      I really like how this video is another example of law enforcement breaking the law. The EPA's Military Munitions Rule puts the responsibility of ordnance from cradle to grave in the hands of the military. Graduates of the FBI's Hazardous Device School aren't authorized or qualified to identify or render safe, military ordnance...

      A Pasco County Detective left his handgun behind in a Burger King, and it was picked up by a homeless man. I think I know who has it, but I decided taking this game wardens' advice is in my best interest. I'm probably better off just avoiding all of it.
      They turned off social media comments and you have to report all tips or complaints in person. You can still commend an officer on the website though. There is no way I'm walking in their department without a lawyer.

      Personally I'd like one of the standards to be evidence the citizen knew what they were doing was illegal before arrest or criminal charges allowed in most cases. As in you can't punish someone for breaking a rule they can't reasonably have known about.

      @@alastermyst Criminal intent is an element of the crime. If they go to court, the judge can take that into account and reduce (or waive) their fines.

      @@alastermyst The legal standard you're talking about is called mens rea, and it does exist in some cases, that the prosecution must prove that the defendant knowingly intended to take an action that is a criminal offense. However, and IANAL, for some reason it doesn't always apply.

      @@furtim1 one of my law professors in college said there were over 50,000 laws, statutes and regulations on the books. that number is a little over a decade old. one of the largest problems with trying to memorize the statutes is legislatures can amend them in any bill they pass, so laws as they are written today are not guaranteed to be permanently written that way.

    Judge Threw out the case and dismissed the citations - DNR Officer was in the wrong and the case was tossed citing - Illegal Citations by way of Out Of Jurisdiction

    As a vet and DoD civilian of over 30 years, never call law enforcement unless absolutely necessary. Even if you are trying to help, sh*t will be turned around on you somehow.

      Just don't call them -- 99% of the time, they'll either make the situation worst or you'll end up in the situation that you weren't originally a part of. I've never found resolution or even partial resolution to a problem by inviting the help of the police. They're a gang of thugs sanctioned by the city / county / state.
      You would probably have better results asking your local gang member for help than a cop. That's how backwards it is. I've had better interactions with thugs than I have cops.
      Don't call cops. Don't talk to cops. Avoid cops. Cops will only cause you more problems. Cops are statistically dumber than you. Cops are evil. Cops will end up shooting your pet dog or your neighbor's dog. Don't purposely call them. Never invite them into your home. Avoid them at all costs.
      Cops are bad. Stay far away.

      Happened to me in the UK too. The police will just look for a reason to write anyone a citation, no matter where you are or what you're doing; they don't serve the people, they serve themselves.

      If it's on a military owned stretch of land, the problem could be unexploded ordinance. You go magnet fishing and accidentally pull up a hand grenade that never detonated, but it decides to go off on you
      You also need special permits to be on those.

    That warden was SO happy to be giving them tickets and giving them the lecture, you could hear it in his voice. Also, why is the river being used as disposal for these kinds of items? that water travels off base property and its really concerning this is how they dispose of this kind of stuff.

    The lesson I took from this: don't ever contact authorities for any reason, no matter how good your intentions are, because it's pretty much guaranteed to end badly.
    As the guy said in the video, "we're getting punished for doing the right thing"

    The fact that that officer compared what these guys were doing to robbing a bank literally pisses me off. Being punished for doing a good deed is beyond reprehensible. He could have just told him what the laws and statutes are and given them a warning. There was absolutely zero reason for him to write tickets other than a power trip

    This is exactly why the general public reacts negatively to law enforcement. A simple warning could have sufficed but he was on his high horse and would not see it any other way. The next time they or anyone else will find something dangerous who has seen this video will think twice about contacting law enforcement

