That really shouldn't even be illegal itself, given that he is, by US federal law, a member of the unorganized US militia, being an able bodied man between the ages of 17-45. Given that the militia is to be armed and well-regulated, laws prohibiting 17 year olds from owning firearms ought to be moot. Title 10 U.S. Code § 246 This case is going to bring that issue under serious light, and, should it somehow make it to SCOTUS, will likely result in a ruling which makes those laws null and void.
They charged the McCloskey's with a felony and seized their weapons. The guns they brandished and didn't use to deter a violent mob on their private property. This case isn’t up to us to debate about. Most of us don’t know enough about how the court works to guess what the outcome of this case will be and even if some of us do know, we have very little of actually evidence that will be presented durning the trials. (I personally think Kyle’s actions were the right thing. I hate pretentious people that go on those kind of riots that pretend to be righteous and I would love to see most of them dead. Mine is a biased opinion. And I can assure you that both defense and prosecution won’t settle with a biased judge that supports the other side. Most likely they’ll agree on a judge that isn’t biased. That alone could take half an year.) But I can logically judge that Kyle was the offender. He openly brought a gun in public and provoked the rioters by putting out the fire. (It doesn’t matter if what he did was “good”, all that matters here is that he initiated the confrontation) logically speaking the outcome was the direct cause of him putting out that fire. Of course this wouldn’t be a big deal if it didn’t result in 2 people dead and another wounded. But more importantly he is the minority here. When he was “defending” himself, from the rioters perspective the said “defense” could be interpreted as “offense”. And rightfully so! Kyle was a danger to others, thus it legally allowed the rioters to disarm him or something like that. (At least that’s if we look at this from rioters perspective, all they knew was that Kyle shot someone.) if he dropped his gun right there and then, he would be justified in self defense. Since if the rioters took aggression even after Kyle surrendered it would be illegal. But he ran with the gun... thus giving the rioters legal reason to “beat his ass”. Most of the charges are likely to be dismissed. But it’s obvious that Kyle was in the wrong legally. He was illegally caring the gun he used to defend himself with. Idk how it works exactly but, I think since he defended himself trough illegal means, he can’t push self defense.
The criminal complaint is basically someone explaining how Kyle was attacked multiple times before shooting his attackers? Sounds more like a brief the defense would submit.
That was my take, they know this won't stick I think the DA just knows if they don't charge him the media will throw a fit and help whip the rioters into a frenzy. Not that that won't happen when the cops aren't charged for Blake and this kid walks away with an acquittal. If these political hacks just stopped bending over to rioters and drew a fucking line in the sand none of this would be happening, instead they try to dance around in the fire thinking they won't get burned.
@@MrMattumbo Pretty much. I even started to wonder whether Donut switched to reading a statement from the defense given how detailed the description of the initial attempted gun grab was.

They exchanged words and he told Kyle to call someone, not fully realizing that it was Kyle he was talking to. Kyle then took up his phone and started calling. When rioters started closing the distance he ran cause he was in a tight spot. Im not really sure who the guy Kyle called is. But i expect that it was someone close to him that was also attending the riots. Kyle may have "disparity of force " on his side due to the size of the group and the fact that at least two of them were armed. upon further investigation it has been ascertained that Kyle had been knocked to the ground and physically assaulted by at least two assailants, one of witch he shot, this combined with the fact that in previous encounters with these "rioter/protesters" they have been known to beat people unconscious and when armed, have been known to shoot people. No matter what you think about this, you cant deny the fact that Kyle was in fear for his life and acted to defend himself from great bodily injury.
He not only defended his life, he did it with all the poise and situational awareness of a combat veteran. He could have easily taken out more of the people that went after him, but left alone the ones who legitimately begged off. GAIGE WAS NEVER "SURRENDERING" OR PUTTING HIS HANDS UP AS IN GIVING UP OR TRYING TO CALM THE SITUATION. I get so tired of hearing that gaige was putting his hands up before he was shot in the arm. He WAS NOT putting his hands up, he flinched (causing his hands to pull up to his head to protect it) from the shot that hit the skateboarder. He then started to charge at Kyle while bringing the gun back onto Kyle. It even looks like he was about to unload on Kyle right as the shot that hits the skateboarder goes off. In my opinion it was amazing that Kyle didn't shoot till the absolute last moment he had to with all 4 of the people he shot at. When he shot gaige he starts to draw on him then while he's flinching he starts to lower the rifle. Then shoots him when he starts coming back towards him. Probably the only reason he was shot in the arm and not the chest, cause Kyle didn't shot him immediately.
Watching the vid I think Rittenhouse had a malfunction in his AR after Huber was shot. He cleared it at the next moment and Grosskreutz decided to try a shot. Grosskreutz' friend later quoted Grosskreutz as saying he would have fired his whole magazine at that Rittenhouse if he hadn't been shot. 4 inches to the right and Grosskreutz would have been unavailable for comment. He probably talked up a ton of crap to the cops who rescued him (right after they drove right by Rittenhouse and told him to beat it!). The fact that Rittenhouse didn't finish Grosskreutz off makes it seem unlikely he had deadly intent and disregard for human life. This coupled with his fire discipline as you mention underline the case as self defense and not wanton shooting by a crazed person. He only shot at people attacking him.

