I remember watching your first video. So glad to see your channel has blown up! Keep up the phenomenal work. In such a short time, you are certainly a leader in our community.
No he should of been charged for false imprisonment and given a ticket.
I could see him using his discretion for just being blocked in - no one's hurt and the guy is educated. But the man's other actions going to her truck door etc went beyond that and an arrest was warranted.

No the officer did the right thing no harm no foul no reason to mess up either persons life’s. It’s a simple meaningless interaction he shouldn’t of done what he did and the lady just needs to forget it and realize the customer is always right and just make sure to drive slow even if she wasn’t speeding and move on.
As a delivery driver myself who has seen and had this type of situation happen multiple times I think we should also note that the residents version of "speeding" might be completely unreasonable. I once had a guy claim I took off from his house and "had to have hit 60mph before reaching the next house." Well, little did he know, our scanners actually track location, speed and rapid acceleration/deceleration events at all time, When my supervisor looked into the claim it showed that I stopped at his box, accelerated at a normal pace from 0 to 30 in a 45 mph zone before stopping at the next mailbox. Some people just get upset if you go any faster than 5mph. His attitude makes me think that's exactly what this.
Amazon lady probably drove 25-35 on what is clearly a long straight driveway with excellent sightlines. The horror....
I've done deliveries as well & i don't think i've had anyone try to block me in with the intent of trying to prevent me from leaving.
That being said, i drive clunkers & some people seem to know that a clunker driver isn't going to give a shit it they get a new dent on the clunker nudging your overpriced car out of the f-kin way, nor will they give a shit about your newly imperfected paint job.
As an OTR semi driver long ago, i had some idiot try to walk out in front of me in hopes of getting me to stop. (Not sure if he wanted to steal the truck, it's cargo, or just try to force me to be his taxi-cab but i wasn't about to find out by asking him) I consider the man very lucky that he didn't end up a pancake.
I was a teenager with loud muscle cars. I won’t lie and say I always obeyed the speed limit but I didn’t drive like a dick in neighborhoods. People seriously misjudge their abilities to accurately measure speed by sight (and more often mistake loud for fast) and they definitely aren’t willing to listen when they think they are in the right.
Used to do deliveries. In one particular private business driveway, the posted speed limit was 10, my speedometer was reading 0 and some of the staff standing around the driveway yelled at me "WOAAH SLOW DOWN BRO!!"
25- 35 mph would be way too fast on a driveway, especially a gravel driveway, no matter the visibility.
@Dol l As literally a professional driveway driver with zero accidents, not even so much as a close call (And yes, I'm in a rural area so gravel is a significantly more common than not) I completely disagree with you.
To say there is no situation where 25-35 would be appropriate is completely unfounded and absurd. Every driveway and the appropriate speed for that driveway are completely independent of one another.
If I didn't lose you and you're curious as to what is actually the most dangerous part of a delivery I'll tell you. It's the seconds directly after a delivery is made when we prepare to start moving again. Most on property accidents happen because of blind spots, not speed. Sadly people, pets, and children often lack the awareness to stay out of a big trucks blind spot and drivers do not always clear blind spots or "plan their exit" like they should.
It's kind of ironic isn't it? You're worried about speed when the most dangerous part is when I'm practically stopped. I'm substantially more likely to back over you at 2mph than I am to hit you at even 60mph.
The cop was about to say “what he’s doing is illegal”, then he caught himself cuz he realized he may have to do some work if he said that to her.
That or he actually thought she would press charges, and didn't want to testify that he actually advised her it was illegal

@@sheldondinkleberg6525 That fact alone, that she is a young woman being held captive by an older man can be enough cause for concern. Many situations leading with those details tend to not be very pleasant, usually the guy being aggressive thinking he can intimidate the woman and get his way in relative the situation.
Add in the info that it's an older white man whose is blocking in a younger black woman on his private property, on a mile long driveway far away from the public. Along with him aggressively trying to open the van door. That is even more cause for concern for her.
She doesn't know this guy, she doesn't know what he is capable of. She's alone in the middle of nowhere delivering for Amazon, a company who notoriously cares very little about their drivers' well being.
Whether you like it or not, race plays a part in a high tension encounter such as this, from her pov (point of view). You can be tired of hearing about it all day 24/7, 365 days a year.
They cop and a-hole property owner here may not have been thinking it. But being who she is in this world she was for damn sure. For good reason since the a-hole was so hostile initially.
"Amazon drivers keep speeding through my driveway, what can I do?? Hmmm... stop ordering Amazon? No. That's crazy talk. I'll illegally confine the driver. Yes, that's the best course of action, for sure."
How can you speed on a driveway? That car must have a record 0-60 mph & one h*** of a breaking system.
Or ... installing a secure drop-box for deliveries to be placed into so that drivers don't have such a distance to travel, which isn't going to be taken into account for the time/cost allotted to for that delivery.
Call cooperate and file a complaint.
I'm an Amazon driver and our speed is tracked along with like 5 other factors. I doubt she was speeding at a ridiculous rate. If you speed too many times you get fired
That's a fact lol, I hope Amazon banned him... did you see his long af dirt driveway? No driver should be forced to dive down a private dirt road going 5 mph, I'd be leaving his packages by his mailbox and just say F him, like they do me and my dirt road lol. criminal confinement isnt a legal term. What happened here was illegal detainment, also known as kidnapping.

