Great video needless to say. What I wish to know is when and why did they make it allowable for the judge to make chamber rules, home rules, judges preference for procedure in criminal cases but not allowed in civil cases.
I just got a call from an actual person telling me that a civil complaint is being filed against me. They had my name, my address, and this woman was reciting a social that wasn't mine, but my father and I have the same name, so it could have been his. She claimed that me or my father took out a credit card back in 2017 and that I was being sued for missing payments on the amount that I originally owed plus interest. I told her that I thought the call was a scam and I hung up. She then called my fathers phone and left him a message. Can you be served over the phone? I'd really appreciate an answer from a guy like you who knows his stuff. This is very scary.
Thank you for sharing! I don't think people have the money to pay people to do this now. This will go a long way in helping people are being attacked by the legal system.
Wouldn't it make sense to put that "long list of defences" on a written affidavit, notarized and filed with the clerk and at the state level as supporting doc and avoid having to take the stand and tripping on your tongue in front of the judge? Looking forward to the following vids on those defenses.
Wish I could be specific, but have to check federal or state rules, or If you are not sure how you must serve your paperwork, ask your court's self-help center, most courts have them. For me personally, yeah, I serve everyone I sue if I am the Plaintiff counsel. Thanks for the great question! SV
Doesn't the defendant have to serve the plaintiff within the 30 days. There is nothing on calendar from the defendant when I look up the case. 30 days is up this Sunday and his attorney sent a email. I haven't been served.

Yes you can. Read the rules of your respective court. You’d be surprised how simple they are, and how easy things get, when you understand the rules of the game, and the rules of evidence.
What if they don't summons you and railroad you into court? No proof was entered to the false allegations and no proof was given to say the other party was summons. Action was taken, but no grounds to remove a child from the parent?
Let's say an individual does choice to sue for malicious prosecution and they claim "good faith" would there possibly be merit in a rebuttal to argue that good faith would be claiming ignorance of the law. Hope I explained my theory properly. Any thoghts anyone?

Trying understand the gray area between what are the rights and responsibilities of an establishment that is “open to the public.” Also would be helpful to understand video recording rights on “private property” that is a business open to the public. For example, one time I was in a Target store and I wanted to speak with the manager who was behind the counter of the CVS. Instead of coming out to talk to me, he summoned the security guard. I hadn’t done anything wrong, and I interpreted this aggression as a form of intimidation. Since I was alone, I then took out my phone to document the situation so this (jJERK!) CVS manager couldn’t try to twist the truth later. Soon the store manager came over, and he told me that I couldn’t record because it was “private property.” I told him, “Yes. It’s private property, but it’s ‘open to the public.’” I have run into this situation before, where all I’m trying to do is protect myself from falsehoods - purely as a defensive maneuver. Target has cameras all around, and expect for areas like the restroom. visitors and staff do not have “a reasonable expectation of privacy.” (This was in CA, btw) I tried looking up Supreme Court law. As far as I could tell, in such a situation, it seems to me I had the right to record what was going on to protect myself against false allegations as well as to document abuses by the personnel of the establishment (both of which were freely accessible to the public - but INSIDE, not in the parking lot). Not looking for “legal advice.” But if you could put out some videos that provide “general legal information only,” that would be helpful.
When would you do a 20-day refiling period? Is there such a thing? The lawsuit just started would this even exist in the begining of a lawsuit? The only thing the defendant did was ask for more time. That's it.

I talked to many many lawyers. I think you need to talk to the consumer lawyers and not the debt collections defense ones. They are all bankruptcy lawyers. I wasn't impressed with any of them and am not paying 23K. Read your complaint well and come up with your defenses and defend yourself. Seems most lawyers I tried to talk to were a-holes and thought they were GOD. 2 hung up on me maybe 3. I don't know what their problem is. Most seem to wanna just do things half ass too. I was charged 550.00 too for one consultation and I went ahead and CONTESTED it and my C C company reversed it. They were not ready and didnt even read my stuff and they admitted it and then was like "ohh my son is calling, gotta go". YOU think i am paying 550.00 for that? I don't think so. DONT be scared, REPRESENT yourself.

There has to be laws for a couple hundred different areas of life (family law, criminal law, injury law, estate planning) on and on and on, and then, new clever means to get around the law pop up, requiring Congress or State legislatures to pass more laws (called statutory laws). Then, because words in statutes are always open to interpretation, the cases go to the judges who make "common law" (judges interpreting the law to say what it really means). Buffalo Rideshare Most states have laws which allow service of process in that way. It’s not unusual though it is highly annoying.
