The lawsuit covered the officer’s actions in the stop and retaliation in response to him exercising his 1st Amendment right to redress he grievances with the police department. The 2nd lawsuit punished the city because the deletion of comments once again violated 2 elements of the 1st amendment in his freedom of speech and redress grievances to the government. Unfortunately because in most cases cops are not personally punished, they probably didn’t change their ways

My point was that even in an age with cameras everywhere and FOIA requests making public information readily available not just to individuals but the public at large, police still; by and large, haven't figured out they need to adjust their behavior and attitudes to account for the reality that what one officer does affects policing as a whole. It affects our perception of their role in society, their tendency towards control and domination of citizens rather than service toward them, and ultimately our perception of whether or not police with weapons and legal immunity from civil (and usually criminal) prosecution can be trusted. This video is a perfect example of what the public perceives as modern policing and despises what they see as abusive and dnagerous. And to your point about things being better these days, maybe? But neither you or I have any real statistical evidence to measure that "better." But anecdotally, I disagree with it almost entirely. The reason is with the intense scrutiny and video evidence of bad police interactions the public has access to there is absolutely no doubt that even when a "bad" officer goes rogue the supposed good officers 99% of the time fail to intervene in any meaningful way. And certainly not in the way the public would expect them to intervene considering their role in society and servant protectors.. Which speaks volumes about policing as a whole and leads those of us who watch closely to suspect that a significantly higher number of incidents of abuses of civil liberties and of officer abuse of power is occurring but goes unreported. Why? I'm sure there is a host of reasons and some more valid than others. But at the base of it all, those "good" cops who would never do what we see the "bad" cops do, but they do and say nothing at all about it at the time and rarely after the incident. They are cowardly scum without a backbone to uphold their own moral code, and to demand it of those they serve with. That's bottom level analysis of the "good" cops. Unfortunately, the detainee in this video began to apologize. Do not ever apologize to police officers; this implies guilt. I can totally understand why he apologized. He probably wanted to de-escalate the situation as much as possible because this cop was CLEARLY abusing his power from the jump. Secondly, do not let the cop make conversation with you. Once this cop tried to finally de-escalate the situation, realizing he most likely overstepped, the detainee shouldn’t have engaged in the conversation at all. None of this “Oh I understand, sir,” bullshit. Do NOT give the cops an out to cover their asses. There is a way to do this properly while remaining calm, but be assertive in your rights. The detainee should’ve kept quiet until the officer started talking. Once the officer started talking, I’d advise him to engage as little as humanly possible with the cop’s conversation. The main thing he needs to do is find out WHY he was pulled over. Once he figured that out, so long as he was not committing a crime, he should’ve began immediately asserting his rights. I hope this helps whoever sees this. You do have rights, and even if a cop does violate those rights, you can always take it to court.

This officer worked at three police departments in the last 8 months prior to this incident. He was only an officer at walnut ridge for 11 days before roughing up this railroad worker. Yes, but paid out immediately by the state and then the assets of the bad individuals are seized to reclaim the money and/or their wages garnished (with interest) until it’s all paid back. He gave him a rail road ID badge, a drivers licence, he even showed him a credit card with his name on it, the officer wasn't interested in any of it, he wanted a confrontation.

For anyone wanting to know what happened to Officer Mercado and Chief Kirksey. Both are no longer employed with the Walnut Ridge police department. Mercado resigned a couple of months after the incident and Kirksey retired after the federal lawsuit was filed. Both saw the writing on the wall.

This cop acts like he was bullied on the playground, and this was his chance to pay it forward. The dude was really compliant and nice and this officer had no reason to behave this way.

There have been studies where cops were anonymously asked if they had behaved violently towards their spouse and about 40% of them answered that they did.

No different then when you open the front door because the police "just want to talk" and then they put a foot into the door way so that you can't close it. Suddenly trying to close your door turns into assault on a police officer and you have 12 cops in your house. It doesn't end there, either! You can sue the city and WIN, but that police station will seek to make your life a living hell until you move so far away that they can't reach you anymore. There's been cases of cops STALKING citizens who sued the city. It's terrifying. Even when you win, you lose.

When I was 16 I was pulled over for speeding and taken out of my car by the trooper placed in the back seat of his car and finger printed after showing him my proof of insurance and my id I was a poor kid and couldn't get get nobody to listen and nutting was done about it some police have no accountability what soever

As a person from Arkansas, I can say this, not all police departments in the state are corrupt, but there are more in Arkansas than there should be, including this one.
I hope Finley does not suffer from the fact he won his court case and the settlement. If a chief and his minions are willing to fabricate charges to cover up for the misconduct of an officer, I see them making retalliatory traffic stops when Finley is driving his personal car.

