  • In this episode of emmakennytv, we confront the heart-wrenching story of Shanda Vander Ark and the untimely demise of her son, Timothy Ferguson. This case takes us on a dark journey through the disturbing actions of a mother, whose role was to protect and nurture, but instead led to an inconceivable outcome.
We will delve into the details of the investigation, the psychological analysis of Shanda's behavior, and the systemic failures that may have overlooked the warning signs leading up to this tragedy. As we unravel the layers of this case, we aim to shed light on the importance of vigilance in child welfare and the dire consequences when it falters.
Join me for a sensitive, in-depth examination of the factors that culminate in such a devastating event, as we pay tribute to the memory of Timothy and discuss what can be done to prevent similar incidents in the future.

Sad thing is there are probably hundreds if not thousands of children being severely abused right now. It hurts me even more because I have disabilities myself and I don’t understand why parents can’t just accept their children for who they are. They do not deserve to share the same air as most of us.

I have multiple disabilities and both of my parents have never accepted it. As an adult, I can stand up for myself; but children just can’t do that and be heard in the same way. In the future, I would love to foster/adopt a child with disabilities so that they don’t have the upbringing that I did. Some people truly do not deserve to have children!

Try pursuing charges with the statute allowing for it and watch cops procrastinate it like a birthday ending in 0. That's the sad part. You can survive nearly 2 decades of hell and the law says the offender (CSA) is fine and their friends think they're saints.

The judge was phenomenal. His statements were SO powerful. He summed up exactly how I always feel - I give so many people the benefit of the doubt bc I don’t want to believe people are just so vicious. I can’t wrap my mind around it. I assume there has to be some impetus for their evil - not a justification for their crimes, but some past trauma that set their future cruelty in motion. And that isn’t always the case. The judge loved her son more than she did - I love that he put up that photo. And I love that he ended it with “HE won. You didn’t win. TIMOTHY won.”
As much as Paul has to be punished for his part, he’s also very much a victim of hers as well. There’s clearly something not entirely right with his development and I can speak from experience to being raised by parents who skew sadistic - not even REMOTELY to her degree, but my parents definitely relished the power they had over us, and it informed my life as a sibling and my early perspectives on child care. I thank GOD I changed direction but parental influence does do quite a bit in the way kids treat others.

The only victim here is Timothy. Paul's been tested. By 3 different doctors who not only evaluated him but also dug deep into his school records, hospital records. Nothing is wrong with him. He was a bully to Timothy before they even moved in with their mother. Per the words of their half sister. Also, there was allegations by their school that Paul was SA Timothy while in Oklahoma. Before even moving in with her. He may be a product of his upbringing but it's an insult to ever refer to him as a victim.

Timothy was just a month younger than my son. All the while my son was growing up, there was Timothy, a child almost exactly his age, living a life of horror and pain. I can't think about it without crying. So much life taken away from this child and maybe even worse: in the years he lived there was so little joy, so little being loved and held. So little laughter. Death shouldn't be a blessing if you're 15. For him, it must have been. I am so sorry Timothy, for what they did to you.

I have PTSD and I understand that it can make me short tempered at times but it doesn’t make me violent or torturous, it makes me anxious and verbally snappish but the minute I loose control and the words escape my mouth I feel devastated and immediately apologetic begging my partner’s forgiveness.
I have never once wanted to punish him, zip tie him, confine him, starve him, monitor him by cameras and motion detectors or control his sleeping, bathroom functions or movements.
Anyone with PTSD knows what trauma can do to you and how it affects the rest of your life so inflicting trauma on another is anathema to them.

But the older boy says something really telling in the police interview. He says," Timothy lived in the past - he couldn't move on". I think Timothy held his mother to account for failings in their early childhood. Her excuses and her attempts to flip the blame onto their dad didn't work so well with Timothy as it did his older brother.

I totally agree with you Emma my 8 year old daughter has recently been diagnosed with adhd and did. And all the doctors have done is try to shove medication on her, which I have absolutely refused point blank... she's 8 bloody years old, and until she is old enough to ask for and understand the medication she's going to be taking she will not be taking any. My partner, her father has suffered with adhd since a child and he has said that he knows first hand the meds for those specific problems never help they just made him feel awful(like a zombie).
So we are aiming to help her learn to be able to notice her triggers herself and find healthy and better ways to manage this that don't involve drugging her.