      @@chasekruse7047 Well that's the shitty thing about laws, is that they don't consider moral ethics all the time.
      And while I do not agree with the tickets, I do agree that it is dangerous to pull shit up that you don't know.
      Its just overall easier but at the same time its unknown how those things got there.
      But that's when the police come in to give judgement. Laws are a moral stand point of safety and fairness. Designed to punish poor negligence and those who do not abide.
      And its up to the officers when situations like these should be taken as informational warning that achieve the same goal. The purpose of fines and jail is that the punishment serves as a method to make people abide them.
      So if giving an informational warning achieves that same affect judging on intention and character and situation. What point does the fine give besides unnecessary back lash.
      And eventually there is going to be that guy to do it if you morally find it just because it's illegal. And the guy who might enforce those laws much more strictly will probably just eventually find them and enforce then. But a warning. All it takes. To save them the trouble even if it is morally right.
      Also if someonne was misinformed, or there is no clear sign of unwanted activity that should always be a warning. School doesn't teach us laws, and we are only human. Even if someone did misinform them perhaps it was through misunderstanding rather than their own lack of knowledge

      Exactly! And these police are able to use discretion and never do! Only for their friends and family! So corrupt and infuriates a lot of Americans! Myself included! I can't stand people who blindly praise police simply because if they didn't , the police would have no backing and no choice but to enforce the law appropriately and hiring officers who were not fit would seldom happen. I can't wait to leave the US because it's a fraud in almost everyway imaginable. I'm on my wife's yt account now and we hope to move to Spain but would also like to come back and possibly work and live while visiting family. I'm pointing out that I am on her account simply because I wouldn't put it past our government to hold this comment against her being able to become a citizen. They have already denied our claim because I'm too poor and my father apparently is too to become her sponsor... We married for love march 18 last year and now she can't go see her family. It's discrimination and I'm extremely fed up with seeing good people pay the price for bad people and immoral laws. I could be getting disability from debilitating anxiety, phobias, depression, but I still try to work because I was raised that way. But now I'm being punished. They also threw me in prison with no criminal record on hearsay and for basically being born in a poor disabled family... I pray daily for change and for strength from God because when you are truly trying your best and meet roadblock after roadblock, it's demoralizing and i believe that's what their game is. For anyone else struggling out there, stay strong, find God/or not, but never give up! You are worth it and you are loved!! don't know you personally, but I pray for everyone daily! ❤️

Like fishing UXO out of the river isn't warning enough? A warning would have been appropriate if they fished out 1 and said "maybe this is a bad idea and we should call someone" but they didn't; they continued to engage in the behavior despite a clear threat to their own safety and the public safety of those on the road.

    As a state trooper, this a*hole of a warden makes my blood boil. I can’t stand when officers go on power trips. We have discretion for this very reason.
    “Hey guys I appreciate you trying to clean the river, it’s a bit dangerous to do that considering the items you’re pulling out of the river. I’ll make sure to let the Army command know they need to get this cleaned up. Have a nice day gents.”

      @@encarn Soldiers coming out of the field for the weekend dont want to waste an hour on ammo turn in and waiting on the ammo count that needs to be done for the unit that is turning in. Soldiers when they go out to the field have ammo disseminated from the Designated ammo person in the unit. He is the one responsible for signatures and dispensing of ammo. Whatever ammo is not used, needs to be turned in. Thats when soldiers be like "oh shit, get rid of it" and gets tossed. I was stationed there for 6 years and I seen all kinds of ammo being tossed. I report it and they look at me like im stupid. Then you wonder why the army retention is at an all- time low now. I am glad I am retired. I couldn't put up with the bullshit ANY military installation puts out.

      I am a retired LEO and agree with you 100%. Back in the day I was guilty of buying the down and out a sandwich and coffee once in a while and even taking them home. I must have missed the lessons on bullying people. A ticket or an arrest isn't always the best solution.

