  • Roberto Baldazo was tubing down the Apple River on July 30, 2022, with his wife, three children, as well as some other family and friends. He had been drinking that day, he testified. He also had a knife on the river that day but it ended up getting lost that day.
    He testified about what he remembered, including his wife running toward the injured tubers. He ran after her to aid Isaac Schuman.

      You ain’t lying… Hot summer day with alcohol.. bound to find some excitement, in this case someone was killed because of bad judgment.. he was angry he was being teased by some “Dopey drunk loud mouth young people…”
      He could have just walked away.. he was no better than them… He was tipsy too.. he doesn’t look scared knowing he’s grabbing his knife out of his pocket… 😢

    This case has solidified for me that I will not be around drinking and drugs, and I will not offer help in a crowd of people. I will stay sober, stay around sober people, and mind my own business.

      no way i drank heavily with tons of people for 20 years. This guy disembowelled 4 people in 4 seconds. He is a crazy Russian with KGB knife skills for a guy who's is 5'7 and 248 pounds.

      Tbh it depends on person and what do you mean being drunk. You would not lose control of yourself, ability to reason or memory, but after 2-3 beer you are losing you reaction speed.For me I consider being drunk you lose control of yourself, ability to reason and partial loss of memory and that starts to happen after +10 beers.

    The problem is, and I’ve been in a similar situation, that your “perception” of the event right after is very dependent on your fight or flight. Meaning you are so keyed up that you may perceive more people or more danger than was actually there. Later, when you are calm and not afraid/keyed up, you can look back on the incident for what it actually was and realize you may have overreacted. So what these people said at first vs what actually happened and they are saying now can vary greatly due to clear heads.

      yes! that's why, after traumatic situations, psychologists wait a day or two before interviewing children. i don't know why cops don't do that same thing with adults, because it's true for both.

      I agree. I don't give any credibility to a seriously traumatized, nearly died, hopped up on drugs after his first major surgery victim. Those situations your brain is loopy as hell, you're hallucinating, dreaming weird stuff, it's a full on mix of real & total fantasy which you don't sort out until much later when you're off the meds & the shock has worn off.

      ​@@user-up5cs9kk4gNot necessarily. When these kids gave statements at the scene or the hospital, they were likely still intoxicated and definitely in a state of extreme shock and grief! They were traumatized. Not all of them saw everything that occurred and each person has different perceptions and memories of the same incident. That is absolutely normal.

      It is in the report probably, and I believe the defendant mentioned that he saw 2 people with knives in the crowd surrounding him. He said he took a knife from 1 of them (which is a proven lie or we at least don't see it on the video), I also do not believe they Mui's knife, but they found his missing knife. I think this may go to the fact he felt threatened or to the fact that Mui was not the only one with a knife drawn, or his feeling he needed to take out his knife to defend himself.

Even said they were talking shit to him. Thank God statements are recorded. If he doesn’t remember it’s cause he was drunker than he admits.

      Nothing did for the 40 years I tubed this river. Tied the inner tubes of our group together before we got in the water, cut the twine off of the tubes when the float was finished. Thus enabling each individual to carry their tube back to the rental place, or campsite. THAT is WHY we brought knives! No big mystery here, people.

      Agreed but the start of the trial date is 1.5 years following the incident so I can understand why their memories and recollections are distorted or inaccurate from original statements. I think the courts should prioritize and triage cases while being cognizant of the degree charges and starting to trial as close to the event date as soon as possible. I can also understand why someone would have a distorted memory during a high stress or traumatic event. I cannot typically recall what I had for dinner last week the exact date the meal was made. I don’t know but is there any reason why this trial started this long after the events occurred? I appreciate any insight provided and I predict that evidence collection, recovery from injuries and obtaining legal counsel contribute to the answer. I would also think that the general court schedule and availability of resources and appropriate staff would effect this as well. Most businesses, manufacturers and etc. are short staffed and hiring so I anticipate that as well. Thank you in advance for your input.

      Well, the thing is, ALL memory is "reconstructive"...... it's not like our brains are camera's that record perfectly. And a year and a half later, with all the publicity, interviews, etc.... that gets encoded into memory also.... so during recall, it's impossible to keep all of those pieces discreet, independent recalls.

    He was buzzed, but he could still walk and talk and stuff. A drunk always minimizes their alcohol usage.

      ​@@knIfebOmb769it means some people (usually regular drinkers) consider drunk=unconcious, heavily impaired, instead of the normal equivalent drunk=inebriated.
      It's not a question of ability wheter you can walk and talk, or drive, it's the fact the your levels of alcohol have reached a noticeable effect on you ( that you yourself can notice) dude himself said he was buzzed alchol had an effecr on him he self addmitely noticed.
      But people tend to downplay it saying they are not drunk because they consider drunk=shitfaced, stumbling around wheter that is because the usual portrayal of someone drunk in media is that of someone heavily, comically inebriated or their own bias is another story.

      Amazing 2 out of 50? By the way a pocket knife is not the kind of knife your friend was stabbing people with. His butcher knife was also razor shard to split a gut open. Mum's knife was not a Boy Scout knife used to whittle willows for the campfire. .