I worked for Amazon as a driver. So many stories of drivers getting their trucks pulled over and stolen while on delivery. I would feel more than harassed, I would fear for my life.

There were plenty of ways to fix it even without speed bumps.
1) post speed limit signs
2) Call and complain to Amazon if broken (they have gps tracks)
3) cancel Amazon if keeps happening
4) put a dropbox by the public road and put a gate up.

The cop was chill as hell and didn't want to squander taxpayers dollars on two petty bureaucrat office types arguing over entitlement. His behaviour was exactly how it should be done, when two adults are acting like children - treat them like children. She shouldn't be speeding, and I have no doubt she was driving like an idiot given her attitude stank the entire time, he shouldn't be over reacting to her speeding. They acted like children about it and the cop wasn't interested in hand holding. THAT is what I want a public servant to do. No wasting taxpayers money on tens of thousands of dollars of lawsuits on garbage. I get it, you're American, you guys love court room drama; the rest of the world surprisingly WANTS TO GO ON WITH THEIR DAY.

Just because the police told the young lady he wasnt angry with her... I sure felt like he was by not listening to her and taken her seriously. That situation was very dangerous due to her being blocked in and open her door. What if a person did that to him as an officer? They would have gotten shot....

To be fair, he tried to convey that exact sentiment to the land owner. It wasn't that he wasn't taking the lady seriously. He even said "hopefully she doesn't press charges." I think he just didn't want to see someone go to jail over a stupid decision. Just trying to push the situation back into the non-problem it should have been to begin with.

Cop stated she was speeding. She was not "speeding" as there is no regulation. She was simply driving faster than the property owner was happy with.

The cop was talking advantage of her ignorance, and he even wanted to stop anybody else from giving her advice on the matter.

@@davecarsley8773 I've never heard of this case, but assuming it has to do with a delivery driver being killed, in which case, it would give delivery drivers more reason to be cautious and possibly fear for their lives when encountering customers, especially one willing to illegally detain them.

I already feel that the modern ability
to get virtually anything delivered to my doorstep is a big luxury. And then to harass and antagonize the delivery driver on top of it - the sense of entitlement is incredible.
Ms. Murphy's actions should be a case study in how delivery drivers should handle situations like these. She remained professional throughout the entire ordeal.
I believe she should would have been in her rights to shoot it dead for this.

Nah, I think he was just fed up with the pettiness and aware of what a crappy job Amazon employees typically have and especially how bad it is also for other customers to hold up a delivery driver like that, and he also didn't want to escalate this to a point where he would actually have to arrest the guy even though he was probably 'just' ignorant and to some degree rightfully upset. The cop indicated a desire to calm shit down, and while admirable, that also went against the humble concept of serving the law and People. He can advise her about options, but if she chooses to pursue a particular path, then he has to act based on that. He is free to use a reconciliatory/apologetic tone while arresting the guy.
Although what I am wondering about is whether the arrest would have made any difference, since the guy wasn't an immediate danger anymore and got advised that what he did was criminal. She/Amazon could have pursued this towards the police later, without needing a lawyer. You can make a report to police. Both parties have the option.
They have his name and can investigate this after he files the report they can arrest him later.
I am of the opinion that the officer didn't want to do the paperwork & felt that the entire situation was petty & a waste of Police time that could be spent going after harder crimes. The officer had already came to the conclusion that the property owner was an idiot & therefore had no clue that he was in the wrong by blocking somebody in his driveway. While i can see the officers point of view, he was being too lenient on the Karen property owner when the woman said that she "wanted to press charges"

most people are children... we have arrested development built into our culture. It's the lack of education, and turning people into 'employee' or 'management' mindsets immediately after schooling is done. both are juvenile mindsets.