    When I was a teenager I got pulled over and cited for doing 42 in a 35 zone even though I was only moments prior stopped at a traffic light and the car to my left arrived at the intersection as the light turned green. That vehicle was speeding. When I pointed it out the officer became aggressive and asked me if I wanted him to inspect my car for other issues. I took the ticket.
    Days later, while at work in our local movie theater, the cop we all knew (he provided mall security) brought in his fellow cop in to ensure we gave him our police officer discount for his upcoming date. We had a policy of free movie admission and refreshments for cops because of the security they provided. I promised our familiar officer I would not forget him because, as you have guessed, he was the cop who wrote me the ticket a few days prior.
    When he showed up with his date, I deftly asked the ticket seller to let me handle it. The cop shows me his badge and said he gets a free ticket. I told him, that would be inappropriate and charged him full price. He begrudgingly paid for his ticket and moved to concessions where I followed and “took care of him” again. He got so frustrated and eventually said, “Young man, don’t you remember me from the other night with Officer XX?” I leaned over the counter and said, “Sir, don’t you remember me from the 42 in a 35 ticket in front of the mall?” He slammed the money on the counter and stormed off.
    Few days later, our usual officer showed up and ask me why I didn’t take care of his comrade. I told him why. He shook his head, said something disparaging about the other officer and tried to get the ticket thrown out on my behalf. Hope that story brightens your day, it was nearly 40 years ago.

    Here's a couple of lessons from this: Don't expect praise from law enforcement for being a good citizen, they don't care. Find a gun or ammo or explosives that aren't in a public, populated area? Shut up and keep them or shut up and leave them alone. Don't call the cops. The first thing they're gonna do is be suspicious of you.

      Because it's in his job description. All recreational activities fall to the game wardens on military installations. If you are driving through publicly accessible roads on a military installation and you pull over to the side, they can ticket you.

    When I was in college in New Brunswick New Jersey, my apartment was burglarized and I called cops. They searched my apartment for drugs. Threw mattresses off of beds, dumped contents of all drawers on the floor. They were never called for subsequent break-ins.

    The game warden completely changed the dynamic of the situation. He knew before he even pulled up that he was about to ruin these guys day, he didn't evaluate anything on the ground before coming to a conclusion on what to do. Re-training is needed I think.

      This guy literally thought "why are these guys finding stuff on my river without asking me permission. And unlike the other cops who had zero attitude initially, they came up, talked to them first, before making any judgements. The warden made his mind up he was going to give them a citation no matter what as soon as he got the call.
      Those guys are the type that give cops a bad name. They just love ruining people's day, and exerting their power.
      Likely heard the word 'youtuber' and decided immediately he would throw the book at them. I mean, not just one citation, but three, three citations is beyond excessive. I might be more on the fence with the guy if he had issued some 15 dollar fine just to give them the hint not to do it again, but three citations, that is just pure rage citation-ing

Down here in Florida it’s a possibility of finding a bundle of cocaine or weed while out fishing off shore in south Florida. I know a few people who have found bundles and they called into the coast guard/ local law enforcement and they just come out and get it and thank you for calling them for it.

      Even though this is just a ticket, the video shows that the officers even acknowledge there was zero criminal intent behind their actions. Everything they did was with good intentions. They were attempting to cleanup the environment. They contacted who they thought were proper authorities for permission. They avoided areas marked “No Fishing”. THEY called law enforcement to the scene when they located what they believed to be hazardous items. The Game Warden was the only LEO there who was “out in left field” with his reactions. Hopefully, the Judge will see the totality of the circumstances (and this video) and rule in favor of these young men.

    Even if this officer is completely right, the fact that he says you shouldn’t call the police if you find drugs just shows the sorry state our police force is in. He’s right that if you report drugs to the police, you can be completely innocent and still be punished in some way. A good samaritan trying to prevent curious kids from overdosing should not be discouraged from helping

      Anyone who understands spoken English should be able to tell those aren't connected clauses; they're unique events being described.
      Also, this entire attitude by cops pisses me off. While there may be the occasional Florida Man who calls 911 because someone stole his crystal meth, no one who has a 10# bag of marijuana in their possession is going to call the police and report they just found a bag of marijuana. No one does that. To treat someone attempting to do the right thing as if they are somehow a criminal does nothing but encourages people to remain silent about criminal activity they've observed, and convinces them that cops are all power-hungry assholes who only want to arrest someone, regardless of whether or not the person being arrested could reasonably be connected to the crime at hand.     Situations like this frustrate me. Why not just give them a warning? Seems cops always ticket and fine you if possible. I have had three speeding tickets. I have never been given a warning. Besides those three tickets I have a spotless record. One of them I even got a diversion on when I went to court. But I know, if I get pulled over, I will be ticketed. Feels like they just want my money, not to serve and protect.