    So I know everyone is saying people are lying, but in a traumatic situation that is also chaotic, memories can change in your mind. Some of the ancillary details become more fuzzy, and you also can be influenced by what someone else says about what happened. So yes some of these people are lying, but some may just not be sure exactly what happened.

      Add into that the speed at which everything escalated, and that people were arriving on scene at different moments during the situation...it was chaos. People saw only parts of what was happening and can only remember their part of it.

    If the defendent was in texas, this would not have even gone to court, the guy was standing his ground, he was confronted by a gang of drunk teenagers calling him a pedo, and pushing him around and then a 2nd group get involved, English is not his 1st language, 1 minute he's looking for a friend's lost phone, the next he's being harrased from every side by strangers, saying he's out to find "little girls"
    If the weapon he pulled was a pistol they would of left him alone immediately, but they didn't see the blade and treated him like a toy for their drunken amusement, I'm extremely sorry that someone, and especially a young person lost his life, but the poor guy was in a situation where he had little to no choice but to defend himself. The 1st time I saw the video I thought it was a clear case of 2nd degree, but having seen it in the context of the situation, it's self defence all day long.

      That’s been going on for decades. My 45 yr old daughter floated down this river in the 90’s. It wasn’t quite as extreme as it is now, as far as the drinking and smoking goes. Times have changed.

      It definitely has a reputation as a party river. We moved to the area in the 90s and my parents took my brothers and me that first summer. I was 8 years old. We witnessed beer bongs, women flashing their breasts as we floated by, and a drunken brawl. No surprise my parents never took us again.

    To me being on a river tubing and drinking seems dangerous. Not just because of what happened here, but also the chance of drowning. When I tube others in my group have had drinks, I personally don’t.

      100 percent agree.
      The trial-long defense strategy of attacking victims who also happen to be witnesses is one with which I disagree, but to some extent I can see why Miu's lawyers are doing it. They've got nothing else to work with.
      I have to draw the line with this witness, however. He and his wife were not witnesses to the incident itself and only stopped to help someone with a life-threatening wound. There is no legitimate purpose in imputing to this witness some ability to assess a threat or lack thereof. And to seemingly attack him for being mistaken about his own knife was off-the-charts bad, IMO. I was waiting for this lawyer to start suggesting the witness' own knife was used in the stabbings. That's how freaking bad the questioning of him was.

      While it is possible to find entertainment in Wisconsin, the general vibe of most small towns in the upper Midwest is deadly boring, and I do mean "deadly," because so many people get into trouble with drugs and alcohol, since there is nothing else to do, and some of them end up dying because of it.
      The Apple River has been a party spot for decades - it sounds fun, actually, although now it's probably over-policed due to all the publicity surrounding this trial.

      A 1st responder would typically do something like 'left, right up, down, thugs drugs, fire, wire' to do a threat assessment...it doesn't mean you are expecting a fight. The whole idea of how far you can see without glasses was moot, the point is they saw something that looked like a party and went over. Where the knife went, I dont understand the extended knife questions though. The stabbing had already occurred. But yes, typical lawyer stuff for the jury.

      This must be a different case.
      This case involves five people getting stabbed. One was a minor (17), and he was killed. The other victims were adults and they survived being attacked.

      Yep , this is it. Started out with teenagers. Asking him what he was doing but he just glared at them and didn't answer them. Then he was grabbing their tubes and going under them and I think they felt quite uncomfortable with that. That's where the pedofile came from that they were yelling. Then older adults got involved and were telling him to just leave (with screaming and cuss words).. He ended up slapping a girl across her face and that's when it really got bad. He ended up killing a 17 year old right through the heart. The others I think were in their early 20's but he got them too. Really bad wounds.

    One thing I’m learning from this trial is regardless if you personally have some involvement in a event or if you’re just a witness to it, don’t talk to Police. You’re going to essentially be put on trial yourself for simply trying to help.

    I was surrounded by drunk angry neighbors a few years ago.
    It was a backyard wedding and the party clearly was out of control by about 11:45 pm.
    Two of the partygoers had assaulted my husband in the street because he was filming the unruly scene on his iPad.
    The angry young group were in my face screaming and yelling .
    I was speaking calmly .
    The bride’s mother ran up to me and pushed me .
    I told the group “ hey - you can say whatever you want to me but you CANNOT touch me.”
    So in my opinion - I was surrounded by many young angry intoxicated people but WORDS would never provoke me to hit anyone.
    I was 56 at the time and I’m a blonde white woman 5 ft 2 and 130 pounds.
    It was very stressful and upsetting but I did stand my ground .
    I was pushed but continued to speak firmly and advocate for my rights.
    Had to call 911 three times before the police came (Chicago)
    A bad night .

      The problem is, and I’ve been in a similar situation, that your “perception” of the event right after is very dependent on your fight or flight. Meaning you are so keyed up that you may perceive more people or more danger than was actually there. Later, when you are calm and not afraid/keyed up, you can look back on the incident for what it actually was and realize you may have overreacted. So what these people said at first vs what actually happened and they are saying now can vary greatly due to clear heads.