He reached a plea deal and got a misdemeanor for disorderly conduct. All other criminal charges were dismissed by the court. 178 days out of the 180 day jail sentence were suspended. Supposedly the defendant was thrilled because justice had been served.
@dzivri Great to get updates. 2/180 days in jail is the royal treatment for the rich, as usual, again a few 100s$ is peanuts for the wealthy, serious offences should require fines proportional to wealth! What about de officer's selective discretion? and will the amazon woman ( pun intended) unload a civil sum from Mr miller? Here, officers' qualified immunity stands strong? But the city/PD will have to pay for sure!

That’s policing today. My wife’s car was stolen, found and the PD refused to process the car for evidence saying, “it won’t do any good. Y’all have been in the car too. It’s pointless.” Ultimately, after an hour of my being disorderly in the PD, I got my fingerprint job. Six weeks later, the thief was caught on the other side of the State and tied to the theft. Lazy bastards.

the judge himself cant decide until now if there was a crime committed weeks after the incident so how can you expect a measly cop to decide on it minutes after the incident. if it is decided by the court that he wrongfully arrested the homeowner he and the department could face thousands of dollars in damages. if the court decides he should have arrested the guy which he didnt i dont think he or his department will pay the lady driver much for any damages they may have caused the lady driver for not arresting the homeowner.
@@boyscout-p3u Not really. If there is evidence of a crime and they arrest him for it, it is EXTREMELY unlikely it would be wrongful arrest.
By your logic, everyone who is ever arrested and found not guilty or the protectors don't believe there is enough evidence to prosecute for, would be able to sue the city for wrongful arrest.

What he can't do, in good faith anyway, is claim someone is speeding on his driveway when he has nothing posted stating what the limit is. It's also no guarantee that anyone is going to follow the limit. The police also can't enforce it unless he has an agreement with them.

No one knows if she was actually speeding. One time in my own residential neighborhood I was casually driving down towards the park at about 26mph and a man yelled something at me. I say “I wasn’t speeding at all-Look I stopped right here-I couldn’t have been speeding. He screams “Everyone speeds here! There are kids!” I say “where? There's a paraplegic guy that lives around here (I mention that because he has a lot of time on his hands, doesn't work), he lives right on a bend in the road. About every 5 years of so someone drunk or tired wrecks into his property (typically an evening event), now in the daylight he sits in his wheelchair at the end of the properly waving/yelling at people to slow down. Brother, I'm going the speed limit, stop waving at me, if you weren't handicapped I'd give you the finger - also, aren't you sitting EXACTLY where the accidents always occur and you're unable to run away?
My car used to have a hole in the muffler and i had so many angry boomers yelling at me to slow down while already going under the limit, because of course loud = fast.

I’ve been checking on Miller since Lackluster posted this video originally and boy, he gets in trouble a lot for issues with his perceived authority, not just relating to his property. He pretty much built his house and built a road in such a way so he could purposely harass people for tresspassing. Guy has a ton of issues (outside of his reckless gambling)

The solution is to put a mail drop off container at the entrance of private property. Doing so will keep other drivers off private drive. It is cheaper than all the legal fees.
As a driver we also would rather drop packages off at the enterance of your land instead of driving in. Saves us a ton of time as well as the headache of finding a way to safely turn around and such.
Cop stated if an accident happens on PRIVATE property they will handle it. Is not what I have been told by local police. I was told they have no jurisdiction, exchange info and be on your way !!! it was in the parking lot of a shopping mall !!

We don't even know that she WAS "speeding". What's his "speed limit" on his driveway? Did he have his radar gun out? I seriously doubt she was flying down the driveway - for one thing I'm sure he would have used stronger words than merely "speeding". For another, it's a half mile. Accounting for amount of distance they'd need for braking so they could stop at the end of the driveway before pulling out into traffic, what speed are all of these Amazon vans really able to get to?

I did a little research on that guy, and it turns out he's been arrested more than once for DWI, and even had his bond revoked on this case and had to wait for trial in jail for over a month because he got arrested for drunk driving again while on bond.
He's "worried" about his safety when people drive a bit fast on an empty driveway yet he drives in public roads while intoxicated!

