  • After my first video on how to get your FFL I have received so many questions regarding FFLs. I have done a decent job answering them in the comments, but this is a condensed version of the questions I have gotten. If I missed something please post it in the comments.

    "RENTAL" and "LOANING" an NFA item are completely different. Yes, you can rent as a part of your business but you would definitely be present or an approved company representative present at all times at an approved facility.

    I do enjoy your videos. As far as owning a machinegun you said it is difficult to get one. That is true and untrue. Now it depends on the state you live in. But if the state has zero restrictions like here in Nevada. Its just a matter of finding a pre-registered 1986 or 1968 MG or SMG for sale and paying a high price for it. In my case it was the local Guitar store.Then after that it is the same as buying a suppressor or building your own SBR. You fill out the Tax stamp paperwork front and back in duplicate tape your mugshot to it go to local law enforcement and get your finger print cards done then send both and $200 to the ATF and when the paperwork comes back then you could go get it or in the case of a home built SBR assemble it. (For some reason I have met a tax I just cant get enough of paying and it is the only tax that has not increased in 88 years) . Basically I believe I can sell you my Mac face to face without going through a gunshop. Although it is a firearm you probably would have to fill out the DOJ form wihch would require a FFL. The MG has to stay in possession of the seller till your tax stamp comes back. To give you an Idea of how easy it may or may not be. Say you lived here in Nevada. I literally can sell you my fullauto Mac 10. I have to keep possession of it till you get your tax stamp then you can come get it. Although you may have to due the DOJ paperwork through an FFL. little known fact since I own my fullauto Mac I can keep possession of it no matter what state or country I was to move to. Thats right even california or NY or any other communist state. Now say you are in a different state and MGs are legal I still could sell it to you and you maybe able to just come get it when the stamp comes back. You would have to check the laws on that. Although you may need to also have to fill out the intent to travel form not sure on that and of course the DOJ paperwork. If not I am sure state to state just requires shipping it too and from a class 3 or SOT similar to suppressors. As far as the guy that wanted to rent out MGs as you pointed out the owner has to be present. I am not sure how the indoor ranges here in Nevada do it but a lot of indoor ranges do rent MGs. A friend of mine was in Reno a couple weeks back with a friend from the PROC that would be calif. They were at an indoor range and his friend rented a belt-fed MG. I do know in the past I have had friends rent MGs and it was pick it up at the counter shoot it in there range then straight back to the counter. Basically the gunshop is still in control of it. As far as what you talked about building or repairing something for somebody. Say I needed to have a gunsmith work on my Mac that gunsmith or anybody else does not need any special kind of FFL or SOT as long as it never leaves my sight. Basically I have to be in control of it at all times. So while it is being worked on I have to be standing there. Its easier to modify a machine gun than a suppressor. Only the manufacturer can modify a suppressor. Look up mac mods you would be surprised at whats out there.
    I have a suggestion for a video or 2 for you lol. Since you seem to like to do these educational videos and have a few related to 80 percenters and building ARs think SBR. Its just a matter of printing out the paperwork off the ATF website filling it out in duplicate, finger prints mug shots and sending it in. For the record SBR paperwork goes to a different address than suppressors and comes back much quicker. And since now you are making videos on SBRs. How about making changes to it down the road? Say your stamp is for a 22 caliber and you want to put a 30 cal upper on it or a longer or shorter barrel? When you come up with the answer to that question you are now armed for many an argument on what ever side you are on.
    Keep the videos coming. You do a good job at not wasting my time watching you listen to yourself talk like a lot of youtubers tend to do.Or maybe the length of this comment.

      Those are all really good points. One day I would like to own a genuine MG. But like you said they are lots of $$. Good video suggestions, I will add them to the list, but no promises on when I will get to them.
      Thanks for the comment on trying to keep things short. I try to do videos as short as possible for the necessary information and even then sometimes I think I talk too much.

    3:08 ATF Compliance inspections can only happen during the licensee's business hours at their business premises.

      That is true. When they don't happen during those hours it is called a Raid... which are rare. Although the ATF did raid a local shop here in my smallish town, so it does happen.

    Yeah that sounds about right with how I'm " " renting a fully automatic rifle is. I shot my first fully automatic M240B here in Texas and essentially they set it up they load it and only thing I do while they're standing right behind me is pop the safety off and squeeze the trigger not supposed to touch the charging handle or anything else Don't know if that's this them being picky or the law either way it was awesome totally worth a hundred bucks for 40 rounds out that belt fed

    Hey, I seen you posted my question. For clarification I never intended on me not being their while I rent out the gun. I take it way to serious to not be there even if it was legal for me to do so. Also one other question, if I have the SOT to manufacture fill autos does that cover me buying them from others as well? Thanks for the video it was very useful.

