It’s funny that if any reasonable civilian was to commit an offence due to a lack of knowledge of the law they would still be prosecuted because ignorance of the law is no excuse, but when cops make a mistake and unlawfully detain people that’s seen as a reasonable mistake, double standards are staggering.
That isn't a legal defense for the police. You can sue, and they can't claim ignorance as a defense. There is qualified immunity for issues that are unsettled, but that doesn't protect officer ignorance of the law, that protects officers when courts have not yet decided the law.
They had no idea how to react. Their whole presence is defined by that badge, and everyone is supposed to respect that badge. So when someone doesn't, they get befuddled.

Believe me, they shrug it off and move on with their day. At worst, they mull over the law when they get home, and discuss with their wife how they were technically possibly correct too. What you’ll never do, is get them to fundamentally rethink their entire perspective towards citizens and examine their own flawed judgement when it comes to assessing probable cause.

This video reminds me of an incident with my late wife in the small community of Bellaire, Texas, a Houston locale. My late wife had lost her left leg to amputation due to diabetes. She and my mother were at a shopping center in my mother's car and parked in a handicapped spot. They had forgotten the placard. A Bellaire Officer wrote them up for failure to display; never mind the wheelchair and stump of one leg, in spite of she and my mother appealing to the actual NEED for the space. She chose to go to court and contest it. When called by the bailiff, my wife rolled up to the judge's bench, held up her stump, and said "is there any doubt?". The judge reprimanded the officer and dismissed the ticket. Common sense prevailed!
That is a terrible loss, what an awesome attitude, and a great memory of her. She sounds like she might have been a courageous badass. (in the most admiring context).

Unfortunately, having dealt with a lot of police in my line of work in the past, I can confirm that even in the bluest of blue states -- cops are completely out of control at least 65% of the time no matter where you are. The kind of people that have been going out to become police over the last 30-40 years are typically problematic people at best, which is exactly why we find ourselves in the mess we're currently in. They don't take the job because they want to protect people, its about power and the paycheck. Police always claim to be underpaid, but I personally don't know a single person who doesn't wear the black and blue who can just stand around at a construction site on a weekend and get paid over $100 an hour for practically doing nothing. The last thing I said is particularly of note in the rural parts of the Northeastern US surprisingly, and they get very gung ho about trying to get "bonuses" by making traffic stops when they can while on construction traffic details. If you ever find yourself traveling by car in any of the New England states and find yourself at a construction zone, be extraordinarily cautious! It could save you a lot of time and potentially jail time.
That's what qualified immunity has done for us. The authorities know about qualified immunity so of course they know they can abuse their power and treat the public with contempt and disrespect.
That Captain was VEEEERY frustrated that he couldn't just throw the "mouthy" disabled guy in jail like he so desperately wanted to. Makes me wonder how many innocent folks whose lives that shmuck has ruined during his "career" in "public service".

I don't get this narrative. As a cop, every cop I know is willing to acknowledge when a civilian makes a mistake or misunderstands the law. Usually it's pretty easy to tell when someone genuinely doesn't understand what they did wrong, and when that's the case, we give them a warning and educate.

Amazing how the courts ruled that cops can make “reasonable mistakes of law” but the same court ruled that citizens are not excused when they misunderstand a law. In other words, citizens are expected to know and understand ALL laws. Every single one. While the very people who enforce them can make mistakes. Also, the main problem with the reasonable mistake language is that it assumes police enforce laws in good faith, which we all know they don’t. So the court created a precedent where cops can pull people over without a lawful reason and then justify it later by pretending they misunderstood the law. “Oh I thought you had to have two license plate lights, not just one.” Oh well, the person was arrested, stripped of their Liberty, and their car towed but hey it’s all good because it was a “reasonable” mistake. I’m sure that’s just what the founders had in mind.
This opens another line of questions. At what point do you feel the police are targeting you? If they were all that corrupt and had a grudge, what’s to stop them from arresting you, planting false evidence, and locking you up forever? Now the real question: What do you do about it? At what point do you fight the police? When does it become reasonable to aim your gun down at an officer?
I would go much further: 1. Officers must clearly state the beginning of the detention. 2. Officer must provide the basis for their reasonable suspicion. 3. If the officer has the person move, they must state the reasons and how it is addressing safety concerns. 4. If the officer handcuffs the person or places them in their car, they must state the reason for their belief additional safety measures are needed. 5. As soon as the safety concern is addressed, the officers must remove cuffs, allow the person to exit the police car, etc. 6. When asked, officers must identify how they are actively advancing an investigation (requirement to continue detention). 7. As soon as RS no longer exists, or the investigation is not actively being advanced, officers must immediately inform the person they are no longer being detained (no holding the person while they go through copspeak). Also... I don't mind if officers lie to try to get a confession, but it should be illegal to lie about the law and the person's rights such as requirements to identify, answer questions, submit to a search, remain when not detained, etc.
That whole because I said so needs to be done away with too, Like if you believe you really do have a good reason to do whatever you're gonna do then just say what it is lol that's de-escalation 101 And it's also funny that cops go through D escalation training but none of them actually do What I'm talking about

