"artistic nudity" is almost impossible to define, especially in this context. Streaming for an audience is a performance which by default you can argue is art.
Technically it's just streaming content. There's a lot of channels that do just that and nothing else, which is obviously not art.

The Miller test considers three criteria to determine whether material is obscene and not protected by the First Amendment:
1. Whether the average person, applying contemporary community standards, would find that the work, taken as a whole, appeals to the prurient interest.
2. Whether the work depicts or describes, in a patently offensive way, sexual conduct specifically defined by applicable state law.
3. Whether the work, taken as a whole, lacks serious literary, artistic, political, or scientific value.
So in reality it shouldnt be allowed in the current state, since people can interpret it as porn more often that it used to be. Censoring on nudity exists for a reason. At least Twitch should demand ID verification if you want to access such content under the category.
And its not like the art thats being made in there is concidered "artistic nudity" according to the definition posted above. Erect penises, in lewd camera angles, sexual positions, flushed expressions and gestures ( even though they are prohibited) are in the top results there.
Hardcore pr0n is "film" so I am assuming that is perfectly acceptable for Twitch's new guidelines.

Instead, they should immediately and permanently lock the CCL to the stream so it doesn't show up on the front page, and maybe offer a way to appeal that requires the streamer to provide proof that their stream shouldn't have the CCL.
Though it's wishful thinking, because this actually requires Twitch to do a good job of moderating this kind of stuff.

Yes there would be an associated cost but that would be covered by the income of one mildly popular streamer who now doesn’t leave the platform. I know one mildly popular streamer who is leaving the platform.

The problem with Twitch having a separate 18+ service is that advertisers will get all huffy about it. “How are we supposed to target children on a platform like that?”, they’ll say. So money ruins everything, and we end up with the even worse system we have now, with Twitch just throwing up their hands and saying, “You win, naked women. Just keep making us money.”

If they keep everything on the same app / website intentionally, all it'd take are a few parents gathering together to sue Twitch to hell & back.
Up til now, Twitch dodged legal responsibility because the users of the site were the ones acting up on their own.
But if Twitch specifically says p0rn / NSFW is allowed now on the app / website and they don't change the age rating on the app store and such, they open themselves up to lawsuits because they are now intentionally accepting and recruiting p0rn onto their site with an inappropriate age rating.
*Change the age rating first and kick all minors off the platform.* If ya can't do that, then going full p0rn / NSFW is not the way. Twitch will be held legally responsible.
And you just know that the +18 section isn't gonna do anything eventually, teenagers can and will be idiots and find a way to lie about their age so they can stream NSFW shit.
One of the most insane things is you dont even need to be logged in to see it. Like you can go to art and theres just nothing but uncensored porn. You dont even need to agree youre 18+ until you go into a video.

As a small female streamer, I just play video games with my friends. But when I am live, next to these boobie streamers, I get men who are using twitch as a porn site coming into my chat. I've been called the most deplorable, gross, and vile things live. I don't care if women do these things as long as it's in the appropriate website. But it effects every female streamer in a very bad way. I don't want twitch to endorse these things because it enables very bad behavior. I mark my videos as 18+ to prevent minors from interacting with me and I drink. I don't want to co exist in the same place as softcore porn because I'm sipping on some wine.
Edit: If you are a woman coming to tell me it's normal. Don't bother. I'm aware. Lessening the issue is ideal, eliminating it is impossible. All women no matter if it's a sex worker or normal woman should have the right to feel comfortable and both sides need to work together to achieve that. I don't think they'll ever fully separate adult content into a whole new like website or whatever. However if you can see all the thumbnails before any sort of 18+ screen is easily breaking COPPA or whatever that law is called that forces all adult websites to have a landing page like that. What they'll probably do is something more akin to the regular Cartoon Network and Adult Swim sharing the same tv channel type of situation. Where Twitch will have all the teen friendly content while all the adult content (probably not just including sexualized stuff either like how Adult Swim works) will be put into some basically glorified super category that will house all this content. It won't ever show up in the top most popular genres or anything like that, and instead have some button that brings you to subsite within Twitch where it'll hold all these new adult content categories.

@@TheWeekndFan-tv8ce As far as I can tell, COPPA only pertains to the collection of minors' data online. Meaning that there has to be some sort of pop-up warning that data may be collected (which I assume the cookie notification takes care of). Various US states have differing laws requiring the 18+ splash or ID age verification. My best guess is that there is no actually enforced law, but most 'legit' sites just put one up to cover their asses.

Once laws go onto the books, they don’t get removed easily and certainly not if they are there to try to protect children, no matter how misguided - particularly if they are misguided.
@@PippetWhippet yea the law is absolutely misguided but the warning landing page is literally the least Twitch has to do keep clean in the law's eyes. COPPA also will try to find them per charge and dear god it would already be sooo many charges

Twitch already has filters that require you to set up an account saying you're an adult if you want to watch streams marked mature. Why are you more opposed to kids seeing tits than them hearing the swears or seeing a character's spine get ripped out of their body?