After seeing the full video and all the action that took place with Rittenhouse, Kyle was actually running from the all mentioned in the case trying to avoid being hit with the skateboard and being shot! In all the shooting looked legitimately as self defense, plus not only did the rioters turn against Rittenhouse for putting out the fire, but the men he shot did in fact attack Rittenhouse first after he extinguished the fire. Most of the problems with the entire case even though Rittenhouse was acquitted of the murder, was the fact that the DAs office in Kenosha Wi wanted to charge him for defending himself and didn’t conduct a thorough investigation into the incident. But what really strikes me as a bad idea is Kyle traveled to Kenosha from another state with the intention to help people and stop the looting and arsonists from burning other companies, store fronts and car dealerships all while under age.
Bad ideas happen when cops don't do their job and minors have to protect their family's lively hood. A lot of cause and effect going on and Rittenhouse certainly wasn't to blame.
@@Chase-vq6eqI mean a massive reason why cops were stretched so thin is this was during the BLM riots and this sorta thing was happening everywhere, mass burning down of stores, mass looting, mass riots. It sucks Kyle had to take on this protective role himself as a minor because a bunch of adults can’t conduct themselves in a reasonable manner. Like in my country (Scotland, yes, the movement spread here too) they had a poster protest, this was creative thousands of posters with messages, images, artwork, poetry, all put on temporary fencing outside the city council (like a city hall), and the other agreed locations of Duthie Park (the most popular park in our city Aberdeen), and Victoria Park on the railings so it was viewable from the road and pavements. The purpose was to give folk a way of expressing their thoughts and opinions in a way that prevented any damage to businesses/homes, prevented vandalism, prevented rioting, folk just behaved and created a poster in a way that allowed them to express their opinion in a rather creative way. Folk travelled from all over to see the posters, wanted to read their messages and view the artwork whilst supporting their cause/message, and it was very popular because it was done in such a polite manner and it was extremely popular on social media with folk singing praises for the great conduct, for expressing their free speech, and for acting in a dignified manner. No toppling of statues, no burning buildings, no having to rely on a young man to protect an entire area because the Police were unable to do their job. Add on American Police being defunded and not having enough Officers, it’s little wonder Kyle was the only responsible and sane voice there, which is incredibly depressing. Despite this being like 3-4 years ago now the effects are still being felt, Cops in America can’t do their jobs without folk being overly aggressive for no reason, without having phones shoved in their faces, without folk getting in the way, are still being defunded, every single move criticised and watched under a microscope. It’s depressing.

I love how the general argument is “they’re only trying to take his gun away” as if we all have no idea what is about to follow that immediately afterwards.
@Falkrim more than that, they would shoot him with his own gun. Several years ago long before this craziness, what I took the CCW class from a local police department, they clearly stated and also gave an actual case example where someone was found justified in shooting another person because they were trying to disarm him. Of course in today's upside down world, you just have to take your beating or shooting because after all, they are just mostly peaceful protesters.
@Tom Wetz Considering he was peaceful until he was being chased by criminal scum, all because he was doing his part to help by putting out a dangerous fire near a gas station... If putting out a fire is grounds for assault, then the guy defending his own life is the one being charged, I don't know what to say about that...
No matter how someone feels about what happened. On what side someone falls politically. There's no way to factually get around the reality Rittenhouse was defending himself.
Legally speaking you can, look at Wisconsin’s self defense laws, because Rittenhouse was committing criminal activity the self defense law will not be applicable to the situation. They look at it as fuck around and find out.

