    The police should be sorting out dangerous crime and not wasting taxpayer's money pursuing petty so called offences.

      Besides, in as much as I have understood this law, it invites neighbors, relatives et al to denounce others. That is a very risky issue! It sets members of a family or a community against each other. Where harmony should be fostered, you would be planting seeds of distrust. Privacy would be eradicated by law. The ripple effect of such an issue is unending.

      I have a problem with men exposinng their private parts in front of women and girls, a bigger problem with men assaulting women and children annd the biggest problemm with a system patting them on the head, calling them women and putting them IN women ´s prisons to protect them from men. If polite phrasings , which were used for thousands of years- like men and women-, lost there meaning due to this utter BS , let us state facts. Penis goes with penis, vagina with vagina. A little less crass would be XY to XY and XX to XX.

      One in which a substantial number of people who engage in such activity cannot do so without incorporating chauvinistic behaviour that is harmful to those on the receiving end. That platform in particular is rife with such behaviour, frankly.

      Protected from what? How many men do you know or read about who have gone into a toilet for example been charged or jailed, and whether said persons were actually transgender or men pretending to be transgender? Reminds me of the 1980s and the hate towards gays, with comments like " keep your kids away from the gays". What i find shameful and disgusting is how people are jumping on the bandwagon and turning this new law all about transgender. At least the black belt barrister is sharing what said law actually means. I know a few transgender people who just want to get on with their lives and be left alone to do so. Not all trans people are out protesting this that and the other.

    1st day they had 3000 complaints. If that number stays up, 365x3000=1.095.000 complaints per year for the police. Each and everyone must be investigated.

      The police cherry pick what they investigate. You didn't listen to the video. They want to investigate non-violent crimes because it's easy, where theft, physical assault, etc., can be dangerous. Heaven forbid they actually do something that protects the public.

This new "law" makes it possible for the police to prosecute anyone who says something they don't like - and that was its intention, which, unfortunately a lot of people don't understand. No doubt you'll understand some day, to your great cost, that this was put in place to silence you as well as anyone else. They just introduced it in a way that it could be snuck in right under the radar of people like you.

      most likely not from what i can understand.
      an example of where this new law might apply is at an old firm game between rangers and celtic, sectarian language could be used which would aggravate and annoy the other side, said by one person to annoy a group from the other side, which would in the past lead to possible fighting, but now might lead to the arrest of the person who started it (if could be picked out) with use of this new law. as well as mouthing off from the other side and probably fighting.

      Depends on what is being said, but the Englishman, as long as he is in England, is not subject to Scotland-specific laws.
      A better version of this question is: If both say something which would run foul of the hate speech laws of both regions and they are both in their own homes, who is in trouble. The answer is the Scotsman. From what I understand, the English/Welsh version covers public spaces - the far more draconian version covers all spaces - including peoples' homes. If you're in Scotland, your family or friends could you report you to the police for telling a very edgy joke at the Christmas dinner table while a bit tipsy.
      These hate speech laws are pernicious.

    The Scottish Police recording an NCHI against an individual is worrying as individual is not notified as 1 Tory MSP found out to his shock. Are there Data Protection Issues regarding this secret Police register list? Is there a FOI issue? Could one take the Police to Court by way of a Judicial Application to appeal to get one's name removed?

    The hate crime act is actually a hate crime in itself. It’s a crazy act and it’s too blurry. So much of it doesn’t make a lot of sense. It’s stupidity at its finest. Johnathon Pie’s video on it is bang on. 💯💯😂

      I'm unfamiliar with JK Rowling's opinions beyond that she is (possibly was) quite left wing and has issues with some of the attempts to define what a woman is (attempts which I myself reject as well - for logical and good reasons).
      I ask as I highly dislike current day feminism, as it's a supremacy movement which disdains men & boys for simply existing., where-as the old school version was more about equality (it still had its extremist nut jobs of course, just like every movement).

    might this not be a cop out (unfortunate pun ) by the police as they have realised very quickly the almighty shit storm there would be if they did arrest her ? By saying, "Nothing to see here " they've saved themselves from having to take a massive bite of a huge shit sandwich. Great news for the magnificent JK Rowling though.

    Being openly charged and allowed your day in court is stressful enough. What people are really worried about is the secretive None Crime Hate Incidents being recorded against your name without you knowing about it.
    If you live in Scotland, send in your Subject Access Request Form on a regular basis. The best way to get rid of bad laws is to enforce them strictly, after all!

    If say, a very vicious and litigious person makes multiple reports where the police subsequently find no offense has taken place, surely would it not be perfectly reasonable to charge such a person with wasting police time?

    I heard - and I don't know if this is true, but it's relevant - that the reason Police Scotland gave for JKR's tweets not being criminal is that she was abroad when she made them. Would it have been different if she had been in Scotland at the time? I wonder if the police are making it up as they go along because the law is badly drafted.

    You said the bill had been delayed to allow time for police training. It’s being reported by police officers themselves that this training only commenced in the past few months and comprised of a 2 hour online course! Very extensive training - NOT!