      It's called the "ticket quotum" thought. He is litterly saying: "I have to write a ticket for every crime then arrest you rather"
      Since tickets give the department money and if there is a quotum for how much ticket money each officer has to bring in... you get it.
      As the warden says: "I get called I have to write a ticket" ...Insted going: "HOW ARROGANT" You can also see it as: "The system forces me to do this, if I don't I lose my job."
      Just a theory fyi.. but it could be he is stuck by a ticket quotum or else he gets fired.

      More so. The fact there was no way for them to know the river was “closed”. By the game warden’s own words they couldn’t have known. But “ignorance of a law, is no excuse for breaking the law” however the Supreme Court has established that a law enforcement officer has no obligation to be right about a law they “reasonably” believe to be correct. Meaning you have to be trained to enforce the law for it to be permissible to not know the law.

      I hope you don't mind me discussing what I saw differently: I didn't interpret the "don't come to court arguing" comment in the same way. My understanding was that he was offering advice to not be argumentative, as in verbally combative. My experience is that courts holding hearings for infractions are often like flea markets--with defendants showing up merely to ask for discounts and judges looking at cursory facts (such as the fact that the defendant was cited for reporting a problem to be corrected) and offering reduced sentences just to avoid having to take the time of hearing arguments. If the game warden was trying to express the idea of showing up and being polite, maybe he had the citizen's well-being in mind. It's conceivable he gets a lot of calls for people doing stupid stuff on the fort's land, and perhaps he's taking criticism or not forgiven himself for being too permissive previously with the result that someone else got hurt. A lot of his communication was outright not helpful, but I never reached a point of concluding his motives were wrong...I couldn't make that diagnosis. It does seem most likely, though, he resented his own job duty of going out there and was punishing them for purely bad reasons.

    Something that always sticks in my head everytime I get a ticket or a law enforcement official is just dead set on giving me a ticket, is the thought that city's, counties, states and the federal government are not in the business of making money, but the business of collecting money. Hence why the DNR officer will always write a ticket, when he is called out.

However letting them carry on could mean they encountered unstable ammunition that could hurt them and anyone driving past at the time.

    This is just sad. Imagine having a hobby you love that helps your community and helps protect local ecosystems and then a Game Warden just scoffs at the idea and says you're lucky he doesn't arrest you for stealing army property. It's just pathetic that he had that mindset considering they willingly forfeited their findings. So many people would attempt to hold on to military items. These guys try their hardest to abide by all laws and regulations wherever they go. I can only hope the judge sees the absurdity of these charges.

    Complete disrespect and excessive action by this extremely hostile and egotistical warden. This could have easily been solved by granting a verbal/written warning, as they were unaware of the laws and regulations in that area, and were clearly not there to break any laws and cause problems. They called and treated the warden with respect. I understand they can go to court to fight the tickets but that shouldn’t have to be the solution here.

      Laws are meant to ensure social order and discourage unwanted activities - and these guys were doing good natured activities, and reported dangerous materials that should NEVER have been dumped in a river to begin with. To be punished for laws they weren't aware of is contrary to the premise of the laws. He's establishing that if something isn't right, you shouldn't get involved, and if you do something that you arent certain the legality of, dont ask the government if its okay - meaning continue breaking the law in intentional ignorance for fear of the consequences that come with trying to be transperant. I'll bet you that warden, if he has kids, they dont talk to him for the same reasons.