This is the way cops are in my state, I've had someone so drunk they couldn't walk leave my house in a car, I knew where he was going and everything. The cops refused to do anything. They also don't like to charge domestic assault in my state even because they didn't actively see it happen supposedly they can't charge you with it

They got in a big fight and then the black guy said he had a gun and the white guy got off him and went outside and we locked the doors. We made sure the black guy was okay and then the white guy came back to the door with blood on his face asking for but some cigarettes.
When the police arrived I told them that the white guy that started the fight was 1 block down as I could see him, they asked if I was the one assaulted and I said no so they yelled at me to shut up and go back inside. They then had the black guy walk to them with his hands up cause he had the gun and started asking him questions. A second car showed up and I told them the guy that was obviously on drugs was just a block down and I could see him talking to a lady with a 3-5 year old kid and was worried what he would do since he fought this guy for no reason out of nowhere. The officer than told me “it’s fine, we are just going to let him go”. So like they didn’t even go talk to the white guy at all about him assaulting random people.
I just thought to myself right there how this would be different if the races had been swapped.

It's pretty scary being accused of Criminal confinement when you know you're innocent. While Working overnight in a grocery store cleaning the floors(i was employed at a cleaning company, not the store). I would show up right as they left at 9pm. They would lock me inside wirh the alarm set until their night crew came in(9pm-10:30pm). One night somehow a teenage girl didnt clock out and leave quick enough, causing her to get locked inside. Im a guy probably 30 at the time. Im sweeping the store, thinking im alone as usual. She finds me, explains her situation. I explain im technically not even employed by the store and that we are locked in. I recently had gotten yelled at for setting off the alarm. Told her if she opened the door the alarm would go off and if she decided to do that please wait for the cops as i wanted nothing to do with it. She must have called her home freaking out blaming me. I went back to work While I thought she just decided to wait the hour by the front door. Next thing I know she's stopping me Saying that a cop at the front door wants to speak to me. Annoyed but I follow her to the front door. Through the locked door I explained to the cop about the alarm, that i can open the door but its gonna go off etc. Suddenly hes screaming at me that he dont care, to unlock the door, threatening me with kidnapping, confinement etc. No hesitation from my part. I dont even remember the conversation besides telling the truth and being threatened. Nothing ever came of it, It just turned into a joke whenever I had to tell the story. But deep down I still resent that cop and it just furthered my distrust.

Cop fails to make an arrest for an obvious crime? That’s an F to me. It would be one thing if was in the name of officer discretion, but it clearly wasn’t. He just didn’t want to be bothered with the inconvenience of dealing with a situation that he personally viewed as ridiculous. It was ridiculous, but he shouldn’t have been so dismissive.
Not sure about US law, do cops legally need to arrest anyone that commits a crime?
In Europe, they will only arrest you if you are a danger to the public or a flight risk. And then just send you a letter to appear in court(Subpoena is the right word maybe? Not sure what that would be called) a couple weeks later.

Tough one. Feels like cops should be able to make judgement calls and not waste resources, and should be able to refuse to arrest someone just because another has legal justification to demand it. This situation boiled down to a two egos going at each other, which is now going to waste public court resources. My opinion is the cop made the right judgement calls, if but 'unprofessionally scolding' and 'angry' the entire time.

There was no threat here. If you want to be fair, the man was obviously a fool, but was feeling burned due to the speeding. The woman, perhaps sped a little bit, but it was not reckless and she certainly should not have been treated the way she was. So now she was feeling burned. This is now a battle of egos.
An ideal outcome would have been, if the male has apologised to the female, and the the female saying she'd be more considerate in the future. No court time wasted, and neither the two of them needing to waste more time on this. right?

He should have told the driver that chargers could be pressed in the same way, the officer mentioned to the property owner that Amazon would be interested in a report. The absolute talking to the officer gave to the citizen was lovely and parent which I feel is an appropriate tone for officers to have for all encounters. I just don't understand why the officer didn't use that tone for the young driver who was held against their will.

Amazon should just leave the deliveries at the property entrance, photographing the packages as evidence of delivery, and leave. No need to use his driveway, because the driver could get into a wreck with the property owner's speed enforcement patrol.

In some cases, I have a general problem with coming back after a few days, weeks or months and telling somebody who wasn't initially charged, "Never mind what we said earlier, we ARE charging you." It's not "Double Jeopardy", that is the protection against retrial following a jury's acquittal or a judge's dismissal, but it's a lot to ask of the defendant and their family after it seems to be water under the bridge to come back after all.
I left town because I decided a police dep't and DA waited until my definition of "too late" to charge me for "Threatening a City Employee". A bus driver repeatedly failed to respond to my question about whether a route detour affected my stop. Not speaking when spoken to is a No-No; you don't cry to the police because your discourtesy backfires. The Transit Authority appologized to ME for HER and that was supposed to be the end of it, so when the city came back after a month and charged me, I packed up and moved on.

