A case of "fuck around and find out". Teens can be brutal but nobody should have lost their life. The kids should have minded their own business and the guy should have walked away.
I agree with you but he intentionally put himself in that situation which is why I believe he should be found guilty. I think pride got the best of him and he confronted them knowing he had a knife in his pocket and could use the excuse of self defense if it went that way. I don’t think he was scared up until he actually got his shit rocked in the water. He also fucked around and is going to find out stabbing someone gets you life in prison because it’s clear as day this wasn’t self defense.

I do think he was scared for his life and was being attacked but context should matter and I think he put himself in that situation INTENTIONALLY when he easily could have avoided the whole thing. Some people love confrontation when they're adrenaline is up. And I come to that conclusion because he RAN up on them in a threatening manner grabbing at their tubes knocking them off. At that point he made first contact when he didn't have to in my eyes. That's regardless if they were screaming at him... doesn't give someone the right to come at you like that. The reason Miu lied about the knife is because he was raised in the United Kingdom where it is illegal to defend himself with a knife. It is an automatic not less than 4 years for selfdefense with a weapon there.

I know one thing. If I am ever in trouble, I want the defendant's lawyer! I think the evidence so far shows that it was reasonable for him to be intimidated. I am not saying what he did as a result was okay, but it does indicate he had a reasonable doubt for his safety. When this case first happened, the media made it seem like a mad man with a machete started randomly attacking young people. So, I went into it already convinced the guy did things just like they said. We don't live too far from here and it is a big party venue. Many people are out of control with their drinking and there are fights. If you have teens, it is best not to let them go tubing unless at least one responsible adult is with their group and is nearby.

I couldn't understand how someone could just stab people for any reason, until I found out he's a Mexican. I'm 61 and grew up in East LA and there is nothing like Mexicans for going around stabbing people with knifes for little or no reason. I've seen it hundreds of times. I've had them pull switchblades on me several times for no reason.
My opinion has massively changed after witnessing the video. This guy stabbed one kid in the gut and pulled the knife upward…that takes some thought and effort. Whether he felt threatened or not, the rowdy kids/young adults didn’t have weapons, this was overkill. He literally brought a knife to a fist fight. Neither group is in the right but I do wonder about Mr Miu’s thoughts and intentions…he IS smiling at some point and seemed to be very calm and controlled after the stabbings, not devastated by his actions or frightened enough to call police or approach them when he saw them. Alcohol does crazy things to people. I had a family member black out and physically assault me for no reason. There was nothing to provoke such a thing. I just remember feeling my hair at the back of my head getting torn out, I was on the floor, protecting my face from getting kicked in. I’ve never given anyone a reason in my life to hurt me like that. I will never trust another drunk again, for any reason.

Even if it hadn't - even if that's literally the first time that they talked - what he did in that moment had zero bearing on whether or not, in the exact moment of the stabbing, he felt like he had to defend his life. You can't seem to understand that those situations are all separate parts. If someone punches you and you don't react, you don't get to walk up to them a minute or two later (or even 30 seconds later) and punch them back. That's not how this works. The situations are separate things. You don't get to blame him for their actions, but that's what you're doing. He did what he did, which was run up to the tubes and try to stop them to get a phone he thought they had (which certainly isn't okay). But what THEY did after is yell, scream, call names, etc., which isn't okay either. He had walked away from them after this and they followed him. Those are three distinct and separate incidents. The assault was yet another incident. The only relevance the lead up had was "how did this make him feel when he was being assaulted" - it made him feel threatened, even if he ran over to them. He was still threatened and THAT is what self-defense is about. He didn't commit a crime - they did. Their crime led to the stabbing. "So, for him to claim self defense, he must 1st explain why he approached them the way he did. " First of all, he did explain why. He was looking for his phone, but secondly, he doesn't have to explain that to claim self defense as it had no bearing on how he felt while he was being punched, slapped, and pushed into the water.
Exactly. Both parties behaved poorly, but to say the man is completely blameless in the incident is incorrect. He definitely instigated an odd situation causing a group of dumb kids to react. Were the kids wrong to act like brats? Yes. Was he wrong to stand around and stay in a situation he created, continuing the confrontation? Yes. I don’t know specifically because I don’t know much about this case, but it’s pretty common for someone to be keeping track/adding/subtracting/changing the order of questions as each witness answers so the other lawyer can concentrate on presenting each question with clarity. It’s really unlikely it’s any sort of training. Law clerks/interns can participate in active cases, but it would be really weird if that was going on for a big, publicly available case. Regardless, would’ve been great if somebody in audio figured that out and didn’t allow the mics to pick up constant whispering lol

