OMG...🤣🤣🤣🤣🤣🤣🤣🤣between the actual video and accompanying chat...I'm going to die from excessive laughing. Before I do...thank you for giving me the opportunity to die with dignity.
I live in the West Coast and fishing treaties were renegotiated within the last 20 years. And it gets crazy. In the treaty it says that natives can use native methods to fish for salmon, which means something called gill netting which the white fishermen are all up in arms about. gill netting can bring in lots of fish more than the whites can bring in and that pisses the white fishermen off. The treaty also says that the natives can take all the fish they can use. The white fishers want that to be more narrowly defined as only the fish the fisherman and his family can eat, the fact that the natives can sell the salmon they catch, which puts them into a more advantageous position than the white fisherman. But there's a whole bunch of other stuff going on like housing that's been promised but hasn't been built in thirty years. Fun stuff
It’s flooding here in California but I’m in my office grateful to have your video to laugh at! Indian Studies doctorate and he thinks he can be an expert on a DUI?😂😂😂😂
If the "consent decree" prevents authorities from being able to protect the public from drunk people operating boats then it is a flawed decree indeed.
At one point you find out the Prosecutor has argued on the Consent Decree and misinterpreted what it says - so he's essentially participated in his case's derailment by this irrelevant document.
The police found that McCloud's boat registration had expired, but why would he need a registration for his boat in the first place if he were a member of the Sioux tribe? I thought Mr. McCloud's "expert" witness claimed that he didn't need to register his "vessel" in the first place because he was a member of an Indian tribe in the state of Michigan. Did Mr. McCloud only find out that he was a member of the Sioux tribe after he registrated his boat, and then after that he didn't renew his boat's registration anymore? I know that all this a moot point since Mr. McCloud was arrested first for DUI, and then latter for the "expired" boat registration. I'm just curious. It should be a "doozy" of a jury trial.
I also looked up the decree, section 24.5 states that operating a boat in a manner that creates a threat to public safety is enforceable by both state and tribunal officer under state law. Thus the officer and this court had jurisdiction. Also, 1.2 states that the michigan district court has jurisdiction. And the interpretation, as shown above, isnt really needed, a plain language reading would be enough. Tag in me prosecutor, im ready! And the expert is kind of right about registration, but tribal registration is required as is evidence of fishing which is a tribal activity. I suspect interpretation would be required to determine whether, if you are intoxicated, then you can be fishing. Thus to do a tribal activity do you have to do it in a safe manner? Finally, 24.4 requires that the person is “currently engaged” in the activity, was the defendant currently engaged in fishing, he was at the dock, just having fishing gear may not be enough. And final, final thing. Has the defendant established that he is a bona fide member of a relevant tribe? Id be asking for proof that he is a member, you dont want non tribal members trying to abuse the rights and privileges others has fought to get.
I'm thinking there were two separate times where the defendant was handcuffed during this incident. Perhaps they cuffed him once and then uncuffed him to allow him to climb off the boat or to get documents and then cuffed him again afterwards. I'm thinking he resisted one time and cooperated the other time they cuffed him. And he, of course, is only showing the judge the tape of the time he cooperated.
I want to see the one and I believe it’s Greenwood County with. I can’t remember her name were Jill, Gerard and Judge Webster. I believe it is supposed to have a person here from Texas for a hearing in person and he supposed to be here or have a warrant out for his arrest, I’m curious if he actually shows today
I just watched that 1 before I came to this video! 😆 oof, she was annoyed AF with him. Mam, it's a 14hr+ drive if I leave now and I still might not make it. Judge: You better not be driving here without a license 😂😂
The expert contradicts themself by highlighting how important each word of this treatywas taking hours on each word, followed by saying, "i assume that is what they meant by possess?"
I think the point that is trying to be made is that the contact was invalid. He is arguing If the officer was not legally allowed to contact the defendant, the objective symptoms of intoxication could not have been observed. Therefore, the arrest is invalid. That is why the judge asked if the tribe issued any placards etc. for boats to tribal members. He argued once the person identifies as a tribal member, no further search can be made. However, in this case the objective symptoms had been observed so the argument holds no weight, even if he was, which he is not, a tribal member.
the case was about boating while drunk with unregistered boat.. what the hell does that have to do with some native american fishing treaties? no freaking way the idiot is going to jury trial with that? the jury is gonna say guilty after 5 mins of his "expert witness" ramblings aboutfishing treaties..
Meh I my theory is more people who were already going to be useless just use the SovCit thing for lack of any alternative. In other words the degeneracy is the same as it always was but they have another pointless defense to try.
"only two treaty areas are currently subject to fishing by tribal governments. The Treaty of Washington, signed in 1836, covers the eastern Upper Peninsula and the northern Lower Peninsula of Michigan." "The tribes that are included in the Consent Decree are the Sault Ste. Marie Tribe of Chippewa Indians, the Bay Mills Indian Community, the Grand Traverse Band of Ottawa and Chippewa Indians, the Little Traverse Bay Bands of Odawa Indians, and the Little River Band of Ottawa Indians." *** Do we know which tribe the defendant claims to be a member of? Michigan v. Caswell says this is important. "The agreement covers 13,837,207 acres of lands and inland waters within the boundaries of the 1836 treaty area, which is located in the eastern half of the Upper Peninsula and the northwest one third of the Lower Peninsula." *** The conservation Officer belongs to Alpena County - most of which is *not* covered by this consent decree, including the *right* bank of the Thunder Bay River. *** Do we know where the alleged offences took place? *** If I understand it correctly - the offence is unrelated to the Michigan Treaty/Consent Decree, so I don't understand why it's been mentioned or why an "expert" was called to give his somewhat woolly overview of it. Nothing in the Consent Decree prevents Conservation Officers from stopping and inspecting boats nor from testing the boat's captain for impairment. He refused a test and the consequences of that refusal are not at all ambiguous.