The real problem is AtA is leading us to a snap judgment without the most relevant information. We don't know if the license plate is compliant, and we don't know if McQueen's commission has expired. Personally, I'm suspecting the plate wasn't compliant. That's probably one of the most common tickets the police write and I'd be hesitant to blithely assume they can't identify compliant plates. My feeling is they probably let it go because a disabled veteran was playing the race victim card and a parking ticket was not worth the scandal.

Although, and this wasn't addressed as far as I can tell, typically when these kinds of drastic changes are made, there's a "grace period" between when the new law is enacted and when it's universally enforced. Because this is a change to the physical license plate design, that requires people to get new plates to be legal. That takes time to get those new plates issued. Provided he can get that symbol at all, because the new law is more restrictive. Take me, I'm >50% Service Connected, I can qualify for the DV plates. It isn't Texas that calls Cops "Peace Officers". It is the most common term. To be fair, the younger officer said there was a recent change, but was cut off by Mr. McQueen. This is why McQueen deserved the B+. He said he had his plate for at least five years. It's clear he is wrong, but was not informed of the change.
@@piper998877 I don't know about the US, but here in europe you usually have some time to adjust to new laws, for example you get by law a time span where your old plates are still valid and you need to get new ones in time. This can be months or even years depending on the type of law. So I would assume that the plates could be still valid if the change was that recent.
Him needing to be versed in the updated law would only need apply here if this weren't an old video. They were wrong here and their loud and aggressive language/behavior did nothing but serve did nothing but prove that these thugs care more about enforcing feelings than laws.
That still depends on just how old it is. AtA was not entirely correct in their statement of when the code changed. It actually took effect Sept 1, 2021. However, the change to require a doctor's signature went into effect Jan 2022. So basically, they gave you a grace period from Sep to Jan to not need a dr. to get the plate, but you still need the plate. The one officer who references tje changed code even states that it went into effect "in September", leading us to believe that this was filmed after Sep 1, 2021, and that was indeed the new code. The officers attitude was abysmal, but based on the information given (and the likely assumption that his plate did not include the ISA symbol based on context of the events), their reason for approaching would have been valid, and his claim it was not would be wrong.
@@luke6612 Not to mention, assuming this law is in effect at the time of the video, the driver also mentions that he has had no problems for the past five years with these plates. As there were no DV plates with the ISA symbol prior to December 1, 2021, I find it hard to believe that he had one for the past five years. So, we can reasonably assume that he had a normal DV plate.
In Louisiana DV plates are authorized to utilize handicap spaces. It’s permanent and free of registration fees. I used to have to keep the statue in my car, because I was harassed so often. And yes, I have physical disabilities that would qualify for a hang tag. Recently they upgraded the DV plates to include the universal symbol, in part because of the issues me and others faced.
Why isn't everyone demanding an end to qualified immunity? Cops should not free from the consequences of their actions and need to be held personally accountable, not the city, but them personally. It's the only thing that will work.
Because those in power don't want actual chnage that will effect how they opperate. Instead they distract people with cries of institutional racism and black lives matter.

ATA is wrong on new DV/disabled parking rule here. If you qualify under the new law, you can still obtain disabled parking placard (blue placard) to park in a disabled parking space. You do NOT need to have a license plate with disabled symbol.
It is also worth noting that as a vet he likely has been trained to be meticulous and very aware of personal responsibility, so that he got angry towards the end and generally had an active desire to prompt them to show their competence could stem from that, too. In the military, sloppiness can quickly become deadly and is a significant offense to the rest of the team, so vets can have a tendency to go hardass on people in civ life when they encounter stuff that in the military would have a superior shout them into the ground.