Ironic that nearly every person that sides with the defendant is an older person, often griping about today’s youth or disrespectful, scary teens. These people will lie blatantly in their testimony, be challenged by the defense, then correct their lie. *Ryan did this many times and so did Dante, his brother and others.* The degree of perjury they committed is absurd, but the D.A. won't prosecute them and they all should be. Miu needs to be acquitted of all charges, then sue every single one of them in civil court for their perjury and false accusations. *If he sues in civil court and wins, it often puts enough pressure on prosecutors to criminally indict the people that lose in cases like this.* In reviewing the video in its full form now up to 20 times, I created a map of where everyone is but the camera creates a "road block" for most people due to framing and where it's pointed. Nicolae Miu was in fact surrounded immediately from every direction. He repeatedly tries to explain himself to everyone, and Ryan admits that he said he was looking for his snorkel once Miu lost it. Madison and Riley refuse to let him explain but he tries telling them twice, then puts his arm at his side, frowns and does not know what to do. At this point, AJ Martin, Dante and his brother have all blocked Miu just off camera, and another half dozen people are on their way that the two young women called for. The girls shove him, put their hands on him mocking him, then he has the knife in his hand. When they claim the punch happened, they all have a different version in testimony, and they all had a different story in their sworn statements to the sheriff's department, both of which are discredited by the video. When he supposedly struck her, *some claim she fell down into the water, others claim she clutched her face, but the video shows a drink in one hand and her cell phone and vape in the other.* The "prosecutor" should be disbarred for this. He built a case knowing all too well these little POS are lying. Once I created a map of where everyone was standing, and where they were coming from, Miu literally armed himself in the nick of time. *They were likely to start drowning him while showing off for the camera.* Every single one of them including the young adults saw an opportunity to make a viral viral video. *We hear Dante shout at them "they're just kids!" and refusing to let him explain himself. They claim he punches the woman at this point, and the video absolutely and conclusively proves that did not happen. Dozens of seconds later, he has in fact *stabbed* the woman, she exclaims that he punched her believing it was a punch in the stomach because she's so wasted, *and this is when the videographer says "he hit a girl?!" mocking and taunting him, but he had in fact stabbed her when they all surrounded him and he got up for I think the 3rd or 4th time at that point.* The more I review what factually happened, was said, and where everyone is located, the more I realize Miu didn't do something despicable but necessary as it initially seems. *He did something in the nick of time, and surely saved himself from grave bodily injury if not being killed by the drunken mob of deranged young people.* Never addressed in the video, one also says "He's looking for little boys!" but he had in fact said he was looking for his snorkel as 2 confirm, and they lied mocking him for fun.

these teens taunted him. he responded in a drunken stuper by coming to them. he could have just stayed away. i myself have been in simalar situation but walked away. I was at a park and taunted by a bunch of people who i gave no reason to mouth off to me. I was walking my dog and they didn't like my little 25lbs dog cause he is aggressive. I had him on leash and they still taunted me. What did I do? I walked away and said nothing to them. Probably 15 people drunk in a state park where no drinking is allowed. Opinions aside you absolutely can use lethal force in a fist fight under the right conditions such as being heavily outnumbered (13-1), being pushed under water (easily drown, threat to life, nowhere to retreat to (surrounded), another common example would be a petite woman being attacked by a 6ft+ 200lb+ man (this is called disparity of force). Also, initial aggression can be withdrawn, at which point the next person to instigate becomes the initial aggression. If words are exchanged that you started, then turn your back and start to walk away, then are attacked, you are no longer the initial aggressor.

i’ve heard a couple people so far say that all he needed to do was “walk away”. Wrong!!!! All he needed to do was NOT approach the children/teens in the first place. He came toward the children knowing that he had a knife in his pocket. A grown man should know that children tease and they laugh. This defense lawyer being interviewed ( Derick Chavins lawyer), stating that he was being “threatened “ because they called him a pedophile. Well, guess what ? He was the one apparently asking for where the girls were and actually It really doesn’t even matter what the teenagers were saying because as an adult he should NOT have approach them. Secondly, you don’t get to claim that you were in fear when you walked towards the individual/group and therefore started the entire situation. This dude wanted to stab (or scare) someone that day. He was across the river from these kids, and chose to run over toward them. On the way over, he checked his pocket for the knife. Once he reached them, he weirdly grabbed one of the kid's inner tubes and touched his leg. He did that expecting them to respond aggressively. But they didn't. No one laid a hand on that guy until he hit a girl. *Then* they hit him. Dude was extra brave because of the knife. He was pissed and walking away would have been "weak" so he dove into this headfirst. He's absolutely guilty of first degree murder. The minute he ran at then checking for his knife, that was his ticket to prison for an extra long stay.