That's fair. I had 130 stops yesterday and did a 12 hour day and barely got finished in the allowed timeline with no breaks and no wasted time. Some routes though I can be done in 9 hours, but they tell us all the routes are supposed to be the same timeline. It's a fun job but that aspect is frustrating as hell
I work at a place that doesn't get this. We get local deliveries on top of regular semi traffic. The locals can not take forever to do this. They need in and out quickly.

LOWELL - A Lowell man accused of confining an Amazon delivery driver in his driveway has been sentenced after entering a plea agreement.
Keith A. Miller, 49, of Lowell, was initially charged with criminal confinement where a vehicle is used, one count of basic criminal confinement and one count of intimidation, according to Lake Superior Court records.
Miller entered a plea agreement filed Jan. 13, in which he pleaded guilty to disorderly conduct where the defendant engages in fighting or tumultuous conduct, a misdemeanor, court documents state.
Miller is a classic, he obviously has anger issues and can barely contain himself even when the police are there. It's obvious that it's the cops size that is intimidating him or he'd continue to be out of control. He's stewing in his house over anger issues and obsessed with confronting delivery drivers and watches them constantly. Millar doesn't express his rage to them because the other delivery drivers size presents a physical threat to him. This indicates that he's done this before, but he's had his ass beat for doing it. He waits until a small woman, who's size presents no physical threat to him, arrives and then goes ballistic on her. Miller's admitted ruminating and obsessive behaviour combined with with his aggressive outbursts indicate that this is an ongoing problem and will continue to be a problem in the future. Cops need to recognise this behavioural profile and arrest these type of people because they are a threat to the public and specifically to this young driver.

The bit where he responds to the officer with "on *my* property" kind of tells it all. He thinks that he can do whatever the hell he wants on his property. The girl was right to call the cops. Who the fuck knows what the guy would've done. You can't just imprison someone on your property because you think they did something wrong on your property lol.
Also, that cop was extremely unprofessional IMO. Clearly didn't want to do his job and deescalate. Remaining as dispassionate as reasonably possible is incredibly important, and this officer absolutely failed to do that.

If the woman was instead someone more upset by the whole ordeal, she likely would have gotten even more upset by this. I don't think the officer did a horrible job by any means, but the way he dealt with who he obviously believed to be a victim here was not good. The way he handled the guy, on the other hand, was!
The officer just was upset about responding to a dude being an idiot and didn't want to do extra work for an easily solvable situation. As a person I understand it but as a police officer he has a duty to take action once she said she wanted to press charges and the officer even knew the man in the truck was unlawfully blocking the deliver driver.

I really think the officer was hoping it would all just go away and they would behave themselves in the future. Obviously he didn't want to hassle doing his own job, I understand to a point that he wanted it to go away he definitely got to the point where he was being neglectful of his actual job. Bummer she had to hire a lawyer, I hope justice is served someday.

Yes when 2 children can't just move on with their life since nothing of substance happened I would act the same way. Put on your big boy pants and move on with your life. The same way if a cop started pulling people over for going 2 miles over the speed limit we would ALL recognize how pointless this is even if it is TECHNICALLY "against the law" this was a waste of taxpayer money.
I don't understand why she had to hire a lawyer, though. If she has evidence of what happened, she can just file a criminal complaint later. Since the property owner was no immediate threat anymore and got educated about the criminal nature of what he did, I don't see an absolute need to arrest him right there if it doesn't make a difference to the bureaucracy. If he had gotten arrested, how would that have changed anything?
Maybe the lack of an arrest was weakening her stance?

If I was Amazon I would not deliver to this address ever again. The nice gentleman can shop elsewhere.
When police investigate themselves, they rarely find any wrongdoing & considering the consequences of admitting any wrongdoing (with respect to opening themselves up for lawsuits), it’s in their best interest to not find any wrongdoing.
Please provide your data that helped you reach this conclusion. I would gather that they would be more harsh on each other.

The CT post looked into 1800 sample cases of police internal investigations. Only 1% of officers were charged or fired. And a large percentage of these cases featured officers who were repeat offenders.
Statistics are hard to find, because many departments refuse to disclose any information about open or closed cases.
Qualified immunity shields many officers from being held accountable even when officers break the law. And they will often just switch departments when they are on the precipice of being fired. More accountability is desperately needed to protect citizens and good police officers.

This happened to me too; 4 men assaulted me, my wife and my car because they felt I had 'parked' in an handicapped spot near an office when in reality, I merely stopped the car for 10 seconds to step out and deliver some post to the office main desk.
No police got involved, and months later I learned that the office apparently contacted my supervisor to ask why I refused to deliver mail the next weeks. No apology AT ALL

You "stopped" and exited the vehicle, you parked dude. You don't have handicap plates, don't do it.