Cop lost it all when he said "I'll pull you over if I want to". That calls into question any reason he gives for stopping someone. Everything after that should be unlawful. Charging and arresting him after fact was retaliatory for filing a complaint.
I have to disagree. First because nobody is perfect and everybody makes mistakes. If a cop gets personally sued for a legitimate mistake and has to pay out of his own pocket, nobody would ever want to be a cop. No organization works like that and employees are sheltered from their mistakes. If it is no mistake but obvious malicious intent in behavior, then the officer can lose his qualified immunity - so what you are requesting is already there. In this video, maybe the officer would have lost his qualified immunity - but to know that you need to go to court, and not settle.
I disagree. As a 19 year old I have never seen another kid act like this. From elementary-high school. It has always been people age 30+ who act like this in public.

Yeah he literally threatened to tase the man and throw him in jail for no reason. The biggest part of the problem is shown when they try to make a complaint. The other officers, even after seeing the video, still willingly defend the toddler cop and harass this citizen with more citations and threats. It's almost as if the powers that be want to provoke us into shooting cops or doing something really bad to a police department. It's almost as if the system was set up to create never-ending conflict between citizens and cops.
That is absolutely insane. This "officer" is a dangerous loose warhead. Unstable, and completely lacking the objectivity and temperament necessary to meet the high standards to be demanded of a peace officer. What is even more frightening is the Chief's attempt at defending this loose warhead, the retaliation, and the attempt at sweeping it all under the rug. Does Walnut Ridge not bother to screen their peace officer candidates and perform proper psychevals?
Take one more look and the answer will reveal itself....at: 3:01.....officer states he works alone and lives in fear. This situation causes the "insane" and "aggressive" attitude. We can't keep judging police officers as long as they continue to be put in these types of situations. We need to get back to two officers per cruiser. This will happen when citizens accept that police officers are human and that humans can't be trusted. When we accept the potential evil in each of us, then derive our procedures accordingly, we will be much better off.
The takeaway is that, he is a rookie officer. They instill vigilance in them at the academy but oftentimes results in fearful hypervigilance in the typical inexperienced rookie. And the chief probably defended him to such a degree out of desperation for officer retention due to being understaffed as most police departments are in this day and age. Not justifying this shit behavior, but I can see the major factors at play here.

My thought is that the psych evals are more to SEEK OUT these types. I know a person who was wanting a job with PD dispatch and failed the psych evals despite being, for all intents and purposes, a normal person.
As far as we know, the chief could have been bluffing as intimidation. Kinda like when you buy a car and the salesman says they need to talk to the boss when we know they are just standing in the break room
My issue here is the Chief. How could the town council or mayor see this video and not remove the chief, and if possible, the prosecutor. It blows me away how government is not responsive to the people who they serve.

The problem of police investigating themselves is on display here. They go into every investigation of their own with a prejudiced view of the public and the belief that as police they are in charge and they are never wrong. Any settlement from a lawsuit that I would accept would require the firing and removal of every officer involved as well as the cash payout.

Yes, the cop's behavior is so over-the-top bad in that one is almost led to believe that this has got to be a con job against the city, with the cop and the victim splitting the $57,500 50/50.
And when they raised the complaint, the chief of police tried to tell them that he deserved to be arrested for obstruction. And when they asked to see the video, he told them they'd need to file a FOIA request. That chief is a total scumbag, and needs to lose his job ASAP. And the chief also claimed the prosecutor had seen the video and advised him to cite them for obstruction. If that is true (I suspect it isn't), then the prosecutor needs to lose his job and be disbarred. No lawyer seeing that tape should EVER think the cop was in the right, or that there was obstruction on the part of the citizen.