Too many people watching all of this are also overlooking the video in a panoramic frame of mind with what it shows. He did go to leave and in his direct path was another half dozen people coming toward him. It's at this point the knife is in his hand and Ryan Nelson testifies that he punched one of the girls in the face, but the video shows otherwise. *When he is asked where he punched her, Ryan says "in the face I believe" and believe is used in a synonymous way with "I think" meaning, he is unsure because he did not actually see it and he did not see it because it did not happen.* When one says "he hit a girl?!" it's not until a barrage of attacks and a significant amount of time has passed from when they said he punched her, and when that is said, he had in fact stabbed her. *I am confident they used that moment in the video as an excuse and all lied saying he punched her, and the video discredits this as does the timeline of all events.* If he did strike her at points when the camera turns away, it is after he has been attacked multiple times. *They all also said it was a slap in their sworn statements, but when they reviewed the video and saw the knife was in his hand at the point he supposedly slapped her, their testimony for trial turned it into a punch since a slap was impossible.*

Video begins by Niu running up to the black kid who’s recording and the girl next to him while they’re sitting in the tubes, and then Niu grabs them. I’d say that fits quite neatly in the category of assault or maybe even battery. Second, when the kids start their little humiliation ritual, Niu turns to face them and pulls a knife on them. Only after that do the kids ever put a hand on him. Having observed those details, who do you think attacked who?

This Nick guy had military training. You can see it in his face when he looked at people when he stabbed them. The disembowelling of AJ was a prime example. Who can do that and look at the person in the eyes as they’re doing it?

I was all for Nicolae at first, after even the opening statement of the state it’s pretty clear this was not self defence. He deliberately attacked these people when he could have just walked away. I’m all against drunk young idiots jumping people but literally nobody touched him. He punches a woman and proceeds to stab everybody back to back. The kids were not even aware of what was happening. When the video is depicted frame by frame the truth is revealed and seemingly very clear. It’s a tragedy someone had to lose their life over this. Had that been me I would have just walked away. He is the “sober adult” and should have acted like one. They probably would have helped him look for the stupid phone. But, they told him to leave multiple times to the point that a second group came to help. They were ALL telling him to go away. He never should have hurt her. Never in my 55 years on this planet have l ever heard of or seen anyone carrying a knife with swim trunks on. I have been making a living with a knife for more than 30 years. This just baffles me why someone would need to carry a while tubing on a river.
It’s really not that hard to figure out. if people fish on that river then he has every right to carry a knife at the river, especially because hes snorkeling. People who dive and snorkel carry knives so if they get caught up in fishing line, they can cut themselves free. I am 59 and a woman I carry a pocket knife for any out door activities because it gets used often. Swim trunks have pockets, so there is that. I don't see the defendant being aggressive even when being surrounded by a group of men. I have only seen the video. He couldn't get back to his group because the group was between him and his group. It was noted in the opening statement of the defence that at least one phone was in a waterproof phone pouch, which are specifically made to float. I have one. It floats. So, “engineer guy” was correct that the phone could have flowed/floated downstream.

I know one thing. If I am ever in trouble, I want the defendant's lawyer! I think the evidence so far shows that it was reasonable for him to be intimidated. I am not saying what he did as a result was okay, but it does indicate he had a reasonable doubt for his safety. When this case first happened, the media made it seem like a mad man with a machete started randomly attacking young people. So, I went into it already convinced the guy did things just like they said. We don't live too far from here and it is a big party venue. Many people are out of control with their drinking and there are fights. If you have teens, it is best not to let them go tubing unless at least one responsible adult is with their group and is nearby.

My opinion has massively changed after witnessing the video. This guy stabbed one kid in the gut and pulled the knife upward…that takes some thought and effort. Whether he felt threatened or not, the rowdy kids/young adults didn’t have weapons, this was overkill. He literally brought a knife to a fist fight. Neither group is in the right but I do wonder about Mr Miu’s thoughts and intentions…he IS smiling at some point and seemed to be very calm and controlled after the stabbings, not devastated by his actions or frightened enough to call police or approach them when he saw them. He would have walked off and gone home no issue. His wife is a sour-faced lump of belligerent misery too.