This case happened in my own county, and shook me to my core. I actually reached out to our school district asking if we can put more regulations on homeschooling parents. We homeschool for my son - he has very complex disabilities and also has an antibody disorder meaning he can't create the antibodies he needs to stay healthy in a classroom. I don't know how Timothy was allowed to fall through the cracks, she should've never had him according to the courts.
She KNEW better but she enjoyed playing dumb during her trial, and it made me ragey.
Michigan sadly has little to no regulations for homeschooling parents. After the school district said there was nothing they can do because the state, I sent a letter to our governor, I don't know if it actually matters but it felt like I could actually do something. I don't care what the regulations are.
Also, there was an amazing school that would've been great for Timothy because the entire school is dedicated to being a safe place for children with complex disabilities. He would've thrived there if Shanda actually tried getting him placed somewhere.
PSA for Michigan parents: You can homeschool with an IEP and get therapy through the school district, which is something because at least other people can interact with the children and make sure they are safe.

There was absolutely a sexual aspect to this sadistic monster. It’s highlighted by constantly insisting he wears nothing on the bottom of his person. That she asks her older son to burn his younger brothers genitals.
    She got off on this.
I’ve watched the trial and it’s eye opening. The prosecutor was AMAZING. He gave that poor baby a voice where he has none.
Adam Vander Ark did say he thought she hyped up his illnesses by far.
He was so thin he had 0% body fat, ligaments tore away from the bone he was so horrifically treated. His last moments were of her… abusing him. It’s so shocking. It’s very troubling. In fact the last video hours before his death wasn’t shown to the jury it was so harrowing that they had the cops to explain it. It’s THAT bad.
    RIP Timothy.

Journalist of Court tv had the opportunity to see the last pic of Timothy before death (picture of when he was about to be put in this mortal ice bath)
His reation speaks for itself. He was horrified and rolled his eyes.
Better for us not seeing this picture. Timothy wasnt anymore the little boy you see on picture when he smiled.
He was so deprived of food, his hair texture, color (became darker and very thin) and facial traits changed.

I think Paul was also abused by his mother from his early years. To coherse someone to constantly abuse younger siblings is a truly unforgivable crime. Now Paul will go to jail. He will sit among criminals, brainwashed by his mother. Poor Timothy is dead, but I think Paul is dead, too.
BTW that nasty, disgusting woman Shanda could have at least taken care of Paul's teeth. Installing cameras, spying on your own children all the time, but taking them to an orthodontist and a dentist is too much for this woman. What a terrible, neglectful person she is.
Maybe this is a stupid detail in this whole tragedy, but somehow it hit me.

She gave birth to Timothy 11 days before I gave birth to my son. He also has multiple diagnoses, both mental health & physical illnesses. I could never imagine hurting him & the thought of someone else doing brings up a rage inside me that brings me to tears. I have another son a year younger than Paul, who is autistic, & he would decimate ANYONE (including me) if they hurt his little brother. NOBODY gets between them. I can't wrap my head around this case. True crime normally doesn't bother me, but I guess because it is so similar to my situation, this one has touched me differently. I pray for Timothy that he isn't suffering anymore & even though he may not have felt loved in this life, he feels the love from everyone who knows his story now. 😢

Could you cover the case of Lorraine Barwell? My mum worked with her and she was kicked to death just doing her job. She was a prison officer and he kicked her in the head, causing catastrophic brain injuries, killing her. She helped care for her disabled granddaughter and was a lovely woman. She was known as ‘Rocky’ because she was a tough yet tiny woman. Her killer has been seen walking around unsupervised, going to the gym, the supermarket etc after just 2 years in a psychiatric hospital. He could flip out and harm or even kill someone at any time. This poor woman and her family have had no justice and barely any media coverage. It would be great if you could raise awareness of this dangerous man and as a tribute to Lorraine. Thank you x