In the first case, everything that "expert" stated being under federal jurisdiction has to do with treaty and Indigenous rights (or Native American as they're called in the States), and their fishing rights. The defendant is not Native American, and therefore under the rules of county or states conservation law, including needing a license and his boat being registered. His "expert" conveniently left that part out (and I seriously doubt that man is really an expert in anything of consequence, and I seriously doubt he has a doctorate)..It also doesn't cancel out the fact that he was drunk, Native or non-Native. By the way, did he ever produce a status card to claim Native rights, because they don't just hand those out, you have to prove you have Native heritage.
@@SpencerfromEarth The defendant was wishy washy when he was 1st asked. Later, I believe it was the judge said he was part of Navajo tribe and the defendant agreed to that. He didn't prove it. Ok, so why didnt the prosecuter ask the "expert" about jurisdiction non-native law enforcement has when they observe a native conducting illegal activities. Like, a woman is screaming on a fishing boat, claiming to be kidnapped, the man on the boat claims they are native, does that mean the police have to just let it go? What does the decree say about that, since it was so carefully written?

The fact that people believe this stuff, just boggles my mind. Really speaks to poor education system in this country.
These people are like 70 years old in the first video. It has nothing to do with education system at this point they already forgot everything from that time lol. They were also in school when people think schools were good. I'm 40 and don't remember any the maths I learned in university so I doubt these guys who are well older remember anything from primary education.

It’s not the education system. It’s the ones that want to be different and come up with this crap. They want to disagree with what they were taught

Fun stuff
Ya don't get to 'object' during the Judge's ruling! You can appeal the ruling but to keep arguing with the Judge is unacceptable.

McCloud was arrested first for DUI, and then latter for the
"expired" boat registration. I'm just curious. It should be a "doozy" of a jury trial.
All I can think about is Jeff Foxworthy. No sir I don't care if the fish are biting, step outta the boat. You lost your skier about a mile back.😂😂😂
I also looked up the decree, section 24.5 states that operating a boat in a manner that creates a threat to public safety is enforceable by both state and tribunal officer under state law.

Where’s his proof that he’s a member of any Indian tribe?
@@stephenmarcus7051 A #SovCit doesn't need to prove anything. You just gotta take their word for it. 😆🤣
Lol he was hilarious. He had until Wednesday for his trial, but caught himself a contempt charge and to report to the Sally port today
The expert contradicts themself by highlighting how important each word of this treatywas taking hours on each word, followed by saying, "i assume that is what they meant by possess?"
This expert sounds like he had a little bit of fire water before the trial.😂
Doctor.....he has a FJD degree: fictus juris doctor 😋
Are sov cits increasing Or are they just getting around faster.
Spreading live the Covid virus...it's a pandemic!
The courts are correcting their errors they made during COVID.
Meh I my theory is more people who were already going to be useless just use the SovCit thing for lack of any alternative. In other words the degeneracy is the same as it always was but they have another pointless defense to try.
"only two treaty areas are currently subject to fishing by tribal governments.
The Treaty of Washington, signed in 1836, covers the eastern Upper Peninsula and the northern Lower Peninsula of Michigan."
"The tribes that are included in the Consent Decree are the Sault Ste. Marie Tribe of Chippewa
Indians, the Bay Mills Indian Community, the Grand Traverse Band of Ottawa and Chippewa
Indians, the Little Traverse Bay Bands of Odawa Indians, and the Little River Band of Ottawa
Indians."
*** Do we know which tribe the defendant claims to be a member of? Michigan v. Caswell says this is important.
"The agreement covers 13,837,207 acres of lands and inland waters within the
boundaries of the 1836 treaty area, which is located in the eastern half of the Upper Peninsula
and the northwest one third of the Lower Peninsula."
*** The conservation Officer belongs to Alpena County - most of which is *not* covered by this consent decree, including the *right* bank of the Thunder Bay River.
@xcrockery8080
Thank you for information.
I was wondering if you have to have/show proof of being part of a tribe?🤔 Otherwise couldn't ANYONE say they are Native American?

Did he really argue that he wasn’t boating under the influence because he did his drinking outside of the boat?
In his mind, the cop didn't see him drinking until he was off the boat. So yea, that's his argument. Lol

I'm not an expert in tribal law, but what does tribal law have to do with you operating a boat intoxicated?
Nothing. Just sovereign citizens crap
Did they not specifically state that the defendant was a member of a tribe?
@@SpencerfromEarth The defendant was wishy washy when he was 1st asked. Later, I believe it was the judge said he was part of Navajo tribe and the defendant agreed to that. He didn't prove it. He didn't say it when initially asked. He took what the judge said and just agreed. That's how I heard it. Might be better to go back and have a re listen. 🤔
I don't think he is Native American.

The Treaty + Consent Decree apply to specific contracting parties including 5 specific tribes which are obviously not going to be random tribes from places like Arizona.
Randy Marsh voice - “Isn’t this America?! I thought this was America!”
Ok, I hadn't finished the video yet when I wrote this. He answered my question, he already had the answer.
“You see, Your Honor, my right to subrogation is the right for me to say ‘I exercise my right to subrogation’ and then I don’t have to pay rent. It’s pretty straightforward.”

I cant imagine what a "sovereign citizen court" would even look like
There wouldn't be any courts because no one could ever be convicted of a crime.
I find them terrifying. There was one held in bend Oregon not long ago and they issued arrest warrants for the sheriff and various other people. Imagine how empowering that would be to a “sovereign”. Now they can act with the “authority of the court”. It’s not hard to see that ending in tragedy.