Alcohol does crazy things to people. I had a family member black out and physically assault me for no reason. There was nothing to provoke such a thing. I just remember feeling my hair at the back of my head getting torn out, I was on the floor, protecting my face from getting kicked in. Incorrect - he left his group to find one of the people's phones. This is a fact. He thought those drunken teenagers had the phone. He shouldn't have run up to them, sure, but he thought they had the phone. If you thought someone had your phone would you confront them? Also, those young adults didn't just "happen" to start recording. They began recording because there was conversation about the phones and asking if he could see the phone, believing it was the phone he was looking for. It probably wasn't, but had the young adults not been drinking illegally, they probably would have been able to understand the situation, but they were drunk, in a group, and they didn't.

Because the interaction with them started prior to the recording. The fact that you believe the first interaction with him was when the camera started rolling proves that you aren't necessarily capable, or willing, to remove the bias of how terrible the situation is and wanting to blame someone for kids being stabbed and one dying. The conversation with them started prior to this.
Even if it hadn't - even if that's literally the first time that they talked - what he did in that moment had zero bearing on whether or not, in the exact moment of the stabbing, he felt like he had to defend his life. You can't seem to understand that those situations are all separate parts. If someone punches you and you don't react, you don't get to walk up to them a minute or two later (or even 30 seconds later) and punch them back. That's not how this works. The situations are separate things.
You don't get to blame him for their actions, but that's what you're doing. He did what he did, which was run up to the tubes and try to stop them to get a phone he thought they had (which certainly isn't okay). But what THEY did after is yell, scream, call names, etc., which isn't okay either. He had walked away from them after this and they followed him. Those are three distinct and separate incidents. The assault was yet another incident. The only relevance the lead up had was "how did this make him feel when he was being assaulted" - it made him feel threatened, even if he ran over to them. He was still threatened and THAT is what self-defense is about. He didn't commit a crime - they did. Their crime led to the stabbing.

I don’t know specifically because I don’t know much about this case, but it’s pretty common for someone to be keeping track/adding/subtracting/changing the order of questions as each witness answers so the other lawyer can concentrate on presenting each question with clarity. It’s really unlikely it’s any sort of training. Law clerks/interns can participate in active cases, but it would be really weird if that was going on for a big, publicly available case. Regardless, would’ve been great if somebody in audio figured that out and didn’t allow the mics to pick up constant whispering lol

In reviewing the video in its full form now up to 20 times, I created a map of where everyone is but the camera creates a "road block" for most people due to framing and where it's pointed. Nicolae Miu was in fact surrounded immediately from every direction. He repeatedly tries to explain himself to everyone, and Ryan admits that he said he was looking for his snorkel once Miu lost it.
Madison and Riley refuse to let him explain but he tries telling them twice, then puts his arm at his side, frowns and does not know what to do. At this point, AJ Martin, Dante and his brother have all blocked Miu just off camera, and another half dozen people are on their way that the two young women called for. The girls shove him, put their hands on him mocking him, then he has the knife in his hand.
When they claim the punch happened, they all have a different version in testimony, and they all had a different story in their sworn statements to the sheriff's department, both of which are discredited by the video. When he supposedly struck her, *some claim she fell down into the water, others claim she clutched her face, but the video shows a drink in one hand and her cell phone and vape in the other.*
The "prosecutor" should be disbarred for this. He built a case knowing all too well these little POS are lying.

Every single one of them including the young adults saw an opportunity to make a viral viral video. *We hear Dante shout at them "they're just kids!" and refusing to let him explain himself. They claim he punches the woman at this point, and the video absolutely and conclusively proves that did not happen.
Dozens of seconds later, he has in fact *stabbed* the woman, she exclaims that he punched her believing it was a punch in the stomach because she's so wasted, *and this is when the videographer says "he hit a girl?!" mocking and taunting him, but he had in fact stabbed her when they all surrounded him and he got up for I think the 3rd or 4th time at that point.*
The more I review what factually happened, was said, and where everyone is located, the more I realize Miu didn't do something despicable but necessary as it initially seems. *He did something in the nick of time, and surely saved himself from grave bodily injury if not being killed by the drunken mob of deranged young people.*
Never addressed in the video, one also says "He's looking for little boys!" but he had in fact said he was looking for his snorkel as 2 confirm, and they lied mocking him for fun.
I love how the DA acts like you have to have a weapon in order to present a danger to someone. People die every day by the bare hands of others.

And tries to kill 5 people with a knife when all they have are bare hands. When is it ok to escalate to a deadly weapon?? I had him on leash and they still taunted me. What did I do? I walked away and said nothing to them. Probably 15 people drunk in a state park where no drinking is allowed. Me to one of my brothers friends got in a fight when he was walking his little . He was huge.
He came to me to patch him up so he wouldn't have go to dr.s or hospital. He had family working there and he didn't want them to know.

