and no actual real policing to do, only on rare ocassions they have to fund the department, so all there officers have to meet there quotas. They are known for running speed traps on highways as well, Sit at the Bottom of a Hill and get people speeding.

Police must be investigated by outside agencies.
Then who will investigate the agencies? Everything becomes corrupted because humans are evil scum. There is only one solution and it will perhaps never happen. Mankind is doomed.
And prosecuted by outside prosecutors. Prosecutors have a close working relationship with their local police departments. This leads to a major conflict of interest as well as outright corruption.

@@JoeS795 you have to change public perception and opinion before laws can be passed. Just going somewhere and demanding change doesn't work. Burning buildings and turning public opinion against your cause doesn't work. Showing people through discussion that it's common sense not to have prosecutors with a conflict of interest overseeing cases involving the same police they work with daily is an important step. Showing people that police investigating police is like asking the fox to guard the henhouse is an important step.

There is no justice POS like this and the system that protects them ensures that there is no justice for the victims of their crimes and abuse. @@wessltov No one is above the law (in theory), DA's can be arrested and charged, in which an ADA would actually try the case I believe. In addition the Governor can remove in many case the DA. We saw that in Florida, twice now.

It's also not difficult to not punch someone in the face and break their jaw for criticizing you. And the fact that this criminal cop did this and then stuck the guy in another agencies police cruiser and left the scene is an open and shut case reason to throw him in prison. What gets me about stops like this, the officer clearly doesn't care about you and is willing to lie, but you have to let them cuff you and put you in the back of a car and just do whatever they want.

Anytime police delete or “accidentally lose” video files it should make all evidence from the incident “fruit of the poisonous tree” forcing dismissal of all charges AND intentionally deleting files must be made a crime.
It already is a crime to intentionally purposefully delete video files that can be used as evidence. A felony crime in fact. Can't believe this cop isn't being criminally charged with the several felonies he committed during this brief traffic stop.