This was only his 11th day as an officer in Walnut Ridge!!!! This is the PERFECT example that even if they don't have a deep bond with their other officers (like friends for years), they protect their own WITHOUT QUESTION. In 11 days there is no way he created a bond with the police chief. The police chief was trying to cover his own butt and department. RIDICULOUS!!!! qualified immunity was crafted "out of thin air" by SCOTUS in 1982. the short version is, it prevents officers from being personally sued. one by one, states are seeing how ridiculous QI actually is and are abolishing it.
Qualified immunity has its place. Without it officers can get sued because someone didn’t like being arrested. It also protects officers from honest mistakes. i feel like it should be more narrowly worded so that in instances like this were there is obvious officer misconduct, the officer himself will be held accountable.
It is absolutely mind blowing that you not only have a cop behaving that way but when the citizen goes to complain, they double down and punish him with a citation. That cop isn’t an exception, he’s the norm in that department.
Or the opposite. This video does not delve into the local publicity the incident might have received, but it could very likely have opened many eyes and the department and chief could now be under the microscope whereby further retaliation could lead to cops catching criminal charges.

The lawsuit covered the officer’s actions in the stop and retaliation in response to him exercising his 1st Amendment right to redress he grievances with the police department. The 2nd lawsuit punished the city because the deletion of comments once again violated 2 elements of the 1st amendment in his freedom of speech and redress grievances to the government. My point was that even in an age with cameras everywhere and FOIA requests making public information readily available not just to individuals but the public at large, police still; by and large, haven't figured out they need to adjust their behavior and attitudes to account for the reality that what one officer does affects policing as a whole. It affects our perception of their role in society, their tendency towards control and domination of citizens rather than service toward them, and ultimately our perception of whether or not police with weapons and legal immunity from civil (and usually criminal) prosecution can be trusted.
This video is a perfect example of what the public perceives as modern policing and despises what they see as abusive and dnagerous.
And to your point about things being better these days, maybe? But neither you or I have any real statistical evidence to measure that "better." But anecdotally, I disagree with it almost entirely.
The reason is with the intense scrutiny and video evidence of bad police interactions the public has access to there is absolutely no doubt that even when a "bad" officer goes rogue the supposed good officers 99% of the time fail to intervene in any meaningful way. And certainly not in the way the public would expect them to intervene considering their role in society and servant protectors.. Which speaks volumes about policing as a whole and leads those of us who watch closely to suspect that a significantly higher number of incidents of abuses of civil liberties and of officer abuse of power is occurring but goes unreported.
Why? I'm sure there is a host of reasons and some more valid than others. But at the base of it all, those "good" cops who would never do what we see the "bad" cops do, but they do and say nothing at all about it at the time and rarely after the incident. They are cowardly scum without a backbone to uphold their own moral code, and to demand it of those they serve with. That's bottom level analysis of the "good" cops. They are cowards for not doing something about it. And NO coward is good in those circumstances. Ever! Unfortunately, the detainee in this video began to apologize. Do not ever apologize to police officers; this implies guilt. I can totally understand why he apologized. He probably wanted to de-escalate the situation as much as possible because this cop was CLEARLY abusing his power from the jump. Secondly, do not let the cop make conversation with you. Once this cop tried to finally de-escalate the situation, realizing he most likely overstepped, the detainee shouldn’t have engaged in the conversation at all. None of this “Oh I understand, sir,” bullshit. Do NOT give the cops an out to cover their asses. There is a way to do this properly while remaining calm, but be assertive in your rights. The detainee should’ve kept quiet until the officer started talking. Once the officer started talking, I’d advise him to engage as little as humanly possible with the cop’s conversation. The main thing he needs to do is find out WHY he was pulled over. Once he figured that out, so long as he was not committing a crime, he should’ve began immediately asserting his rights. I hope this helps whoever sees this. You do have rights, and even if a cop does violate those rights, you can always take it to court.

For anyone wanting to know what happened to Officer Mercado and Chief Kirksey. Both are no longer employed with the Walnut Ridge police department. Mercado resigned a couple of months after the incident and Kirksey retired after the federal lawsuit was filed. Both saw the writing on the wall.

If I remember correctly he has been in trouble with the law earlier in his life and I guess she thought he was going to revert back to that because of what these piece of shit cops told her.

This is one of the most unbelievable encounters Ive ever seen and certainly puts this city on the map.

No different then when you open the front door because the police "just want to talk" and then they put a foot into the door way so that you can't close it. Suddenly trying to close your door turns into assault on a police officer and you have 12 cops in your house.
It doesn't end there, either! You can sue the city and WIN, but that police station will seek to make your life a living hell until you move so far away that they can't reach you anymore. There's been cases of cops STALKING citizens who sued the city. It's terrifying. Even when you win, you lose.