Opinions aside you absolutely can use lethal force in a fist fight under the right conditions such as being heavily outnumbered (13-1), being pushed under water (easily drown, threat to life, nowhere to retreat to (surrounded), another common example would be a petite woman being attacked by a 6ft+ 200lb+ man (this is called disparity of force).
Also, initial aggression can be withdrawn, at which point the next person to instigate becomes the initial aggression. If words are exchanged that you started, then turn your back and start to walk away, then are attacked, you are no longer the initial aggressor.
Put yourself in his shoes surrounded by a bunch of drunk and violent bullies escalating the situation. That is a terrifying situation. If you had a knife you would defend your life if you thought you were in danger. It's called self defense

This defense lawyer being interviewed ( Derick Chavins lawyer), stating that he was being “threatened “ because they called him a pedophile. Well, guess what ? He was the one apparently asking for where the girls were and actually It really doesn’t even matter what the teenagers were saying because as an adult he should NOT have approach them. Secondly, you don’t get to claim that you were in fear when you walked towards the individual/group and therefore started the entire situation. This dude wanted to stab (or scare) someone that day. He was across the river from these kids, and chose to run over toward them. On the way over, he checked his pocket for the knife. Once he reached them, he weirdly grabbed one of the kid's inner tubes and touched his leg. He did that expecting them to respond aggressively. But they didn't. No one laid a hand on that guy until he hit a girl. *Then* they hit him.
Dude was extra brave because of the knife. He was pissed and walking away would have been "weak" so he dove into this headfirst.
He's absolutely guilty of first degree murder. The minute he ran at then checking for his knife, that was his ticket to prison for an extra long stay.

Too many people watching all of this are also overlooking the video in a panoramic frame of mind with what it shows. He did go to leave and in his direct path was another half dozen people coming toward him. It's at this point the knife is in his hand and Ryan Nelson testifies that he punched one of the girls in the face, but the video shows otherwise.
*When he is asked where he punched her, Ryan says "in the face I believe" and believe is used in a synonymous way with "I think" meaning, he is unsure because he did not actually see it and he did not see it because it did not happen.* When one says "he hit a girl?!" it's not until a barrage of attacks and a significant amount of time has passed from when they said he punched her, and when that is said, he had in fact stabbed her.
*I am confident they used that moment in the video as an excuse and all lied saying he punched her, and the video discredits this as does the timeline of all events.* If he did strike her at points when the camera turns away, it is after he has been attacked multiple times. *They all also said it was a slap in their sworn statements, but when they reviewed the video and saw the knife was in his hand at the point he supposedly slapped her, their testimony for trial turned it into a punch since a slap was impossible.*

Video begins by Niu running up to the black kid who’s recording and the girl next to him while they’re sitting in the tubes, and then Niu grabs them. I’d say that fits quite neatly in the category of assault or maybe even battery.
Second, when the kids start their little humiliation ritual, Niu turns to face them and pulls a knife on them. Only after that do the kids ever put a hand on him.

On the video you can clearly see him getting pushed & falling into the water, twice. Multiple people push him, hit him on the head, push him down again yet no one is charged. That is not fair.

Never in my 55 years on this planet have l ever heard of or seen anyone carrying a knife with swim trunks on. I have been making a living with a knife for more than 30 years. This just baffles me why someone would need to carry a while tubing on a river.
It’s really not that hard to figure out. if people fish on that river then he has every right to carry a knife at the river, especially because hes snorkeling. People who dive and snorkel carry knives so if they get caught up in fishing line, they can cut themselves free. Go look it up every smart person who dives or snorkels has some sort of knife tool for emergencies like I stated above. I’m also a woman who carries a pocket knife every day. How do I know this and you don’t?

In my opinion Choice of words can hurt Someone’s ego . but I didn’t hear no threats. They didn’t threaten to beat them up or hurt him or even threaten his life. They might have hurt his feelings or ego or pride, but that’s just words and you can’t take words personal, And sadly it led to an altercation because he had to prove himself instead of walking away from the situation. Ok he the fact was he was surrounded By a group of people but He walked into that crowd instead ignoring or walking away toward his group and he put himself in a situation where he may have been scared but then he struck first and then brought out a weapon. It was noted in the opening statement of the defence that at least one phone was in a waterproof phone pouch, which are specifically made to float. I have one. It floats. So, “engineer guy” was correct that the phone could have flowed/floated downstream.

I'm gonna say what nobody else is saying. It was the black kids fault. None of this would've happened had he not started trying to get video content. He started the ped*file accusation and chanting, he riled his whole group up. You can even see him approach Nikolae and push him ever so slightly to get him going.