    Things have seemingly changed since I was an Army MP in the late 80's. We as Federal Law Enforcement Officers, (Yes, MP's are "Federal" law enforcement officers.) We would not have informed or summoned any civilian law enforcement to the scene, nor would we have allowed their intrusion into our investigation. We might allow them to stay as observers only and back up if needed. The MP's on the scene should have informed the Warden of his lack of jurisdiction and continued their investigation. If the Warden disagreed with them, they should have respectfully (yet sternly if necessary) directed the Warden to separate himself from the immediate site of the investigation and from contact with the civilians then called their Patrol Leader to the scene. They then would execute the orders of their commanding officer thereafter. (Trust me, the Warden would have been departing the scene in short order.) Until the Warden arrived, the MP's were handling the situation appropriately and as they were trained. Which is to say professionally and with the demeaner appropriate to the situation. This Warden is the embodiment of an attitude of overbearing, combative, and unwarranted authority that needlessly, and some times dangerously, escalates calm, non combative situations. (Basically "Everything" I was trained not to be.) He is a disgrace to the law enforcement profession and the reason so many people dislike and sometimes despise Police Officers. Basically this Warden is what we Army MP's at the time referred to as a "Jag Off, Shitbird or Dirt bag ". He could best serve the Law Enforcement profession, and the general public he was sworn to protect and serve by retiring.

      Yep, so this Warden cost the state money by issuing 9 tickets when a warning would suffice... but the person really at fault is whatever game office clerk gave these young men bad information about where they could/couldn't magnet fish. Why does the state map of the green zones include federal military base property if it really isn't part of the same jurisdiction?

      His job is to enforce laws. That means writing tickets. His job is not deciding who has a good or excusable reason for violating the law. That's what judges do.

      @@jasonlongton1876 Law Enforcement already has that capability, and it can be abused easily, but I would argue that the authority of discretion is in place ESPECIALLY for scenarios like this one, where there was good faith effort to remain within the law.
      Hopefully the judge will do the right, moral and just action, dismissing those tickets... and stripping that game warden of the authority he's been abusing. He can't be trusted to responsibly handle authority over others. Being humbled would be the best thing for him AND the community he SERVES.

    Lt. Hollmen - upon walking up to the scene and having heard no explanation - says: "The good news is that none of you are going to jail. The bad news is that you all are getting tickets."
    This is not a fair minded person. This is a man justifying his paycheck to his employers - and validating his own self-perceived importance to himself.
    It was within his discretion to give them a warning - but exercising power won out over better judgement. These are the kind of people who have no business wearing badges.
    He did a disservice to the state of Georgia.

      @@Grisbane The “treasure hunters” had absolutely no reason to suspect that they would find pounds of live ordinance in a river which is publicly accessible and bears none of the standardized warnings typically found at DoD ordinance dumping grounds. Their conduct was perfectly reasonable, the only reason their actions potentially justified the citation was because the river was technically under federal jurisdiction (again, despite any of the typical signage to that effect) and *not* because the river is a known ordinance dumping ground. Combine those facts with the decision of these people to immediately request assistance from the authorities in properly disposing what they did find, and there is an overwhelming amount of evidence to justify this warden exercising his discretion and giving these people a warning rather than a ticket. Your comment suggests negligence that goes well beyond what the circumstances justify

      @@Grisbane The judgment of the situation and the need for the tickets should have changed when they explained that they had called and been told about green and red zones and had passed by bridges that were marked. These were not cowboy going just anywhere doing whatever they wanted, but were trying to do it the right way. They knew something was very off because of what they found and called for help because they couldn't very well leave the munitions behind responsibly.
      This guy came in already decided that these were a bunch of delinquent punks and his attitude reflects that. He doesn't take into consideration that these guys had incomplete information about the green zones and tried to do their due diligence. Doesn't change anything about anything to him, he stays just as hostile even when these men explain they had maps of where it was supposedly alright for them to do this. That's not recklessness by any measure. That's getting bad/incomplete information from an authority they should have been able to trust. Huge difference, doesn't even register.

Besides they removed not 1, not 2 but 86 rockets, not to mention the other UXO BEFORE calling the authorities. The argument that they had "no reason to suspect" what they would find and their conduct was perfectly reasonable goes out the window as soon as the first UXO was pulled from the river and they decided to continue their activities.
      They created a public safety hazard and were rightly fined for it... Also the original source video shows them absolutely giddy with excitement over their "finds" and overall poor, negligent handling of UXO.