    That's odd and a contradiction to say, "I don't remember saying that ", when answering the guestion of whether or not you told the cop that the one guy was "threatening and seemed like he wanted to attack me, so I just threw the snorkel at him", when we heard him clearly state just minutes earlier that as soon as he plucked it from the river, he gave it to the officer standing next to him. 🤔

No need to ban something, even individually, if a person enjoys and uses responsibly. And, though I have swung from an Independent (who definitely leans Libertarian) to Conservative out of political necessity, I even feel that way about hard drugs contrary to the position of most on the Right.

    Were his actions INTENT on causing fatal bodily injury? Was he in danger of a reasonably clear and present immediate physical threat to life or limb? These are basically the 2 questions the jury is being asked to decide, thats the reality of this case

He might get away with it - the video certainly sets him up well to make that self-defense plea. But his actions and statements after the attack really undercut his plea.

    1) these lawyers have NEVER “floated the river” or “been floatin” as us southerns in MS may say.
    2) it would be considered ignorant to not have some sort of sharp knife on you when floating…… and to keep on your person the ENTIRE TIME!
    Exhibit A: ALL rivers are moving bodies of water that are ever changing! Limbs, trees that have fallen/been cut, and debris constantly move and shift! People unfortunately get stuck and sucked under by currents every year!! That knife could assist in cutting away small limbs, tangled up vines, ropes, etc.
    Exhibit B: SNAKES
    Exhibit C: potential threats to yourself or your family or even innocent bystanders by drunken idiots that just want to start a scene!

    One thing I hope the jury is paying attention to-in other parts of the trial if an attorney asks a witness something and then after asking says something to the effect “if it says ….” and refers to something in writing, they are referring to a transcript of a deposition. In a deposition there is generally a court reporter there typing every word and there is often an audio recording as well. However, in 9:01 when the attorney says “if it says….” He’s not referring to the transcript of a deposition, he’s referring to notes a police officer wrote. There’s a huge difference between the two. A police officer is not expected to write everything down word-for-word. And this attorney is referring to the officer’s notes, not a transcript of the officer’s body cam video (if they were wearing one).

      Neighbor said the male victim had a young girl spend the weekend with him several weeks ago.
      That girl was his adult daughter visiting for Christmas.
      Trials are a jigsaw puzzle; you have to put many small pieces together to find what is most likely true.

      It seems odd that they would subpoena expert witnesses, but I guess anything is possible.

    When you have incidents like this, its obviously time to bring a ban on alcohol consumption in public. We had bad violence like this 20 years ago and now its illegal to drink in public and the police will detain you for being drunk in public in a "drunk tank" (Basically a cell you sit in for 12 hours till you sober up)

      What were the other incidents?
      One might say that it's obvious that we should ban alcohol, considering the tens of thousands of Americans it kills every year.
      We should also ban sugar, mountain climbing, skydiving, driving, etc.
      What I'm getting at is that all of life is a risk-reward analysis. I personally hate alcohol, but no way would I take away one of the few exciting things there are to do in that incredibly boring part of the country just because of some random incident that could have happened anywhere.
      I also suspect that if you could count the number of tubers who went down the Apple River over the past 40 years and the number of murders that have occurred during that time period, you'd find that the Apple River has a low murder rate.

    Prosecutor is terrible. The prosecutor has spent less than half the time cross examining each witness. The court was having to hold his hand while working on the phrasing for the motion with the wife. Embarrassing. It feels like SUCH an uneven match that it was almost deliberate. Like the prosecution was meant to fail by whomever was in charge of assigning him the case.

      the lawyer was trying to see if he could convince him to saying something that would make him look like an accomplice, the ol 2 for 1 deal.... more parties prosecuted = bigger pay/bonus for lawyer

      @@ImJamieX Umm…no. If anything, they were hoping to introduce doubt about the murder weapon. Clearly the DNA evidence proved that the knife Miu tossed away was the actual murder weapon. But this trial has gone a bit out of order. Usually the Prosecution calls all of its witnesses first, and then rests so the Defense can call all of its witnesses. Because so many witnesses for the defense needed a translator, and some of the prosecution’s witnesses weren’t available today, they have occasionally had witnesses for the defense and prosecution being questioned in the same sessions. If things had gone normally, it’s likely the Defense would not have even bothered with this witness. The DNA was proof enough that the knife Miu held was the murder weapon. But I think they were hoping his comments to the police would corroborate the notion that things were chaotic and the kids were out of control.

      this was one of his weaker days but you can tell he is a seasoned vet, not sure why people nitpicking him today.
      regardless i don't think the jury will buy into the self defense argument, given his mannerisms even with the video showing he was clearly defending himself at points, all the eye witnesses claiming he struck the woman first, the fact he stabbed one of the women in the back, his hiding the knife after, and his lying to the police. these are gonna be very difficult hurdles for juries to overcome.

She touched him first I believe twice and was told not too by verbal communication and with hand gestures. She then got in his face screaming more. I don’t know for sure but that seems like grounds to slap someone in their face or push whatever he did. After that fact I think it’s all self defense.