      Yes, you or a member of your FFL would have to be there. Also you would want to discuss it all with the ATF because it is likely that you would not be able to use post sample machine guns in which case you would have to use pre 1986 firearms which cost north of 20K. As far as the SOT goes to buy other manufactures machine guns I believe you would need your 03, but to make your own the 02. With the 02 you can sell the ones you make. Again in the world of full auto things get expensive fast. Good luck!

      @@TheLarkinsLair how do other SOT holders get away with using post 89 samples? I’ve seen numerous new NFA guns being used on UA-cam channels. I think I’ll ask the atf about it or speak with a lawyer.

      It IS government extortion, just like the $200 extortion fee for NFA items.

      Yeah, that video got me a strike on my channel because UA-cam hates free speech and guns... I am working on a duplicate channel on Rumble as well as doing a new "Lead" casting video but it won't be up for another month.     Great video and answered a ton of questions for me most importantly the separation of personal vs business firearms. That said, during the interview, does the ATF agent have a right/need to see whatever personal firearms you have??

      Unfortunately I don't have a video dedicated to owning machine guns with an FFL. I will add it to my list of videos to make. Unfortunately I have a bunch in the que already so it may be a month until I get it uploaded.

    07 FFL/Class 2 SOT is the perfect combination because you can make and sell pretty much as an FFL 01 and manufacture any kind of firearm or NFA device including machine guns right?

    I want to be able to own a full auto firearm or two and be able to buy guns and have them shipped to me, would that be covered by a type 07 and an sot stamp?

      Yes, but FFLs are for business purposes not personal. So find some way to turn into a business and then use it from time to time for personal as well.

    To keep your FFL by actively dealing in firearms, you said if you do not it can get taken away. However, what if you just aren’t getting much business? Is there some kind of quota you must meet to keep your FFL?

      From my understanding it is pretty subjective on how much is "actively engaged" in the business of firearms. Although as long as you have one transfer a year and something to report on your taxes I would doubt anyone would come tasking. Unless your local ATF office sucked.

    FFL 06, what is the cost for business, especially insurance if you run it out of your home

      Insurance MASSIVLY varies by state, I can't give a good estimate for that.

    Do gun stores buy weapons from ffl type 7 without question or is there alot of haggling with the prices? Id like to make firearms get them serialized customly made at home and be able to walk into a gunstore and sell it to them to place it on the market i dont know if there would be any way to make money that way or if gun stores would just buy them for less then what it cost me to make said weapon and sell it for just digging myself into a hole. Or would it be smarter to make the weapons and sell them to other people after they pass a background check for the price id like?

      You would have to find a gun store that would take them. You could probably work out a deal where they only pay you if they sell. That way they are not on the hook for the money. You could also sell directly to the consumer. But it is hard if your firearms don't have a "brand" name behind them.

    Hey man i have a question for you a class 08FFL is used for importing weapons and ammunition with a class 1 SOT but would i be able to sell those imported firearms and ammunition or do i require more licenses

      From my understanding that is correct, with the 08 you can both import and sell. Although you should clarify with your ATF field office. Also finding foreign companies that export firearms/ammo may be a task in and of itself as many countries have strict ammunition and intellectual property laws regarding exportation of weapons/ammo.

    Hey ,
    Question , let's say I get my 07/02 .
    When it comes time to renewal or when I get my yearly inspection , will regular non NFA transfers be counted as " business " for my 02 ?

      Yes, the 02 is just an add on for you FFL, however if you aren't actively using your SOT they may want to yank your FFL entirely. Lately the ATF has been pulling FFLs just because they feel like it. (www.ammoland.com/2022/05/atf-ffl-revocations-up-a-staggering-500/)

    I was looking into getting an 07 ffl, but I was under the impression that the 07 also lets you deal firearms as well as manufacture. If I wanted to deal firearms that I did not personally manufacture would I require a separate ffl? (all under the same location)

      My understanding is you can both deal and manufacture firearms with an 07.

    After my FFL expires does the ATF still have the authority to visit my house whenever they want? I live in ct and want to buy a fully auto ar-15. I want to get a type 3 FFL.

      No they can't inspect you after you FFL expires. But if you get a post 1986 full auto you can't keep it if you no longer have an FFL. Your best bet is to get a pre1986 model.

    do you have to run a background check on yourself if it goes through your ffl to you?

      Nope, you skip the 4473 and background check. When you have an FFL the ATF is constantly monitoring everyone who has one so there is no need to run a NICS check. However it will have to go through your A&D (acquisition and disposition) book and be dispositioned to yourself.
      The ATF can check inspect this book at any time so they will now know all the guns you obtain since you got your FFL. Also it is recommended that you store your personal firearms separate from your business firearms. And you can't just use your FFL for personal use.

      @@DexterJrParks You have to conduct business, doesn't mean you have to make a profit, but you do need to sell guns of some kind . Not sure if there's a minimum quantity or if just one glock out the door counts.

      "Rent" is a relative term. A member of the NFA trust must be present.