How is it a “mass shooting” when the mass is the one attacking the shooter? He made every effort to retreat and evade the crowd. THEY put themselves in harms way.
He even stopped himself from shooting the guy with the pistol at first because he saw that he stopped charging him. It wasn't until the guy with the pistol charged him a second time and pointed the pistol at him that the guy shot him. So much restraint, he did not want to shoot people: he had to shoot people.
The fact that people still send kyle death threats on twitter every single day saying hes a mass murderer and he is guilty is fucking insane to me. Because they all use the exact same fucking lies in their argument that were all disproven in court.
It's a common strategy of liberal fascists to always accuse their 'opponents' of what they themselves are doing. They will hunt and hound Kyle for the rest of time if they get the chance, just because he exposed them for who and what they really are!! When do Americans hit back? Ballot box alone will not cut it.
They were more concerned with railroading a teenager that was trying to save the city…. They wanted the city to burn to the ground. Then, “they” can “revitalize” the town, aka, gentrification….. That’s why they let all these felons out of jail, some were even bussed in, knowing that they would cause as much damage as they possibly could, because the cops have been told to not do anything accept watch, but things went wrong for “them” when LEGALLY armed citizens showed up to fix and prevent damages. And in Kyle’s case, render medical aid to ANYONE who needed it. He even used hollow point varmint rounds, 40 grain federal hollow points, you can buy them real cheap at Walmart. Because even at 17 he knew the dangers of over penetration. Especially when going into a riot with people all over the place. You want that bullet to stop completely in the attacker. And not sail right through the attacker/attackers, and hit someone doing nothing but maybe, just maybe, actually peacefully protesting. Yet they want to portray him as a mass shooter? He didn’t even have a spare magazine….. just the 30 rounder, and possibly +1 in the chamber. So at most he had 31 rounds…. He fired 8 or 9 rounds, had no spare mag, was surrounded by people yelling get him, beat him up, all kinds of shit. There was even someone else in the crowd shooting at him…. This whole thing was outrageous, and the fact the ones in charge, yeah, are more concerned about a 17 year old defending himself against violent felons high on all kinds of bad shit, and attacking him, 2 people attempting to take his gun, and we know exactly what they would have done with it had they successfully took it from him, is unacceptable. And should be addressed. This was a political attack on Kyle. He didn’t even shoot or kill any black people, sure, he shot at one, after they flying jump kicked him in the face, and their also portraying him as a white supremacist….. This is absolutely pathetic, and infuriating. They tried the same BS on that couple who stood in their front yard with firearms, after a psychotic mob broke through a rod iron gate, and poured in like termites. And after watching the news in 2020, with people like that burning places down, killing shop owners, killing cops left and right, gunning down right wing journalists then shooting at cops when they show up to arrest him, and attacking civilians, including an elderly woman in a wheelchair, why shouldn’t they take up arms and defend their home, and their lives, neighborhood and property??? We must never forget the psychotic lefts behavior in 2020, and their Democrat “representatives”, who by the way they couldn't legally vote for being felons…. DEFENDING their violent actions, calling the riots "firey, but peaceful protests"…. We must never forget 2020…. For many reasons. But, like 9/11, most will forget…. And continue absorbing anything they hear on MSNBC, or CNN, ABC….. regarding the “Jan 6” committee….. I try to just go about life anymore, but this should concern people more than it appears it does….

I'm all for Kyle but if they convict him it means the begging of the end for people trying to "legally" defend themselves from death.
Code § 246
This case is going to bring that issue under serious light, and, should it somehow make it to SCOTUS, will likely result in a ruling which makes those laws null and void.

That alone could take half an year.)
But I can logically judge that Kyle was the offender.

I never in my life thought I would witness two people dressed as medics having a gun fight in the middle of the street!

Also he was fine with what he did, without stand your ground laws, that just means you have a duty to retreat if possible, which was the first thing he attempted and only after he was persistently pursued and cornered did he fire the weapon.

We didn't know what started the mob's aggression towards him, but now I know, I can say that 100% I think he shouldn't be charged as it was in fact self defence
yea i dont think the norm should be, let mobs of criminals with criminal backgrounds mob onto people when they dont know what happened and to beat or kill someone without due process, kind of ruins the point of the court system he is in now. when your being chased by a mob of angry people shooting firearms around you and your "innocent" at least in the eyes of the court without due process (and you came back to the scene and called 911 to report what happened and try to stay around the violent crowd who just shot off rounds at you or around you and you dont know if ur about to be shot) you shouldnt have to risk your life to find out how badly is the mob going to beat you or even kill you like we seen happen. you know i dont think thats exactly legal to stomp on someone on the ground or to hit them in the head with a skateboard when they are running for their life from a mob of animals, and it shouldnt be accepted. if you didnt see what happened you have to call the cops or record what you can and react off what you see for yourself, you cant get involved in third party encounters when you didnt see what happened and not expect there to be consequences for when you step over the line and are wrong, even if that person is forced to defend their life.

That's like saying killing police who are trying to arrest you is clearly self defense. Yes, logically it is, but that doesn't mean it's justified.
@A KB I hope so. FREE KYLE!!! I would have done the same thing if I were in his shoes. Being attacked by many people and his life was in danger. Stand your ground and do what needs to be done. He better win his case. People need to learn we are tired of this shit and are no longer fucking around!

Did anyone that burned that city get prosecuted, or were they more concerned with railroading a teenager that was trying to save the city?