I have to disagree. First because nobody is perfect and everybody makes mistakes. If a cop gets personally sued for a legitimate mistake and has to pay out of his own pocket, nobody would ever want to be a cop. No organization works like that and employees are sheltered from their mistakes. If it is no mistake but obvious malicious intent in behavior, then the officer can lose his qualified immunity - so what you are requesting is already there. In this video, maybe the officer would have lost his qualified immunity - but to know that you need to go to court, and not settle.

The other officers, even after seeing the video, still willingly defend the toddler cop and harass this citizen with more citations and threats. It's almost as if the powers that be want to provoke us into shooting cops or doing something really bad to a police department. It's almost as if the system was set up to create never-ending conflict between citizens and cops.
That is absolutely insane. This "officer" is a dangerous loose warhead. Unstable, and completely lacking the objectivity and temperament necessary to meet the high standards to be demanded of a peace officer. What is even more frightening is the Chief's attempt at defending this loose warhead, the retaliation, and the attempt at sweeping it all under the rug. Does Walnut Ridge not bother to screen their peace officer candidates and perform proper psychevals?

This situation causes the "insane" and "aggressive" attitude.
We can't keep judging police officers as long as they continue to be put in these types of situations.
We need to get back to two officers per cruiser. This will happen when citizens accept that police officers are human and that humans can't be trusted. When we accept the potential evil in each of us, then derive our procedures accordingly, we will be much better off.
The takeaway is that, he is a rookie officer. They instill vigilance in them at the academy but oftentimes results in fearful hypervigilance in the typical inexperienced rookie. And the chief probably defended him to such a degree out of desperation for officer retention due to being understaffed as most police departments are in this day and age. Not justifying this shit behavior, but I can see the major factors at play here.

My thought is that the psych evals are more to SEEK OUT these types. I know a person who was wanting a job with PD dispatch and failed the psych evals despite being, for all intents and purposes, a normal person.

My issue here is the Chief. How could the town council or mayor see this video and not remove the chief, and if possible, the prosecutor. It blows me away how government is not responsive to the people who they serve.

The problem of police investigating themselves is on display here. They go into every investigation of their own with a prejudiced view of the public and the belief that as police they are in charge and they are never wrong. Any settlement from a lawsuit that I would accept would require the firing and removal of every officer involved as well as the cash payout.
That settlement is worthless if it didn’t include the officer and chief being charged and losing their cert.
I will say this again... Citizens are the enemy according to law enforcement. Guilty until proven innocent

Yes, the cop's behavior is so over-the-top bad in that one is almost led to believe that this has got to be a con job against the city, with the cop and the victim splitting the $57,500 50/50.
Imagine that, a cop worried about someone sitting in their vehicle and not doing any work. Cops do that all the time.

And when they raised the complaint, the chief of police tried to tell them that he deserved to be arrested for obstruction. And when they asked to see the video, he told them they'd need to file a FOIA request. That chief is a total scumbag, and needs to lose his job ASAP.
And the chief also claimed the prosecutor had seen the video and advised him to cite them for obstruction. If that is true (I suspect it isn't), then the prosecutor needs to lose his job and be disbarred. No lawyer seeing that tape should EVER think the cop was in the right, or that there was obstruction on the part of the citizen.

This was only his 11th day as an officer in Walnut Ridge!!!! This is the PERFECT example that even if they don't have a deep bond with their other officers (like friends for years), they protect their own WITHOUT QUESTION. In 11 days there is no way he created a bond with the police chief. The police chief was trying to cover his own butt and department. RIDICULOUS!!!! He should've stepped up and said "this was uncalled for and I apologize- he will no longer be an officer here anymore."

qualified immunity was crafted "out of thin air" by SCOTUS in 1982. the short version is, it prevents officers from being personally sued.

Qualified immunity has its place. Without it officers can get sued because someone didn’t like being arrested. It also protects officers from honest mistakes. i feel like it should be more narrowly worded so that in instances like this were there is obvious officer misconduct, the officer himself will be held accountable.
QI is necessary if you want to have police. Although if you are a leftist that wants to abolish the police, eliminating QI is the way to do that.

And people who aren't close to the guy will believe it (if not think it by themselves without coercion). Local news organizations aren't going to cover body cam footage of a cop being an asshole and the police Chief bringing retaliatory charges. It will be covered in a 60 second segment and will be forgotten in a week.

He deserves a larger settlement than what he got. This kind of trauma can live with a person long after the events transpired and send a ripple of fear throughout the community. The guy is superhuman for being so calm and rational!