    Sometimes, in cases like this, a judge will toss out the ticket and tell the person that did the good deed to check with the local authorities. Hopefully this man take this to court. That cop could have easily warned him and that would have likely been the end of it.

      My first thought exactly. Any level-headed judge is going to immediately throw at least 2 of the 3 tickets out, if not all of them outright. There's barely even a case for "criminal negligence" on their end, let alone malicious intent. They contacted no less than 4 different state and federal authorities to try to stay on the right side of the law; these guys are obviously not the kinds of people that these laws were designed to punish.

Many have the mindset of what happens on a military base stays on a military base, they don't expect an entire river to be owned by them. This is the reason why signs exist and why the fence around the base is covered in "no trespassing" signs.

A better question would be how they expect civilians to know WHICH regulations and/or policy letters to look up.
      BTW... I'm an Army vet. IDK what kind of ass backward fucktard unit you're in to not know something that a curious 11 year old can figure out, but I HIGHLY recommend finding some time to sit down with your first line/rater and get some professional development in.

    I once volunteered to help out at the local animal shelter... I showed up about 15 minutes late due to a family issue... The lady at the shelter literally started yelling at me for not being "on time" I told her that not only was I late but I was also going to be leaving early to make up for it... Then turned around and got back in my truck.... Some people just think everything revolves around them... can't fix stupid, but I can point and laugh at the results.

    Man. This game warden is absurd. Thank the young men for pulling out POLLUTION and a bunch of retired weapons out of the river, which were inside a suspicious backpack of sorts, but tell them "thanks but hey you shouldn't be out here so here's a warning." At no point did the warden investigate what they found, where they were at, and what their initial response was. You can tell even the MP was in the dark about his behavior. Discretion should have been used here but instead he makes these young men feel like criminals and even compares them to actual criminals like bank robbers or drug smugglers. He even ADMITS to them "yall just made a mistake" but still gives them the lashing for it despite no harm done to anyone. Trash. Did they break several laws? Yes, but I don't think they knew the full extent of the law.

      @@THEREALSEVEN you are correct. officer do have qouta to meet. I was shocked with first learned that fact in the late 90's. My stepfather at that time had a police scanner from radio shack and he intercepted a message from the local police department regarding a topic of police quota.

    WHAT?! How is finding something and telling authorities you found something that might be harmful or illegal worth a fine or jail? Would they rather people just up and leave with it? Make it make sense!

      Because police aren’t in it for us, not in it to actually protect and serve several Supreme Court cases where police have testified against that slogan to relieve themselves of liability and it passed the Supreme Court. they are only in it for themselves and that’s by long and far the majority. Anyone that claims otherwise is politically motivated to say so. Truth is much more grim than some people would like to accept.

      Possession? What he didn't say is leaving it there and then calling when it comes to the weed. It was kind of a bad example but it still works in this situation kind of. They weren't even supposed to be out of their car to begin with it's a travel only road.

    The fact that the "bomb squad" said call 911 when there were EXPLOSIVE materials says a lot about that department.

      The reason for that was probably because they called the local civilian bomb squad and told them their location. They were on military grounds so they needed to get the military police bomb squad. Fastest way to do that was most likely through a 911 call. I bet the bomb squad these guys called also contacted the military police immediately after that call

    Once again, just another incident to reinforce a growing public sentiment, that you are better off not calling the authorities, regardless of your genuine law-abiding goodwill. As for the motivation, as expressed by this officer, is to justify their job, by robbing you, by means of issuing fines for whatever reason they can fabricate.

      Because People don't the law, neither does any gov agency, people will comply with anything an agency says. Learn the Law, No gov agency has any Legal Authority over you nor do they enforce legal laws against you. Look meeee up "Rod Class Trading with the Enemy Act", and "Rod Class The United States Code. Are they real Law or Color of Law"