    Was JKR actually in Scotland when she posted the ‘offensive’ tweets on X? I know she was at some point out of the country as she challenged Police Scotland to arrest her on her return. Does where she was when posting matter? Is Scottish law now supra-national. So I can stir up racial hatred in Uzbekistan and yet be arrested for it when I pop to see my granny in Arbroath?

      from what i read, being here in canada, if i were to post something in scotland, or even england, they could charge me and issue a warrant for my arrest here in canada, and then i would have to be extradited. scotland is lost.

    How can her comments NOT be an offence under the legislation as enacted?
    Surely the Scottish Police must be challenged? Police forces are charged with enforcing the law. They cannot pick and choose. If they ARE allowed to do so then they are in effect exercising powers they do not possess. That is a very dangerous situation to acknowledge.

    The First Amendment in the United States Federal Constitution (and principles e.g. Brandenburg v Ohio) should be the standard for laws on speech, religion, expression, and more. The state shouldn't be involved in the business of censorship.

The police have been caught be over zealous with regards this type of "crime" and only backed down when their antics were made public - usually when their target is a public figure. You have to remember that many of the police these days went through the university system which has a tendency to indoctrinate and radicalise people into certain beliefs.
      Time will tell, I guess.

      @@dandy193 Although it's possible that such laws can be changed, you have to take into account that you're really dealing with a cross-party elite political class who virtue signal to each other by creating such laws and to strike such a law down would make them look bad. Also, it would then be used by their enemies (naturally). Combine those two things and there will be a great deal of reluctance to reverse course.

    BBB - The fact that police won't prosecute JK Rowling isn't really a big "win" for free speech in my opinion.
    JK said she was not in Scotland as she posted the tweets therefore surely the Scottish police CANNOT prosecute whether they wanted or not since JK was out of their jurisdiction. The first thing police would need to prove is that Scots law applies

    First Minister Humza Yousef said at Holyrood that the bar for arrest and prosecution would be set fairly high, as free speech must not be limited the way that many people think it will. Where there is genuine abuse, stirring up of hatred or violence then yes, it MAY be criminal, but holding an opinion that people dont like is not

      You really believe Useless? The bar for reaching the criminal threshold in this law is actually very low, and includes situations where a defendant may even have to prove their innocence, which is very unusual in criminal law. One of the criteria is that a complainant may find a remark 'insulting'.

    Being overwhelmed with complaints that they say they will investigate is worrying, it could mean that they won't investigate properly, it will probably be automated and lead to people just being called guilty to make it easy on the system, it will be down to you to prove your innocense, and only then will a human do any investigation. It will be like an automatic parking fine. Worrying.

    Politicians worldwide seem to have a tendency to rule by law aspects of our life that cannot be solved just by deciding they are ilegal or unlawful. Hate is one of those issues. We would all like to live in a society where hate is eradicated. However, you cannot do that just by passing a law. Basically, complex issues like hate need to be addressed in a systemic and intelligent way. Just passing a law is neither of both.

    The reality of being a non-celebrity woman in Scotland is very different though. There have been a number of feminist woman witch hunted by PS here, dragged to the police station after complaints of transphobia made against them. They are not charged but the stigma of what happened remains and is noted by employers. This law was being tested well before its release.
    The double standards PS play when it comes to women is immense, last year i was taken of my bike by a man overtaking a bus, who then just sped up and drove at me. I got nothing but coffee and cake talk, no effort to question the bus driver who he overtook or get any other witnesses. I was lucky to not be seriously hurt. Yet if i was to openly in public say that men in a bit of lippy shouldn't be allowed into womens social cycle events and said men complained, they'd be onto me in a day.

    The thought police have been alive & well in the UK for many years now - it's just that their actions have not always attracted a lot of publicity - especially against lesser-known people who may not be as much in the public eye.
    A number of years ago, police paid a home visit to a person because they had made a comment/post on a social media site, which included a quote of something another commenter had previously said.
    Apparently, someone found that quote offensive, & reported the person who had quoted it in their post (not the person who had originally posted it) to the police - as they obviously did not like it for some reason.
    This resulted in the police visiting the person in their home, & questioning them about their post. Amongst the things which the police said to the person was " we're just here to make sure your "thinking" is correct".
    This demonstrates that the UK police believe part of their role is to monitor/police people's thoughts, in addition to anything they may say/write in social media.
    I just hope that it's eventually made clear to the police that they should not be trying to police people's thoughts, or arresting them for "wrong thinking". How can they sufficiently prove, in a court of law, that someone's "thinking" was not correct, if they have not also stated it out loud, or put it into writing? Or were these police officers just a couple of "rogue" police - a case of "police gone bad"?
    I can't recall what ultimately came of that situation, but fortunately the person did manage to capture most of that police encounter in an audio recording.

      Indeed, I'd like to know the grounds for Police Scotland saying her tweets did not reach the criminal threshold. Why? Apparently, they also confirmed that they had received thousands of complaints on 1 April and that hundreds were made about JKR, but I haven't seen an official statement.

    I'm pretty sure 'variations of sexual characteristics' refers to DSDs (differences or disorders of sexual development - often referred to as 'intersex'), not sex per se. Sex is not a protected characteristic under this legislation.
