You must be struck with the bullet, then it's attempted murder. It's assault with a Firearm when you shoot at someone and miss, Brandishing a Gun when you point it at someone.

@@dr.professor4974 Because he was continually retreating from them and continually being chased. Anyone who carries knows that retreating almost always disqualifies you from pursuing with force. That is called vigilante justice and it is illegal. Just because Kyle was in an area where SOME people were getting hurt does not mean he was hunting down aggressors lmao. We ALL have a constitutional right to assembly and counter-assembly. Him being there is his own decision and testimony backs up that his main purpose there was to provide first aid (which is very simple medical stuff but does help people from further injury) I think if you are going to something like this be it left wing or right wing, you should carry a weapon no matter what. Especially a firearm if you can conceal. If you want to open carry that's your choice, I choose not to because that puts a target on me but that doesn't mean I would be wrong in doing so. That is just my own personal risk assessment and not everyone has the same measurement of personal risk. Do you really think Kyle was the only person to defend themselves that night or across the country all of last summer? Again, everyone has a right to be there (peacefully i.e. in a non-destructive manner). The only angle that Kyle's chasers have is they believed they were stopping a "mass shooter" which he clearly was not. They were out to get him because he was on the other side of their politics and viewed anyone not on his side as their ally (Rosenbaum).

There was absolutely no way any attempted murder charge against Grosskreutz would have succeeded. It would have been another massive waste of time and money. Had he shot Rittenhouse, he almost certainly would have been justified under self defense. He just saw Rittenhouse kill Huber and thought Rittenhouse was preparing to fire again. (Search for Rittenhouse Forward Assist for more details on what precisely happened.)
The question would have been "Is it reasonable that Grosskreutz thought that 'Rittenhouse was about to shoot me'?" with the specific timing of Rittenhouse manipulating his rifle. The question would NOT have been whether Grosskreutz was right and would only be going off of what Grosskreutz knew.

Man on stand pulls his gun when he’s around a kyle who’s already shot and killed another man. (Justified or not) Why is the man on the stand not allowed to have his gun pulled in self defense? You guys are arguing against using a firearm in self defense.

@@thekurtrussell4007 In point of fact, the man on the stand is not allowed to have a gun at all (felony conviction and all). But, if he was allowed to carry, and was carrying legally, it still isn't self defense to run after someone who is clearly trying to run away and shoot them. Kyle was trying to run to the police.
But, if Gaige thought he was the 'good guy with the gun trying to stop an active shooter' and if he had been legally carrying, he would certainly have a solid case not to be charged with anything. He made a mistake in a difficult situation, and was wrong. Further, he didn't actually hurt an innocent victim. However, he was illegally carrying. That should be a charge all by itself. For people who want less guns and less gun crime, this one is a slam dunk. Prosecute the person who illegally possessed a gun, illegally carried it, and is the kind of gun responsible for FAR more crimes than AR15s.

@@thekurtrussell4007the man on the stand ran towards the man who was armed and had just killed someone. He wasn’t trying to defend himself he was trying to attack someone. Running into danger whilst armed towards an armed person is in no way or shape “self defence”
