Very Very Special Agent Beazit is back, this time he is training up his fellow ATF officers on how the ATF decides what is and what is not a machine gun. (This isn't a real leaked internal training video from the ATF, it's a cartoon pretend ATF man ... for those of you who are a little slow.)
While what you see in the video is not real, it is based very much on reality. These are all real examples of things the ATF has claimed are machine guns. Nothing in the video or in associated materials like this description should be construed as legal advice. Despite being dead wrong on the law, the ATF can and does F people's lives up pretty regularly on a whim.
For the fun stuff:
In the United States v Prince the ATF claimed that flat pieces of metal were firearms because they had lines lasered on them... the district court disagreed. The ATF appealed the case but did NOT appeal the ruling that the items were not considered to be NFA. So they 100% lost on that issue and accepted their loss. The ATF promptly ignored this loss and just continued on designating drawings as firearms.
"The court finds that the metal flat shipped to Prince is not a firearm. The court carefully considered the expert testimony of Agent Adam Galbraith, and reviewed the material submitted by the government concerning ATF opinions. However, the court simply does not believe that a flat piece of metal with laser perforations and holes constitutes a "receiver," i.e., a "firearm." Rather, the flat piece of metal is somewhat akin to a piece of paper with lines drawn on it as a guide to make a paper airplane. Although making the paper airplane might be the intended use, it is not an airplane until it is properly folded. Until that time, it is a patterned piece of paper. Simply put, this court has no evidentiary or legal basis for holding that a flat piece of metal with laser perforations and some holes constitutes, ultimately, a "firearm." "
In United States v Thompson Center Arms the ATF claimed that a collection of parts, which could eventually become an NFA item, were an NFA item prior to being made into an NFA item... Sound familiar? It is exactly the same kind of reasoning that leads to drawings being classed as NFA items. The Supreme Court disagreed, on the basis that the items which the ATF claimed were to be "made" into NFA items could also be made into non-NFA items. Since there is a reason to own the parts other than NFA construction, the parts in question were not NFA until they were actually assembled into an NFA item. Think about that and how that compares to the Auto-keycard and the cosmetic "felony hole" on AR15s. Both of those items have legitimate purposes other than the construction of an NFA item. @@Fit4C Just received notice from the ATF: they aren't sure about all this repenting stuf, but they have now classified Jesus as a machine gun, as Jesus died for humanity's sins and thus allowed us create illegal machine guns. They also said that the use of the word "dog" in usernames is illegal, as dogs are destructive devices.
The F In ATF is a machine gun because it can be the outline for a real life machine gun, and thus can be used to cut out the metal required to fabricate a machine gun.

We allow that all the time. Any agency that creates "regulations" that are enforced with fines/jail time deserves to be defunded and disbanded. The Adirondack Park Agency in NY pops into my mind first and foremost. If duly elected legislators didn't create an actual law, it isn't legal. A regulation is not a law.

These are the kind of patently ridiculous rulings and reasoning you get when you put an anti-gun organization in charge of your firearms legislation and administration. It reminds me of RCMP classification of new guns in Canada: The Firearms Division bodge together the receiver of the new gun with parts from a completely different gun that's already prohibited. They must custom machine several bits, and literally hold it together with clamps and duct tape. They keep re-configuring and testing this Frankenstein rifle until they finally get it to fire (one single round, whereupon it exploded in the case I read). But since it did _technically_ work at least once, that somehow proved the new firearm in question as legally a "functional variant" of a prohibited gun. Therefore it's classed prohibited and banned as well; nevermind that the gun as designed and sold is completely different than what they created in their lab. But it can technically be made to "function" with illegal parts, so you can't have it. Logic!
This actually happened c2012. I wish I was joking, but that's the standard procedure for classing all new firearms in Trudeau's Republic of Kanada. When something fails to meet the legal criteria for banning, just modify it until it does and call the result a "variant" that justifies a ban on the normal version. Logic! Trying to police possible intent AKA pre-crime, is an extremely scary, dangerous thing to do...

We can’t say for certain. There’s a bunch of judges that are supposed to interpret the law but instead side with popular politics. See ninth circuit Ammo ban, mag ban, and awb ban, and pistol roster.

Part of the ATF's reasoning was that you apply back pressure on the trigger once and don't consciously pull the trigger each time, therefore it's multiple rounds being fired by a single function of the trigger.
Which:
A you can't prove what somebody thought.
B would make conscious thought or lack thereof, a machine gun. Shoot your auto sear AR one round at a time and it's not a machine gun.
C would make world champion speed shooter Jerry Miculek a machine gun. If you've ever seen him pull the trigger several times after the gun goes empty it's because he's doing it through reflex and not conscious thought.

Yes very much. Cause the government doesn’t have the the power to regulate arms for civilian use on any level under the 10th amendment. People say the NFA is legal because it’s for taxes but it is only for control and you can’t tax a right.

Did you realize that every other law enforcement agency out there has the mission of protecting our rights? The ATF is unique in that it restricts rights by punishing ownership of something that might be theoretically used in a real crime at a later date.

It was either Trump or Biden. Trump banned bump stocks without understanding the law or firearms because few people have them and because of the LV incident. Biden and the rest of the totalitarian cabal want to ban all semi autos. The Trump bumpstock ban actually cracked the foundation of the NFA with how clumsily it was accomplished. The FRT is widening that crack. The NFA, GCA, and FOPA might all get struck down if Biden actually signs that international arms treaty.

Once republicans have control they focus on other things or just plain out don't care for 2A. The democrats do the exact same thing with certain communities. It's a play card to use for votes. I just support other groups/parties. At smaller groups may be more motivated to fight for freedoms because they don't have a monopoly like the Dems and Rep do.

To your point, regardless of whether he is or not, the truly insane thing is that this is all real information that is available to all citizens on government websites. Most people just don't bother reading it.
Sadly this is the actual logic of the ATF. Federal Judges, Public Defenders, and Prosecutors also follow this same logic. The only thing in the way is a Jury where 1 or more can read and care.