Sorry for your loss

Isn’t it lovely cops can make “reasonable mistakes of law”, but any misunderstanding of the law as a civilian isn’t ever an excuse
I don't get this narrative. As a cop, every cop I know is willing to acknowledge when a civilian makes a mistake or misunderstands the law. Usually it's pretty easy to tell when someone genuinely doesn't understand what they did wrong, and when that's the case, we give them a warning and educate.

I agree. Auditors abound, but police interaction assessments with detailed legal context is another level. Some 'regulars' here get bent out of shape about grades, but that's inherently subjective, and I don't even care about that part. ATA has missed some points of law at times, but he gives so much detail on the basis of his assessment that it enables viewers to check and verify when there's uncertainty.
“Oh I thought you had to have two license plate lights, not just one.”
Oh well, the person was arrested, stripped of their Liberty, and their car towed but hey it’s all good because it was a “reasonable” mistake.

It is just the rulers vs ruled
I'd like to see a new law that requires a police officer to give clear "yes" or "no" answer when someone asks if they're being detained.
It's their pride that makes them dance around it cuz they know legally they can't force him to stay but doesn't want him to know that.
I'd like the current laws to be applied to cops.
I would go much further:

Being disabled while black. Honestly, I had no idea about the DV license plates at all. Even if the law has changed for that particular plate in Texas and it's outdated, just let the guy know and he can get it corrected. Almost like a "fix it" ticket... these cops definitely barked up the wrong tree.
You can't get disabled plates unless you qualify for a disabled plaque.
But it doesn't show the symbol on the tag. If it's there, he's legal. If it not there, he parked illegally.
Where did they bring race into the question? You assume that every interaction between a white person and a minority is because of their race. That assumes then that no minority can ever commit a crime or violate the law.
The disabled plate vs the disabled veteran plate is totally the falt of the legislature as research was not correct when the bill was written as to the requirements of parking in a disabled parking spot.
@@ImBradCrites Chances are good that he doesn't have the Disabled symbol, yet. He's saying "it's been this way for years", meaning he's likely operating under knowledge of the old law. However, I don't have a physically visible or limiting disability (limiting is subjective where heart conditions are concerned, mind you), which means I wouldn't qualify for the Disabled symbol under this law.
Under the new law, I wouldn't be able to use Accessibility spaces. Even if I could before. And chances are good that I wouldn't know about that change until I had a cop write me up for the violation, because these kinds of changes to the law are notoriously slow to circulate. So I suspect that's also true here. But he didn't get written up, either. Either he's got the symbol, or those cops are grossly ignorant of the laws they're supposed to enforce. I lean toward the latter.
How about this:
Officer: "how are ya? Thank you for your service. Just an FYI, effective Jan 2022, your DV plate will need the proper indication on it that will continue to grant the permission to park in this spot." Establishes if the plate is current to the new standards and also whether the person knew of the changes.

And if I’m not mistaken they are acting trying to fight the law in Texas cause it’s erroronous
If you wait for most cops to "just figure things out" you will be there all day.
I think it's interesting that Texas refers to these Cops as "Peace Officers". Now you gotta ask yourself. Does any of them remotely seem peaceful in any way?
It isn't Texas that calls Cops "Peace Officers". It is the most common term. A Cop is generally employed by a city Department, a Deputy by a county Department, and an Agent by a State or Federal Agency. All are Peace Officers. Cop is a specific term, Peace Officer a general one. The Colorado equivalent for the Texas organization they were talking about is Colorado POST which stands for Peace Officer Standards and Training. Most states have something similar.
I mean peace officers definitely can be turned into a term for evil people
But realistically there is no such thing as someone that keeps the peace without using a threat or action of violence to keep it. You can’t just walk up to gang members and ask politely to stop or ask a theif to kindly return what was stolen. With no threat of violence there’s no peace

That Mr. McQueen protests he's been allowed to so park for years, suggests he is ignorant of the change to the law and his plates are *not* compliant.
Also, we very much are dealing with "what ifs". The entire encounter hinges on two elements on which we have no information; are Mr. McQueen's plates compliant, and; has his peace officer commission expired.

What's right and what will generate the best outcome for you are often very different when it comes to police interactions.
